Taniwha are powerful water creatures in te ao Māori (the Māori world/worldview). Taniwha sometimes affect public works in Aotearoa New Zealand: for example, consultation between government agencies and tangata whenua (the people of the land) about proposed roading developments sometimes results in the route being moved to avoid the dwelling place of a taniwha. Mainstream media responses have tended to be hostile or mocking, as you might expect, since on the face of it the dominant western scientific worldview has no (...) place for beings like taniwha. However, in the 2020s, there appears to be an increased willingness to engage with te ao Māori. In this spirit, this paper proposes a way for non-Māori to begin to take taniwha more seriously, taking as its starting point the work of Dan Hikuroa on the practical usefulness of taniwha pūrākau (traditional narratives) in encoding information about natural hazards. The focus of this paper is narrow, but aspects of the strategy it proposes may be generalisable both to other aspects of te ao Māori and to other bicultural and multicultural contexts. (shrink)

Building Information Modelling (BIM) is a process for managing construction project information in such a way as to provide a basis for enhanced decision-making and for collaboration in a construction supply chain. One impediment to the uptake of BIM is the limited interoperability of different BIM systems. To overcome this problem, a set of Industry Foundation Classes (IFC) has been proposed as a standard for the construction industry. Building on IFC, the ifcOWL ontology was developed in order to facilitate representation (...) of building data in a consistent fashion across the Web by using the Web Ontology Language (OWL). This study presents a critical analysis of the ifcOWL ontology and of the associated interoperability issues. It shows how these issues can be resolved by using Basic Formal Ontology (ISO/IEC 21838-2) as top-level architecture. A set of competency questions is used as the basis for comparison of the original ifcOWL with the enhanced ontology, and the latter is used to align with a second ontology – the ontology for building intelligent environments (DOGONT) – in order to demonstrate the added value derived from BFO by showing how querying the enhanced ifcOWL yields useful additional information. It is no longer a revelation that companies have some responsibility to uphold human rights. However, delineating the boundaries of the relationship between business and human rights is more vexed. What is it that we are asking corporations to assume responsibility for and how far does that responsibility extend? This article focuses on the extent to which economic, social and cultural rights fall within a corporation's sphere of responsibility. It then analyses how corporations may be held accountable for violations of (...) such rights. Specifically, the article considers the use of soft law as a protective mechanism; it also details how victims of harmful corporate behaviour are using litigation (pursuant to ATCA and common law domestic causes of action) to seek redress and recognition of the harms they have directly or indirectly experienced. The article concludes with an analysis of Professor Ruggie's (the United Nations Special Representative on the issue of transnational corporations and human rights) 2008 and 2009 Reports in which it is suggested that a respect-based framework must be interpreted as imposing proactive requirements on companies to prevent the infringement of human rights. Future efforts must also be directed towards the recognition of a specialised complementary corporate responsibility to protect human rights. (shrink)

This article demonstrates that typical restrictions which are imposed in dialogical logic in order to recover first-order logical consequence from a fragment of natural language argumentation are also forthcoming from preference profiles of boundedly rational players, provided that these players instantiate a specific player type and compute partial strategies. We present two structural rules, which are formulated similarly to closure rules for tableaux proofs that restrict players' strategies to a mapping between games in extensive forms and proof trees. Both rules (...) are motivated from players' preferences and limitations; they can therefore be viewed as being player-self-imposable. First-order logical consequence is thus shown to result from playing a specific type of argumentation game. The alignment of such games with the normative model of the Pragma-dialectical theory of argumentation is positively evaluated. But explicit rules to guarantee that the argumentation game instantiates first-order logical consequence have now become gratuitous, since their normative content arises directly from players' preferences and limitations. Finding a naturalistic account of biological function is important both for making sense of the way functions are talked about in biology and medicine and for the project in the philosophy of mind of naturalising mental content via teleosemantics. The selected effects theory accounts for the proper functions of traits in terms of their selectional history, and is widely considered to be the most promising approach to naturalising biological functions. However, new challenges to the selected effects account have recently emerged. (...) Matthewson ( 2020 ) argues that natural selection comes in degrees and that on the face of it biological function does not, suggesting that analysing the latter in terms of the former is therefore problematic. Christie et al. (forthcoming) argue that the selected effects account of function does not fit with biologically detailed accounts of actual selection processes, in that it focuses on the functions of traits of individuals rather than the frequency of traits in populations and does not generate accurate selectional explanations in cases in which there is not a uniform selective environment. This paper defends the selected effects account against these challenges, arguing that a viable response to Matthewson is that _any_ degree of selection suffices to confer proper functions, and that Christie et al. mischaracterise the aims and assumptions of the selected effects account. In this paper I present the double disjunction task as introduced by Johnson-Laird. This experiment is meant to show how mental model theory explains the discrepancy between logical competence and logical performance of individuals in deductive reasoning. I review the results of the task and identify three problems in the way the task is designed, that all fall under a lack of coordination between the subject and the experimenter, and an insufficient representation of the semantic/pragmatic interface. I then propose a (...) reformulation of the task, that makes explicit the underlying semantic reasoning and emphasizes the difference of interpretation of the DDT between the experimenter and the subjects. Our aim in this paper is to provide a referential account of functional anaphora within a Skolem functions framework. We will give an interpretation of indefinite NPs as Skolem terms in order to show that the referential link established between an anaphoric pronoun and its antecedent is a descriptive one. Then we will argue that functional anaphora can be understood as a particular kind of E-type pronouns, in the sense that, for a large corpus, the pronoun can be replaced by (...) a descriptive expression of a first-order language. It will next be shown that the functional framework can be fruitfully applied to other kinds of sentences involving pronominal anaphora,especially in modal contexts. (shrink)

