Financial misconduct has come into the spotlight in recent years, causing market regulators to increase the reach and severity of interventions. We show that at times the economic benefits of illicit financial activity outweigh the costs of litigation. We illustrate our argument with data from the US Securities and Exchanges Commission and a case of investment misconduct. From the neoclassical economic paradigm, which follows utilitarian thinking, it is rational to engage in misconduct. Still, the majority of professionals refrain from misconduct, (...) foregoing economic rewards. We suggest financial activity could be reimagined taking into account intrinsic and prosocial motivations. A virtue ethics framework could also be applied, linking financial behavior to the quest for moral excellence and shared flourishing. By going beyond utilitarian thinking and considering alternative models, we offer a fuller account of financial behavior and a better perspective from which to design deterrence methods. (shrink)

The spectral fluctuations of quantum (or wave) systems with a chaotic classical (or ray) limit are mostly universal and faithful to random-matrix theory. Taking up ideas of Pechukas and Yukawa we show that equilibrium statistical mechanics for the fictitious gas of particles associated with the parametric motion of levels yields spectral fluctuations of the random-matrix type. Previously known clues to that goal are an appropriate equilibrium ensemble and a certain ergodicity of level dynamics. We here complete the reasoning by establishing (...) a power law for the ħ dependence of the mean parametric separation of avoided level crossings. Due to that law universal spectral fluctuations emerge as average behavior of a family of quantum dynamics drawn from a control parameter interval which becomes vanishingly small in the classical limit; the family thus corresponds to a single classical system. We also argue that classically integrable dynamics cannot produce universal spectral fluctuations since their level dynamics resembles a nearly ideal Pechukas–Yukawa gas. (shrink)

In the former socialist countries the relation of philosophy to social reality, as shaped by the political interests of the State, must be considered for each particular case with a view to the historical dynamics of its own development. The Polish case is not typical in this regard — it was determined by the failure of forced sovietization at the institutional, cultural level and the maintenance of Poland''s traditional contacts with Western European culture. In this regard Polish universities played an (...) important role since they preserved normal structures of academic activity.Philosophy in Poland has been marked by three currents which managed to rebuff the advances of Marxism. Best known among them is the Lwów-Warsaw school of logic and analytic philosophy. Its contribution is especially important in the methodology of philosophical inquiry and the style of responsible philosophical discourse. Though not a bed of political opposition the school''s members mounted a spiritual opposition to Marxism, especially during the Solidarity period. Catholic philosophy, as represented by the Catholic University of Lublin (KUL), has been and remains a completely independent force in Eastern and Central Europe. Doctrinally, Catholic philosophy in Poland has been divided between a more traditional, dated Thomism and the more progressive circles in Cracow where Western European philosophy, especially phenomenology, existentialism, and hermeneutics, has been influential (the significance of Józef Tischner and Karol Wojtyla, now Pope Jean Paul II). The third major current, centered in Cracow, is the phenomenology of Roman Ingarden, whose influence is manifest in a style of philosophizing that has attracted professional philosophers as well as committed intellectuals from different disciplines. W swojej książce Tropy i uniwersalia: Badania ontologiczne zaproponowałem systematyczną i historyczną analizę problemu uniwersaliów. Odróżniłem trzy podstawowe pojęcia powszechników, rozumianych kolejno jako wspólne własności, wspólne aspekty i wspólne całości, a następnie zastosowałem je do szczegółowej analizy teorii Romana Ingardena, św. Tomasza z Akwinu i Georga Wilhelma Friedricha Hegla. W tym tekście przedstawiam założenia metodologiczne mojej pracy, przyjmowane przeze mnie rozumienie powszechników i główne rezultaty moich interpretacji. Następnie omawiam krótko dyskusje, jakie wywołała moja książka. Katarzyna Barska i Marek Piwowarczyk (...) kwestionowali moje odczytanie teorii Ingardena, a Tomasz Tiuryn i Michał Głowala krytykowali moją interpretację stanowiska św. Tomasza. Na koniec pokazuję, w jaki sposób Karol Kleczka ciekawie rozwinął interpretację pojęcia konkretnego powszechnika w ramach współczesnej teorii uprawdziwiania. (shrink)

