Du Yu’s 杜預 commentary on the Zuo Tradition 左傳 is often touted as an enduring scholarly achievement from a latter-day perspective, because early Tang scholars treated it as the definitive official interpretation of the imperially approved Chunqiu Zuozhuan zhengyi 春秋左傳正義. But few studies have analyzed the specific components of Du Yu’s thought that sometimes adapt, other times maintain, previous conceptions of the Annals and Zuo. This paper argues that Du Yu’s schematization of the Annals into three categories of material—Zhou/institutional “general (...) norms,” Confucian/moral “transformed norms,” and historical/neutral “non-norms”—configures older ideas into a new structure of understanding designed to elevate the authority of the Zuo Tradition, unofficial but influential in the Western Jin, above that of rival Gongyang 公羊 and Guliang 穀梁 traditions during his time. Included in this discussion is Du Yu’s treatment of the Annals as a text that can be checked against a parallel ancient source newly available to him, the Bamboo Annals. (shrink)

In 1932, Wolfgang Pauli was a world-renowned physicist and had already done the work that would win him the 1945 Nobel Prize. He was also in pain. His mother had poisoned herself after his father's involvement in an affair. Emerging from a brief marriage with a cabaret performer, Pauli drank heavily, quarreled frequently and sometimes publicly, and was disturbed by powerful dreams. He turned for help to C. G. Jung, setting a standing appointment for Mondays at noon. Thus (...) bloomed an extraordinary intellectual conjunction not just between a physicist and a psychologist but between physics and psychology. Eighty letters, written over twenty-six years, record that friendship. This artful translation presents them in English for the first time. Though Jung never analyzed Pauli formally, he interpreted more than 400 of his dreams--work that bore fruit later in Psychology and Alchemy and The Analysis of Dreams. As their acquaintance developed, Jung and Pauli exchanged views on the content of their work and the ideas of the day. They discussed the nature of dreams and their relation to reality, finding surprising common ground between depth psychology and quantum physics. Their collaboration resulted in the combined publication of Jung's treatise on synchronicity and Pauli's essay on archetypal ideas influencing Kepler's writings in The Interpretation of Nature and the Psyche. Over time, their correspondence shaped and reshaped their understanding of the principle they called synchronicity, a term Jung had suggested earlier. Through the association of these two pioneering thinkers, developments in physics profoundly influenced the evolution of Jungian psychology. And many of Jung's abiding themes shaped how Pauli--and, through him, other physicists--understood the physical world. Of clear appeal to historians of science and anyone investigating the life and work of Pauli or Jung, this portrait of an incredible friendship will also draw readers interested in human creativity as well as those who merely like to be present when great minds meet. Moral distress is a phenomenon of increasing concern in nursing practice, education and research. Previous research has suggested that moral distress is associated with perceptions of ethical climate, which has implications for nursing practice and patient outcomes. In this study, a randomly selected sample of registered nurses was surveyed using Corley’s Moral Distress Scale and Olson’s Hospital Ethical Climate Survey (HECS). The registered nurses reported moderate levels of moral distress intensity. Moral distress intensity and frequency were found to be inversely (...) correlated with perceptions of ethical climate. Each of the HECS factors (peers, patients, managers, hospitals and physicians) was found to be significantly correlated with moral distress. Based on these findings, we highlight insights for practice and future research that are needed to enhance the development of strategies aimed at improving the ethical climate of nurses’ workplaces for the benefit of both nurses and patients. Logical puzzles like the doctrinal paradox raise the problem of how to aggregate individual judgements into a collective judgement, or alternatively, how to merge collectively inconsistent knowledge bases. In this paper, we view judgement aggregation as a function on propositional logic valuations, and we investigate how logic constrains judgement aggregation. In particular, we show that there is no non-dictatorial decision method for aggregating sets of judgements in a logically consistent way if the decision method is local, i.e., only depends on (...) the individual judgements on the proposition under consideration. Multinational corporations are operating in complex business environments. They are confronted with contradictory institutional demands that often represent mutually incompatible expectations of various audiences. Managing these demands poses new organizational challenges for the corporation. Conducting an empirical case study at the sportswear manufacturer Puma, we explore how multinational corporations respond to institutional complexity and what legitimacy strategies they employ to maintain their license to operate. We draw on the literature on institutional theory, contingency theory, and organizational paradoxes. The results of (...) our qualitative longitudinal study show that managing corporate legitimacy is a dynamic process in which corporations adapt organizational capacities, structures, and procedures. A study examined the journalistic codes of ethics from 23 countries involved in the Conference on Security and Cooperation in Europe (CSCE), using descriptive and interpretative content analysis. The contents of the 24 codes from the 23 countries were divided into explicit categories on the basis of a 17-part classification scheme, including: "truth, ""acquisition of facts, ""professional secrecy, ""freedom of information, ""professional integrity, ""human rights," and "values." Results indicated that: (1) the most important principle in all the codes was represented (...) by truth; (2) the general rule on acquisition and checking of facts was that journalists should use open and honest means to acquire information; (3) confidentiality of sources must be maintained; and (4) freedom of information figures prominently in nearly all of the codes. Findings suggest the development among the CSCE countries of some sort of basic, universal model of journalistic codes where the accent is on truth, freedom of information, and protection of the individual. Studies like this one point to the increasing urgency for research on the "new Europe" and its rapidly changing cultural landscape. Descartes argued that productivity, namely our ability to generate an unlimited number of new thoughts or ideas from previous ones, derives from a single undividable source in the human soul. Cognitive scientists, in contrast, have viewed productivity as a modular phenomenon. According to this latter view, syntactic, semantic, musical or visual productivity emerges each from their own generative engines in the human brain. Recent evidence has, however, led some authors to revitalize the Cartesian theory. According to this view, a single (...) source or a single mechanism in the human brain produces productivity in every cognitive domain, whether in the domain of music, semantics or syntax. In this article, we will address recent evidence concerning the single source hypothesis from brain-imaging studies, linguistics, cognitive theories of music perception, biology of cognition and cognitive development, along with several objections that have been presented against this hypothesis. We formulate two versions of the Cartesian theory which combine the more recent computational theory of cognition with Descartes' view on productivity. (shrink)

