Even now, however, Wegener's work remains virtually unknown to the English speaking world. Wegener's main work was published in 1885. It has its origin in two lectures given in 1883 and 1884 at school teacher meetings held in the Magdeburg area and it still recalls those (...) original occasions and maintains much of the oral style. Part of the volume treats the subject in a systematic and theoretical manner; other sections contain vivid examples and are characterized by a considerable didactic effort. The book is held together by leitmotif-questions, such as 'How do we understand language?' and 'How does language function as a means of everyday communication?'. We witness the experiences of the talented school teacher and the observations of the innovative dialect researcher combined, condensed, and conceptually ordered.In spite of the relatively unsystematic form of presentation, the book remains thoroughly consistent in thought and argument. No discussion of academic freedom, research integrity, and patient safety could begin with a more disquieting pair of case studies than those of Nancy Olivieri and David Healy. The cumulative impact of the Olivieri and Healy affairs has caused serious self examination within the biomedical research community. The first part of the essay analyses these recent academic scandals. The two case studies are then placed in their historical context—that context being the transformation of the norms of science through increasingly close (...) ties between research universities and the corporate world. After a literature survey of the ways in which corporate sponsorship has biased the results of clinical drug trials, two different strategies to mitigate this problem are identified and assessed: a regulatory approach, which focuses on managing risks associated with industry funding of university research, and a more radical approach, the sequestration thesis, which counsels the outright elimination of corporate sponsorship. Motivated by accounts of concept use in autistic spectrum disorder and a computational model of weak central coherence we examined comprehension and production vocabulary in typically‐developing children and those with ASD and Down syndrome. Controlling for frequency, familiarity, length and imageability, Colorado Meaningfulness played a hitherto unremarked role in the vocabularies of children with ASD. High Colorado Meaningful words were underrepresented in the comprehension vocabularies of 2‐ to 12‐year‐olds with ASD. The Colorado Meaningfulness of a word is a measure of (...) how many words can be associated with it. Situations in which high Colorado Meaningfulness words are encountered are typically highly variable, and words with High Colorado Meaningfulness often involve extensive use of context. Our data suggest that the number of contexts in which a particular word can appear has a role in determining vocabulary in ASD. This suggestion is consistent with the weak central coherence theory of autism. (shrink)

We explore the extent to which Boards use executive compensation to incite firms to act in accordance with social and environmental objectives (e.g., Johnson, R. and D. Greening: 1999, Academy of Management Journal 42(5), 564-578; Kane, E. J.: 2002, Journal of Banking and Finance 26, 1919-1933.). We examine the association between executive compensation and corporate social responsibility (CSR) for 77 Canadian firms using three key components of executives' compensation structure: salary, bonus, and stock options. Similar to prior research (McGuire, J., (...) S. Dow and K. Argheyd: 2003, Journal of Business Ethics 45(4), 341-359), we measure three different aspects of CSR, which include Total CSR as well as CSR Strengths and CSR Weaknesses. CSR Strengths and CSR Weaknesses capture the positive and negative aspects of CSR, respectively. We find significant positive relationships between: (1) Salary and CSR Weaknesses, (2) Bonus and CSR Strengths, (3) Stock Options and Total CSR; and (4) Stock Options and CSR Strengths. Our findings suggest the importance of the structure of executive compensation in encouraging socially responsible actions, particularly for larger Canadian firms. This in turn suggests that executive compensation can be an effective tool in aligning executives' welfare with that of the "common good", which results in more socially responsible firms (Bebchuk, L., J. Fried and D. Walker: 2002, The University of Chicago Law Review 69, 751-846; Zalewski, D.: 2003, Journal of Economic Issues 37(2), 503-509). In addition, our findings suggest the importance of institutional context in influencing the association between executive compensation and CSR. The purpose of this article is to demonstrate the epistemic position of psychiatry between the science of general laws in relation to frequently encountered generality and the science of specific events which is directed towards the particular. In this respect the development of the dichotomy of nomothetic and idiographic methodology from its generally forgotten neo-Kantian origins is delineated within the context of a historical-philosophical analysis and then its incorporation into psychology and psychopathology is reconstructed. In the course of this analysis (...) and also in the discussion of the currently accepted theories of analytical philosophy and critical rationalism it becomes clear that, in spite of widespread current opinions to the contrary, individualizing concept formation is an indispensable element in the methodological inventory of psychiatric science. This study aims at justifying one of Gilbert Durand’s postulates according to which all imaginaire (as a result of mental imagery) is anchored in our physiology but by directing it rather now towards our neurophysiology. New advances in neurobiology, connectome and neurogenomics lead to rethinking the framework of psychic activity and the induction of neural images.

