Nurses may, and often do, experience moral distress in their careers. This is related to the complicated work environment and the complex nature of ethical situations in everyday nursing practice. The outcomes of moral distress may include psychological and physical symptoms, reduced job satisfaction and even inadequate or inappropriate nursing care. Moral distress can also impact retention of nurses. Although research has grown considerably over the past few decades, there is still a great deal about this topic that we do (...) not know including how to deal well with moral distress. A critical key step is to develop a deeper understanding of relational practice as it pertains to moral distress. In this article, exploration of the experience of moral distress among nurses is guided by the key elements of relational ethics. This ethical approach was chosen because it recognizes that ethical practice is situated in relationships and it acknowledges the importance of the broader environment on influencing ethical action. The findings from this theoretical exploration will provide a theoretical foundation upon which to advance our knowledge about moral distress. (shrink)

In pediatric critical care, nurses are the primary caregivers for critically ill children and are particularly vulnerable to moral distress. There is limited evidence on what approaches are effective to minimize moral distress among these nurses. To identify intervention attributes that critical care nurses with moral distress histories deem important to develop a moral distress intervention. We used a qualitative description approach. Participants were recruited using purposive sampling between October 2020 to May 2021 from pediatric critical care units in a (...) western Canadian province. We conducted individual semi-structured interviews via Zoom. A total of 10 registered nurses participated in the study. Four main themes were identified: (1) “I’m sorry, there’s nothing else”: increasing supports for patients and families; (2) “someone will commit suicide”: improving supports for nurses: (3) “Everyone needs to be heard”: improving patient care communication; and (4) “I didn’t see it coming”: providing education to mitigate moral distress. Most participants stated they wanted an intervention to improve communication among the healthcare team and noted changes to unit practices that could decrease moral distress. This is the first study that asks nurses what is needed to minimize their moral distress. Although there are multiple strategies in place to help nurses with difficult aspects of their work, additional strategies are needed to help nurses experiencing moral distress. Moving the research focus from identifying moral distress towards developing effective interventions is needed. Identifying what nurses need is critical to develop effective moral distress interventions. (shrink)

Moral distress is a common phenomenon among nurses and is related to the complicated work environments and complex nature of ethical situations in day-to-day nursing practice. Few strategies have been identified for instructors to effectively engage with learners when communicating about moral distress. The global pandemic has intensified the risk of moral distress due to increased demands on already limited human resources and uncertainty of the pandemic’s trajectory. Nurses commonly experience moral distress: a conflict between the morally correct action and what they are required or capable of doing. Effective moral distress interventions are rare. For this reason, our team conducted a multi-phase research study to develop a moral distress intervention for pediatric critical care nurses. Biobanking activities for genetic research purposes have recently undergone nothing short of a small revolution. Many biobanks have left their traditional home of a small refrigerator in a laboratory to reach the unprecedented proportion of large, sophisticated storage centers containing DNA samples from whole populations. As we turn our attention to research on complex diseases and show great interest in human genetic variation and genetic epidemiology, we need to base our research not only on the DNA of small family cohorts, (...) but on larger sample collections, coupled with geographic location, genealogical information, and environmental and medical data. Population genetic research projects are underway around the world. Setting up such large-scale population biobanks is a challenge for any researcher. Population genetic research projects raise legal, ethical, and social issues that need to be addressed properly in order to maintain the trust of the population, an absolute requirement for the success of such research endeavour. Abstract:To date, our understanding of ethical decision making and behavior in organizations has been concentrated in the area of moral judgment, largely because of the hundreds of studies done involving cognitive moral development. This paper addresses the problem of our relative lack of understanding in other areas of human morality by applying a recently developed construct—moral approbation—to illuminate the link between moral judgment and moral action. Recent debates between modernists and postmodernists have shaken the foundations of modern social science. The epistemological assumptions of long-established procedures for constructing and validating knowledge claims have been called into question. This article discusses how two major contributors to the “new feminist epistemologies”—Dorothy Smith and Patricia Hill Collins—selectively integrate premises of modernist and