To hold an environmental ethic is to hold that non-human beings and states of affairs in the natural world have intrinsic value. This seemingly straightforward claim has been the focus of much recent philosophical discussion of environmental issues. Its clarity is, however, illusory. The term ‘intrinsic value’ has a variety of senses and many arguments on environmental ethics suffer from a conflation of these different senses: specimen hunters for the fallacy of equivocation will find rich pickings in the area. This (...) paper is largely the work of the underlabourer. I distinguish different senses of the concept of intrinsic value, and, relatedly, of the claim that non-human beings in the natural world have intrinsic value; I exhibit the logical relations between these claims and examine the distinct motivations for holding them. The paper is not however merely an exercise in conceptual underlabouring. It also defends one substantive thesis: that while it is the case that natural entities have intrinsic value in the strongest sense of the term, i.e., in the sense of value that exists independently of human valuations, such value does not as such entail any obligations on the part of human beings. The defender of nature’s intrinsic value still needs to show that such value contributes to the well-being of human agents. (shrink)

No net loss approaches to environmental policy claim that policy should maintain aggregate levels of natural capital. Substitutability between natural assets allows losses in some assets to be compensated for by gains in others while maintaining overall levels of natural capital. This paper argues that significant goods that matter to people’s well-being will be lost through a policy of no net loss. Logical positivism is widely associated with an illiberal technocratic view of politics. This view is a caricature. Some members of the left Vienna circle were explicit in their criticism of this conception of politics. In particular, Neurath's work attempted to link the internal epistemological pluralism and tolerance of logical empiricism with political pluralism and the rejection of a technocratic politics. This paper examines the role that unified science played in Neurath's defence of political and social pluralism. Neurath's project of unified (...) science addressed problems that lie at the centre of recent debates around liberalism concerning the possibility of social co-operation in conditions of pluralism. His response is distinctive in calling upon an empiricist tradition that differs from Kantian proceduralist approaches that have predominated in recent liberalism. While Neurath's position has problems, it deserves reconsideration, especially in so far as it questions the Kantian assumption that a thin language of abstract rights provides the best basis for the cosmopolital lingua franca required by conditions of social pluralism. An investigation of the role that unified science plays in Neurath's politics also gives reasons for revising common misconceptions about the nature of the unity of science programme itself. Is logical empiricism incompatible with a critical social science? The longstanding assumption that it is incompatible has been prominent in recent debates about welfare economics. Sen’s development of a critical and descriptively rich welfare economics is taken by writers such as Putnam, Walsh and Sen to involve the excising of the influence of logical empiricism on neo-classical economics. However, this view stands in contrast to the descriptively rich contributions to political economy of members of the left Vienna Circle, such as (...) Otto Neurath. This paper considers the compatibility of the meta-theoretical commitments of Neurath and others in the logical empiricist tradition with this first-order critical political economy. (shrink)

The paper addresses two questions central to recent environmental political thought: Can a reduction in consumption be rendered compatible with a maintenance or improvement of well-being? What are the conditions for a sense of citizenship that crosses different generations? The two questions have elicited two conflicting responses. The first has been answered in broadly Epicurean terms: in recent environmental thought appeal has been made to recent hedonic research which appears to show that improvements in subjective well-being can be decoupled from (...) increased material consumption. The second has usually been answered in broadly Aristotelian terms: republicans have suggested that a public world and projects that are shared over generations are a condition of human well-being. These Epicurean and Aristotelian responses appear to look in opposite directions. They start from different accounts of well-being and appear to look in different places for human flourishing. This paper suggests that the broadly Aristotelian response is in fact owed to both problems. It shows that recent empirical research in the hedonic tradition can be rendered consistent with that Aristotelian response. (shrink)

Worldwide, there is a growing expectation that teachers will act in a ?professional? manner. Professionalism, in this regard, includes identification of a unique body of occupational knowledge, adherence to desirable standards of behaviour, processes to hold members to account and commitment to what the profession regards as morally right or good. In other words, as ethical conduct. Teaching ethically involves making reasoned decisions about what to do in order to achieve the most good for learners. Often, this involves a complex (...) interplay between current context, past experience and personal beliefs and values. However, teacher education and accountability frameworks typically give priority to the ?practical rationality? of planning, delivery and assessment of the official curriculum, not the ?value rationality? involved in exploring the ethics of teaching in difficult practical circumstances. An aspirational code of ethics for teachers was recently developed by the New Zealand Teachers Council. The authors were part of a group commissioned to design and deliver a single professional development workshop for teachers to raise awareness about the code. This article focuses on the challenges of developing a workshop that both informs and educates teachers about ethics. (shrink)

This paper describes a tool for assisting lawyers and paralegal teams during document review in eDiscovery. The tool combines a machine learning technology (CategoriX) and advanced multi-touch interface capable of not only addressing the usual cost, time and accuracy issues in document review, but also of facilitating the work of the review teams by capitalizing on the intelligence of the reviewers and enabling collaborative work.