In the article I discuss the conceptual problem of other minds and different approaches to mental concepts. Firstly, I introduce the conceptual problem and argue that solutions proposed by theory-theory and direct perception approach are inadequate. I claim that mental concepts are neither theoretical terms nor observational terms. Then, I consider third option which states that mental concepts are dispositional terms, i.e. they concern particular patterns (stereotypes) of behavior. Finally, I argue that dispositional approach is to some extent coherent with (...) phenomenological account and that phenomenological concept of embodiment can improve this position. (shrink)

Predictive Processing theory, hotly debated in neuroscience, psychology and philosophy, promises to explain a number of perceptual and cognitive phenomena in a simple and elegant manner. In some of its versions, the theory is ambitiously advertised as a new theory of conscious perception. The task of this paper is to assess whether this claim is realistic. We will be arguing that the Predictive Processing theory cannot explain the transition from unconscious to conscious perception in its proprietary terms. The explanations offer (...) by PP theorists mostly concern the preconditions of conscious perception, leaving the genuine material substrate of consciousness untouched. (shrink)

We investigate an extension of the formalism of interpreted systems by Halpern and colleagues to model the correct behaviour of agents. The semantical model allows for the representation and reasoning about states of correct and incorrect functioning behaviour of the agents, and of the system as a whole. We axiomatise this semantic class by mapping it into a suitable class of Kripke models. The resulting logic, KD45n i-j, is a stronger version of KD, the system often referred to as Standard (...) Deontic Logic. We extend this formal framework to include the standard epistemic notions defined on interpreted systems, and introduce a new doubly-indexed operator representing the knowledge that an agent would have if it operates under the assumption that a group of agents is functioning correctly. We discuss these issues both theoretically and in terms of applications, and present further directions of work. (shrink)

The paper concerns the problem of the legal responsibility of autonomous machines. In our opinion it boils down to the question of whether such machines can be seen as real agents through the prism of folk-psychology. We argue that autonomous machines cannot be granted the status of legal agents. Although this is quite possible from purely technical point of view, since the law is a conventional tool of regulating social interactions and as such can accommodate various legislative constructs, including legal (...) responsibility of autonomous artificial agents, we believe that it would remain a mere ‘law in books’, never materializing as ‘law in action’. It is not impossible to imagine that the evolution of our conceptual apparatus will reach a stage, when autonomous robots become full-blooded moral and legal agents. However, today at least, we seem to be far from this point. (shrink)

In this study, we examine differences in cheating behaviors in higher education between two countries, namely the United States and the Czech Republic, which differ in many social, cultural and political aspects. We compare a recent (2011) Czech Republic survey of 291 students to that of 268 students in the US (Klein et al., 2007). For all items surveyed, CR students showed a higher propensity to engage in cheating. Additionally, we found more forms of serious cheating present in the Czech (...) sample. In all cases, the differences between the US and Czech samples were statistically significant. (shrink)

W związku z 30. rocznicą nadania przez Akademię Teologii Katolickiej w Warszawie doktoratu honoris causa J.M. Bocheńskiemu dokonano kwerendy dokumentów, związanych z tym wydarzeniem, obecnie znajdujących się w Archiwum Uniwersytetu Kardynała Stefana Wyszyńskiego w Warszawie. W jej wyniku odnaleziono nagrania audio i zdjęcia z tej uroczystości oraz dokumentację starań Wydziału Filozofii Chrześcijańskiej ATK, mających na celu nadanie tego tytułu o. Bocheńskiemu. Jak się okazało, począwszy od 1981 roku WFCh trzykrotnie ubiegał się o nadanie tego doktoratu i podejmował stosowne uchwały w (...) tej sprawie. Celem artykułu jest prezentacja i omówienie tych archiwaliów w kontekście związków o. In an era of fiscal austerity and dualization of social protection, has organized labor become increasingly split along skill and industry lines? Against recent political science accounts of trade union involvement in social policymaking, this paper argues that, in the specific area of pensions, unions representing high-skilled workers and the core industrial sectors of the economy have paradoxically been led to increase their cooperation with unions representing the less privileged segments of labor, in order to improve coverage of private pensions (...) across the board. These unions’ motivations for doing so and the strategies they have employed have nonetheless differed according to the preexisting institutional design of domestic pension systems. The argument is supported with case studies of British, French, German, and Belgian unions’ involvement in contemporary pension reform. (shrink)

In this paper we investigate the structure of uncountable maximal antichains of Silver forcing and show that they have to be at least of size d, where d is the dominating number. Part of this work can be used to show that the additivity of the Silver forcing ideal has size at least the unbounding number b. It follows that every reasonable amoeba Silver forcing adds a dominating real.

