This book, formed as a series of essays in honour of Professor Carl Baudenbacher, addresses the very art of judicial reasoning, and features contributions from many of the foremost current or former national, supranational, or international judges. This unique volume is intended first and foremost for legal scholars, but its approachable style makes it readily accessible for students and for those with a general interest in the application of the law and justice in today's multi-layered world. The collection of essays (...) is rather more philosophical and reflective as opposed to doctrinal. Each contribution focuses on the nature and operation of justice, the independence of the judiciary, and on judicial style primarily from the perspective of the judges themselves. The book provides perspectives on what it means to be accountable and independent as a judge, the role of language and languages in the quest for justice, while other contributions acquaint readers with the some of the structures of courts themselves, or indeed question for whom judgments are written. Each chapter has been written by a presiding judge, or head of an institution and the book is divided into three parts: - Part I Art and Method - Part II Justice and the Judiciary - Part III Reasoning and Language(s). Health authorities increasingly request that general practitioners use information and communication technologies such as electronic patient records for accountability purposes. This article deals with the use of EPRs among general practitioners in Britain. It examines two ways in which GPs use the EPR for accountability purposes. One way is to generate audit reports on the basis of the information that has been entered into the record. The other is to let the computer intervene in the clinical process through prompts. The (...) article argues that GPs' ambivalence toward using the EPR makes them active in finding ways that turn the EPR into a meaningful tool for them, that is, a tool that helps them provide what they see as good care. The article's main contribution is to show how accountability and autonomy are coproduced; less professional autonomy does not follow from more requests to document one's work. Instead, new forms of autonomy are produced in the sociotechnical network that is made up by health policy and local engagements with patients and technology. (shrink)

A study of the philosophical and theological thought of Henry Cornelius Agrippa of Nettesheim (1486-1535). It contains new perspectives on Agrippa's place in the world of humanism and offers a new approach to the interpretation of Renaissance declamations.

Human cognition is unique in the way in which it relies on combinatorial (or compositional) structures. Language provides ample evidence for the existence of combinatorial structures, but they can also be found in visual cognition. To understand the neural basis of human cognition, it is therefore essential to understand how combinatorial structures can be instantiated in neural terms. In his recent book on the foundations of language, Jackendoff described four fundamental problems for a neural instantiation of combinatorial structures: the massiveness (...) of the binding problem, the problem of 2, the problem of variables, and the transformation of combinatorial structures from working memory to long-term memory. This paper aims to show that these problems can be solved by means of neural “blackboard” architectures. For this purpose, a neural blackboard architecture for sentence structure is presented. In this architecture, neural structures that encode for words are temporarily bound in a manner that preserves the structure of the sentence. It is shown that the architecture solves the four problems presented by Jackendoff. The ability of the architecture to instantiate sentence structures is illustrated with examples of sentence complexity observed in human language performance. Similarities exist between the architecture for sentence structure and blackboard architectures for combinatorial structures in visual cognition, derived from the structure of the visual cortex. These architectures are briefly discussed, together with an example of a combinatorial structure in which the blackboard architectures for language and vision are combined. In this way, the architecture for language is grounded in perception. Perspectives and potential developments of the architectures are discussed. These last years, the development of AI robots for agriculture, livestock farming and food processing industries is rapidly increasing. These robots are expected to help produce and deliver food more efficiently for a growing human population, but they also raise societal and ethical questions. As the type of questions raised by these AI robots in society have been rarely empirically explored, we engaged in four case studies focussing on four types of AI robots for agri-food ‘in the making’: manure collectors, (...) weeding robots, harvesting robots and food processing robots which select and package fruits, vegetables and meats. Based on qualitative interviews with 33 experts engaged in the development or implementation of these four types of robots, this article provides a broad and varied exploration of the values that play a role in their evaluation and the ethical questions that they raise. Compared to the recently published literature reviews mapping the ethical questions related to AI robots in agri-food, we conclude that stakeholders in our case studies primarily adopt a relational perspective to the value of AI robots and to finding a solution to the ethical questions. Building on our findings we suggest it is best to seek a distribution of tasks between human beings and robots in agri-food, which helps to realize the most acceptable, good or just collaboration between them in food production or processing that contributes to realizing societal goals and help to respond to the 21 century challenges. Various issues concerning the neural blackboard architectures for combinatorial structures are discussed and clarified. They range from issues related to neural dynamics, the structure of the architectures for language and vision, and alternative architectures, to linguistic issues concerning the language architecture. Particular attention is given to the nature of true combinatorial structures and the way in which information can be retrieved from them in a productive and systematic manner.

