En el contexto de los años veinte y treinta del siglo XX, ambos autores plantean una pregunta por la justicia que en manos de autores como Hugo Bergmann, Frank Rosenzweig y Martin Buber (...) dio pie a un replanteamiento del judaísmo centroeuropeo, hoy casi olvidado, y a una revisión de la crisis de la modernidad europea en su conjunto. Jorge Oteiza (1908-2003) dio escasas pistas sobre su estancia en Argentina, Chile y Colombia entre 1935 y 1948. Este artículo desarrolla un análisis de la evolución de sus ideas estéticas a la luz de un cotejo de sus publicaciones de las décadas de 1940, 1950 y 1960 y la documentación personal del artista conservada en el archivo y la biblioteca de la Fundación Museo Jorge Oteiza (Alzuza, Navarra). Se presta especial atención a la relación de Oteiza con diversos artistas americanos (...) y del exilio español, en un tejido en cuyo centro se encontraría en muchas ocasiones el poeta Vicente Huidobro. En particular, se analiza su encuentro con poetas como Pablo de Rokha, Pablo Neruda y Juan Larrea, así como su estudio del arte precolombino y su recepción del muralismo de David Alfaro Siqueiros y el constructivismo de Joaquín Torres García, que lo llevarían a proponer un cambio de paradigma cultural, en los albores de la posmodernidad, en diálogo con el indigenismo y el poscolonialismo. BackgroundEthics review is the process of assessing the ethics of research involving humans. The Ethics Review Committee (ERC) is the key oversight mechanism designated to ensure ethics review. Whether or not this governance mechanism is still fit for purpose in the data-driven research context remains a debated issue among research ethics experts.Main textIn this article, we seek to address this issue in a twofold manner. First, we review the strengths and weaknesses of ERCs in ensuring ethical oversight. Second, we map (...) these strengths and weaknesses onto specific challenges raised by big data research. We distinguish two categories of potential weakness. The first category concerns persistent weaknesses, i.e., those which are not specific to big data research, but may be exacerbated by it. The second category concerns novel weaknesses, i.e., those which are created by and inherent to big data projects. Within this second category, we further distinguish between purview weaknesses related to the ERC’s scope (e.g., how big data projects may evade ERC review) and functional weaknesses, related to the ERC’s way of operating. Based on this analysis, we propose reforms aimed at improving the oversight capacity of ERCs in the era of big data science.ConclusionsWe believe the oversight mechanism could benefit from these reforms because they will help to overcome data-intensive research challenges and consequently benefit research at large. Background Informed consent is one of the key principles of conducting research involving humans. When research participants give consent, they perform an act in which they utter, write or otherwise provide an authorisation to somebody to do something. This paper proposes a new understanding of the informed consent as a compositional act. This conceptualisation departs from a modular conceptualisation of informed consent procedures. Methods This paper is a conceptual analysis that explores what consent is and what it does or does (...) not do. It presents a framework that explores the basic elements of consent and breaks it down into its component parts. It analyses the consent act by first identifying its basic elements, namely: a) data subjects or legal representative that provides the authorisation of consent; b) a specific thing that is being consented to; and c) specific agent(s) to whom the consent is given. Results This paper presents a framework that explores the basic elements of consent and breaks it down into its component parts. It goes beyond only providing choices to potential research participants; it explains the rationale of those choices or consenting acts that are taking place when speaking or writing an authorisation to do something to somebody. Conclusions We argue that by clearly differentiating the goals, the procedures of implementation, and what is being done or undone when one consent, one can better face the challenges of contemporary data-intensive biomedical research, particularly regarding the retention and use of data. Conceptualising consent as a compositional act enhances more efficient communication and accountability and, therefore, could enable more trustworthy acts of consent in biomedical science. (shrink)