We investigate under what conditions a given set of collective judgments can arise from a specific voting procedure. In order to answer this question, we introduce a language similar to modal logic for reasoning about judgment aggregation procedures. In this language, the formula expresses that is collectively accepted, or that is a group judgment based on voting. Different judgment aggregation procedures may be underlying the group decision making. Here we investigate majority voting, where holds if a majority of individuals accepts, (...) consensus voting, where holds if all individuals accept, and dictatorship. We provide complete axiomatizations for judgment sets arising from all three aggregation procedures. (shrink)

BackgroundThe theory and practice of ethics consultations (ECs) in health care are still characterized by many controversies, including, for example, the practice of giving recommendations. These controversies are complicated by an astonishing lack of evidence in the whole field. It is not clear how often a recommendation is issued in ethics consultations and when and why this step is taken. Especially in a facilitation model in which giving recommendations is optional, more data would be helpful to evaluate daily practice, ensure (...) that this practice is in line with the overarching goals of this approach and support the development of standards.MethodsWe analyzed all consultations requested from an EC service working under a facilitation approach at a maximum-care university hospital in Germany over a period of more than 10 years. Our aim was to better understand why—and under what circumstances—some consultation requests result in a recommendation, whereas others can be sufficiently addressed solely by facilitated meetings. We especially wanted to know when and why clients felt the need for clear advice from the EC service while in other cases they did not. We compared ethics consultations in terms of the differences between cases with and without recommendations issued by the ethics consultants using χ2 difference tests and Welch’s t-test.ResultsA total of 243 ECs were carried out between September 2008 and December 2019. In approximately half of the cases, a recommendation was given. All recommendations were issued upon the request of clients. When physicians asked for an EC, the consultation was significantly more likely to result in a recommendation than when the EC was requested by any other party. ECs in cases on wards with ethics rounds resulted in comparably fewer recommendations than those in wards without ethics rounds. When interpersonal conflicts were part of the problem or relatives were present in the meeting, clients less frequently asked for a recommendation.ConclusionFrom the client’s point of view, there does not seem to be only one “right” way to provide ethics consultations, but rather several. While facilitated meetings are obviously appreciated by clients, there also seem to be situations in which a recommendation is desired (especially by physicians). Further empirical and theoretical research is needed to validate our single-center results and re-evaluate the role of recommendations in ethics consultations. (shrink)

The paper works with a formal model of referenda, where a finite number of voters can choose between two options and abstention. A referendum will be invalid if too many voters abstain, otherwise the referendum will return one of the two options. We consider quorum rules where an option is chosen if it is preferred by the majority of voters and if at least a certain number of voters (the quorum) votes for the alternative. Contract cheating – outsourcing student assignments for a fee – presents a growing threat to the integrity of higher education. As contract cheating is based on students purchasing assignments that are original, traditional plagiarism detection tools remain insufficient to detect contract cheating. Part of the problem is that proving contract cheating is difficult. As a result, instructors may find it hard to prosecute students. To help address the problem, this conceptual paper builds upon extant scholarship on contract cheating and argues (...) that a novel evidence-based approach is needed. Such an approach should allow instructors to detect and prosecute cases of contract cheating effectively and efficiently. The paper then presents an outline of such an approach and calls it the “Doping Test” approach as it mimics some aspects of doping testing in professional sport. (shrink)

An Abelian group G is strongly λ -free iff G is L ∞, λ -equivalent to a free Abelian group iff the isomorphism player has a winning strategy in an Ehrenfeucht–Fraı̈ssé game of length ω between G and a free Abelian group. We study possible longer Ehrenfeucht–Fraı̈ssé games between a nonfree group and a free Abelian group. A group G is called ε -game-free if the isomorphism player has a winning strategy in an Ehrenfeucht–Fraı̈ssé game of length ε between G (...) and a free Abelian group. We prove in ZFC existence of nonfree ε -game-free groups for many successors of regular cardinals. We also show that the length of the game obtained is very close to the optimal length provable in ZFC alone. On the other hand, assuming existence of a Mahlo cardinal, we sketch a proof that it is consistent to have a very highly game-free still nonfree group. First we present an introduction to basic constructions and then we introduce some results concerning the standard tools for building more complicated groups, namely transversals and λ -systems. It follows that all the constructions generalize to algebras in a fixed variety satisfying the strong construction principle. (shrink)

