La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Este es el viaje apasionante que se propone en este libro, un viaje en el que autores como Poe, Stevenson o Conrad se atreven a proponernos lecturas de Nietzsche, Heidegger o Deleuze y Foucault, en el que personajes como Frankenstein o el doctor Jekyll nos enseñan aspectos inéditos de la filosofía de los siglos modernos, un viaje en el que la posmodernidad se revela como el penúltimo recurso retórico de un personaje ficticio y casi olvidado. The objective of this study has been to establish the level of significance that Gustavo Gutierrez and Juan Luis Segundo attribute to politics in their contributions to liberation theology and to extract the relevant consequences for political theory. ;A systematic analysis of the theory of history in the works of these two authors indicates a higher level of integration between Christianity and politics that is usual in Christian political thought. Liberation is equated with salvation and political liberation is seen as (...) one of its components. This brings politics to a position of privilege. When at the service of justice it occupies, for our authors, a high rank among Christian concerns and when devoted to oppression it requires diligent response from every Christian. ;This understanding of politics is valuable in that it accentuates the political aspect of the Christian theory of history, an element frequently underestimated. Certain tensions remain, however, in the theory as a result of this emphasis: between the moral improvement expected from the involvement in political activities conducive to justice and the moral ambiguity of political structures emerging from such activity; and between the use of the concept of class struggle and notions of conversion and reconciliation. Finally, there is the danger of reducing the critical ability of Christians regarding a particular political project by identifying it with the concept of eschatology. (shrink)

ResumenEste artículo propone una idea de intervención e institución que se entrelace en lo social a través del concepto de contagio como elemento filosófico articulador. En primer lugar, se establece un marco teórico-filosófico para pensar la vida como una ontología social del contagio, que permita habitar un pensar relacional etológico que se abra a otros modos de existencia. Desde este marco, los hallazgos perfilan la relación intervención-institución desde la sensibilidad que evoca esta forma distinta de intervención en lo social, disponiendo (...) de otros modos las variaciones de la institución y sus procesos de instituir el campo social. Se concluye discutiendo la relación entre intervención y sus capacidades transformativas como componente metódico y epistemológico distinto que trae consigo un fuerte potencial político y ético. Al multiplicar los modos de ser y los procesos de subjetivación se abren prácticas humanas y más-que-humanas, instituyendo otros modos de hacer-y-pensar toda intervención del presente.Palabras clave: institución; intervención; contagio; formas de vida; cartografías. Ortega y Gasset’s old lament that no one had so far attempted a rigorous phenomenology of pain no longer holds since the appearance of Christian Grüny’s recent monograph Zerstörte Erfahrung. Eine Phänomenologie des Schmerzes. Grüny argues for the use of phenomenological categories from Merleau-Ponty in order to understand physical pain as a “blocked escape-movement” , concluding that corporeal suffering makes impossible both a clean distinction and a pure identification between the lived body and the physical body that I am. In (...) my paper, I would like to suggest some improvements to Grüny’s approach through the utilization of the category of self-affection, as the material phenomenology of Michel Henry has developed it. In addition to the radical immanence in which hyle, noesis, and noema are unified into a “carnal cogito,” however, I argue that it is necessary to describe the painful self-affection not only in terms of any sensitive excess whatever , as Grüny posits, but also in terms of a mutation of the sensitive excess into the intra-tactile sphere of sensibility. Thus I endorse the Husserlian insight that makes tactility the primordial structure of sensibility. (shrink)

