The focus on animal welfare in society has increased during the last 50 years. Animal welfare legislation and private standards have developed, and today many farmers within animal production have both governmental legislation and private standards to comply with. In this paper intentions and values are described that were expressed in 14 animal welfare legislation and standards in four European countries; Sweden, United Kingdom, Germany and Spain. It is also discussed if the legislation and standards actually accomplish what they, in (...) their overall description and ethics, claimed to do, i.e. if this is followed up by relevant paragraphs in the actual body of the text in the legislation and standards respectively. The method used was an on-line questionnaire from the EconWelfare research project and text analyses. This study shows that the ethical values within a set of legislation or private standards are not always consistently implemented, and it is not always possible to follow a thread between the intentions mentioned initially and the actual details of the legislation or standard. Since values will differ so will also the animal welfare levels and the implications of similar concepts in the regulations. In general, the regulations described were not based on animal welfare considerations only, but also other aspects, such as food safety, meat quality, environmental aspects and socio-economic aspects were taken into account. This is understandable, but creates a gap between explicit and implicit values, which we argue, can be overcome if such considerations are made more transparent to the citizens/consumers. (shrink)

A brain-computer interface is a rapidly evolving neurotechnology connecting the human brain with a computer. In its classic form, brain activity is recorded and used to control external devices like protheses or wheelchairs. Thus, BCI users act with the power of their thoughts. While the initial development has focused on medical uses of BCIs, non-medical applications have recently been gaining more attention, for example in automobiles, airplanes, and the entertainment context. However, the attitudes of the general public towards BCIs have (...) hardly been explored. Among the general population in Germany aged 18–65 years, a representative online survey with 20 items was conducted in summer 2018 and analysed by descriptive statistics. The survey assessed: affinity for technology; previous knowledge and experience concerning BCIs; the attitude towards ethical, social and legal implications of BCI use and demographic information. Our results indicate that BCIs are a unique and puzzling way of human–machine interaction. The findings reveal a positive view and high level of trust in BCIs on the one hand but on the other hand a wide range of ethical and anthropological concerns. Agency and responsibility were clearly attributed to the BCI user. The participants’ opinions were divided regarding the impact BCIs have on humankind. In summary, a high level of ambivalence regarding BCIs was found. We suggest better information of the public and the promotion of public deliberation about BCIs in order to ensure responsible development and application of this potentially disruptive technology. What kind of reality is legal reality, how is it created, and what are its a priori foundations? These are the central questions asked by the early phenomenologists who took interest in social ontology and law. While Reinach represents the well-known “realist” approach to phenomenology of law, Felix Kaufmann and Fritz Schreier belonged to the “positivist” “Vienna School of Jurisprudence,” combining Hans Kelsen’s Pure Theory of Law with Edmund Husserl’s phenomenology—and thereby challenging Reinach’s views on how legal reality and the (...) legal a priori were to be conceived. This paper addresses the controversy between these positivist and realist approaches to phenomenology of law, with the goal of introducing the lesser known theories of Kaufmann and Schreier. The special focus on their critique of Reinach’s outline should give us an overview of their positions vis-à-vis the basic and a priori elements of which legal reality consists and the role that phenomenology plays in analyzing them. There is one general tendency to be noted: While the phenomenological legal positivists see the root of legal reality in an act of interpretation according to a “normative scheme of interpretation,” Reinach locates the roots of legal reality in social interaction and argues for the existence of entities independent of any interpretation. Cameras, microphones, and other sensors continue to proliferate in the world around us. I offer a new metaphor for conceptualizing these technologies: they are _digital wormholes_, transmitting representations of human persons between disparate points in space–time. We frequently cannot tell when they are operational, what kinds of data they are collecting, where the data may reappear in the future, and how the data can be used against us. The wormhole metaphor makes the mysteriousness of digital sensors salient: digital sensors have (...) brought us to a strange place. If humans are to be capable of making sensible decisions while under observation by digital sensors, we must improve the epistemic position of potential sensor subjects. (shrink)