People should be at the centre of attention within knowledge-based economics. The leaders of each enterprise ought to focus on providing the best conditions for their employees’ professional and individual development and treat them with respect in terms of their dignity and needs. In contemporary literature two notions in perceiving people in organisations are noticeable. The first one treats employees as ‘resources’ which have to be properly used or as ‘capital’ that should bring a decent return on investment. The second (...) notion derives a lot from Christian philosophy and sees the human as a person who treats work as a way to realize his calling and thus is able to take responsibility for the decisions made and actions taken. Acting in a constantly changing environment, people have to be flexible and able to take advantage of emerging opportunities and avoid threats. Within this process it is not a matter of being a human ‘being’ but rather becoming, which means that they are incessantly developing their potential. Although it is hard to predict human behaviour, the main task for managers is to lead in a way that will help employees use their full potential for both their own and the company’s benefit. In Béziau a logic \ was defined with the help of the modal logic \. In it, the negation operator is understood as meaning ‘it is not necessary that’. The strong soundness–completeness result for \ with respect to a version of Kripke semantics was also given there. Following the formulation of \ we can talk about \-like logics or Beziau-style logics if we consider other modal logics instead of \—such a possibility has been mentioned in [1]. The correspondence result between (...) modal logics and respective Beziau-style logics has been generalised for the case of normal logics naturally leading to soundness–completeness results [see Marcos :279–300, 2005) and Mruczek-Nasieniewska and Nasieniewski :229–248, 2005)]. In Mruczek-Nasieniewska and Nasieniewski :185–196, 2008), :189–203, 2009) some partial results for non-normal cases are given. In the present paper we try to give similar but more general correspondence results for the non-normal-worlds case. To achieve this aim we have to enrich original Beziau’s language with an additional negation operator understood as ‘it is necessary that not’. (shrink)

Experiences are interpreted as conscious mental occurrences that are of phenomenal character. There is already a kind of (weak) intentionality involved with this phenomenal interpretation. A stricter conception of experiences distinguishes between purely phenomenal experiences and intentional experiences in a narrow sense. Wittgenstein’s account of psychological (experiential) verbs is taken over: Usually, expressing mental states verbally is not describing them. According to this, I believe can be seen as an expression of one’s own belief, but not as an expression of (...) a belief about one’s belief. Hence, the utterance I believe it is raining shows that I believe that it is raining, although it is not said by these words that I believe that it is raining. Thinking thoughts such as I believe it is raining, but it is not raining (a variant of Moore’s paradox) is an absurdity between what is already said by silently uttering It is not raining and what is shown by silently uttering I believe it is raining. The paper agrees with a main result of Wittgenstein’s considerations of Moore’s paradox, namely the view that logical structure, deducibility, and consistency cannot be reduced solely to propositions—besides a logic of propositions, there is, for example, a logic of assertions and of imperatives, respectively. In the context of modal logics one standardly considers two modal operators: possibility ) and necessity ) [see for example Chellas ]. If the classical negation is present these operators can be treated as inter-definable. However, negative modalities ) and ) are also considered in the literature [see for example Béziau ; Došen :3–14, 1984); Gödel, in: Feferman, Collected works, vol 1, Publications 1929–1936, Oxford University Press, New York, 1986, p. 300; Lewis and Langford ]. Both of them can be (...) treated as negations. In Béziau a logic \ has been defined on the basis of the modal logic \. \ is proposed as a solution of so-called Jaśkowski’s problem [see also Jaśkowski ]. The only negation considered in the language of \ is ‘it is not necessary’. It appears that logic \ and \ inter-definable. This initial correspondence result between \ and \ has been generalised for the case of normal logics, in particular soundness-completeness results were obtained [see Marcos :279–300, 2005); Mruczek-Nasieniewska and Nasieniewski :229–248, 2005)]. In Mruczek-Nasieniewska and Nasieniewski it has been proved that there is a correspondence between \-like logics and regular extensions of the smallest deontic logic. To obtain this result both negative modalities were used. This result has been strengthened in Mruczek-Nasieniewska and Nasieniewski :261–280, 2017) since on the basis of classical positive logic it is enough to solely use \ to equivalently express both positive modalities and negation. Here we strengthen results given in Mruczek-Nasieniewska and Nasieniewski by showing correspondence for the smallest regular logic. In particular we give a syntactic formulation of a logic that corresponds to the smallest regular logic. As a result we characterise all logics that arise from regular logics. From this follows via respective translations a characterisation of a class of logics corresponding to some quasi-regular logics where \ is the smallest element. Moreover, if a given quasi-regular logic is characterised by some class of models, the same class can be used to semantically characterise the logic obtained by our translation. (shrink)

