In the wake of corporate governance scandals, questions arise about the effectiveness and intent of corporate ethical codes: Are they genuine governance mechanisms to enhance corporate responsibility, or are they mere shields against legal risks? This study delves into the linguistic choices within ethical codes, positing that these choices serve as communication devices that articulate a firm’s institutional logic. We use stakeholder theory to differentiate between code language that is governed by instrumental (legal-oriented) or normative (behavior-oriented) logic. Upon analyzing the (...) lexicon of Fortune 500 corporate codes, our findings reveal that behavior-oriented codes are associated with a decrease in the number of environmental, social, and governance (ESG) issues. Yet, they correspond to an increase in class action lawsuits. By contrast, legal-oriented codes are linked to an increase in ESG issues but to reduced legal litigation. Notably, firms that blend approaches from both logics experience lower litigation rates. These findings enrich the discourse on stakeholder theory and provide practical guidance for organizations aiming to refine their ethical codes. O trabalho discute os pressupostos metaéticos e normativos para a construçáo de uma nova ética ambiental. Em especial, ele procura mostrar que a metaética realista que está presente nos escritos da assim chamada “ecologia profunda” é problemática. Como alternativa, o trabalho apresenta uma análise conceitual diferente de valor intrínseco e examina as suas implicações normativas e práticas para uma ética ambiental.

This paper tries to rethink the notion of human rights and to evaluate whether we should redefine them in light of the main challenges presented by advances in technoscience (genetic engineering, robotics, nanotechnology etc.). It claims that there are basic, intrinsic rights to personhood, which, on the one hand, allow us to justify a moral claim to a posthuman existence (should it become possible) and to attribute rights to artificial agents, while, on the other hand, granting the moral entitlement to (...) remain human. This shows that the notion of human rights is far from becoming obsolete, as claimed by some scholars. The paper is divided into five parts. It (1) presents reasons for rethinking the notion of “a right” in order to apply it to beings other than humans (e.g., nonhuman animals, robots etc.); (2) discusses the metaethical problem concerning the meaning of “a right”; (3) presents a basic system of rights that are intrinsic to personhood and that can be attributed to different kinds of agents (human or not); (4) analyzes whether there is a right to a posthuman existence or a right to remain human; and finally, (5) presents some reasons to justify such a system of rights. In several important works in ethics, Hillary Putnam criticizes the traditional fact/value dichotomy, which is based on the Humean question whether ought follows from is. More recently, Putnam even declared the collapse of this dichotomy calling once again for rethinking the last dogma of empiricism, namely the positivist creed that facts are objective and values are subjective. The aim of this work is to reassess Putnam’s main arguments to show the entanglement between facts and values. Putnam is right in many (...) of his criticisms, but it is not clear also how he avoids reductionist monistic naturalism, which he considers an “inadequate philosophy”. Using his pragmatic pluralism inspired by Wittgenstein, I will try to show that we have reasons to make a distinction between facts and values. (shrink)

This paper explores the interconnections between philosophical wisdom and bioethical expertise, arguing that the latter can be enlightened by the former. First, it analyses the arguments of those who think that philosophy has nothing to say to bioethics, and afterwards, it shows that philosophical wisdom has an irreducible ethical component, which in turn helps bioethics to reach its aims. Thus, this paper shows that some Wittgensteinian commentators (e.g., Paul Johnston) did not grasp the contributions the author of the Tractatus Logico-philosophicus (...) and even his later work made to ethics (and potentially to bioethics as a subfield) as an autonomous domain of investigation independent of logic, the empirical sciences, and metaphysics. O debate contemporâneo nas teoria das relações internacionais é marcado por duas perspectivas: de um lado a perspectiva do realismo político que concebe a paz como um ideal inacessível e a guerra como meio necessário para a aquisição e manutenção do poder; e de outro lado a perspectiva do normativismo ou idealismo que pensa o fim das relações internacionais para além dos conflitos de interesse e da luta por poder. A primeira perspectiva trata as relações internacionais em nível do ser, (...) a segunda em nível do dever ser. Tendo em vista esse cenário, a nossa ideia neste artigo consiste em abordar o problema da guerra e da paz a partir de um estudo interdisciplinar mediante contribuições do Direito Internacional Público e da Filosofia de Kant. Num primeiro momento analisaremos o paradoxo da guerra, em seguida o papel do Direito Internacional Público para a problemática da paz, e por último as contribuições de Kant para a redefinição normativa do direito internacional a partir do seu projeto republicano da liga de paz. Defendemos a necessidade de que se atue com rigor ético durante a pandemia do novo coronavírus e que não se afrouxem os padrões científicos e normativos nas pesquisas sobre possíveis medicamentos, em especial a Cloroquina, para a COVID-19. Argumentamos que, excepcionalmente, seria justificado pular algumas etapas