This paper offers an economic analysis of one aspect of the possible liability for incorrect information traded on information markets: expert liability for incorrect asset valuation. The article does not address the questions of whether and under what circumstances an expert should bear contractual liability for an incorrect valuation. Rather, it assumes such contractual liability towards the person who has solicited the opinion and focuses instead on analyzing the circumstances under which the expert’s liability should be extended to third parties (...) as well. Zeigen lässt sich, wie seit den 1970er Jahren der Gebrauch sich wan­delnder Medientechnologien nicht nur das Aneignen von Manövern beeinflusst und beschleunigt. Auch auf die Vergemeinschaftung der Teilnehmer zu stilistischen ‚Kulturen‘ hat diese Entwicklung erheblichen Einfluss, indem sie immer wieder neue AutorenInnen und Bildgenres (...) zulässt. Eine Zä­sur markiert der in den frühen 1980er Jahren durchgesetzte Videorekorder, auf dessen Basis sich das ‚klassische‘ Skateboard-Video etabliert: Die Praktik verbreitet sich in körperlicher Aneignung von „Rockvideos über Sport“, die zugleich Imagefilme von Jugendmarken sind. Dieser Prozess, so die These, platziert ihre Träger exakt im Schnittpunkt von Sport- und Popkultur - und macht die Skateboard-Praktik zu einer exemplarischen Selbsttechnik, in denen sich ab 1980 das „konsumatorische Kreativsubjekt“ der postmodernen Ordnung heranbildet. The reliability of clinical practice guidelines has been disputed because guideline panel members are often burdened with financial conflicts of interest. Current recommendations for COI regulation advise not only detailed declaration but also active management of conflicts. To continuously assess COI declaration and management in German guidelines we established the public database LeitlinienWatch. We analyzed all German guidelines at the highest methodological level that included recommendations for pharmacological therapy according to five criteria: declaration and assessment of COI, composition of the (...) guideline development group, independence of the coordinators and lead authors, imposed abstentions because of COI and public external review. Each criterion was assessed using predefined outcome categories. Most guidelines contained a detailed declaration of COI. However, none of the guidelines provided full transparency of COI assessment results. The guideline group was composed of a majority of participants with COI in 55% of the guidelines, no guideline was free of participants with COI. Only 9% of guidelines had coordinators and lead authors without any financial COI. Most guidelines did not provide a rule for abstentions for participants with COI. In 21% of guidelines there was a rule, but abstentions were either not practiced or not documented, whereas in 7% partial abstentions and in 2% complete abstentions were documented. Two thirds of the guideline drafts were not externally reviewed via a public website. COI are usually documented in detail in German guidelines of the highest methodological level. However, considerable improvement is needed regarding active management of COI, including recruitment of independent experts for guideline projects, abstention from voting for participants with COI and external review of the guideline draft. We assume that the publicly available ratings on GuidelineWatch will improve the handling of conflicts of interest in guideline development. (shrink)

Cet article propose de rappeler les faits en se plaçant depuis la perspective de baptistes opposés à l’extrême-droite chrétienne, en revenant sur le sur le cas du Baptist Joint Committee for Religious Liberty (BJC) qui, appuyé par plusieurs figures de militants évangéliques, fait activement campagne pour dénoncer les (...) dérives de ce christianisme suprémaciste et ses dangers pour la démocratie. La naissance du CRI à Grenoble doit être replacée dans le contexte intellectuel de la nouvelle critique des années 1960. Les trois courants dominants du matérialisme historique, de la psychanalyse freudienne et du structuralisme ont alors été dépassés par le CRI au profit d’un « nouvel esprit anthropologique » qui privilégiait la réalité sensible des images au détriment des idéologies réductrices. Les intellectuels des villes ont perdu le lien charnel avec une civilisation rurale et un mode de vie ayant façonné (...) notre langue, nos croyances et nos fêtes, ainsi que des artisanats séculaires. The birth of the CRI in Grenoble is replaced in the intellectual context of new criticism of the 1960s. The three mainstream have been overtaken by the CRI in favour of a “new anthropological spirit” that emphasizes the sensible reality of images at the expense of reducing ideologies. The modern scholars of the cities have lost the carnal connection with a rural civilization and a way of life that have shaped our language, our ancient beliefs and feasts and also centuries-old handicrafts. The medievalist can find the link with this memory of time. But if he has lost a pagan soul and a spirit of peasant, he is sentenced to a post-modern posture. Thinking Western culture in bypassing or ignoring the middle ages appears like a mere sham. An example of long-life images stresses the importance of cultural relays against all preconceived theory of the archetypes. (shrink)

