An option for Business Ethics course offered in business schools or in philosophy departments, this text balances the perspectives of business and philosophy in the cases and readings. The focus of this text is on the benefits of good corporate conduct to the companies who practice good business ethics.

This article engages in debates about the potential for aesthetics to be a positive, ethical, and moral frame for relating to the environment. Human‐environment relations are increasingly tied up with aesthetics. We problematize this trend by contending that aesthetics is an insufficient paradigm to motivate and shape environmentalism because it exceptionalizes some landscapes while devaluing others. This article uses four illustrative case studies to complicate aesthetic environmentalist frames. These case studies indicate that even when positive aesthetic qualities are deployed in (...) environmentalist advocacy, their usefulness is mitigated by a range of factors including: sensationalization, obfuscation, and further degradation. Researchers designing a clinical trial may be aware of disputed evidence of serious risks from previous studies. These researchers must decide whether and how to describe these risks in their model informed consent document. They have an ethical obligation to provide fully informed consent, but does this obligation include notice of controversial evidence? With ACCORD as an example, we describe a framework and criteria that make clear the conditions requiring inclusion of important controversial risks. The ACCORD model consent document did (...) not include notice of prior trials with excess death. We develop and explain a new standard labeled risk in equipoise. We argue that our approach provides an optimal level of integrity to protect the informational needs of the reasonable volunteers who agree to participate in clinical trials. Animal and plant species exhibit an astonishing diversity of sexual systems, including environmental and genetic determinants of sex, with the latter including genetic material in the mitochondrial genome. In several hermaphroditic plants for example, sex is determined by an interaction between mitochondrial cytoplasmic male sterility (CMS) genes and nuclear restorer genes. Specifically, CMS involves aberrant mitochondrial genes that prevent pollen development and specific nuclear genes that restore it, leading to a mixture of female (male‐sterile) and hermaphroditic individuals in the population (...) (gynodioecy). Such a mitochondrial‐nuclear sex determination system is thought to be rare outside plants. Here, we present one possible case of CMS in animals. We hypothesize that the only exception to the strict maternal mtDNA inheritance in animals, the doubly uniparental inheritance (DUI) system in bivalves, might have originated as a mitochondrial‐nuclear sex‐determination system. We document and explore similarities that exist between DUI and CMS, and we propose various ways to test our hypothesis. (shrink)

Patient autonomy, as exercised in the informed consent process, is a central concern in bioethics. The typical bioethicist's analysis of autonomy centers on decisional capacity—finding the line between autonomy and its absence. This approach leaves unexplored the structure of reasoning behind patient treatment decisions. To counter that approach, we present a microeconomic theory of patient decision-making regarding the acceptable level of medical treatment from the patient's perspective. We show that a rational patient's desired treatment level typically departs from the level (...) yielding an absence of symptoms, the level we call ideal. This microeconomic theory demonstrates why patients have good reason not to pursue treatment to the point of absence of physical symptoms. We defend our view against possible objections that it is unrealistic and that it fails to adequately consider harm a patient may suffer by curtailing treatment. Our analysis is fruitful in various ways. It shows why decisions often considered unreasonable might be fully reasonable. It offers a theoretical account of how physician misinformation may adversely affect a patient's decision. It shows how billing costs influence patient decision-making. It indicates that health care professionals' beliefs about the ‘unreasonable’ attitudes of patients might often be wrong. It provides a better understanding of patient rationality that should help to ensure fuller information as well as increased respect for patient decision-making. (shrink)

According to Richard Gelwick, one of the fundamental implications of Polanyi’s epistemology is that all intellectual disciplines are inherently heuristic. This article draws out the implications of a heuristic vision of theology latent in Polanyi’s thought by placing contemporary theologian David Brown’s dynamic understanding of tradition, imagination, and revelation in the context of a Polanyian-inspired vision of reality. Consequently, such a theology will follow the example of science, reimagining its task as one of discovery rather than mere reflection on a (...) timeless body of divine revelation. The ongoing development of a theological tradition thus involves the attempt to bring one’s understanding of the question of God to bear on the whole of the human experience. The pursuit of theology as a heuristic endeavor is a bold attempt to construct an integrated vision of nothing less than the entirety of all that is, without absolutizing one’s vision, and without giving up on the question of truth. Patient noncompliance with physician prescriptions, especially in nonsymptomatic chronic diseases, is frequently characterized in the literature as harmful and economically costly (Miller 1997).1 Nancy Houston Miller views patient noncompliance as harmful because noncompliance can result in continued or new health problems leading to hospital admissions. Further, she places the annual monetary cost of noncompliance at $100 billion.Patient noncompliance with prescribed treatment is considered the least understood form of health behavior (Coons 2001). The current work builds a definition of irritability from both academic definitions and lay perspectives. In Study 1, a quantitative content analysis of academic definitions resulted in eight main content categories. In Study 2, a community sample of 39 adults participated in qualitative interviews. A deductive thematic analysis resulted in two main themes. The first main theme dealt with how participants positioned irritability in relation to other negative states. The second dealt with how participants constructed irritability as both a loss (...) of control and as an experience that should be controlled. The discussion integrates the findings of both studies and provides a concise, but comprehensive definition. (shrink)

The Scottish Philosophy of Common Sense originated as a protest against the philosophy of the greatest Scottish philosopher. Hume's sceptical conclusions did not excite as much opposition as might have been expected. But in Scotland especially there was a good deal of spoken criticism which was never written; and some who would have liked to denounce Hume's doctrines in print were restrained by the salutary reflection that if they were challenged to give reasons for their criticism they would find it (...) uncommonly difficult to do so. Hume's scepticism was disliked, but it was difficult to see how it could be adequately met. At this point Thomas Reid stepped into the field. He was the only man of his time who really understood the genesis of Hume's scepticism and succeeded in locating its sources. At first sight it would seem that this discovery required no peculiar perspicuity. It would seem that nobody could help seeing that Hume's sceptical conclusions were based on Locke's premises, and that Hume could never be successfully opposed by any critic who accepted Locke's assumptions. But this is precisely one of those obvious things that is noticed by nobody. And in fact Reid was the first man to see it clearly. It thus became his duty to question the assumptions on which all his own early thought had been based. The result of this reflection was the conclusion that, since the "ideal theory" of Locke and Berkeley logically led to Hume's scepticism, and since scepticism was intolerable, that theory would have to be amended, or, if necessary, abandoned. : While Abū Jaʿfar Muḥammad b. Jarīr al-Ṭabarī is known to posterity primarily as a historian and commentator on the Qurʾan, his most creative work may have been in the law, and Ibn al-Nadim places his main entry on al-Ṭabarī in Book VI of the Fihrist, on law. Unfortunately, most of his legal works have been lost. Building on and revising George Makdisi’s analysis of the relationship between the ṭabaqāt genre and the theoretical justification of the legal madhhabs, this study (...) argues that one of these lost books, Marātib al-ʿulamāʾ “Degrees of the Scholars,” was devoted to the generations of jurists and intended to provide a theoretical basis for the authority of the Jarīrī madhhab, one among a number of pieces of evidence that suggest al-Ṭabarī was consciously designing and creating his own legal madhhab, in contrast to earlier jurists, such as Abū Ḥanīfah and al-Shāfiʿī, whose legal madhhabs were created by subsequent generations of students.