We discuss a visual blackboard architecture that could be involved in imagery. In this architecture, networks that process identity information interact with networks that process location information, in a manner that produces structural (compositional) forms of representation. Architectures of this kind can be identified in the visual cortex, but perhaps also in prefrontal cortex areas related with working memory.

Cet article offre une analyse succincte des œuvres critiques de Ramus contre les deux grands rhéteurs de l’ancienne Rome, Cicéron et Quintilien, les Brutinae Quaestiones in Oratorem Ciceronis de 1547 et les Rhetoricae Distinctiones in Quintilianum de 1549. Ces œuvres se présentent comme des commentaires textuels, mais elles ne constituent pas une contribution substantielle à l’étude philologique des deux traités antiques. Elles semblent plutôt avoir pour but de montrer que, selon Ramus, la rhétorique ne concerne que l’élocution et l’action, et (...) que la séparation stricte des arts du Trivium au niveau de la théorie est la seule méthode appropriée pour les enseigner. Cognitive agents are dynamical systems but not quantitative dynamical systems. Quantitative systems are forms of analogue computation, which is physically too unreliable as a basis for cognition. Instead, cognitive agents are dynamical systems that implement discrete forms of computation. Only such a synthesis of discrete computation and dynamical systems can provide the mathematical basis for modeling cognitive behavior.