This is a study that investigated the extent of use of the three principles of ethics – utility, morality, and justice – in managerial ethical decision making, in addition to the personal attitude towards them. It involved undergraduate and graduate business students (total N=163) from the Olayan School of Business in the American University of Beirut, Lebanon. Two kinds of measurements were done: self assessment, and testing with the Saschkin’ s Managerial Value Profile (1997). It showed that morality was the (...) overriding ethical principle used, especially in the graduate group (professionals). Business students still believed in the justice system despite the weakness of the country’s law. Utility was the least used, although males were found to be more utilitarian than females. Finally there was no relation between personal attitudes toward the three ethical principles, and the intentional behavior when faced with ethical dilemmas. The findings were discussed and recommendations were given. (shrink)

This paper analyses some current jurisprudential and conceptual issues in evidence and procedure from the perspective of a computational legal theory. It introduces a specific investigative device, Trojans operated by police during crime investigation, and analyses whether current formal approaches to legal reasoning can be modified in such a way that the software code underlying this device can represent the relevant legal constraints that should govern its operation. We will argue that traditional formalist theories of legal reasoning are typically restricted (...) to reasoning within a system, and incapable therefore of making the notion of “legal system” sufficiently explicit. We discuss possibilities to expand on these approaches and identify the necessary elements of a computational theory of legal reasoning in an age of porous borders.Resumen:En este ensayo se analizan algunos tópicos conceptuales y filosóficos de actualidad sobre el procedimiento y las pruebas desde la óptica de una teoría del derecho computacional. En él se presenta un mecanismo específico de investigación, relativo a los “troyanos” operados por la policía durante la investigación de delitos, y analiza si los enfoques formales contemporáneos sobre el razonamiento jurídico pueden ser modificados de tal modo que el código de sofware que subyace a este mecanismo puede representar las limitaciones jurídicas relevantes que deberían regir su operación. Los autores sostienen que las teorías formalistas tradicionales del razonamiento jurídico se limitan por lo general al razonamiento dentro de un sistema y, por lo tanto, son incapaces de hacer la noción de “sistema jurídico” suficientemente explícita. Asimismo, se discuten las posibilidades de ampliar estos enfoques e identificar los elementos necesarios de una teoría computacional del razonamiento jurídico en una era de fronteras porosas. Ariès traces Western man's attitudes toward mortality from the early medieval conception of death as the familiar collective destiny of the human race to the modern tendency, so pronounced in industrial societies, to hide death as if it were an embarrassing family secret.

There are various conceptions of objectivity, a characteristic of the scientific enterprise, the most fundamental being objectivity as faithfulness to facts. A brute fact, which happens independently from us, becomes a scientific fact once we take cognisance of it through the means made available to us by science. Because of the complex, reciprocal relationship between scientific facts and scientific theory, the concept of objectivity as faithfulness to facts does not hold in the strict sense of an aperspectival faithfulness to brute (...) facts. Nevertheless, it holds in the large sense of an underdetermined faithfulness to scientific facts, as long as we keep in mind the complexity of the notion of scientific fact (as theory-laden), and the role of non-factual elements in theory choice (as underdetermined by facts). Science remains our best way to separate our factual beliefs from our other kinds of beliefs. (shrink)

We have entered a new long-term war regime. This regime is multiform, and deployed on two mutually interpenetrating fronts: one internal, the other external. The military and the forces of a law and order » cooperate with each other to face a supposed common enemy: international terrorism, both actual and potential. If, in this war regime, the American government occupies a leadership position, several other governments are engaged at the sane level, France and Russia amongst them. This state of affairs (...) cannot be reduced to a simple model of American imperialism. This article argues that the principal cause is at once the deepest and largest: it reflects the fear of globality, of the subversive emergence of a humanity at once globalised and mixed, which in multiple ways, shifts future prospects: shaking up dominations, confronting the big, global problems, without playing the game of conflicts of force and territory. It is this, fear which, whilst it motivates those promoting this new regime, also poses to us, a real challenge: that of expressing, more than they can suppress, the virtualities of this globality.