postmodernist thought into their standpoint approaches. However, the particular premises they select result in significant ontological and epistemological differences between their works. How educators and students process and respond to emotions can either enhance or impede the development of the whole child. Social and emotional learning (SEL) refers to the processes of developing social and emotional competencies, which depend on individuals’ capacity to recognize, understand, and manage emotions (i.e., emotional intelligence or EI). Consensus across disciplines about the importance of EI highlights the need to advance the science of how to teach SEL. RULER, an evidence-based approach to teaching EI, provides an educational (...) framework that encompasses a set of practices for comprehensive SEL integration across a school or district. Some bioethicists argue that conscientious objectors in health care should have to justify themselves, just as objectors in the military do. They should have to provide reasons that explain why they should be exempt from offering the services that they find offensive. There are two versions of this view in the literature, each giving different standards of justification. We show these views are each either too permissive (i.e. would result in problematic exemptions based on conscience) or too restrictive (i.e. would (...) produce problematic denials of exemption). We then develop a middle ground position that we believe better combines respect for the conscience of healthcare professionals with concern for the duties that they owe to patients. Our claim, in short, is that insofar as objectors should have to justify themselves, they should have to do it according to the standard that we defend rather than according to the standards that others have developed. Working in and around the ‘chain of command’: power relations among nursing staff in an urban nursing homeBy most accounts, the discipline of nursing enjoys considerable hegemony in US nursing homes. Not surprisingly, the ethos of this setting is influenced, in large part, by nursing’s value system. This ethos powerfully impacts both the residents who live in nursing homes and the staff who work there. Using ethnographic methods, this project explored power relations among nursing assistants and nurses in an urban (...) nursing home in the United States. Factors contributing to tensions among nursing staff were the stigma attached to nursing homes and those who work in them, as well as the long history of class conflict and power struggles within the discipline of nursing. The latter struggles, in turn, reflected nursing’s quest for professional status in the face of medicine’s hegemony over health‐care. Ultimately, these factors coalesced to produce a local work environment characterized by conflict — and by aides’ resistance to nurses’ domination. (shrink)

Gilles Deleuze and Félix Guattari’s notion of becoming-animal offers a mode of interaction that goes beyond the symbolic language and conceptual thought that are often used in the western philosophical tradition to circumscribe the limits and define the nature of an ethical engagement. They fail, however, to provide a robust account of how becoming may yield an ethical exchange between the human being and the animal other. In the 17th century, English plague-tract writers began replicating a practice begun some decades earlier by their French and Italian counterparts: creating local histories to better describe the disease and explain how best to manage it. After the great London outbreak of 1665, however, plague deaths often went unrecorded and English tract-writing declined significantly. Without local epidemics to record or historicize, the authors became remote spectators of plague elsewhere, their own outbreaks perhaps now seemingly safe in the past. When plague (...) raged in Marseille in 1720, the disease generated fear but was in some ways a bygone event to English tract-writers. Marketing their tracts as historical accounts, a number of English authors likened the Marseille plague to the epidemics that were forming part of England's social memory. By repeatedly hailing 1665 as the last time plague had raged in London, some writers emphasized England's long plague-free status, pointing to the success of past efforts to contain the disease and also, in some cases, denying that plague could ever have been endemic in the kingdom. They did not downplay the threat that the Marseille outbreak posed should it spread; indeed, concern that plague might devastate English cities once again is at times palpable in the tracts. However, for numerous writers, plague had become an imported foreign threat, one that could be mitigated with appropriate measures, not one that arose domestically. They pointed specifically to the Ottoman Empire, describing it as disease-ridden and the source of their own plagues-historically and, potentially, in the future. In other words, 18th-century English tract-writers relegated their plague epidemics to the past by both firmly historicizing them and making the disease definitively foreign. Although it has disappeared as a clinical diagnosis, a Disability Studies perspective on Civil War nostalgia offers an opportunity to recover the process by which understanding around a medical event occurs. By incorporating and examining the interplay between and among participants in the conversation surrounding nostalgia as they operate within various site specific temporal and social contexts, this method of analysis offers an opportunity to arrive at an understanding not only of