Ethical difficulties arise in health-care practices. However, despite extensive research findings that demonstrate that most nurses are involved in recurrent ethical problems, institutions are not always able to effectively support nursing care professionals. The limited availability of ethics consultation services and traditional nursing training fails to meet the frequent and strong requests by health workers to support their ethical dilemmas. A questionnaire was administered to 374 nurses attending a specialist training and a lifetime learning programme in Italy. The respondents reported (...) a high frequency of ethically sensitive situations, and they described the poor development of ethics support and a scarcity of ethics training programmes. The results suggest the importance of promoting ethics services that include consultation and ethics training. A need for systematic ethics educational activities was identified for improving the capacity of nurses to manage ethical issues in patient care. (shrink)

According to a rights forfeiture theory of punishment, liability to punishment hinges upon the notion that criminals forfeit their rights against hard treatment. In this paper, I assume the success of rights forfeiture theory in establishing the permissibility of punishment but aim to develop the view by considering how forfeited rights might be reclaimed. Built into the very notion of proportionate punishment is the idea that forfeited rights can be recovered. The interesting question is whether punishment is the sole means (...) for reclaiming forfeited rights. I argue for a pluralistic theory of rights reclamation, according to which, there are multiple ways by which a wrongdoer can recapture her forfeited rights. In particular, I argue that offering remorseful compensation is a valid means by which a wrongdoer might partially, or fully, reclaim her right against punishment. (shrink)

The role of evolutionary theory at the origin of life is an extensively debated topic. The origin and early development of life is usually separated into a prebiotic phase and a protocellular phase, ultimately leading to the Last Universal Common Ancestor. Most likely, the Last Universal Common Ancestor was subject to Darwinian evolution, but the question remains to what extent Darwinian evolution applies to the prebiotic and protocellular phases. In this review, we reflect on the current status of evolutionary theory (...) in origins of life research by bringing together philosophy of science, evolutionary biology, and empirical research in the origins field. We explore the various ways in which evolutionary theory has been extended beyond biology; we look at how these extensions apply to the prebiotic development of (proto)metabolism; and we investigate how the terminology from evolutionary theory is currently being employed in state-of-the-art origins of life research. In doing so, we identify some of the current obstacles to an evolutionary account of the origins of life, as well as open up new avenues of research. (shrink)

Moral Case Deliberations are reflective dialogues with a group of participants on their own moral dilemmas. Although MCD is successful as clinical ethics support, it also has limitations. 1. Lessons learned from individual MCDs are not shared in order to be used in other contexts 2. Moral learning stays limited to the participants of the MCD; 3. MCD requires quite some organisational effort, 4. MCD deals with one individual concrete case. It does not address other, similar cases. These limitations warrant (...) research into complementary ways of providing CES to healthcare professionals. Our research objective was therefore to develop a low threshold CES tool based on a series of MCDs on autonomy in long-term care. We used a qualitative research design in which we analyzed the process and content of a series of MCDs, combined with reflections on the theoretical background of MCD. In total 28 MCDs were analyzed by means of a thematic content analysis. In various rounds of development, the results of the analysis were combined with theoretical reflections on CES. Consequently, the tool was evaluated in three focus groups and adjusted. The CES tool, called ‘moral compass’, guides the users through a series of six subsequent questions in order to methodically reflect on their concrete moral dilemma, in the form of a booklet of 23 pages. It combines a methodical element that encourages and structures a reflection process with a substantive element, including norms, values, options, strategies, and insights regarding dealing with client autonomy. By using data from a series of MCDs, combined with theoretical reflections on MCD, ethics support and moral learning, we developed a thematic, low-threshold CES tool that supports healthcare professionals in daily practice in dealing with moral questions regarding client autonomy. It integrates examples and insights from earlier MCDs on the same topic. The moral compass is not a replacement of, but can be used complementary to MCD. The feasibility and impact of the moral compass need to be investigated in an evaluative follow-up study. The methodology presented in this paper may be used to develop moral compasses on different topics in various healthcare organizations. (shrink)