The value for human wellbeing and social development of information and its associated tools and technologies is no longer controversial. While still less well-endowed than other regions, Africa has growing numbers of print and electronic journals, funding programmes, and researcher and practitioner networks concerned with the generation and use of information in multiple domains. Most of this activity focuses on information as a knowledge resource, providing the factual basis for policy and intervention. By contrast more creative applications of information – (...) as the basis for new ideas whether or not they turn out to be factual – has been almost entirely ignored. Being able to generate and develop new ideas is, however, an equally important and arguably a prior capability, but until recently one that has been little understood. Recent advances in cogni-tive science and creativity research are changing this, however, and it is now possible to see how a rich research agenda can be developed concerned with the role of information and information and communication technology as creative resources. The South China Sea territorial dispute has been a contentious issue in the international community. In the course of 3 years, China and the Philippines had undergone arbitral proceedings over the maritime rights and entitlements in the South China Sea. As the Permanent Court of Arbitration reached its decision, this paper aims to examine the interpretation process of the Arbitral Tribunal in the judgment of the South China Sea conflict between China and the Philippines. The primary objective of the study (...) is to reconstruct or explain how the Tribunal came up with its interpretation of the written arguments presented by the parties involved and to distinguish whether such reconstruction the Tribunal has successfully interpreted or made sense of the said arguments and submissions. Doing so would necessitate a pragmatic analysis– the relevance-theoretic account of human communication and cognition. Data analyzed include written submissions and arguments as well as the legal documents used during the arbitral process. Using content analysis, the data were evaluated through applying the tool of interpretation based on the criteria set by the three conditions of the relevance theory: logical condition, pragmatic condition, and condition of optimal relevance. This paper argues that in order for the addressee of an utterance, in this case the Arbitral Tribunal, to attain a successful interpretation, it should meet these three conditions. This study found that the reconstruction of the interpretation based on the three conditions showed that the Tribunal had attained a valid and correct interpretation of the Philippines’ and China’s arguments. Furthermore, the paper asserts that implied conclusion and the contextual assumptions can be a guiding principle for the cognitive comprehension or interpretation of legal texts. (shrink)

Cet article a pour objectif d’exposer les potentialités d’adaptation de la théorie de l’interpellation d’Althusser à un cadre phénoménologique, et ce à l’aide de ses récupérations par Judith Butler et Sara Ahmed. Non seulement leurs écrits aident à pallier plusieurs critiques émises à l’égard de la théorie althussérienne de l’idéologie – notamment son déterminisme latent et son universalisation du sujet –, mais ils nous aident aussi à mieux comprendre comment l’idéologie fonctionne au niveau du corps marginalisé. En effet, l’idéologie agit (...) comme une orientation discursive et corporelle du sujet dans le monde, et ce en limitant son espace, sa temporalité et les objets lui étant accessibles. En liant interpellation et corps, il nous sera également possible de pousser la théorie de l’émancipation butlérienne vers une performativité corporelle ayant pour objet le corps vécu. À cet effet, nous soulignerons que les écrits d’Ahmed sur l’interpellation bonifient ceux de Butler, car ils ouvrent la porte vers une résistance à l’idéologie ancrée dans le corps via le concept de désorientation. Bien que la désorientation puisse servir de mécanisme d’assujettissement, elle peut également, selon certaines phénoménologues, créer de nouvelles voies d’émancipation (et possibilités) pour le sujet marginalisé. Although Hume did not produce any major work in aesthetics, several of his essays, as well as numerous passages in A Treatise of Human Nature and in An Enquiry Concerning the Principles of Morals, do address central debates in eighteenth-century aesthetics. In this dissertation I show that Hume made some interesting contributions to these debates that in fact changed the course of aesthetic inquiry. He was the first British thinker to apply systematically an empirical method to such aesthetic concepts as (...) the nature of beauty, the experience of the sublime, the pleasures of tragedy, and the standard of taste. His views on these concepts represent a significant departure from the classical emphasis on the formal features of aesthetic objects, and a new emphasis on the psychological processes by which the object is experienced. Hume's importance within the Anglo-aesthetic tradition is that his approach instigated a radical shift in aesthetic discourse from the study of beautiful things to the causal analysis of the emotional experiences of the percipient. Hume recognized the relativistic implications of the displacement of the aesthetic object by the experiencing subject, but he remained hopeful that a "science" of aesthetics based on principles of human nature could still be developed. This study aims to situate Hume's aesthetics within the context of his "science of man," and thereby to enhance understanding of his philosophical project as a whole. (shrink)

We conclude that although there is much to be gained by identifying the virtues of the good arguer and by considering the ways in which these virtues can be developed in ourselves and in others, virtue argumentation theory does not offer a plausible alternative definition of good argument.