the factors that contribute to different perspectives on an (...) illness, but also into how some voices become ascendant in constructing medical understanding and why others become subordinate, dismissed, or disappear. This article indicates a reflective paradigm generally ignored in feminist research regarding the sex/gender debate, as presented in the work of Judith Butler ( Gender Trouble ). First, I address the fact that Butler’s philosophy is inscribed in the hermeneutical tradition of suspicion. Second, I put into relief the implicitly Platonic concept of mimesis , which is central to the anticipated subversion of gender, but uncriticized by Butler and others who follow her line of thought. Third, since Butler’s feminism can’t (...) ward off dualism, nor consider idem and ipse identity , I emphasize Paul Ricoeur ’s concept of triple mimesis and narrative identity, which allows us to depart from dichotomies and hierarchies. Following the path of Ricoeur and Françoise Heritier, I finally defend a feminist hermeneutical point of view, which is differentialist and universal. (shrink)

In studying Caryl Churchill's work This Is a Chair, however, I would suggest the personal and political to be intimately related and possibly each even a causation of the other. To take care of one may (...) be eliminating the problem of the other as well. Might political problems stem from petty, personal qualms? Even more specifically might jeopardizing moral norms affect the greater social order? BackgroundMedical aid in dying was introduced in Quebec in 2015. Quebec clinical guidelines recommend that MAiD be approached as a last resort when other care options are insufficient; however, the law sets no such requirement. To date, little is known about when and how requests for MAiD are situated in the broader context of decision-making in end-of-life care; the timing of MAiD raises potential ethical issues.MethodsA retrospective chart review of all MAiD requests between December 2015 and June 2017 at two (...) Quebec hospitals and one long-term care centre was conducted to explore the relationship between routine end-of-life care practices and the timing of MAiD requests.ResultsOf 80 patients requesting MAiD, 54% received the intervention. The median number of days between the request for MAiD and the patient’s death was 6 days. The majority of palliative care consults came less than 7 days prior to the MAiD request and in another 25% of cases occurred the day of or after MAiD was requested. 35% of patients had no level of intervention form, or it was documented as 1 or 2 at the time of the MAiD request and 19% were receiving life-prolonging interventions.InterpretationWe highlight ethical considerations relating to the timing of MAiD requests within the broader context of end-of-life care. Whether or not MAiD is conceptualised as morally distinct from other end-of-life options is likely to influence clinicians’ approach to requests for MAiD as well as the ethical importance of our findings. We suggest that in the wake of the 2015 legislation, requests for MAiD have not always appeared to come after an exploration of other options as professional practice guidelines recommend. (shrink)

Unconsented intimate exams on men and women are known to occur for training purposes and diagnostic reasons, mostly during gynecological surgeries but also during prostate examinations and abdominal surgeries. UIEs most often occur on anesthetized patients but have also been reported on conscious patients. Over the last 30 years, several parties—both within and external to medicine—have increasingly voiced opposition to these exams. Arguments from medical associations, legal scholars, ethicists, nurses, and some physicians have not compelled meaningful institutional change. Opposition is (...) escalating in the form of legislative bans and whistleblower reports. Aspiring to professional and scientific detachment, institutional consent policies make no distinction between intimate exams and exams on any other body part, but patients do not think of their intimate regions in a detached or neutral way and believe intimate exams call for special protections. UIEs are found to contribute to moral erosion and moral distress of medical students and compromise the sacred trust between the medical community and the general public. This paper refutes the main arguments in favor of the status quo, identifies a series of harms related to continuing the current practice, and proposes an explicit consent policy for intimate exams along with specific changes to medical school curriculum and institutional culture. Because patients are the rights-holders of their bodies, consent practices should reflect and uphold patient values which call for explicit consent for intimate exams. (shrink)