na realização de testes clínicos ou tratamentos experimentais, mas que é inadequado fazer um uso indiscriminado de medicamentos off label para tratar pacientes enquanto os resultados das pesquisas não forem publicados em veículos de comprovada (...) reputação científica. Para sustentar essa posição, aplicamos princípios bioéticos e da ética médica. Defendemos que políticas públicas para o uso de Cloroquina durante a pandemia não devem ser implementadas até que sejam divulgados os resultados das pesquisas realizadas pela “Coalizão COVID Brasil” e pela Solidarity da OMS. O objetivo central do presente trabalho é mostrar que o livro Investigações Filosóficas, de Ludwig Wittgenstein, a exemplo de seu Tractatus Logico-philosophicus, possui um sentido ético. A fim de atingir esse objetivo, sustentarei que o primeiro livro de Wittgenstein estabelece uma separação entre ciência e moralidade, proibindo a redução desta àquela. Tem, por essa razão, um sentido ético. Na segunda parte, mostrarei que a distinção entre diferentes jogos de linguagem, principalmente entre jogos descritivos e normativos, contém a tarefa principal do (...) pensamento analítico e crítico, a saber, proibir a redução da moralidade à ciência. This paper deals with the question whether science and philosophy are continuous, as Quine thought, or whether they are completely separated, as Wittgenstein held. Reconstructing the reasons why the latter kept a sharp distinction between science and philosophy, it examines the attempts of the former to resolve philosophical problems in scientific terms. It maintains that Quine’s scientism is misconceived and presents further reasons for making a distinction (if not a separation) between science and philosophy.

O autor Darlei Dall’Agnol é formado em Filosofia pela Universidade de Caxias do sul e cursou mestrado em Filosofia na Universidade Federal do Rio Grande do Sul, com uma dissertação sobre ética e linguagem em Wittgestein; fez Doutorado em Filosofia na Universidade de Bristol, Inglaterra, defendendo tese sobre valor intrínseco na ética de Moore. Publicou vários livros na área de Ética e possui inúmeros artigos e capítulos de livros publicados no Brasil e no exterior. Algumas das obras desse autor (...) são: Ética e Linguagem: uma Introdução ao Tractatus de Wittgenstein, Valor Intrínseco – Metaética, ética normativa e ética prática em G. E. The understanding of value in moral naturalism as a descriptivist endeavor will be analized through an application of the naturalistic fallacy on an evolutive perspective of moral psychology. From a brief analysis of the naturalistic fallacy as proposed by Dall’Agnol, I’ll criticize the author’s application of such on what he refers to as moral naturalism. Contrasting E. Wilson’s sociobiology with R. Triver’s theory of reciprocal altruism I will procure a definition of naturalized ethics by investigating the psychological roots of (...) moral motivation. Once identified the descriptive and non-reductionist aspects of contemporary moral naturalism, the naturalistic fallacy presents itself as unbecoming of its hallmark and metaethical importance, and it becomes clear that a naturalized comprehension of human moral behavior is vital to the understanding of the motivations for action and the conception of value; though weak under a normative perspective. The quasi-ubiquity of ICT is transforming contemporary politics and seems to deteriorate democracy, for the technologies undermine debates, contest the grounds of reason and truth, and influence people’s votes. Donald Trump’s election and Brexit are good examples of their effects on public opinion. More fundamentally, these technologies cause theoretical problems to the way we traditionally conceive public opinion. Thus, I seek to rethink public opinion beyond conventional approaches. Departing from Deleuze and Guattari’s work, I develop the first steps of a (...) post-representational theory of public opinion as a regime of political truths that has new dimensions of truth production with information and communications technologies. Este artigo analisa, aproximando as áreas da Literatura e da Filosofia, a Moral e a Ética sob a perspectiva do filósofo grego Epicuro, na obra italiana _Così parlò Bellavista: Napoli, amore e libertà_, de Luciano de Crescenzo, publicada em 1977. Apesar das ideias de Epicuro terem sido concebidas há séculos do personagem professor de filosofia Gennaro Bellavista, este acredita que os napolitanos se comportam conforme os ensinamentos do mestre grego: pela via do prazer e pela negação das dores físicas e (...) das atribulações mentais. Ainda que a análise de Bellavista seja pautada em Epicuro, o professor acrescenta suas próprias reflexões sobre a vida em Nápoles, contextualizando a filosofia epicurista para esse povo. A partir deste contexto, busca-se analisar também, com base na antinomia utilizada no pensamento filosófico _apolíneo-dionisíaco_, por trechos do romance e pela análise de uma anedota, intitulada “Geraldinho, o kamikaze”, presente no livro estudado, como os napolitanos podem ser observados por esse viés. Observa-se que os napolitanos, pensados pelo professor Bellavista, seguem um comportamento epicurista-napolitano: ética e moral são pautadas nas características do dionisíaco, isto é, preferência pela desordem, desprezo pelas leis e desfrute dos prazeres primários, segundo a classificação dos prazeres de Epicuro. This article intends to analyze the relations between Nietzsche’s concept of herd animal and Arendt’s concept of mass man. It will be highlighted the parallels between both philosophers concepts in an attempt to answer why Arendt doesn’t mention Nietzsche regarding this specific subject.