Traditionally, acts of civil disobedience are understood as a mechanism by which citizens may express dissatisfaction with a law of their country. That expression will typically be morally motivated, non-violent and aimed at changing their government’s policy, practice or law. Building on existing work, in this paper we explore the limits of one well-received definition of civil disobedience by considering the challenging case of the actions of animal activists at sea. Drawing on original interviews with advocates associated with Sea Shepherd, (...) Greenpeace and Humane Society International we find that even if animal activists are morally motivated and civil, the transnational nature of their activity makes it difficult to assess their intention to bring about a change in law or public policy. This means that a civil disobedience defence may not be available to activists operating across international borders. This raises important questions about the usefulness of the civil disobedience concept within the context of a globalised world. We conclude that while the actions of some anti-whaling activists may not meet definitions of civil disobedience as conventionally understood, this says more about the narrow way in which that concept has been traditionally defined, than it does about the type of activity some anti-whaling activists have undertaken in the Southern Ocean. Finally, we argue that activists wishing to make a stand against whaling may have no choice but to act as global citizens because policy change within a single nation-state is unlikely to lead to the cessation of this inherently transnational activity. David Brink presents a study of T. H. Green's classic Prolegomena to Ethics and its role in his philosophical thought. Green is one of the two most important figures in the British idealist tradition, and his political writings and activities had a profound influence on the development of Liberal politics in Britain. The Prolegomena is his major philosophical work. It begins with his idealist attack on empiricist metaphysics and epistemology and develops a perfectionist ethical theory that aims to bring together (...) the best elements in the ancient and modern traditions, and that provides the moral foundations for Green's own distinctive brand of liberalism. Brink aims to restore the Prolegomena to its rightful place in the history of philosophy by providing a prolegomenon to the Prolegomena - one that situates the work in its intellectual context, sympathetically but critically engages its main themes, and explains Green's enduring significance for the history of ethics and contemporary ethical theory. Brink examines Green's life and work, his idealist attack on empiricism, his conception of agency, his perfectionist ethics of self-realization, the connections he draws between perfectionism and the common good, his conception of the differences between perfectionism and utilitarianism, and the connections between his perfectionism and his defense of a new form of political liberalism. Because Green develops his own views out of an examination of other traditions in the history of ethics, a fair assessment of Green's own contributions must compare his claims with the traditions that he examines and sometimes criticizes. Brink's study examines Green's relation to Aristotle, Locke, Hume, Butler, Mill, Kant, Hegel, Bradley, and Sidgwick, and concludes by examining Green's legacy for ethical theory. Recent theorizing about the nature of the cognitive impairment in autism suggests that autistic individuals display abnormally weak central coherence, the capacity to integrate information in order to make sense of one’s environment. Our article shows the relevance of computational models of coherence to the understanding of weak central coherence. Using a theory of coherence as constraint satisfaction, we show how weak coherence can be simulated ina a connectionist network that has unusually high inhibition compared to excitation. A puzzle has been presented in the recent past in Northern Ireland: what is the correct description of the person who dies as a result of a hungerstrike? For many the simple answer is that such a person commits suicide, in that his is surely a case of ‘self-inflicted death’. Where then is the puzzle? It is that a number of people do not see such deaths as suicides. I am not here referring to political propagandists or paramilitaries, for whom (...) the correct description of such deaths is ‘murder by Mrs Thatcher’ or ‘killed by British intransigence’. I am rather thinking of some theologians who, despite being opposed to the hunger-strike and indeed publicly condemning the whole campaign, refused to describe what the hunger-strikers did as suicide. This book critically assesses arguments for the existence of the God of classical theism, develops an innovative account of objects’ persistence, and defends new arguments against classical theism. The authors engage the following classical theistic proofs: Aquinas’s First Way, Aquinas’s De Ente argument, and Feser’s Aristotelian, Neo-Platonic, Augustinian, Thomistic, and Rationalist proofs. The authors also provide the first systematic treatment of the ‘existential inertia thesis’. By connecting the thesis to relativity theory and recent developments in the philosophy of physics, and (...) by developing a variety of novel existential-inertia-friendly explanations of persistence, they mount a formidable new case against classical theistic proofs. Logical positivism is widely associated with an illiberal technocratic view of politics. This view is a caricature. Some members of the left Vienna circle were explicit in their criticism of this conception of politics. In particular, Neurath’s work attempted to link the internal epistemological pluralism and tolerance of logical empiricism with political pluralism and the rejection of a technocratic politics. This paper examines the role that unified science played in Neurath’s defence of political and social pluralism. Neurath’s project of unified (...) science addressed problems that lie at the centre of recent debates around liberalism concerning the possibility of social co-operation in conditions of pluralism. His response is distinctive in calling upon an empiricist tradition that differs from Kantian proceduralist approaches that have predominated in recent liberalism. While Neurath’s position has problems, it deserves reconsideration, especially in so far as it questions the Kantian assumption that a thin language of abstract rights provides the best basis for the cosmopolital lingua franca required by conditions of social pluralism. An investigation of the role that unified science plays in Neurath’s politics also gives reasons for revising common misconceptions about the nature of the unity of science programme itself. The attempt to connect philosophy and social hope has been one of the key distinguishing features of critical theory as a tradition of enquiry. This connection has been questioned forcefully from the perspective of a post-philosophical pragmatism, as articulated by Rorty. In this article I consider two strategies that have been adopted by critical theorists in seeking to reject Rorty's suggestion that we should abandon the attempt to ground social hope in philosophical reason. We consider argumentative strategies of the philosophical (...) anthropologist and of the rational proceduralist. Once the exchanges between Rorty and these two strands of critical theory have been reconstructed and assessed, an alternative perspective emerges. It is argued that philosophical reasoning best helps to sustain social hope in a rapidly changing world when we consider it in terms of the practice of democratic criticism. (shrink)

Many current theories of human rights are flawed in that they fail to recognise differences between fundamental human rights and others of lesser significance. If some rights are superior to others than it is possible to formulate a hierarchy of rights, and rules to resolve potential conflicts of rights. Only by self-examination can we determine what is personally significant in how we live meaningful and directed lives.