This article compares Hannah Arendt's famous essay on Adolf Eichmann's trial in Israel in 1961 to Simone de Beauvoir's little studied piece, "An Eye for an Eye," on the trial of Robert Brasillach in France in 1945. Arendt and Beauvoir each determine the complicity of individuals acting within a political order that seeks to eliminate certain forms of otherness and difference, but come to differing conclusions about the significance of the crimes. I explain Beauvoir's account of ambiguity, on which she (...) draws in her judgment of Brasillach and elaborates in her 1948 Ethics of Ambiguity, ana measure it against Arendt's account of Eichmann's thoughtlessness and its effects on the destruction of conditions of worldly plurality. Linking the failure of ethical judgment on the part of individuals to prior systemic political conditions, Beauvoir helps us recognize struggles over the meaning of bodies and conditions of inequality as central to politics. ITC technologies have come to comprehensively represent images and expectations of the future. Hopes of ongoing progress, economic growth, skill upgrading and possibly also democratisation are attached to new ICTs as well as fears of totalitarian control, alienation, job loss and insecurity. Currently, with the terms "Industry 4.0." and ‘Fourth Industrial Revolution”, public institutions, private institutions, and literature refer to the inchoate transformation of production of goods and services resulting from the application of a new wave of technological innovations: interconnected (...) collaborative robots; machine learning; Artificial Intelligence; 3D printers connected to digital development software; simulation of interconnected machines; integration of the information flow along the value chain; multidirectional communication between manufacturing processes and products. According to the main representations of Industry 4.0. by private and public institutions, its effects are expected to be mainly positive, for what regards productivity, economic opportunities and the future of work. The positive potentials now attributed to the new cycle of innovation evoke and expand those attributed to the previous waves of innovation linked to ITC technologies, and, even before, to the transition from Fordism to Post-Fordism. However, these transformations have so far not achieved any of the promises they raised. Improvements for workers in terms of work conditions, work performance and work relationships cannot be determined by any technical innovation in itself, being technological innovation always socially shaped. Je montre ici qu’une certaine tendance du discours français sur le care peut être diagnostiquée comme le symptôme d’une culture désenchantée, dépouillant le monde non de ses dieux, mais de ses dimensions esthétique, artistique et imaginative. Le renversement que ce discours tend à opérer, de la figure morale de l’autonomie à celle de la vulnérabilité, illustrerait ce (...) « symptôme ». C’est plus précisément l’idée du care comme « maintien du monde » chez Tronto que je critique, puisque l’auteure exclut de ces activités les domaines esthétique, artistique et intellectuel. Je discute trois auteures ayant déjà critiqué cette notion de care, qui chacune font progresser mon propos vers ce que je considère être un oubli du monde « existentiellement » habitable chez la philosophe. Enfin je contribue à combler ce qui manque dans la théorie de Tronto, soit un horizon esthétique et une réflexion sur le langage qui s’encastre dans une herméneutique du soi. Je me penche alors sur un care qui consiste à veiller sur la « fragilité du langage politique » chez Paul Ricoeur. Je conclus que s’agissant de faire du care une valeur publique à la fois féministe et soucieuse non seulement de la vie, mais aussi du monde, les activités artistiques, intellectuelles et éducationnelles sont de loin les plus efficaces, contrairement à ce que Tronto semble penser. | : In France, the ambassadresses of care ethics mainly align themselves with Joan C. Tronto’s theory—rather more than with Carol Gilligan’s. Here I want to state that a certain tendency of French discourse of “care” might be diagnosed as a symptom of a disenchanted culture, since it strips the world of its aesthetic, artistic, and imaginative dimensions. I contend that we can find the best illustration of this symptom when that discourse tends to shift from the moral figure of autonomy to the moral figure of vulnerability. More precisely, I aim to challenge Tronto’s idea of “care” as a “maintaining of the world”, since she excludes from it the areas of aesthetics, the arts, and intellectual activities. I shall discuss three authors who have already criticized Tronto’s notion of “care”. Each of them presents an opportunity for me to refine my reflection on what I consider to be Tronto’s disregard for an existentially liveable world. Finally, I help to fill in what is lacking from Tronto’s theory —that is to say, an aesthetic horizon and a real reflection on language, a reflection framed by a hermeneutics of the self. To this end, I focus on a “care” consisting in keeping watch over the “political language’s fragility” in Paul Ricoeur. I conclude by stating that if we really want to make “care” a public value, this feminist value should be concerned not only with life, but also with world. Custodero Teachers College, Columbia University Introduction...enrichment of the present for its own sake is the just heritage of childhood....1In this paper, the qualities of artistic pursuit exemplified in the musical play of children and the compositional processes of adults provide a context for exploring how (...) "being with" influences teaching and learning. Specifically I propose that "being with" music generates a sense of the aesthetic as we both transform musical materials — timbres, pitches, rhythms, phrases, harmonies — and are transformed by our experiences with them, and that "being with" others as we partake in musical activity often broadens and deepens that experience. In many ways, this is an exploration into why childhood matters, how it functions as a mirror for our adult lives as we experience and revel in the seemingly miraculous moments of aesthetic insight, where the familiar is welcomed with fresh perception and the addition of novelty is greeted as the solution to a previously unfathomable problem. It is also about why children matter, as our