In [1] J.-Y. Bèziau formulated a logic called Z. Bèziau’s idea was generalized independently in [6] and [7]. A family of logics to which Z belongs is denoted in [7] by K. In particular; it has been shown in [6] and [7] that there is a correspondence between normal modal logics and logics from the class K. Similar; but only partial results has been obtained also for regular logics. In a logic N has been investigated in the language with negation; (...) implication; conjunction and disjunction by axioms of positive intuitionistic logic; the right-to-left part of the second de Morgan law; and the rules of modus ponens and contraposition. From the semantical point of view the negation used by Došen is the modal operator of impossibility. It is known this operator is a characteristic of the modal interpretation of intuitionistic negation. In the present paper we consider an extension of N denoted by N+. We will prove that every extension of N+ that is closed under the same rules as N+; corresponds to a regular logic being an extension of the regular deontic logic D21. The proved correspondence allows to obtain from soundnesscompleteness result for any given regular logic containing D2, similar adequacy theorem for the respective extension of the logic N+. In Jaśkowski’s model of discussion, discussive connectives represent certain interactions that can hold between debaters. However, it is not possible within the model for participants to use explicit modal operators. In the paper we present a modal extension of the discussive logic $\textbf{D}_{\textbf{2}}$ that formally corresponds to an extended version of Jaśkowski’s model of discussion that permits such a use. This logic is denoted by $\textbf{m}\textbf{D}_{\textbf{2}}$. We present philosophical motivations for the formulation of this logic. We also give syntactic characterizations (...) of the logic and propose a comparison with certain other modal systems. In particular, we prove that $\textbf{m}\textbf{D}_{\textbf{2}}$ is neither normal nor regular. On the basis of the axiomatization of $\textbf{D}_{\textbf{2}}$, we give an axiomatization of $\textbf{m}\textbf{D}_{\textbf{2}}$. We also give another axiomatization which is not based on the axiomatization of $\textbf{D}_{\textbf{2}}$. Furthermore, we give a natural Kripke-style semantics for $\textbf{m}\textbf{D}_{\textbf{2}}$ and prove the respective adequacy theorems. (shrink)