This article is part of the Dossier on Tacitus published in last year's issue of Grotiana. It offers a combined study of both the content and the language and style of Grotius' account of the capture of Breda in the second book of the Historiae, published in 1657 together with the Annales under the title Annales et Historiae de rebus Belgicis. A thorough analysis of Grotius' account of this eventful and dramatic turning point in the Dutch revolt reveals that it (...) is nothing but a defective and occasionally unclear rehearsel of the standard narrative of the capture based on the well-known and in Grotius' day widely read history-books written in French and Dutch. The rather artificial imitation of Tacitus's brevitas on the stylistic level does not suffice to qualify Grotius's account as a masterful piece of Tacitean writing, because it does not highlight the motives of the chief characters in the story nor the connection between the events and their effects, and because Grotius fails to present his own perspective on this important episode in the war against Spain. We discuss the role of synchrony of activationin higher-level cognitive processes. Inparticular, we analyze the question of whethersynchrony of activation provides a mechanismfor compositional representation in neuralsystems. We will argue that synchrony ofactivation does not provide a mechanism forcompositional representation in neural systems.At face value, one can identify a level ofcompositional representation in the models thatintroduce synchrony of activation for thispurpose. But behavior in these models isalways produced by means conjunctiverepresentations in the form of coincidencedetectors. Therefore, models that rely onsynchrony (...) of activation lack the systematicityand productivity of true compositional systems.As a result, they cannot distinguish betweentype and token representations, which resultsin misrepresentations of spatial relations andpropositions. Furthermore, higher-levelcognitive processes will likely integrateinformation from widely distributed areas inthe brain, which puts severe restrictions onthe underlying neural dynamics if synchrony ofactivation is to play a role in theseprocesses. This article challenges the general thesis that an unconditional basic income, set at the highest sustainable level, is required for maximizing the income-leisure opportunities of the least advantaged, when income varies according to the responsible factor of labor input. In a linear optimal taxation model (of a type suggested by Vandenbroucke 2001) in which opportunities depend only on individual productivity, adding the instrument of a uniform wage subsidy generates an array of undominated policies besides the basic income maximizing policy, including (...) a “zero basic income” policy which equalizes the post-tax wage rate. The choice among such undominated policies may be guided by distinct normative criteria which supplement the maximin objective in various ways. It is shown that most of these criteria will be compatible with, or actually select, the zero basic income policy and reject the basic income maximizing one. In view of the model's limited realism, the force of this main conclusion is discussed both in relation to Van Parijs' argument for basic income in Real Freedom for All (1995) and to some key empirical conditions in the real world. William Whewell’s 19th century philosophy of science is sometimes glossed over as a footnote to Kant. There is however a key feature of Whewell’s account worth noting. This is his appeal to Aristotle’s form/matter hylomorphism as a metaphor to explain how mind and world merge in successful scientific inquiry. Whewell’s hylomorphism suggests a middle way between rationalism and empiricism reminiscent of experience pragmatists like Steven Levine’s view that mind and world are entwined in experience. I argue however that Levine does (...) not adequately explain exactly how mind and world entwine. He could nonetheless do so if he appealed to Whewell’s hylomorphic metaphor. We may prefer a reductive metaphysical explanation, but I suggest that pragmatists only have recourse to metaphor in this case. Both reductive and metaphorical explanations can enjoy great explanatory power if they exhibit a suitable measure of what I will call sematic distance. Semantic distance measures how close or how far apart explanandum and explanans are from each other in meaning. Metaphorical explanation - as evident in Whewell’s hylomorphism and as detailed via the notion of semantic distance - presents a valuable new explanatory tool to those who hold that mind and world are entwined sans recourse to metaphysics. Inspired by Bas van Fraassen’s Stance Empiricism, Anjan Chakravartty has developed a pluralistic account of what he calls epistemic stances towards scientific ontology. In this paper, I examine whether Chakravartty’s stance pluralism can exclude epistemic stances that licence pseudo-scientific practices like those found in Scientology. I argue that it cannot. Chakravartty’s stance pluralism is therefore prone to a form of debilitating relativism. I consequently argue that we need (1) some ground or constraint in relation to which epistemic stances can be (...) ranked by degrees, and (2) some way to demarcate science from pseudo-science so that we know what epistemic stances are about. Regarding (1), I argue that empirical detectability can serve as the ground in relation to which epistemic stances are ranked by degrees. Regarding (2), I argue for ranking sciences on a continuum according to established institutional criteria, rather than attempting to draw a strict demarcation. (shrink)

I identify two versions of the scientific anti-realist’s selectionist explanation for the success of science: Bas van Fraassen’s original and K. Brad Wray’s newer interpretation. In Wray’s version, psycho-social factors internal to the scientific community – viz. scientists’ interests, goals, and preferences – explain the theory-selection practices that explain theory-success. I argue that, if Wray’s version were correct, then science should resemble art. In art, the artwork-selection practices that explain artwork-success appear faddish. They are prone to radical change over time. (...) Theory-selection practices that explain theory-success in science are however not faddish. They are mostly stable; that is, long-lived and consistent over time. This is because scientists (explicitly or implicitly) subscribe to what I will call the testability norm: scientific theories must make falsifiable claims about the external physical world. The testability norm and not psycho-sociology explains the theory-selection practices that explain theory-success in science. Contra Wray, scientific anti-realists can then maintain that the external physical world (as expressed in the testability norm) explains theory-success. (shrink)

Several complexity theorists draw a sharp and ontologically robust distinction between (merely) complicated systems and (genuinely) complex systems. I argue that this distinction does not hold. Upon fine-grained analysis, ostensibly complicated systems turn out to be complex systems. The purported boundary between the complicated and the complex appears to be vague rather than sharp. Systems are complex by degrees.

