In The Paradox of Self-Consciousness, Jose Luis Bermúdez presents an abductive argument for what he calls ‘the Symmetry Thesis’ about self-ascription: in order to have the ability to self-ascribe psychological predicates to oneself, one must be able to ascribe psychological predicates to other subjects like oneself. Bermúdez discusses joint engagement as a key phenomenon that underwrites his abductive argument for the Symmetry Thesis. He argues that the ability to self-ascribe is “constituted” by the intersubjective relations that are realized in joint (...) engagement. I will argue in §1 that although Bermúdez may be correct that these phenomena support the idea that pre-linguistic infants and non-linguistic animals possess primitive forms of self-consciousness, for conceptual reasons, his account of joint engagement cannot be used to argue for the Symmetry thesis. I will argue in §2 that while Bermúdez is correct that joint engagement is significant for the constitution of self-ascription, his description of that phenomenon is too robust, because it requires that the infant have a mental representation of the other as a psychological subject of perceptions. I argue that Bermúdez’s description requires an iteration of representations each of which requires a form of self-reference, which goes against Bermudez’s aim of avoiding the paradox of self-consciousness. In presenting his argument for the Symmetry thesis and his account of joint engagement, Bermúdez critiques P. F. Strawson’s argument for the Symmetry Thesis. In §3 of the paper, I turn to the positive project of presenting a constructive argument for the Symmetry thesis. In a variety of sources, P. F. Strawson and Gareth Evans present a transcendental argument for the Symmetry thesis. I suggest that an argument for the Symmetry thesis is available in Strawson’s notion of the primitiveness of the person. In §4, this leads to a corresponding account of joint engagement. Instead of the robust account of joint engagement presented by Bermúdez, I suggest that the infant perceives the mother’s acknowledgement of the infant without the capacity for self-reference that the Bermúdez’s iteration requires. I reconstruct an account of other-ascription in terms of what I call “person perception,” relying on a recent discussion of Strawson’s view by Axel Seemann (2008). On the Strawsonian account that I provide, an adult summons a child to recognize and acknowledge a form of life in which it participates as a person. In closing, I consider how my account of other-ascription differs from two classic accounts— the theory-theory and the simulation theory— and discuss how my account provides a genuine third alternative: the Persons theory. I would argue that the Persons theory offers a new approach to key issues in philosophy and psychology concerning self-consciousness and intersubjectivity. (shrink)

The relationship between science, law and justice has become a pressing issue with US Supreme Court decisions beginning with Daubert v. Merrell-Dow Pharmaceutical. How courts review scientific testimony and its foundation before trial can substantially affect the possibility of justice for persons wrongfully injured by exposure to toxic substances. If courts do not review scientific testimony, they will deny one of the parties the possibility of justice. Even if courts review evidence well, the fact and perception of greater judicial scrutiny (...) increases litigation costs and attorney screening of clients. Mistaken review of scientific evidence can decrease citizen access to the law, increase unfortunate incentives for firms not to test their products, lower deterrence for wrongful conduct and harmful products, and decrease the possibility of justice for citizens injured by toxic substances. This book introduces these issues, reveals the relationships that pose problems, and shows how justice can be denied. (shrink)

In Morals By Agreement, David Gauthier concludes that under certain conditions it is rational for an agent to be disposed to choose in accordance with a fair cooperative scheme rather than to choose the course of action that maximizes his utility. This is only one of a number of important claims advanced in that book. In particular, he also propounds a distinctive view concerning what counts as a fair cooperative arrangement. The thesis concerning the rationality of adopting a cooperative disposition (...) is, however, logically independent of his substantive view of a fair cooperative scheme and is itself central to the project as a whole. Gauthier's concern is to establish that certain moral principles are those that fully rational, self-interested persons would agree to take as regulative of their dealings with one another – that a contractarian approach, in this sense, can provide an adequate basis for a theory of morality. Transplantation of vital organs has been premised ethically and legally on "the dead donor rule" (DDR)—the requirement that donors are determined to be dead before these organs are procured. Nevertheless, scholars have argued cogently that donors of vital organs, including those diagnosed as "brain dead" and those declared dead according to cardiopulmonary criteria, are not in fact dead at the time that vital organs are being procured. In this article, we challenge the normative rationale for the DDR by rejecting the (...) underlying premise that it is necessarily wrong for physicians to cause the death of patients and the claim that abandoning this rule would exploit vulnerable patients. We contend that it is ethical to procure vital organs from living patients sustained on life support prior to treatment withdrawal, provided that there is valid consent for both withdrawing treatment and organ donation. However, the conservatism of medical ethics and practical concerns make it doubtful that the DDR will be abandoned in the near future. This leaves the current practice of organ transplantation based on the "moral fiction" that donors are dead when vital organs are procured. (shrink)