What happens when management consultants enter the academic arena and offer their services to universities? In the following article, we examine this question by drawing on findings from a qualitative study based on a series of 30 interviews with senior management consultants and academic managers in Germany. The aim of this explorative study is, first of all, to provide theoretically informed observations about the working mechanisms of management consulting in academia. A second, and related objective, is to contribute to the (...) ongoing debate on the changing nature, role, and implications of managerial expertise and authority in higher education institutions. We begin our study by providing an overview of the literature on the changing nature of university management. Although these studies show a shift in the power constellation of universities from professional to managerial authority, we argue that they remain suspiciously vague as concerns the way academics and managers actually deal with this conflicting situation. By drawing on the insights of consulting studies, we then explore the stakes of consultancy in academic change projects and determine the analytical factors that will guide our qualitative analysis. Finally, we present and discuss the findings before concluding with more general remarks on the nature of academic management in German universities. (shrink)

European quality assurance has a complicated history that must be viewed as taking place on two levels: first, in a national effort to deregulate the public sector and to make universities accountable for their teaching performance; and second, a supranational endeavor to accomplish European integration in the field of higher education. Similarly, the web of institutional constraints and opportunity structures in which accreditation agencies are embedded spans two policy levels, the national and the European. In this paper, we examine how (...) German accreditation agencies achieve some level of autonomy in a highly entrenched institutional environment. The paper is based on a qualitative study comprising archival data and over 70 semi-structured interviews. Drawing on the insights of neo-institutional theory, we argue that quality assurance agencies seek political leverage at the European level in order to strengthen their standing in the higher education systems of their own countries. Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

Las metodologías activas son unas excelentes herramientas para la mejora del desarrollo de competencias, así como del aprendizaje del alumnado. Se recogen las percepciones y el uso que 92 profesores de educación secundaria de la Comunidad Valenciana (España) manifestaron en un cuestionario tras haber realizado una formación en las mismas. Los resultados permiten constatar que, si bien se produce un aumento en el uso y una mejora en las percepciones, sigue habiendo una considerable resistencia al cambio de este colectivo de (...) profesorado. Encuentran desventajas como considerarlas muy exigentes con el tiempo y son escépticos en el aprendizaje real del alumnado. (shrink)

El acceso equitativo a la energía y a la vivienda es una preocupación básica de la justicia social. A pesar de los numerosos vínculos entre estos dos bienes esenciales, los marcos teóricos de la justicia y la pobreza energética se han referido casi exclusivamente a la cuestión de la vivienda en términos de la eficiencia energética de los edificios residenciales. En respuesta a esta carencia conceptual, se propone la reintegración del factor vivienda en el marco de la justicia y pobreza (...) energética a lo largo de los siguientes tres ejes: dimensiones materiales y temporales; dimensiones políticas; y dimensiones éticas y legales. Como ejemplo empírico de la importancia del nexo vivienda-energía en la práctica de la justicia social, se presenta el caso de dos movimientos sociales surgidos en Barcelona que trabajan con una perspectiva conjunta de derecho a la vivienda y a la energía: la Plataforma de Afectados por la Hipoteca (PAH) y la Aliança contra la Pobresa Energètica (APE). El artículo subraya la importancia de la vivienda y la energía como fundamentos materiales de una vida digna y su naturaleza conflictiva como necesidades esenciales y bienes de mercado. (shrink)