Both the concept of a Darwinian tree of life (TOL) and the possibility of its accurate reconstruction have been much criticized. Criticisms mostly revolve around the extensive occurrence of lateral gene transfer (LGT), instances of uptake of complete organisms to become organelles (with the associated subsequent gene transfer to the nucleus), as well as the implications of more subtle aspects of the biological species concept. Here we argue that none of these criticisms are sufficient to abandon the valuable TOL concept (...) and the biological realities it captures. Especially important is the need to conceptually distinguish between organismal trees and gene trees, which necessitates incorporating insights of widely occurring LGT into modern evolutionary theory. We demonstrate that all criticisms, while based on important new findings, do not invalidate the TOL. After considering the implications of these new insights, we find that the contours of evolution are best represented by a TOL. (shrink)

Logical puzzles like the doctrinal paradox raise the problem of how to aggregate individual judgements into a collective judgement, or alternatively, how to merge collectively inconsistent knowledge bases. In this paper, we view judgement aggregation as a function on propositional logic valuations, and we investigate how logic constrains judgement aggregation. In particular, we show that there is no non-dictatorial decision method for aggregating sets of judgements in a logically consistent way if the decision method is local, i.e., only depends on (...) the individual judgements on the proposition under consideration. Paul Cilliers has developed a novel post-structural approach to complexity that has influenced several writers contributing to the current complexity literature. Concomitantly however, Cilliers advocates for modelling complex systems using connectionist neural networks (rather than analytic, rule-based models). In this paper, I argue that it is dilemmic to simultaneously hold these two positions. Cilliers’ post-structural interpretation of complexity states that models of complex systems are always contextual and provisional; there is no exclusive model of complex systems. This sentiment however appears (...) at odds with Cilliers’ promotion of connectionist neural networks as the best way to model complex systems. The lesson is that those who currently follow Cilliers’ post-structural approach to complexity cannot also develop a preferred model of complex systems, and those who currently advocate for some preferred model of complex systems cannot adopt the post-structural approach to complexity without giving up the purported objectivity and/or superiority of their preferred model. En 1893, « physicien-ingénieur » André Blondel invente l’oscillographe bifilaire permettant de visualiser les tensions et courants variables. À l’aide de ce puissant moyen d’investigation, il entreprend tout d’abord l’étude des phénomènes de l’arc électrique alors utilisé pour l’éclairage côtier et urbain puis de l’arc chantant employé comme émetteur d’ondes radioélectriques en T.S.F. En 1905, il met en évidence un nouveau type d’oscillations non-sinusoïdales au sein de l’arc chantant. Vingt ans plus tard, Balthasar Van der Pol reconnaitra qu’il s’agissait en (...) réalité d’oscillations de relaxation. Pour expliquer ce phénomène, il fait appel à une representation dans le plan de phase et montre que son évolution prend la forme de petits cycles. Pendant le premier conflit mondial la triode remplace peu à peu l’arc chantant dans les systèmes de transmission. Au sortir de la guerre, Blondel transpose à la triode la plupart de ses résultats par analogie avec l’arc chantant. En avril 1919, il publie un long mémoire dans lequel il introduit la terminologie « oscillations auto- entretenues » et propose d’illustrer ce concept à partir de l’exemple du vase de Tantale qui sera ensuite repris par Van der Pol et par Philippe Le Corbeiller. Il fournit alors une définition d’un système auto-entretenu assez proche de celles qui seront données par la suite par Aleksandr’ Andronov et Van der Pol. Pour étudier la stabilité des oscillations entretenues par la triode et par l’arc chantant il utilise cette fois une représentation dans le plan complexe et explicite l’amplitude en coordonnées polaires. Il justifie alors l’entretien des oscillations par l’existence de cycles qui présentent presque toutes les caractéristiques des cycles limites de Poincaré. Enfin, en novembre 1919, Blondel réalise, un an avant Van der Pol, la mise en équation des oscillations d’une triode. En mars 1926, Blondel établit l’équation différentielle caractérisant les oscillations de l’arc chantant, en tous points similaire à celle qu’obtient concomitamment Van der Pol pour la triode. Ainsi, tout au long de sa carrière, Blondel, a apporté une contribution fondamentale et relativement méconnue à l’élaboration de la théorie des oscillations non linéaires. L’objet de cet article est donc d’analyser ses principaux travaux dans ce domaine et de mesurer leur importance, voire leur influence en les replaçant dans la perspective du développement de cette théorie. Prima facie, we make successful decisions as we act on and intervene in the world day-to-day. Epistemologists are often concerned with whether rationality is involved in such decision-making practices, and, if so, to what degree. Some, particularly in the post-structuralist tradition, argue that successful decision-making occurs via an existential leap into the unknown rather than via any determinant or criterion such as rationality. I call this view radical voluntarism (RV). Proponents of RV include those who subscribe to a view they (...) call Critical Complexity (CC). In this paper, I argue that CC presents a false dichotomy when it conceives of rationality in Cartesian – i.e. ideal and transcendental – terms, and then concludes that RV is the proper alternative. I then outline a pragmatist rationality informed by recent work in psychology on bounded rationality, ecological rationality, and specifically embodied rationality. Such a pragmatist rationality seems to be compatible with the tenets of post-structuralism, and can therefore replace RV in CC. (shrink)