responses to their ways of being connect and transform us as adults. In this piece, recorded observations of children's musicality are juxtaposed with first-person accounts of adults' creative processes, revealing contributions to our understanding of artistry-in-action as it is manifested in both the musical and the pedagogical. The Aesthetic in Childhood and Adulthood To be "in the moment" is to encounter the aesthetic — fully engaged in an activity for which one's individual contributions are perceived as vital, aware of surprise relationships between seemingly disparate phenomena, and enveloped by sensory messages of color, sound, and movement meeting personal criteria for beauty. Such experiences exemplify features of artistry, an approach defined by openness to possibility and orientation toward discovery, where cues emanating from involvement in activity are clearly interpreted and utilized, and reflection is an ongoing process informing action. Characterized by a sense of wonder and ability to imagine and invent, the creative worlds of young children have provided a source of artistic genesis cited by composers, performers, psychologists, and educators.2Edith Cobb's thoughtful, groundbreaking account of the relationship between childhood and artistry, The Ecology of Imagination in Childhood, was introduced by Margaret Mead, who highlighted the work's thesis: "that in the imaginative experiences of childhood could be found the essential kernels of the highest forms of human thought."3 The legacy of childhood is universal to our existence; in acknowledging its contributions to ontological and cultural artistry, we can both connect personal histories across the [End Page 36] lifespan and identify characteristic trends across a spectrum of aesthetic rendering.4One trait common to both the child and the creative adult is a focused attentiveness to perceived affordances, that is, materials and human resources accessible in the environment. Acting upon and with these resources,children and artists become aesthetic agents as sensitivity to both experience and milieu combine to produce relevant and innovative outcomes.5 These two interactive dimensions have been described in interviews with composers I have interviewed as "being with the moment" and "being with yourself and at the same time with another" and are operating in the musical play of children, as noted in this description recorded by a mother/student: On Thanksgiving Day, we had a family gathering of sixteen people, five of whom are under the age of eight years. Three-year-old Louise is thrilled to be with her female cousins, who all dress up in ballet-type frilly costumes in order to put on a "show" for the family. Cousin Lily, now eight years old, assumes the role of pianist, while Louise, and five-year-old cousin Amy creatively dance to Lily's improvised accompaniment. Their movements are directly related to Lily's playing, in her fluidity and well as "jumps!" Val Plumwood urged us to attend to earth others in non-dualistic ways. In this essay I suggest that such attention be promoted through what I call "engaged empathy." Engaged empathy involves critical attention to the conditions that undermine the well being or flourishing of those to whom empathy is directed and this requires moral agents to attend to things they might not have otherwise. Engaged empathy requires gaining wisdom and perspective and, importantly, motivates the empathizer to act ethically.

In 1890 a man sold the rights to his body after death to the Royal Caroline Institute in Sweden for research purposes. Later, he tried to return the money and cancel the contract. In the subsequent lawsuit, the court held that he must turn his body over to the Institute and also ordered him to pay damages for diminishing the worth of his body by having two teeth removed.Today, it would be an anathema for a person's body to be used (...) against his wishes and for a research subject not to be allowed to withdraw from a study. In fact, the Uniform Anatomical Gift Act allows people to change their minds and withdraw a previous agreement to donate organs and tissue after their death and the federal research regulations allow people to withdraw from studies without penalty or loss of benefits. Recent, groundbreaking work in neuroscience has illuminated sex differences that could have a profound impact on business organizations. Distinctions between the sexes that may have previously been presumed to be due to “nurture” may now also be demonstrably related to “nature.” Here, we report recent neuroscience findings related to males’ and females’ brain structures and brain chemistry, along with the results of recent neuroeconomic studies. We learn not only that male and female brains are structured differently, but also that different (...) portions of their brains are used for the same tasks, often leading to identical conclusions. Neuroeconomic studies also demonstrate that the effects of hormones—most notably, oxytocin and testosterone—urge males and females to both think and behave differently in ethical situations. We suggest that examination of these new results could benefit six areas of business ethics research: trust, moral decision-making, organizational justice, moral development, the ethic of care, and female management styles. We conclude with a discussion of the implications of these findings for business practice, suggesting that it may be ethical to allow men and women to be treated differently in the workplace: such treatment may be advantageous not only for the workers’ firms, but also for the workers themselves.