What are the ethical concerns among the growing populations of business people in Central & Eastern Europe, and how might they be dealt with practically in the course of business life? David Murray has been a management consultant since 1979 working primarily with the Hay Group in the area of strategic organisational change. Since founding Maine Consulting Services in 1991 he spends most of his time in the field of business and professional ethics, also holding a Visiting Fellowship at the (...) University of Central Lancashire. He is chairman of the Professional & Technical Board at the (British) Institute of Quality Assurance and a coordinating editor of the quarterly Organisations & People. Marek Kucia is a social researcher operating his own research agency (which organised the Polish part of this exercise) and an academic teaching sociology, and conducting and co‐ordinating Central European Studies at the Jagiellonian University, Krakow. He studied political science, sociology and philosophy at Krakow and studied for his PhD at Oxford. He has also worked for Gallup, London, in opinion and market research. This survey report is based on presentations made in April 1994 to the EBEN Research Centres Conference in Prague, and in June 1994 to the conference on “Ethics in Transition” organised in Gödöllö, Hungary, by the Democracy after Communism Foundation, Budapest. W opracowaniu tym poszukiwana jest odpowiedź na dwa pytania: „co to są prawa człowieka?” oraz „jakie są zasadnicze elementy konstytucyjnej koncepcji tych praw?” Odpowiadając na pierwsze pytanie, zmierzać będę do wskazania zasadniczych elementów współczesnej – opartej przede wszystkim na prawie międzynarodowym – koncepcji służącej ujęciu tych praw, czyli do eksplikacji pojęcia praw człowieka. Odpowiadając na drugie, będę poszukiwać zasadniczych konsekwencji, które dla konstytucyjnych regulacji ma uznanie tej koncepcji. Analizy mają charakter projektujący. Nie jest moim celem rekonstrukcja koncepcji praw człowieka zawartej (...) w obecnie obowiązującej konstytucji lub w projektach nowej ustawy zasadniczej, lecz zmierzam do wskazania zasadniczych rozstrzygnięć, których przyjęcie w konstytucji jest postulowane ze względu na uznanie praw człowieka. Trzeba tu zastrzec, że całościowe opracowanie zagadnienia wymagałoby obszernej monografii, toteż nie zostaną tu podjęte zagadnienia dotyczące normowania poszczególnych praw, ale problemy konstytucyjnego ujęcia praw człowieka w ogóle, które jest decydujące dla rozumienia poszczególnych praw. Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje się (...) do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności. The author poses a question: which of the two fundamental, constitutional values – common good or human dignity – can be considered to be the cornerstone, the unifying value in the Constitution of the Republic of Poland from 1997. The paper shows the crucial reasons for accepting each of these values as primary and also presents the underlying relationships between these values . The prominence of a given value for defining the aim of the constitution and the legal order based (...) on it was accepted as the most important aspect for determining the order of primacy. In respect of the direct aims of activities of public authorities and more broadly – of the aims of subjects whose activities are defined by the constitution – the primary value should be common good understood as certain social conditions of life which support human development. It defines the space in which other constitutional values, also human dignity, are integrated. Human dignity, however, the primary value defining human being, gives the reason why human development is a first and autonomous aim of the constitutional order. In this respect dignity has priority before common good. -/- Autor stawia pytanie o to, którą z fundamentalnych wartości konstytucyjnych – dobro wspólne czy godność człowieka – można uznać za wartość pierwszą i stanowiącą podstawę spójności aksjologicznej Konstytucji RP z 2 kwietnia 1997 roku. Wskazane są zasadnicze racje przemawiające za uznaniem każdej z tych wartości za wartość pierwszą i identyfikowane są zasadnicze relacje zachodzące między tymi wartościami. Za aspekt najistotniejszy dla ustalenia pierwszeństwa którejś z tych wartości uznana jest doniosłość danej wartości dla określenia celu konstytucji i opartego na niej porządku prawnego. Z punktu widzenia bezpośredniego celu działań władzy publicznej i szerzej – podmiotów, których działanie wyznaczone jest porządkiem konstytucyjnym, wartością tą jest dobro wspólne wyznaczające przestrzeń, w której integrowane są inne wartości konstytucyjne, z godnością włącznie. Dobro wspólne jest celem porządku konstytucyjnego ze względu na godność człowieka, która czyni jego rozwój pierwszym i szczególnym – autotelicznym dobrem. W tej perspektywie godność ma pierwszeństwo przed dobrem wspólnym. (shrink)

The aim of this paper is to present and analyse legal acts cited in the European Parliament resolution of 20 January 2011 on the situation of Christians in the context of freedom of religion. The author presents the substance of the right to religious freedom and the position of religious freedom among other human rights. The paper also shows the formation of European law on religious freedom and grasps the development trends in this area. Because of the discrepancies that arise (...) when translating the same foreign terms into the Polish language, in order to better explain the content of the cited documents, the texts are also given in English language. The article is the summary of basic legal regulations relevant to reflect on religious freedom at EU level. Compiled materials may be useful to continue the reflection on religious freedom. (shrink)