Douglas Edwards is arguably the most prominent contemporary advocate of moderate alethic pluralism. Significantly influenced by Crispin Wright and Michael Lynch, his work on the nature of truth has become widely discussed in the topical literature. Edwards labels his version of moderate alethic pluralism determination pluralism. At first blush, determination pluralism appears philosophically promising. The position deserves thoughtful consideration, particularly because of its capacity to accommodate the scope problem. I argue, however, that upon analysis the view is better understood as (...) a form of metaphysical dualism or what I will call meta-dualism. Furthermore, determination pluralists face a dilemma; there appears to be an instability at the core of their dualistic model. On the one horn of the dilemma, they need a clear metaphysical demarcation at the interface of their two necessary domains. On the other horn, they seem to need to a metaphysically vague boundary at the interface of their two necessary domains. Determination pluralism needs substantial revision. (shrink)

Epistemic pluralists in the philosophy of science often argue that different epistemic perspectives in science are equally warranted. Sandra Mitchell – with her Integrative Pluralism (IP) – has notably advocated for this kind of epistemic pluralism. A problem arises for Mitchell however because she also wants to be an epistemological pluralist. She claims that, not only are different epistemic perspectives in science equally warranted in different contexts, but different understandings of these epistemic perspectives in science are also equally warranted in (...) different contexts. The problem is that Mitchell argues that her understanding of epistemic perspectives in science (IP) is the correct one, and it is dilemmic to then claim that there is more than one such understanding. As solution, I suggest that we abandon epistemological pluralism and instead follow Feyerabend in being opportunistic pluralists. We can adopt pluralism as a short-term strategy in the pursuit of a long-term unitary goal. This unitary goal is what philosophers of understanding call objectual understanding, the kind of understanding that Integrative Pluralism tacitly aspires to anyway. (shrink)

This book chapter addresses two questions. First, can targeted killing by drones in non-battlefield zones be justified on basis of just war theory? Second, will the proliferation and expansion of combat drones in warfare, including the introduction of autonomous drones, be an obstacle to initiating or executing wars in a just manner in the future? The first question is answered by applying traditional jus ad bellum and jus in bello principles to the American targeted killing campaign in Pakistan; the second (...) question is answered on basis of principles of “just military preparedness” or jus ante bellum, a new category of just war thinking. It is concluded that an international ban on weaponized drones is morally imperative and, certainly, that an international treaty against autonomous lethal weapons should be adopted. (shrink)

We investigate the notion of minimal cognition, and claim that this notion already applies to bacterial behavior. On the basis of the example of E. coli, we argue that the basis of cognition can be profitably cast as sensorimotor coordinations which subserve the metabolic requirements of organisms.

The neo-Kantian Hermann Cohen famously wrote that Kant “is the true and real originator of German socialism.” This paper seeks to explicate Cohen’s socialist reconstruction of Kant’s ethics and show that this reconstruction overcomes some weaknesses of Kant’s ethics. In conclusion, the paper discusses the contemporary relevance of Cohen’s cooperative socialism.
