This article explores the mystical impulse in the American mind, reflected in the work of William James, Kenneth Burke, and most especially the case of Ralph Waldo Emerson. The parallels and differences between Emerson's mystical idea of Nature and the ancient Greek pre-Socratic idea of the universe as a union of opposites are explored. The divergence between the Americans and the Greeks concerning the idea of limits is reflected on. The optimism of the Americans is explained as a function of (...) their mystical theodicy, and the greatness of their power as a function of their mystic ability, so well assayed by Emerson, to bear crushing paradoxes with a cheerful lightness of being. This article argues that considering cross-sector collaborations through the lens of indigenous-corporate engagements yields a more comprehensive understanding of the range of cross-sector engagement types, emphasizes the importance of cross-cultural bridge building which has received little attention in the literature :849–873, 2005), and highlights the potential for innovation via collaborations with fringe stakeholders. The study offers a more overarching typology of cross-sector collaborations and, building on an ethical approach to sustainable development with indigenous peoples, proposes a theoretical framework for cross-cultural (...) bridge building between businesses and fringe stakeholders. By incorporating this framework into the literature on value creation in cross-sector collaborations, we suggest a model for value creation in cross-sector collaborations with fringe stakeholders. In his still-authoritative history of science essay, Kuhn showed that scientific discoveries commence with awareness of anomaly that researchers initially struggle to notice. Kuhn drew on a psychological study to illustrate the problem. Bruner and Postman asked people to name playing cards on brief exposure. Most cards were normal, but some were anomalous, such as a red six of spades and a black four of hearts. On brief exposure all participants fitted the anomalous cards unhesitatingly into their existing cognitive scheme, (...) identifying them as, for example, a six of spades or a four of hearts. Jerry Fodor has argued that a modular mind must include central systems responsible for updating beliefs, and has defended this position by appealing to shared properties of belief fixation and scientific confirmation. Peter Carruthers and Stephen Pinker have attacked this analogy between science and ordinary inference. I examine their arguments and show that they fail. This does not show that Fodor's more general position is correct.

This essay compares Robert John Russell's work in his recent book Cosmology from Alpha to Omega: The Creative Mutual Interaction of Theology and Science (2008) to that of the authors known collectively as "the new atheists." I treat the latter as recent contributors to the modern tradition of scientific naturalism. This tradition makes claims to legitimacy on the basis of its close relations to the natural sciences. The Republic represents the good life as some sort of harmony or composition between the different interests of which the threefold nature of the soul makes it capable. The rational factor, τ λολιστικν, not only chooses which impulses shall be satisfied and which rejected but is credited also with impulses of its own, such as the desire for knowledge, to the importance of which the Republic testifies by various strands of argument. But in Plato's attempt to prove the goodness of (...) this mixed life he may be thought to have relied too much on arguments about its pleasantness. If he had really meant from the first to prove against Thrasymachus that the just life is more prolific in pleasure1 than the unjust, he would have had to undertake the task of proving a necessary connection between just activities and pleasant states of feeling which could scarcely exist unless feelings were under the control of the will. If this had been his intention, the whole weight of the argument would rest on the two comparatively short passages in Book IX in which he makes first a dubious appeal to experience and then, by an equally dubious piece of metaphysics, attempts to reinforce his ethical conclusion by denying the reality of such pleasures as might tend to throw doubt on it. The financial crisis of 2007–2008 had its origins in the manner by which complex financial instruments allowed qualitative phenomena to become a tradable commodity. This process is part of a profound tendency in modern economic life to convert the qualitative, specific and non-commensurable into quantitative data. Simmel, in his Philosophy of Money, identified this transformative quality as an inherent characteristic of money. This paper argues that Simmel’s work continues to provide important insights. Michael J. Almeida offers two criticisms of the argument of my ‘A trilemma for divine command theory’. The first criticism is that I mistakenly assume the validity of the following inference pattern: property A is identical to property B; property B supervenes on property C; therefore, property A supervenes on property C. The second criticism is that I have misinterpreted the moral-supervenience thesis upon which I rely in making this argument. The first of Almeida's criticisms is completely untenable. My aim is to defend the conscience principle: One ought never to act against the dictates of one’s conscience. In the first part of this paper, I explain what I mean by “conscience” and “dictate of conscience,” and I show that the notion that the conscience principle is inherently anti-authoritarian or inherently fanatical is mistaken. In the second part, I argue that the existence of mistaken conscience does not reduce the conscience principle to absurdity. Donald Green and Ian Shapiro discover a curious gulf between the prestige of rational choice approaches and the dearth of solid empirical findings. But we can understand neither the prestige of rational choice theory nor its pathologies unless we see it as a variant of the equilibrium analysis found in physics, economics, and biology. Only such a global perspective on rational choice theory will reveal its core assumptions and the likely shape of its future in political science. The motives and consequences of harvesting sperm from brain dead males for the purpose of effecting post mortem fatherhood are examined. I argue that sperm harvesting and post mortem fatherhood raise no harms of a magnitude that would justify forbidding the practice outright. Dead men are not obviously harmed by the practice; children need not be harmed by this kind of birth; and the practice enlarges rather than diminishes the reproductive choices of surviving partners. Certain ethical and legal issues nevertheless (...) require attention. As a matter of consistency with other harvesting protocols, there ought to be a mechanism for respecting the wishes of men who when alive do not wish to become fathers post mortem. Mechanisms governing entitlement to harvest and use sperm will also be required. I note that the law is unlikely to recognize the paternity of children born from harvested sperm, though there may be reasons to recognize that paternity in some instances. (shrink)