La recherche, en effet, n'avait jamais pris en vue de manière systématique et détaillée l'ensemble de la philosophie schellingienne dans son rapport à la théologie. (C'est d'autant plus surprenant si l'on se rappelle que la pensée de Schelling représente le dernier essai de grand style d'établir une médiation entre ces deux disciplines.) En pratiquant sur toute l'œuvre une coupe longitudinale - depuis les premiers écrits critiques sur le mal et le mythe, à travers la (...) spéculation théogonique des Ages du monde, jusqu'aux développements christologiques et ecclésiologiques de la dernière période - le livre retrace le devenir de la théologie de Schelling, s'intégrant dans sa pensée comme l'une de ses composantes. Cette méthode permet de mettre en évidence la façon dont le philosophe théologien s'est critiqué lui-même dans les diverses phases de sa longue carrière et a modifié ses positions initiales pour tenter d'échapper à la synthèse idéaliste de la foi et du savoir, sans parvenir toutefois à se dégager entièrement du schéma de l'identité. En varios pasajes de la obra de Lévinas vemos que su manera de presentarse frente a lo político es ambigua. O bien, resulta mejor decir que solo en apariencia el "objeto" de lo político en sus reflexiones sobre la justicia y el Estado resultan claras; hay una suerte de equívoco que vale la pena precisar y distinguir. Así, el objetivo central de este trabajo es describir dos momentos políticos en Lévinas leídos en clave Estado, como una figura posible de la (...) política; desentrañamos así la trama anti-política en tanto crítica política al Estado, para llegar a la trama del Estado justo e igualitario, lo que abre nuevas puertas para pensar lo político. A partir de esta descripción reflexionamos, por un lado, una postura crítica frente a las ideas sobre el Estado de Lévinas desde las vinculaciones ético-políticas que hace, tal como la de Alberto Sucasas. Y por otro, en contraposición a éstas, las interesantes y extravagantes lecturas que hace Miguel Abensour de Lévinas creyendo que las relaciones ético-políticas levinasianas aportan a renovar críticamente una nueva figura de Estado dejando el terreno político y estatal abierto a nuevas reflexiones. In several passages of Levinas' work we see that his way of presenting the political front is ambiguous. Or, more precisely, that the "object" of the political in his reflections about justice and the State is only apparently clear; there is a sort of equivocalness that is worth clarifying and distinguishing. The aim of this article is to describe two political moments in Levinas, read in terms of the State as a possible figure in politics. We thus unravel an anti-political theme which is critical of the politics of the State, in order to reach a theme of a State that is just and egalitarian. This opens up new territory from which to think of the political. One critique of Levinas' ideas of the State in terms of its ethical-political linkages is that put forth by Alberto Sucasas. A second contrasting critique is the interesting and extravagant reading of Miguel Abensour, in which Levinasian ethical-political relationships lead to a critical renewal of a new figure of the State, leaving the political and state terrain open to new reflections. Observational studies have suggested that some nonhuman primates’ cooperative behavior may rely on their capacity to share goals and understand the role of their partners. Experimental studies have tried to find evidence for this under controlled conditions, investigating aspects like the degree of organization in different primate species and the individuals’ capacity to recognize and choose good partners, switch roles with them, and care about their outcomes. Often, the results have been mixed. Partly, this is because of the methodological difficulties (...) inherent to empirical research. In this paper, I offer a critical, methodological review of the experimental studies done in the last years on nonhuman primates’ cooperation, I discuss their findings, and suggest possible solutions to some of the procedural problems. Hopefully, this will contribute to improve the design of future studies and therefore our knowledge about the evolutionary history of cooperation. (shrink)

Grace a son interrogation incomparablement tenace et incisive sur le sens de l'etre, la pensee heideggerienne accede a une comprehension du sacre qui semble irreductible a tout autre, et qui, par son originalite et sa profondeur, compte parmi les plus significatives elaborees a notre epoque. Le present ouvrage etudie le rapport complexe entre cette notion du sacre et les eclaircissements heideggeriens sur le divin et la mediation poetique. Il s'articule en quatre parties, dont la premiere expose la genese de l'interpretation (...) heideggerienne du sacre. La deuxieme partie propose une etude thematique du nouveau lexique que Heidegger, au contact notamment de la poesie de Holderlin, introduit dans sa meditation du sacre. La troisieme partie entreprend une serie de discernements critiques, en se laissant instruire par les principaux travaux qui ont examine explicitement la comprehension heideggerienne du sacre, du divin, et du poete. Dans une perspective synthetique, la quatrieme partie, enfin, s'efforce de ressaisir l'approche de Heidegger par le biais de ce qui la deborde, en la faisant dialoguer avec d'autres pensees philosophiques et theologiques marquantes; ce qui conduit a considerer, entre autres, la difference du sacre et du Saint. Degage a partir des developpements diachroniques de la premiere partie, le triptyque du sacre, du divin, et du poete structure aussi bien les synchronisations thematiques de la deuxieme partie que les discernements critiques fournis par la troisieme, et il est assume, tout en etant "depasse", par les chapitres systematiques de la derniere partie. The theme of the other (autrui) in Deleuze is confused with the double task of articulating a new perspective of the sense while questioning the traditional image of thought. This opens up ground from which to analyze this theme in the work of Deleuze which although is systematically visible in Différence et répétition (1968) and Logique du sens (1969) some elements of are discernable in Proust et les signes (1964). This study addresses the idea that the territory of the other (...) is the sense as identified in these three texts. Further ideas will also be introduced that center on the face and the manner in which it reformulates ties to sense. As suggested in Deleuze, a type of thinking is installed in the opening to the other, however not necessarily entering into the registry of morality nor of knowledge. (shrink)