This article intends to contribute to the science–religion historiography with two topics—philology and the construction of national identities—that can help provide a more complex picture of the relations between science and religion. We use the life and work of the Mallorcan Catholic priest Antoni Maria Alcover (1862–1932) as a case study that puts language, linguistics, and nationalism on the board of science and religion studies. Alcover was the main driving force of the Catalan Dictionary, a collective enterprise that set out (...) to inventory the complete oral and literary lexicon of this language, and which mobilized thousands of people, many of which were clergymen, from all over the Catalan‐speaking territories. In the article, we will explore Alcover's education; the way he established a link between language, religion, and fatherland; the shaping of his identity as a philologist in the image mainly of new German notions and practices; as well as his role in the institutionalization process of the Catalan language as a scientific language, as a language for science and for religion. With this special issue, we would like to promote research on changes in the funding of the sciences, social sciences, and humanities. Since funding secures the livelihood of researchers and the means to do research, it is an indispensable condition for almost all research; as funding arrangements are undergoing dramatic changes, we think it timely to renew the science studies community’s efforts to understand the funding of research. Changes in the governance of science have garnered considerable attention from science studies (...) and higher education research; however, the impact of these changes on the conduct and content of research has not received sufficient attention, and theoretical insights into the connections between funding practices and research practices are few and far between. The aim of this special issue is to contribute to our theoretical understanding of the changing nature of research funding and its impact on the production of scientific knowledge. More specifically, we are interested in the interplay between funding and research practices: What is the impact of institutionalised funding arrangements on the production of scientific knowledge? In this work I have tried to justify the principle theses of Meinong's Theory of Objects and to criticize some ontological theses that do not seem to derive from the Theory of Objects. This work has been divided into three parts according to the fundamental classification of objects given by Meinong: object of representation, object of thought, and objects of emotion. ;In the first part I have analysed the doctrine of intentionality in relation with intentional act and content, and their (...) sorts of presentation in discussion with Brentano. ;In following I have given an interpretation of "pure object" and its status of "Assersein" by which pure object is beyond being and non-being. This is developed in close connection to the doctrine of impossible objects and the Theory of Objects as the most universal science inasmuch as it harbors both real and unreal worlds . I have built an extensive critique of Russell's theory of Descriptions and Denoting, and other opposing views. The rest of this part is devoted to both incomplete objects and objects of higher order . The theory of incomplete object is connected to our way of knowing things, and it expresses the incompleteness of our intentional attitudes. The theory of objects of higher order tries to explain the problem of space-time continuum. ;The second part began with the demonstration of "existence" and nature of Objectives . The Objective is grasped by either a judgment or an assumption, whether its true/false value is included in it or not. I have developed an extensive analysis of modalities--factuality, necessity and possibility--, and quasi-modalities--probability and truth--in order to give a complete Theory of Knowledge integrated in an Ontology. ;The last part was an analysis the objects of emotional lived experiences: the "dignitative" and the "desiderative." The dignitative harbors ethical and esthetical values, while the desiderative contains moral and esthetical laws, and in general, the "duties." The main analysis of this part treats the question of justification of the ethical objects and their grounding in intellectual objects. (shrink)

In recent years, many disciplines have become interested in the scientific study of morality. However, a conceptual framework for this work is still lacking. In The Moral Background, Gabriel Abend develops just such a framework and uses it to investigate the history of business ethics in the United States from the 1850s to the 1930s. According to Abend, morality consists of three levels: moral and immoral behavior, or the behavioral level; moral understandings and norms, or the normative level; and (...) the moral background, which includes what moral concepts exist in a society, what moral methods can be used, what reasons can be given, and what objects can be morally evaluated at all. This background underlies the behavioral and normative levels; it supports, facilitates, and enables them. Through this perspective, Abend historically examines the work of numerous business ethicists and organizations--such as Protestant ministers, business associations, and business schools--and identifies two types of moral background. "Standards of Practice" is characterized by its scientific worldview, moral relativism, and emphasis on individuals' actions and decisions. The "Christian Merchant" type is characterized by its Christian worldview, moral objectivism, and conception of a person's life as a unity. The Moral Background offers both an original account of the history of business ethics and a novel framework for understanding and investigating morality in general. (shrink)

Around the Council of Basel, and opposing the nominalism renewal, in the University of Salamanca a whole new movement of humanistic renewal is promoted from the field of philosophy and theology, having in Pedro Martinez de Osma one of its most significant representatives. In this paper the meaning of his work, with influences from L. Bruni and L. Valla, is shown and two of his most significant texts are rescued from that fight which confronted the humanism against the nominalism.