This paper describes a cross-cultural research project on the relation between how people conceptualize nature and how they act in it. Mental models of nature differ dramatically among and within populations living in the same area and engaged in more or less the same activities. This has novel implications for environmental decision making and management, including dealing with commons problems. Our research also offers a distinct perspective on models of culture, and a unified approach to the study of culture and (...) cognition. We argue that cultural transmission and formation does not consist primarily in shared rules or norms, but in complex distributions of causally-connected representations across minds in interaction with the environment. The cultural stability and diversity of these representations often derives from rich, biologically-prepared mental mechanisms that limit variation to readily transmissible psychological forms. This framework addresses a series of methodological issues, such as the limitations of conceiving culture to be a well-defined system or bounded entity, an independent variable, or an internalized component of minds. This paper argues that it is prudentially wise to defer to groups about how they are essentially constituted and defined. After a few words situating the paper in my greater research project (§1), I articulate the kind of deference I have in mind (§2). Then I offer two conditional arguments on why it is epistemically desirable to let other people tell you how they ought to be identified (§3). The first argument is that people are owed lexical sovereignty because denying (...) it is absurd; the second is that modest skeptics ought to agree with it on the basis of some relatively anodyne and plausible epistemic considerations. Chris Tucker's paper on the hiddenness argument seeks to turn aside a way of defending the latter which he calls the value argument. But the value argument can withstand Tucker's criticisms. In any case, an alternative argument capable of doing the same job is suggested by his own emphasis on free will.

Intellectual character education has been primarily expressed in terms of educating for intellectual virtues (EFIV). This aim of teaching intellectual virtues has received some challenges, such as how it fails to articulate adequate action guidance through exemplarist pedagogy, and how it neglects the pervasiveness of intellectual vice among students. To respond to these challenges, this paper considers the aim of educating against intellectual vices (EAIV) – teaching students not to develop intellectual vices or weakening those that they have already developed (...) – which comes with the emergence of vice epistemology. More specifically, I look at how negative epistemic exemplars can be used as a classroom strategy for EAIV, and demonstrate how this could address the aforementioned weaknesses of EFIV. (shrink)

We ponder whether theology meets (...) the requirements of a scientia and argue about just how to understand the task of theology in the face of Aquinas’s concern about theology as a scientia. Part of this ongoing argument is shaped by the philosophical and epistemological needs of theologians attempting to justify their positions in an academic world driven by the secular and scientific norms of the Enlightenment. Additionally, some interest in theology as a scientia is driven by the desire to provide a philosophically acceptable alternative to secular forms of reason—thus Leo’s XIII’s promotion of Thomistic philosophy.The interest in theology as a science was shaped by the historical work of Chenu in his influential articles on the topic and then by almost every other important Thomist in the last fifty years.1 Theology as a scientia is such a pressing topic that it would almost be fair to say that Thomists have developed their own scientia of theology as a scientia. [End Page 273]Beyond the modern and, perhaps, postmodern concerns driving this interest, there are good reasons to pay attention to Aquinas on the status of theology. If we focus on theology as a scientia, it is because Aquinas invites us to do so by taking up this question in one form or another at the beginning of his major theological syntheses. We are, after all, only following his lead and pondering with him just what we are thinking about, and how we are thinking, when we think about God.Within the Thomistic corpus there is, however, a minority report with regard to the status of theology. In his prologue to his commentary on Boethius’s Hebdomads, Aquinas looks at theology in a very different way, one that can supplement our understanding of sacred doctrine in its role as both an intellectual and an affective enterprise. In this commentary Aquinas journeys into a different territory and explores theology, not as a scientia, but as a kind of play—a play that evokes delight and pleasure in the one who pursues wisdom.My approach will be first to describe Aquinas’s theology with regard to regular play—the kind of recreational activities we all engage in, whether they are physical or verbal. He takes up the question of the morality of play in several places and in a way that will inform our understanding of what he means when he describes theology as play. With this understanding of regular play in place, we will then explore theology as play, based on the supposition that there is something analogical between regular play and theology as play. I will finish with some reflections on how this might contribute to our present understanding of theological work.IWhile he scatters comments about play across his corpus and mentions it in all of his theological syntheses, Aquinas gives sustained attention to play in two places: first, in his commentary on Aristotle’s Ethics, and second, in question 168 of the Secunda secundae (in the treatise on temperance) of the Summa theologiae. Il n'y a pas une seule question de théorie juridique qu'on puisse traiter aujourd'hui sans examiner d'abord l'analyse qu'il en fait, mais son œuvre ne concerne pas seulement le droit et la philosophie du droit ; elle touche aussi la philosophie politique, l'épistémologie, l'éthique ou la logique. Sa théorie du droit représente, à côté du réalisme, l'une des deux branches du juspositivisme moderne, connue sous le nom de (...) normativisme et que lui-même appelait " Théorie pure du droit ". Elle se donne comme une théorie scientifique qui se borne à décrire son objet, le droit positif, et qui donc est " pure " de tout jugement de valeur. La pureté ne concerne toutefois que la méthodologie. Le droit, lui, n'est nullement pur, car il exprime des choix moraux et politiques. Partial reasons are considerations in favor of something that, taken individually, are not sufficient to establish an obligation. I consider the extent to which partial reasons are reasons, and why they cannot be reduced to or identified with pro tanto reasons. I lay out two approaches to the content of reasons, the flat theory and the structured theory. I argue that parts of reasons are not partial reasons, by showing that natural ways to represent parts of reasons in the flat (...) theory and the structured theory lead to overgeneration problems with regard to partial reasons. I then formulate two notions of partial reasons: one based on a notion of partial support, which is in turn captured by the notions of full support and partial content, and one based on the notion of in exact verification. I show under which conditions the two notions of partial reasons (based on partial content, and based on inexact verification) coincide. (shrink)

