Pourquoi refuser une médiation? Quels sont les mécanismes, humains, sociologiques, professionnels qui peuvent pousser certains acteurs, parties à un différend, à préférer le coût, la durée et l’aléa d’un contentieux à la tentative de trouver rapidement un accord satisfaisant? Pour comprendre ces ressorts, il faut s’intéresser aux enjeux de pouvoir.

L’ouvrage codirigé par Antoine Garapon et Pierre Servan-Schreiber vise à illustrer un changement de « paradigme » opéré au cours des dernières années dans la régulation des affaires internationales.En effet, traditionnellement, l’activité des entreprises multinationales est organisée selon le droit de l’Etat de leur siège social, et éventuellement selon le(s) droit(s) des Etats au sein desquels elles poursuivent leur activité. Par exemple, dans l’affaire Siemens, chaque acte illicite pouvait ainsi être soumis à trois droits nationaux (p. 10). (...) Par conséquent, l’organisation d’institutions complexes comme les entreprises multinationales dont le siège, les actionnaires et l’activité marchande sont généralement situés dans des Etats distincts a ouvert à ces dernières des possibilités inégalées de contournement des lois étatiques. The very name of Bihar, a district in the eastern part of India, evokes images of anarchy, banditry, and disarray. Already traversed by distinct cultural zones - Bhojpuri, Mithila, Magadha, and the tribal zone of Jharkhand - Bihari society is characterized by bloody clan conflict over territorial rights. The doggedness with which the region's protagonists form militias is a perpetual source of front-page news. Pitted against the Brahmans and Bhumihar Rajputs, the large landowners, are the herding and soldier castes such (...) as the livestock-herding Yadavas, the farming Kurmis, and the former saltpeter miners, the Noniyas, whose economic, social, and political growth has given them real power. And although Magadha's rich Buddhist past attracts pilgrims and tourists, and Mithila's beautiful painted murals and villages draw art connoisseurs, Bihar ranks as one of the least safe regions of India. We explore a network architecture introduced by Elman (1988) for predicting successive elements of a sequence. The network uses the pattern of activation over a set of hidden units from time-step 25-1, together with element t, to predict element t + 1. When the network is trained with strings from a particular finite-state grammar, it can learn to be a perfect finite-state recognizer for the grammar. When the network has a minimal number of hidden units, patterns on the hidden units (...) come to correspond to the nodes of the grammar, although this correspondence is not necessary for the network to act as a perfect finite-state recognizer. We explore the conditions under which the network can carry information about distant sequential contingencies across intervening elements. Mais des fondements communs cimentent ces deux traditions. And yet, the two traditions are bonded together by their common foundations. Does the war of images echo scores being settled over a post-modern deconstructing trend? How people learn chunks or associations between adjacent items in sequences was modelled. Two previously successful models of how people learn artificial grammars were contrasted: the CCN, a network version of the competitive chunker of Servan‐Schreiber and Anderson [J. Exp. Psychol.: Learn. Mem. Cogn. 16 (1990) 592], which produces local and compositionally‐structured chunk representations acquired incrementally; and the simple recurrent network (SRN) of Elman [Cogn. Sci. 14 (1990) 179], which acquires distributed representations through error correction. The models' susceptibility (...) to two types of interference was determined: prediction conflicts, in which a given letter can predict two other letters that appear next with an unequal frequency; and retroactive interference, in which the prediction made by a letter changes in the second half of training. The predictions of the models were determined by exploring parameter space and seeing howdensely different regions of the space of possible experimental outcomes were populated by model outcomes. For both types of interference, human data fell squarely in regions characteristic of CCN performance but not characteristic of SRN performance. (shrink)

Cette note identifie comme sa source un chapitre d’Albert le Grand, De natura et origine animae II, 13, dont la traduction en (...) hébreu se trouve dans un ouvrage inédit de Juda de Rome, son Commentaire du Qaddīš et de la Qeduššāh. La traduction du chapitre est éditée, l’histoire de l’ exemplum reconstituée et son emploi par les trois auteurs, remis en contexte et interprété. (shrink)

In this 1999 book Pierre Keller examines the distinctive contributions, and the respective limitations, of Husserl's and Heidegger's approach to fundamental elements of human experience. He shows how their accounts of time, meaning, and personal identity are embedded in important alternative conceptions of how experience may be significant for us, and discusses both how these conceptions are related to each other and how they fit into a wider philosophical context. His sophisticated and accessible account of the phenomenological philosophy of (...) Husserl and the existential phenomenology of Heidegger will be of wide interest to students and specialists in these areas, while analytic philosophers of mind will be interested by the detailed parallels which he draws with a number of concerns of the analytic philosophical tradition. In this article, I analyse the role of the concepts of ‘practice,’ ‘relations,’ and ‘process’ in Rein Vihalemm’s philosophy of science and the way he defined and articulated these concepts to study the production of scientific knowledge. Then, following Vihalemm’s line of reasoning, I will show how this approach is promising for thinking in a new way about some developments in contemporary sciences and technology.