Self-Governance and Cooperation offers solutions to two fundamental problems in moral philosophy, one concerning the nature and requirements of morality and the other the nature and requirements of practical reason. Robert Myers’s achievement is not just that his solutions are original and plausible, but that his arguments acknowledge and demonstrate the need to approach the problems as an inseparable pair. Philosophical tradition tells us that questions about the content of morality cannot be answered in isolation from questions about its rational (...) force, and that, even more so, questions about the place of morality in practical reason cannot be answered without taking a stand on contested questions of substantive ethics. Myers’s book is a welcome counterforce to a tendency in contemporary moral philosophy to artificially subdivide the subject. (shrink)

In response to calls for more research on how to prevent or detect fraud (ACAP, Final Report of the Advisory Committee on the Auditing Profession, United States Department of the Treasury, Washington, DC, 2008 ; AICPA, SAS No. 99: Consideration of Fraud in a Financial Statement Audit, New York, NY, 2002 ; Carcello et al., Working Paper, University of Tennessee, Bentley University and Kennesaw State University, 2008 ; Wells, Journal of Accountancy, 2004 ), we develop a framework that identifies three (...) psychological pathways to fraud, supported by multiple theories relating to moral intuition and disengagement, rationalization, and the role played by negative affect. The purpose of developing the framework is twofold: (1) to draw attention to important yet under-researched aspects of ethical decision-making, and (2) to increase our understanding of the psychology of committing fraud. Our framework builds on the existing fraud triangle (PCAOB, Consideration of fraud in a financial statement audit. AU Section 316, www.pcaobus.org , 2005 ) which is used by auditors to assess fraud risk. The fraud triangle is composed of three factors that, together, predict the likelihood of fraud within an organization: opportunity, incentive/pressure, and attitude/rationalization. We find that, when faced with the opportunity and incentive/pressure, there are three psychological pathways to fraud nestled within attitude/rationalization: (1) lack of awareness, (2) intuition coupled with rationalization, and (3) reasoning. These distinctions are important for fraud prevention because each of these paths is driven by a different psychological mechanism. This framework is useful in a number of ways. First, it identifies certain insidious situational factors in which individuals commit fraud without recognizing it. Second, it extends our knowledge of rationalization by theorizing that individuals use rationalization to avoid or reduce the negative affect that accompanies performing an unethical behavior. Negative affect is important because individuals wish to avoid it. Third, it identifies several other methods fraudsters use to reduce negative affect, each of which could serve as potential “psychological red flags” and helps predict future fraudulent behavior. Finally, our framework can be used as a theoretical foundation to explore several interventions designed to prevent fraud. (shrink)

Throughout his excellent book One Body, Alex Pruss relies upon the view that there is a requirement of universal love: each and every one of us is required to love each and every one of us. Although he often appeals to revealed truth in making arguments for his various theses, he supports the requirement of universal love primarily through a philosophical argument, an argument that I call the “argument from responsiveness to value.” The idea is that all persons bear a (...) sort of nonrelational value, and because this value gives every agent reasons to respond to it positively, each and every person is bound to love each and every person. The aim of this paper is to criticize this argument. Pruss’s argument has two important gaps, one concerning the sort of reasons that the value of persons gives and one concerning whether the required response is the response of love. (shrink)

Post-Analytic Philosophy is a symptom of a certain discontent with the analytical heritage. This discontent is very heterogeneous, uneven, and frequently, depressingly timid. Partly at least, the aura of timidity which surrounds too much of this volume is a reflection of the very conservative, and inward-looking, “principles” of selection which the editors have adopted. With its distinctively amero-centric orientation, this volume displays an unfortunate chauvinism that excludes the more radical post-analytical philosophies from the Continent. Most notably absent is the work (...) of Ricoeur and Habermas, who have fused together the immanent critique of early analytical philosophy by later analytic thinkers (Austin, Toulmin, Searle, Winch) with other non-analytical traditions in which their thinking was formed (phenomenology, Critical Theory) or to which they have responded (psychoanalysis; structuralism; hermeneutics). I discuss why one critical aspect of the process of political reconciliation involves the restoration of mutual respect for the rule of law and suggest that psychological research on post-traumatic stress disorder (PTSD) provides valuable resources for understanding how successfully to restore such mutual respect.

Carson Strong has argued that if human cloning were safe it should be available to some infertile couples as a matter of ethics and law. He holds that cloning by somatic cell nuclear transfer should be available as a reproductive option for infertile couples who could not otherwise have a child genetically related to one member of the couple. In this analysis, Strong overlooks an important category of people to whom his argument might apply, couples he has not failed to (...) consider elsewhere. In this discussion, however, Strong refers exclusively to opposite sex couples facing obstacles such as surgically removed ovaries and the inability to produce sperm. In fact, however, there are many adult couples who, while fertile in and of themselves, are not fertile as couples. This group includes not only opposite sex couples but coupled same sex partners as well. I believe the defenses Strong offers regarding the use of SCNT by opposite sex infertile couples would extend to same sex couples for two reasons. First, some same sex couples might face the inability to have a genetically related child, and second, Strong's arguments ultimately ground a general defense of SCNT independent of the question of a couple's fertility. Sosa’s topic is the use of intuitions in philosophy. Much of what I have written on the issue has been critical of appeals to intuition in epistemology, though in recent years I have become increasingly skeptical of the use of intuitions in ethics and in semantic theory as well.

The epistemology and ontology of experimentation are discussed in depth with special reference to biology and medicine. Two types of experiments are distinguished: exploratory (or "blazing") and consolidating. They Have objectives and canons that are strikingly different. A contrast is drawn between the literalism of the most pragmatic scientists and the formalism of most statisticians. The terms and notions of the one may have imperfect correspondence with those of the other, or perhaps none at all. The dangers are pointed out (...) of both the conclusion that the gap between the two is unbridgeable and the contrary view that the gap is trivial and merits no serious attention.