Mais c'est également une difficulté pour sa propre explication des formes de base de la perception et de la pensée, et Aristote introduit la phantasia précisément pour répondre à cette question. Il soutient qu'elle ne peut (...) être réduite aux autres états mentaux et offre donc une nouvelle explication causale du contenu, laquelle explique comment un état mental peut être aussi bien vrai que faux. The present article offers a new interpretation of Aristotle's concept of « imagination » or phantasia through a close reading of On the Soul, 3. 3, with special attention to the chapter's opening. Aristotle argues that his predecessors cannot explain how error can ever occur. But it is equally a difficulty for his own account of the most basic types of perception and thought, and Aristotle introduces phantasia precisely to answer this problem. He argues that it cannot be reduced to other mental states and then offers a new causal account of content which explains how a mental state can be either true or false. (shrink)

Treatment-resistant depression (TRD) holds centrality in many debates regarding psychiatric euthanasia. Among the strongest reasons cited by opponents of psychiatric euthanasia is the uncertainty behind the irremediability of psychiatric illnesses. According to this argument, conditions that cannot be considered irremediable imply that there are possible remedies that remain for the condition. If there are possible remedies that remain for the condition, then patients with that condition cannot be considered for access to euthanasia. I call this the irremediability requirement (IR). I (...) argue that patients with TRD can, indeed, meet the operationalisation of irremediability in the IR. This is because the irremediability it asks for is not some global or absolute irremediability, but rather a present irremediability based on the current state of medical science. I show this by considering irremediability relating to (1) possible future treatments and (2) not trying presently available alternative treatments. I extend Schuklenk nd van de Vathorst’s argument from parity to terminal malignancies, to show that (1) is an unreasonable expectation for all cases of euthanasia. Taking (2) as a more serious opponent to psychiatric euthanasia, I show how the IR, based on how it is presently operationalised, can be realistically applied to cases of TRD. I do this by further developing Tully’s argument on broad-sense treatment resistance with the robust empirical data from the STAR*D trials. If my argument from Tully’s is valid, then we have reasons to, again, seek parity between the operationalisations of irremediability in terminal malignancies and TRD. (shrink)

In this paper we argue that to adequately capture the complicated relationship between Descartes' work and late medieval thought, philosophers need to think not only about his ideas but also about his presentation and choice of genre. Reading the Meditations as a mere discursive treatise containing a progressive and consistent set of arguments intended to establish a particular philosophical position fails to appreciate the eponymous genre that Descartes explicitly chose to employ in writing them. Instead, we argue that reading the (...) text in light of the long tradition of contemplative meditative literature opens up a radically new way of interpreting the Meditations as a “mystagogical” project of spiritual edification and epistemic and volitional transformation. During such a transformation, the meditator undergoes a series of revelatory experiences structurally similar to those we find in various so-called “mystical” or “mystagogical”literature, in the Christian West. We show how paying attention to these mystagogical aspects of the Meditations can open up new avenues for understanding the connection between the theoretical, practical, and theological aspects of Descartes' thought. Such a reading resolves a number of seemingly glaring problems and peculiarities in the Meditations including the Cartesian circle, and the tension in the Cartesian notion of the freedom of the will. We also argue that the odd detours the meditator takes in the Sixth Meditation through physiology are not mere digressions but rather mark an often overlooked aspect of the mystagogical story – the return to embodiment as a transformed self. Indeed, the overly intellectualist emphasis of contemporary scholars on both the contemplative aspects of mystagogical literature and the epistemological focus of Descartes' project in the Meditations have caused them to largely overlook the ways in which the aim of both medieval and Cartesian meditation involves a transformative re-orientation of the whole person and their understanding of the world – one which has practical, moral, and social consequences that have gone underexplored in discussions of these texts. In 1931, in the remarks collected as Culture and Value, Wittgenstein writes: ‘A thinker is very much like a draughtsman whose aim it is to represent all the interrelations between things.’ At a glance it is clear that this analogy might contribute significantly to a full description of the autobiographical thinker as well. And this conjunction of relations between things and the work of the draughtsman immediately and strongly suggests that the grasping of relations is in a sense visual, or (...) that networks or constellations of relations are the kinds of things brought into focus by seeing in the right way.