We present a preliminary high-level formal theory, grounded on knowledge representation techniques and foundational ontologies, for the uniform and integrated representation of the different kinds of (quali- tative and quantitative) knowledge involved in the designing process. We discuss the conceptual nature of engineering design by individuating and analyzing the involved notions. These notions are then formally charac- terized by extending the DOLCE foundational ontology. Our ultimate purpose is twofold: (i) to contribute to foundational issues of design; and (ii) to support (...) the development of advanced modelling systems for (qualitative and quantitative) representation of design knowledge. El filósofo resulta, pues, guardián de una tradición de inquietudes y problemas intelectuales hondamente humanos que no deben ser acallados. Para ellos la (...) ciencia no tiene una adecuada solución, pero permanecen ahí incitando al pensamiento e invitando a superar toda concepción positivista de la razón. ¿Cómo hacer compatible la pervivencia actuante de esa tradición y el irrenunciable criticismo que hacia la misma mantiene, por razones sobradamente justificadas, la racionalidad ilustrada? He aquí quizá una de las tareas más difíciles, pero también más estimulantes, que tiene ante sí la filosofía actual. (shrink)

BackgroundUmbilical cord banks are a central component, as umbilical cord tissue providers, in both medical treatment and scientific research with stem cells. But, whereas the creation of umbilical cord banks is seen as successful practice, it is perceived as a risky style of play by others. This article examines and discusses the ethical, medical and legal considerations that arise from the operation of umbilical cord banks in Mexico.DiscussionA number of experts have stated that the use of umbilical cord goes beyond (...) the mere utilization of human tissues for the purpose of treatment. This tissue is also used in research studies: genetic studies, studies to evaluate the effectiveness of new antibiotics, studies to identify new proteins, etc. Meanwhile, others claim that the law and other norms for the functioning of cord banks are not consistent and are poorly defined. Some of these critics point out that the confidentiality of donor information is handled differently in different places. The fact that private cord banks offer their services as "biological insurance" in order to obtain informed consent by promising the parents that the tissue that will be stored insures the health of their child in the future raises the issue of whether the consent is freely given or given under coercion. Another consideration that must be made in relation to privately owned cord banks has to do with the ownership of the stored umbilical cord.SummaryConflicts between moral principles and economic interests (non-moral principles) cause dilemmas in the clinical practice of umbilical cord blood storage and use especially in privately owned banks. This article presents a reflection and some of the guidelines that must be followed by umbilical cord banks in order to deal with these conflicts. This reflection is based on the fundamental notions of ethics and public health and seeks to be a contribution towards the improvement of umbilical cord banks' performance. (shrink)

La renta básica se nos presenta en la obra de Philippe van Parijs como una propuesta política filosóficamente argumentada, de modo tal que convencerá tanto al teórico de la justicia como al ciudadano que votará su implantación. En este artículo analizamos la argumentación de van Parijs mostrando cómo la efectividad política de sus tesis sólo se sostiene a costa de reducir el debate sobre la renta básica a los términos de su propia concepción de la ética. Ponemos en duda, por (...) nuestra parte, el alcance de esta reducción sobre un doble plano: diluye por completo la dimensión prudencial de toda argumentación política, y no deja más alternativa que la educación sentimental para quienes no se dejen convencer por el equilibrio reflexivo. Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

Product structures are represented in engineering models by depicting and linking components, features and assemblies. Their understanding requires knowledge of both design and manufacturing practices, and yet further contextual reasoning is needed to read them correctly. Since these representations are essen- tial to the engineering activities, the lack of a clear and explicit semantics of these models hampers the use of information systems for their assessment and exploita- tion. We study this problem by identifying different interpretations of structure rep- resentations, (...) and then discuss the formal properties that a suitable language needs for representing components, features and combinations of these. We show that the representation of components and features require a non-standard mereology. (shrink)