Background:The first wave of the COVID-19 pandemic caused a shortage of qualified nurses in Spain. As a result, the government authorized the hiring of senior students.Objectives:To explore the ethical dilemmas and ethical conflicts experienced by final-year nursing students who worked during the first outbreak of the COVID-19 pandemic in Spain.Research design:A qualitative exploratory study was conducted using purposive sampling. Semi-structured interviews were carried out using a question guide. Interviews took place via a private video chat room platform. A thematic, inductive (...) analysis was performed of the information gathered.Participants and research context:Eighteen nursing students were recruited from two universities of Madrid, aged between 18 and 65 years old, enrolled in the fourth year of nursing studies and who were hired under a relief contract for health professionals during the pandemic.Ethical considerations:The present study was carried out in accordance with the Declaration of Helsinki, and the study was approved by the Local Ethics Committee of Universidad Rey Juan Carlos.Results:Three specific themes emerged: (a) coping with patient triage, (b) difficulties in providing end-of-life care, and (c) coping with patient death. Nursing students participated in the process of patient selection for resource allocation and ICU bed occupancy. They were shown how to care for patients who were not admitted to the ICU, in their last moments and were faced with the difficulties of applying end-of-life care. Finally, the nursing students were confronted with the death of their patients, in overwhelming numbers and under adverse conditions.Conclusions:These findings can help shed light on the ethical dilemmas and ethical conflicts faced by novice nursing students, incorporated into the workforce during the COVID-19 pandemic. Moreover, it was described that students may normalize the death due to the exhaustion and overwhelmed routine. (shrink)

Artificial intelligence (AI) has become nearly ubiquitous in modern society, from components of mobile applications to medical support systems, and everything in between. In societally impactful systems imbued with AI, there has been increasing concern related to opaque AI, that is, artificial intelligence where it is unclear how or why certain decisions are reached. This has led to a recent boom in research on “explainable AI” (XAI), or approaches to making AI more explainable and understandable to human users. In the (...) military domain, numerous bodies have argued that autonomous and AI-enabled weapon systems ought not incorporate unexplainable AI, with the International Committee of the Red Cross and the United States Department of Defense both explicitly including explainability as a relevant factor in the development and use of such systems. In this article, I present a cautiously critical assessment of this view, arguing that explainability will be irrelevant for many current and near-future autonomous systems in the military (which do not incorporate any AI), that it will be trivially incorporated into most military systems which do possess AI (as these generally possess simpler AI systems), and that for those systems with genuinely opaque AI, explainability will prove to be of more limited value than one might imagine. In particular, I argue that explainability, while indeed a virtue in design, is a virtue aimed primarily at designers and troubleshooters of AI-enabled systems, but is far less relevant for users and handlers actually deploying these systems. I further argue that human–machine teaming is a far more important element of responsibly using AI for military purposes, adding that explainability may undermine efforts to improve human–machine teamings by creating a prima facie sense that the AI, due to its explainability, may be utilized with little (or less) potential for mistakes. I conclude by clarifying that the arguments are not against XAI in the military, but are instead intended as a caution against over-inflating the value of XAI in this domain, or ignoring the limitations and potential pitfalls of this approach. Little has been studied on the relationship between affect and school problems related with attendance. This study aims to identify different affective profiles and to determine whether these profiles differ from each other based on the four functional conditions of school refusal behavior. Participants comprised 1,816 Spanish adolescents aged 15–18 years. The Positive and Negative Affect Schedule for Children-Short Form and the School Refusal Assessment Scale-Revised for Children were administered. Latent profile analysis revealed five affective profiles: low affective profile, self-fulfilling (...) profile, low positive affect profile, self-destructive profile, and high affective profile. The self-destructive profile revealed the highest average scores in the first three factors of the SRAS-R-C, whereas the high affective profile reached the highest average score in the fourth factor. On the contrary, the self-fulfilling profile obtained the lowest average scores in the first two factors of the SRAS-R-C, whereas the low affective profile revealed the lowest average scores in the last two factors. Findings suggest the relevance of developing more adaptative affective profiles, such as the self-fulfilling profile, which would contribute to diminishing school attendance problems. (shrink)