Este trabalho tem o objetivo de analisar a representação da mulher e da família no discurso de Dom Antônio Mazzarotto, primeiro bispo de Ponta Grossa-PR (1930-1965). Dom Antônio Mazzarotto representou o esforço normatizador da instituição católica na diocese que tomou posse em três de Maio de 1930. Nesta desenvolveu em trinta e cinco anos um intenso trabalho pastoral. Uma das estratégias de seu bispado foi à publicação de cartas pastorais para se comunicar com o clero e os fiéis. Durante sua (...) atuação na Diocese de Ponta Grossa o bispo escreveu trinta e seis cartas pastorais, uma a cada ano. Nestas cartas Dom Antônio se posicionou de forma conservadora acerca do casamento e do papel da mulher na família, algo que não fugia à norma da Igreja Católica de então. A normatização feminina perpassa pelos escritos de Dom Antônio, mais especificamente na Carta Pastoral “O Matrimônio Christão- 1934”, documento que aponta a Virgem Maria como modelo ideal de mulher esposa e mãe. Palavras Chave: Casamento, Catolicismo, Mulher.This study aims to analyze the representation of women and family in the speech of Dom Antônio Mazzarotto, first bishop of Ponta Grossa, Paraná (1930-1965). Dom Antônio Mazzarotto represented the effort of normalizing Catholic institution in the diocese in which took office on May 3, 1930. At that institution he developed an intense pastoral work in thirty-five years. One of the strategies of his bishopric was the publication of pastoral letters to communicate with the clergy and the faithful. During his tenure at Ponta Grossa Diocese the bishop wrote thirty-six pastoral letters, one every year. In these letters Dom Antônio stood conservatively about marriage and the role of women in the family, something that did not escape the rule of the Catholic Church then. The normative feminine permeates the writings of Dom Antônio, more specifically in Pastoral Letter “O Matrimônio Christão-1934”, document that shows the Virgin Mary as a model of ideal woman wife and mother. This is a critical notice of Mario Gómez-Torrente's novel account of demonstrative reference presented in chapter 2 of the recently published book Roads to Reference. After presenting the main tenets of his view, I go on to critically examine a couple of its features. In section 2, I assess Gómez-Torrente’s assumption that demonstrative thought based on perception is less likely to succumb to indeterminacy than the others. I show that this aspect of his view invites unwelcome consequences regarding the transparency (...) of thought. I do however suggest that this problem could be overcome by individuating perceptual intentions dynamically. In section 3, I express a distinct worry regarding a case, introduced en passant by Gómez-Torrente, that involves successful demonstrative reference regardless of its utterer's conflicting intentions, a result that seems to contradict his general theory. Instead of conceiving the case as exceptional, I use it to motivate the necessity of distinguishing between a subject’s referential intentions and a subject’s merely collateral beliefs about the target of his utterance. Os videogames ganharam destaque desde os anos 1970 e com a popularização da internet, originaram-se diversos relatos de que jovens vêm exagerando nos jogos fazendo com que em muitas vezes o uso deixe de ser recreativo. Esta pesquisa objetiva investigar, por meio da literatura, quando o uso de jogos eletrônicos é caracterizado como uma atividade recreativa e quando começa a ser considerado uma dependência. Foi realizada uma revisão na literatura na qual foram selecionados artigos científicos relacionados ao tema. Os resultados (...) apontam que os jogos eletrônicos são a atividade de lazer mais praticada pelos adolescentes e por proporcionar um ambiente seguro e controlado permitem uma fuga da realidade para evitação dos problemas sociais. Concluindo, o uso abusivo dos jogos eletrônicos está associado a diversas comorbidades, interferindo de forma significativa na vida social, familiar, acadêmica e afetiva do sujeito, sendo que os adolescentes são os mais vulneráveis a desenvolver uma dependência. Resumo Este artigo defende o ponto de vista de que as bases da ciência cognitiva contemporânea estão em sintonia com o pensamento de Merleau-Ponty, em seus aspectos antiobjetivista e antirrepresentacionalista. A ideia de representação mental é contestada, tanto na CC quanto no pensamento de Merleau-Ponty. A cognição não espelha um mundo exterior independente dos sujeitos incorporados. O mundo é um existencial, como afirmam Merleau-Ponty e a CC. A hipótese da representação mental supõe que o mundo pode ser percebido de forma (...) independente do sujeito que percebe. Isso não é verdade. A percepção depende da forma como o sujeito age em seu