Early reactions to the publication of Harold Garfinkel's Studies in Ethnomethodology, which have persisted over the passing decades, was that ethnomethodology could not address what sociology deemed to be socially significant matters such as 'power' and 'the state'. This, however, is not the case. How such matters enter into the practical everyday affairs of members is of equal interest to ethnomethodology when compared to how any matter enters into members' everyday life, and how they display that. It just does not (...) have more importance. Egon Bittner spelt this out with regard to Weber's interest in bureaucracy when he reminds sociology that when Weber talked about efficiency he was not referring to an objective standard but as something that is attuned to practical interests as they emerge in the context of everyday life. This paper examines some of the actions and interactions that were encountered in a Governmental Department in one of the European countries. It makes visible how characterisations of bureaucracy such as 'rational', and 'efficient' are achieved in the actions and interactions of Department employees, and some of the practices involved in that achievement. Garfinkel, and ethnomethodology in general, are not, in principle, to be found wanting where matters of overarching, primordial interest to sociology are concerned. (shrink)

A recent study suggests that vaccine hesitancy amongst key demographics – including females, younger individuals, and certain ethnic groups – could undermine the pursuit of herd immunity against COVID-19 in the United Kingdom. At the same time, the UK Joint Committee on Vaccination and Immunization (JVCI) indicated that it will not facilitate the choice between available COVID-19 vaccines. This paper reflects upon lessons from the introduction of the UK’s combined Measles, Mumps and Rubella (MMR) vaccine strategy of the 1980s when (...) Member of Parliament Miss Julie Kirkbride argued that had parents been allowed to choose between vaccine variants, then the crisis of low herd immunity – and subsequent outbreaks – could have been avoided. This paper explores this argument, as applied to the COVID-19 vaccination strategy, by considering how three key elements of informed consent – disclosure of risk, benefit, and reasonable alternatives – may be employed to tackle vaccine hesitancy and build vaccine confidence. An important but neglected difference between modern utilitarian and Kantian ethics on one side and virtues ethics on the other concerns the relation of good and evil. By taking virtues to be ethical primitives, standard versions of virtues ethics entail that some goods are logically evil‐dependent. That is, at least some central virtues cannot be characterised without reference to the possible existence of an evil, and cannot be exercised without the actual existence of that evil. Given this account on the (...) logical relation of good and evil, can a virtues ethic be defended? In particular, does a virtues ethic sanction an inference from a virtue to the evil that is the occasion for its exercise? The paper examines some prima facie examples of such inferences and considers how they might be blocked from within a virtues ethic. (shrink)

Carl J. Friedrich (1901?1984) defined constitutionalism as something more than can be expressed by the dominant behavioralist paradigm of modern political science and the typical academic focus on law and courts. A leading but now neglected post-WWII authority on constitutionalism, Friedrich argued that it should be understood as an institutionally-based, interactive system for deliberating the meaning and legal application of the norms of a political community. His approach shares much with the contemporary ?historical institutionalist? call to situate law and courts (...) within a broader, more normative, and more interactive conception of constitutionalism. Accordingly, a reconsideration of Friedrich's work may help current efforts to better articulate the full richness and complexity of constitutionalism as a distinctive way of ordering political life. Socialists and liberals have engaged in a long standing debate in political philosophy about the desirability of markets. Those debates have focused on a series of questions about the market: the kind of moral character it fosters, its tendency to enhance or diminish human welfare, the distribution of goods it promotes, its relationship to political democracy and freedom, its compatibility with socialist goals, and so on. Recently, the very possibility of this debate has been questioned. The whole tradition of argument (...) about the market is rejected on the grounds that it assumes an “essentialist” view of the market. Both defenders of the market and its traditional socialist critics assume that it is possible to talk of “the market.” They assume that different markets share some essential nature such that one can engage in a general discussion of the relation of the market to moral character, welfare, justice, freedom, democracy and so on. However, the argument goes, that essentialist assumption should be rejected. The standard arguments between defenders and critics of the market rest on a mistake. (shrink)