Despite a consensus across the political spectrum that the problem of the chronically uninsured is in dire need of solution, little progress has been made. Public spending goes to topping up coverage for the elderly, already heavily subsidized under Medicare, or helping people temporarily without insurance because of international trade dislocations, so that it is clear that something is lacking in the case for significantly reducing the number of uninsured persons. In this paper I suggest that there have been two (...) missing ingredients: a strategy for breaking the political deadlock around this issue, and information about the benefits of coverage sufficient to persuade kindly but skeptical taxpayers that they should be willing to pay to help solve this problem. To achieve lower medical spending with as little reduction as possible in good outcomes, practitioners and policy makers alike have been experimenting with the use of practice guidelines. These guidelines both recommend certain types of therapies and proscribe others in the treatment of patients with particular conditions. This paper explores the question of whether guidelines which do reduce total resource costs of medical care to a population will be feasible and produce “acceptable” results. The definition of acceptable is part of (...) the policy problem, so it will be left open for a while, but the question of which outcomes match with which levels of resource cost will form the positive basis for the normative judgment of “acceptability.”. Axiomatic characterization results in social choice theory are usually compared either regarding the normative plausibility or regarding the logical strength of the axioms involved. Here, instead, we propose to compare axiomatizations according to the language used for expressing the axioms. In order to carry out such a comparison, we suggest a formalist approach to axiomatization results which uses a restricted formal logical language to express axioms. Axiomatic characterization results in social choice theory then turn into definability results of formal logic. (...) The advantages of this approach include the possibility of non-axiomatizability results, a distinction between absolute and relative axiomatizations, and the possibility to ask how rich a language needs to be to express certain axioms. We argue for formal minimalism, i.e., for favoring axiomatizations in the weakest language possible. (shrink)

Game Logic is a modal logic which extends Propositional Dynamic Logic by generalising its semantics and adding a new operator to the language. The logic can be used to reason about determined 2-player games. We present an overview of meta-theoretic results regarding this logic, also covering the algebraic version of the logic known as Game Algebra.

There is compelling linguistic evidence that many words (e.g., boil) are derived from phrasal sources (e.g., cause to boil). Among causation, typical semantic primitives composing word meanings are becoming, having and getting. While linguists have argued that word meanings contain semantic knowledge that we can grasp but cannot express linguistically, Fodor and his colleagues maintain that words express primitive, semantically unanalysable concepts. Under this view, putative linguistic semantic decompositions express nonsemantic metaphysical regularities. After reviewing the debate, it is suggested in (...) this article that semantic features that are linguistically salient and unspeakable emerge neither from the analytical connections between words, nor from the metaphysical structure of the world, but from the logical syntax of the grammar. Understanding the acquisition and performance of voluntary movements in biological and artificial systems requires the integration of knowledge from a variety of disciplines from neurophysiology to biomechanics.

Research on moral distress has paid limited attention to nurses’ responses and actions. In a survey of nurses’ perceptions of moral distress and ethical climate, 292 nurses answered three open-ended questions about situations that they considered morally distressing. Participants identified a range of situations as morally distressing, including witnessing unnecessary suffering, being forced to provide care that compromised values, and negative judgments about patients. They linked these situations to contextual constraints such as workload and described responses, including feeling incompetent and (...) distancing themselves from patients. Participants described considerable effort to effect change, calling into question the utility of defining moral distress as an “inability to act due to institutional constraints” or a “failure to pursue a right course of action.” Various understandings of moral distress operated, and action was integral to their responses. The findings suggest further conceptual work on moral distress and effort to support system-level change. (shrink)

Based on the findings of a qualitative empirical study of corporate social responsibility (CSR) in Swiss MNCs and SMEs, we suggest that smaller firms are not necessarily less advanced in organizing CSR than large firms. Results according to theoretically derived assessment frameworks illustrate the actual implementation status of CSR in organizational practices. We propose that small firms possess several organizational characteristics that are favorable for promoting the internal implementation of CSR-related practices in core business functions, but constrain external communication and (...) reporting about CSR. In contrast, large firms possess several characteristics that are favorable for promoting external communication and reporting about CSR, but at the same time constrain internal implementation. We sketch a theoretical explanation of these differences in organizing CSR in MNCs and SMEs based on the relationship between firm size and relative organizational costs. (shrink)

A visible role in the theoretical discourses on education has been played in the last couple of decades by the constructivist epistemologies, which have questioned the basic assumptions of realist epistemologies. The increased popularity of interpretative approaches especially has put the realist epistemologies on the defensive. Basing itself on critical realism, this article discusses the ontological and epistemological commitments of educational research and its consequences for text interpretation.