mundo percebido. Todas as estimulações que o organismo encontra só são possíveis pelos seus movimentos precedentes que resultam na exposição do órgão receptor às influências externas. Os estímulos sensoriais que o organismo encontra dependem diretamente do seu comportamento motor e a forma como o organismo se move depende diretamente das consequências sensoriais dos seus comportamentos anteriores.This article defends the view that the foundations of contemporary cognitive science are in tune with Merleau-Ponty’s thinking in its anti-objectivist and anti-representationalist aspects. The idea of mental representation is contested both in CC and in Merleau-Ponty’s thinking. Cognition does not mirror an outside world independent of embodied subjects. The world is an existential one as Merleau-Ponty and the CC say. The mental representation hypothesis assumes that the world can be perceived independently of the perceiving subject. This is not true. Perception depends on how the subject acts in his perceived world. All the stimulations that the organism finds are only possible by its previous movements that result in the exposure of the receiving organ to external influences. The sensory stimuli that the organism finds depend directly on its motor behavior and the way the organism moves depends directly on the sensory consequences of its previous behaviors. (shrink)

We discuss the way the early quarantine period during the coronavirus crisis illuminated some aspects of previous daily life in downtown São Paulo. Changes in our surroundings and withdrawal into confinement elicited a new relationship to the senses and to imagination. With that, it became apparent the degree to which the free use of these faculties is repressed by violence and inequality, as they are usually manifest in the city center. We explore the idea that some of the changes in (...) social interaction, as they became widespread during the pandemic, were already prefigured in the relationship between social classes in this part of town. We then discuss the dependency this has on the spacialization of social inequalities in the urban fabric. (shrink)

A teoria da justiça proposta por John Rawls investiga a estrutura básica da sociedade, tendo como base a justiça política, a justiça pública e a justiça distributiva. Rawls propõe uma teoria que representa uma alternativa ao utilitarismo, pois para o autor os direitos não deverão estar sujeitos à negociações políticas ou sujeitos ao cálculo de interesses sociais. Rawls proposed a theory that is an alternative to utilitarianism, in which rights should not be subject to political negotiations or subject to calculation of social interests. It seems plausible that successfully communicating with our peers requires entertaining the same thoughts as they do. We argue that this view is incompatible with other, independently plausible principles of thought individuation. Our argument is based on a puzzle inspired by the Kripkean story of Peter and Paderewski: having developed several variations of the original story, we conclude that understanding and communication cannot be modeled as a process of thought transfer between speaker and hearer. While we are not the first (...) to reach this conclusion, the significance of our argument lies in the fact that it only relies on widely accepted premises, without depending on any especially controversial theory of mental and linguistic content. We conclude by drawing out the implications of that conclusion: if communication and understanding do not require thought identity, then one important motivation for the postulation of inter-personally shared thoughts is undercut. The purpose of professional education programs is to prepare aspiring professionals for the challenges of practice within a particular profession. These programs typically seek to ensure the acquisition of necessary knowledge and skills, as well as providing opportunities for their application. While not denying the importance of knowledge and skills, this paper reconfigures professional education as a process of becoming. Learning to become a professional involves not only what we know and can do, but also who we are (becoming). It (...) involves integration of knowing, acting, and being in the form of professional ways of being that unfold over time. When a professional education program focuses on the acquisition and application of knowledge and skills, it falls short of facilitating their integration into professional ways of being. In addition, through such a focus on epistemology (or theory of knowing), ontology (or theory of being) is overlooked. This paper explores what it means to develop professional ways of being where the focus is becoming, not simply knowing as an end in itself. (shrink)