The Aristotelian view that public institutions should aim at the good life is criticized on the grounds that it makes for an authoritarian politics that is incompatible with the pluralism of modem society. The criticism seems to have particular power against modem environmentalism, that it offers a local vision of the good life which fails to appreciate the variety of possible human relationships to the natural environment, andso, as a guide to public policy, it leads to green authoritarianism. This paper (...) argues to the contrary that an Aristotelian position which defends environmental goods as constitutive of the good life is consistent with recognition of the plurality of ways our relations to the natural world can be lived. It is compatible with the recognition of distinct cultural expressions of such relations and of the special place particular histories of individuals and social groups have in constraining environmental policy. ABSTRACT The UK Supreme Court ruling of Montgomery v Lanarkshire clarified that in obtaining informed consent to treatment, practitioners are under a duty to inform patients of material risks. Traditionally such risk has pertained to the clinical risks inherent to treatment. In examining empirical and judicial evidence, this paper makes the case for disclosure of potent financial interests; with potency relating to those interests likely to have greatest influence over practice. The paper explores how financial interests may detrimentally influence practice (...) patterns and how non-disclosure of such interests may be linked to the erosion of patient trust and subsequent disinclination to consent to treatment. Judicial notions of material risk are explored, and the conclusion reached that they offer a broader interpretation of disclosable risk compared to current UK GMC guidance. It is anticipated that empirical evidence could be used by the courts in determining questions of both materiality and causation in cases of negligent non-disclosure of potent financial interests. The paper concludes that there is sufficient reason to surmise that a test case could successfully apply the principles identified therein to establish the materiality of conflict of interest in informed consent to medical treatment. We are currently approaching a political stalemate between two discursive idioms of community and difference. A third way has been introduced through the politics of identity recognition. Yet the latter tends to overwhelm the politics of community on the grounds of its outmoded universalism and sacrifice of singularity. More with the interests of a welfare society in mind than the stakes in cultural politics, the article restates the Hegelian dialectic of recognition as a critique of both absolute subject-position and absolute (...) other-position. Hegel regards this polarization as the non-starter in state of nature politics. Because global capitalism threatens a regression to a similar zero-point, Hegel’s dialectic of recognition is restated as the proper ground for a politics of civic recognition. (shrink)

Public choice theory presents itself as a new institutional economics that rectifies the failure of the neo-classical tradition to treat the institutional dimension of economics. It offers criticism of both neo-classical defenders of cost-benefit analysis and their environmental critics. Both assume the existence of benign political actors. While sharing some of its scepticism about this assumption, this paper argues that the public choice perspective is flawed. The old institutionalism of classical economics provides a better perspective to examine both explanatory and (...) nonnative problems occasioned by environmental problems than does the new institutionalism, raising significant questions about the relationship between environmental goods, virtues and institutions which have been lost to recent discussion. Central to Raimon Panikkar’s work is the acclaimed Cosmotheandric epigram, according to which reality has three interrelated and irreducible dimensions, the human, the cosmos, and the divine. The paper examines this thesis and examines related concepts, such as ‘sacred secularity’ in Panikkar’s thinking. The overall pluralistic thesis allows for dialogue, communication and conversations across cultures. Panikkar considers that a new mythos may be emerging that places value on actions in this world and on temporality. Related to the above is Ken (...) Wilber’s ‘Integral Theory’ that underscores the stages of development of consciousness and worldviews, especially with regard to spirituality. Different perspectives on the divine and atheism are said to arise at each level of development. Wilber’s principal thesis is that religions and spiritualities have continuing and future potentials as ‘conveyor-belts’ of human development in three movements of the Spirit : art, religion and science. A brief discussion will follow on ‘participative spirituality’ and Nondual Śaiva Tantra, and their relation to contemporary atheism. The paper argues that rich space and forum for dialogue are opened between the discourses explored here with global a/theism. (shrink)

Hume has a special place in justifications of claims made for rational choice theory to offer a unified language and explanatory framework for the social sciences. He is invoked in support of the assumptions characterising the instrumental rationality of agents and the constancy of their motivations across different institutional settings. This paper explores the problems with the expansionary aims of rational choice theory through criticism of these appeals to Hume. First, Hume does not assume constancy. Moreover, Hume’s sensitivity to the (...) relationships between institutional setting and individual motivation owes something to the relative transparency of the plural language of vices and virtues that he employs. Second, rational choice theory’s minimal modification of Hume’s account of the relation of reason and the passions through the introduction of constraints of consistency on preferences is unstable. Background No previous study has provided evidence for the scope and frequency of ethical dilemmas for paediatric nurses. It is essential to understand this to optimise patient care and tailor ethics support for nurses. Research aim The aim of this study was to explore the scope of nurses’ ethical dilemmas in a paediatric hospital and their engagement with the hospital clinical ethics service. Research design This study used a cross-sectional survey design. Participants and research context Paediatric nursing staff in a (...) tertiary paediatric centre in Australia completed an online survey asking about their exposure to a range of ethical dilemmas and their knowledge of the clinical ethics service. Analysis used descriptive and inferential statistics. Ethical considerations Ethical approval was granted from the hospital research committee. The survey was anonymous, and no identifying details of participants were collected. Results Paediatric nurses experienced a wide range of ethical dilemmas frequently, both in the intensive care and general areas. Knowledge and use of the clinical ethics service was poor and the most frequent challenge for nurses in managing dilemmas was feeling powerless. Conclusion There is a need to recognise the moral burden of ethical dilemmas for paediatric nurses in order to foster ethical sensitivity, and to provide adequate support to improve care and mitigate nursing moral distress.