The globalization in business and tourism becomes crucial more and more for the economical sustainability of local communities. In the presence of an epidemic outbreak, there must be such a decision on the policy by the host community as whether to accept visitors or not, the number of acceptable visitors, or the condition for acceptable visitors. Making use of an SIRI type of mathematical model, we consider the influence of visitors on the spread of a reinfectious disease in a community, (...) especially assuming that a certain proportion of accepted visitors are immune. The reinfectivity of disease here means that the immunity gained by either vaccination or recovery is imperfect. With the mathematical results obtained by our analysis on the model for such an epidemic dynamics of resident and visitor populations, we find that the acceptance of visitors could have a significant influence on the disease’s endemicity in the community, either suppressive or supportive. Risk–benefit assessment is a routine requirement for research ethics committees that review and oversee biomedical research with human subjects. Nevertheless, it remains unclear how to weigh and balance risks to research participants against the social benefits that flow from generating biomedical knowledge. In this article, we address the question of whether there are any reasonable criteria for defining the limit of permissible risks to individuals who provide informed consent for research participation. We argue against any a priori limit to permissible (...) research risks. However, attention to the uncertainty of potential social benefit that can be derived from any particular study warrants caution in exposing prospective research participants to a substantial likelihood of serious harm. Robert Kimball, in “What’s Wrong with Argumentum Ad Baculum?” (Argumentation, 2006) argues that dialogue-based models of rational argumentation do not satisfactorily account for what is objectionable about more malicious uses of threats encountered in some ad baculum arguments. We review the dialogue-based approach to argumentum ad baculum, and show how it can offer more than Kimball thinks for analyzing such threat arguments and ad baculum fallacies.

This article explores some of the ways in which the conceptual apparatus of A Thousand Plateaus, and especially its machinic metaphysics, can be connected to recent developments in computer modelling and social simulation, which provide new tools for thinking that are becoming increasingly popular among philosophers and social scientists. Conversely, the successful deployment of these tools provides warrant for the flat ontology articulated in A Thousand Plateaus and therefore contributes to the ‘reversal of Platonism’ for which Deleuze had called in (...) his earlier works, such as Logic of Sense. The first major section offers a brief exposition of some key concepts in A Thousand Plateaus in order to set the stage for the second and third major sections, which argue that the fabrication of a metaphysics of immanence can be accelerated by connecting its conceptual apparatus more explicitly to insights derived from philosophical analyses of computational modelling and simulation and the social scientific use of ‘assemblage theory’. The article concludes with a summary of the argument and a brief consideration of some of the potential ethical and political implications of this interdisciplinary engagement. (shrink)

Although established in the law and current practice, the determination of death according to neurological criteria continues to be controversial. Some scholars have advocated return to the traditional circulatory and respiratory criteria for determining death because individuals diagnosed as ‘brain dead’ display an extensive range of integrated biological functioning with the aid of mechanical ventilation. Others have attempted to refute this stance by appealing to the analogy between decapitation and brain death. Since a decapitated animal is obviously dead, and ‘brain (...) death’ represents physiological decapitation, brain dead individuals must be dead. In this article we refute this ‘decapitation gambit.’ We argue that decapitated animals are not necessarily dead, and that, moreover, the analogy between decapitation and the clinical syndrome of brain death is flawed. Growth of the philosophy of management might result from the consideration of man's potential as viewed by two different men, an industrialist and a philosopher. James Finney Lincoln was president and board chairman of The Lincoln Electric Company for 37 years. During that time, and for 14 previous years when he was the firm's general manager, he developed a philosophy basic to a practice of business management that gained national and international attention. A comparison of both men's philosophies reveals the following: In each view man's potentiality was approached by the dynamic, on-going process of developing his latent abilities or powers. Both views stressed freedom as being critical to the development of man's latent abilities or powers. For Lincoln the individual must gain satisfaction from the recognition of developing his latent abilities. For Humboldt the individual must enjoy the 'freedom of developing himself.' Lincoln warned against custom as being a barrier to development since it places man in situations which are without variation, forcing him merely to follow precedent. Whether a predicate is a referential expression depends upon what reference is conceived to be. Even if it is granted that reference is a relation between words and worldly items, the referents of expressions being the items to which they are so related, this still leaves considerable scope for disagreement about whether predicates refer. One of Frege's great contributions to the philosophy of language was to introduce an especially liberal conception of reference relative to which it is unproblematic to suppose (...) that predicates are referring expressions. According to this liberal conception, each significant expression in a language has its own distinctive semantic role or power, a power to effect the truth-value of the sentences in which it occurs.