The California Critical Thinking Dispositions Inventory is a commonly used tool for measuring critical thinking dispositions. However, research on the efficacy of the CCTDI in predicting good thinking about students’ own deeply held beliefs is scant. In this paper we report on preliminary results from our ongoing study designed to gauge the usefulness of the CCTDI in this context.

In this paper we argue that while a full-blown virtue-theoretical account of argumentation is implausible, there is scope for augmenting a conventional account of argument by taking a character-oriented turn. We then discuss the characteristics of the good epistemic citizen, and consider approaches to nurturing these characteristics in critical thinking students, in the hope of addressing the problem of lack of transfer of critical thinking skills to the world outside the classroom.

Achieving genuine engagement and understanding between communities with radically divergent worldviews is challenging. If there is no common ground on which to stand and have a discussion, the likely outcomes of an apparent intercultural disagreement are a stalemate, or the (sometimes colonialist) imposition of a single worldview, or a kind of relativistic tolerance that falls short of genuine engagement. In this paper, we suggest a way forward that takes as its starting point the philosophical discussion of deep disagreement, using the (...) example of taniwha (powerful water beings that must be treated with respect) to outline a strategy for building intercultural understanding and enabling constructive intercultural dialogue. To have the burden of proof is to be rationally required to argue for or provide evidence for your position. To have a heavier burden than an opponent is to be rationally required to provide better evidence or better arguments than they are required to provide. Many commentators suggest that differential or uneven distribution of the burden of proof is ubiquitous. Confronted by the multiscaled ecological crisis, many experience so-called ecological emotions such as ecological grief and eco-anxiety. Visual media can channel and contribute to creating and nurturing ecological emotions. Specifically, eco-documentaries are one of the triggers of ecological emotions. This paper explores the role of images in the generation of emotions regarding the environmental crisis through a case study of five contemporary Swiss eco-documentaries: It All Begins, Citizen Nobel, Lynx, Taming the Garden and The Mushroom Speaks. It analyses the ecological (...) emotions expressed by the characters or the filmmakers, or the expected emotions of the viewers, with regard to the types of images and their framing, editing, narrative and attractiveness. Finally, drawing on interdisciplinary literature from environmental humanities, this paper discusses the variety and intertwinement of ecological emotions and their interrelations to knowledge of the ecological crisis and pro-environmental actions. The presentation and paper for this conference go to the heart of the relationship between globalization and poverty worldwide. Data from the United Nations reveal the dramatic increase in exports and imports from 1990 to 2004, along with the uneven economic performance/quality of life across development groupings and geographical regions. Thus, findings suggest the possibility that trade growth has failed expectations that developing countries would rise to greater levels of productivity and subsequendy reduce abject poverty. Nonetheless, the situation is far (...) from hopeless and real progress can occur with a continued movement by transnational corporations toward socially responsible human rights, proactive governmental strategies that support productive dynamism, and removal of public policies that unfairly restrict less developed nations. Developing and implementing a meaningful code of conduct by managers or consultants may require a change in orientation that modifies the way these precepts are determined. The position advocated herein is for a different approach to understanding and organizing the guiding parameters of the firm that requires individual reflection and empowerment of the entire organization to advance their shared values. The processes involved are discussed using four discrete stages that move from the personal to the work team and to the (...) unit to the full company, followed by the board of directors’ evaluation. The hoped-for end product is dynamic, employee-driven, codes of conduct that recognize the systemic and far-reaching impact of organizational activities across internal and external stakeholders. The Barth–Krabbe–Hintikka–Hintikka Problem, independently raised by Barth and Krabbe and Hintikka and Hintikka Sherlock Holmes confronts modern logic: Toward a theory of information-seeking through questioning. Indiana University Press, Bloomington, 1983), is the problem of characterizing the strategic reasoning of the players of dialogical logic and game-theoretic semantics games from rational preferences rather than rules. We solve the problem by providing a set of preferences for players with bounded rationality and specifying strategic inferences from those preferences, for a variant of logical (...) dialogues. This paper provides an overview of how the social licence to operate (SLO) of the Swedish forest industry has been developed over time. For many decades, the SLO has been implicitly operating, shaped by dominant discourses of the day. We can see these SLOs through the agrarian, industrial and post-industrial era. During this era, a focus on bioenergy has seen whole stump removal become a more mainstream practice. This practice gained increasingly widespread acceptance when framed as a necessary response to (...) climate change. However, research has identified problems associated with whole stump removal, including decreased biodiversity, nutrient removal, soil acidification and mechanical soil preparation threatening soil carbon stores. In light of these recent developments, this paper examines the role of knowledge production and accepted discourses in the creation and maintenance of an industry’s SLO.