This chapter first evokes the objects of chemistry and the role played by experimentation in the constitution of its objects. It then studies how chemists set up experimental protocols to deal with the dependence of chemical bodies on the inert or living environments in which they are found. To this end, its pays particular attention to the preparation of reference matrices for measurement and for the validation of results. In so doing, it stresses the fact that chemists use a dizzying (...) pluralism of instruments, procedures, reasonings, and methods in order to characterize and quantify substances, which are never truly detachable, except in the case of approximations satisfying particular objectives, from the empirical complex {apparatus-methods-chemical substances-associated medium} in which they are scrutinized. Self-criticism is a trait associated with increased psychopathology, but self-criticism is also a personality state reflecting an action that people do in moments of time. In the current study, we explored factors associated with heightened self-criticism in daily life. Participants (N = 197) received five random prompts per day for one week on their mobile phones, where they reported their current affect (negative and positive affect), willpower self-efficacy, distress intolerance, degree of support and criticism from others, current context (location, activity, (...) hunger, tiredness) and momentary self-criticism. We first demonstrated that self-criticism varies over time and across contexts, and is associated with heightened trait self-criticism. Then, using multilevel modelling, we explored the contextual factors associated with greater self-criticism. We found that self-criticism was higher when people were at home, and more tired. We also found higher self-criticism to be associated with greater negative and lower positive affect, greater distress intolerance, lower willpower and greater perceived criticism from others. In addition, self-criticism predicted subsequent distress intolerance, willpower and positive affect in lagged analyses. This study provides evidence that both environmental and psychological factors are associated with the dynamics of self-critical thoughts. (shrink)

Suppose that knowledge and ignorance are complements in the sense of being mutually exclusive: for person S and fact p, either S knows that p or is ignorant that p. Understood in this way, ignorance amounts to a lack or absence of knowledge: S is ignorant that p if and only if it is not the case that S knows that p. Let us call the thesis that knowledge and ignorance are opposites the “Complement Thesis”. In this article, I discuss (...) its deployment in an ingenious new argument advanced by Alvin Goldman and Erik Olsson (2009) which, if sound, establishes that there is a kind of knowledge that amounts to nothing more than true belief. I rebut their argument and in doing so delineate some important epistemological lessons brought to light by the contrast between ignorance and knowledge. (shrink)

I present and defend here a thesis named vehicleless externalism for conceptual mental episodes. According to it, the constitutive relations there are between the production of conceptual mental episodes by an individual and the inclusion of this individual in social discursive practices make it non-necessary to equate, even partially, conceptual mental episodes with the occurrence of physical events inside of that individual. Conceptual mental episodes do not have subpersonal vehicles; they have owners: persons in interpretational practices. That thesis is grounded (...) on inferentialism and on the endorsement of the idea that "meaning is normative". After having recapitulated this heritage and after having presented that thesis, the paper especially attempts to articulate how, in that framework, we may then positively conceive the relations there are between conceptual mental episodes, intracranial events and inferential behaviour. Frederick Griffith was an English bacteriologist at the Pathological Laboratory of the Ministry of Health in London who believed that progress in the epidemiology and control of infectious diseases would come only with more precise knowledge of the identity of the causative microorganisms. Over the years, Griffith developed and expanded a serological technique for identifying pathogenic microorganisms, which allowed the tracing of the sources of infectious disease outbreaks: slide agglutination. Yet Griffith is not remembered for his contributions to the biology (...) and epidemiology of infectious diseases so much as for discovering the phenomenon known as ‘transformation’. Griffith’s discovery, for many, was a pure case of serendipity whose biological relevance had also largely escaped him. In this paper, I argue that the key to understanding the significance of bacterial transformation – and the scientific legacy of Fred Griffith – rests not only on it initiating a cascade of events leading to molecular genetics but also on its implications for epidemiology based on the biology of host–parasite interactions. Looking at Griffith’s entire career, instead of focusing only on the transformation study, we can better appreciate the place of the latter within Griffith’s overall contributions. Presented in this way, Griffith’s experiment on bacterial transformation also ceases to appear as an anomaly, which in turn leads us to rethink some of the most prevalent historical conceptions about his work. Dans le traité De la divination dans le sommeil, Aristote entend réfuter la thèse d’une origine divine des rêves qui semblent annoncer les événements futurs. Pour cela, il ne se contente pas de soutenir une thèse différente. Il dénonce également la faiblesse épistémologique de la pratique divinatoire, en proposant un modèle scientifique alternatif : une méthode de classification des rêves et de division par épuisement, qui exclut les rêves inspirés. Cette méthode conduit à souligner le caractère irréductible des faits de (...) hasard et à admettre le caractère inexplicable d’un grand nombre de rêves « véridiques ». La notion de coïncidence ( sumptôma ) joue sur ce point un rôle essentiel. Ce rôle est à la fois descriptif et critique : il permet de définir la classe des rêves dont la dimension véridique est absolument fortuite, et il dénonce l’illusion commune qui les relie à des événements réels. De ce point de vue, le chapitre 1 du De divinatione apporte une contribution, modeste mais spécifique, à la théorie des modalités physiques. (shrink)

Mais peut-on, alors, encore envisager d'écrire Le Livre (Mallarmé)?

Dans les écrits posthumes de Merleau-Ponty (en particulier Le visible et l’invisible), il semble que soit convoquée une « expérience » fort différente de celle mise au jour dans la phénoménologie de la perception, celle de la chair. On essaie d’établir, tout à la fois, l’originalité indéniable de ces textes et l’impossibilité, finale, de rompre avec une certaine tradition que l’on symbolise par le référent bergsonien.

Editor’s Introduction The following text was prepared by Pierre Bourdieu for delivery at a conference on his work held at Duke University, April 21–23, 1995. Entitled “Pierre Bourdieu: Fieldwork in Culture,” the conference was sponsored by the Duke Graduate Program in Literature and included such well‐known literary scholars as Barbara Herrnstein Smith, Jonathan Culler, and Fredric Jameson. Bourdieu, of course, was the invited guest of honor, but was uncertain as to whether he should make the effort of attending, (...) particularly since he was recovering from a short period of poor health. As I too had been invited , Bourdieu discussed the question with me in Paris.He was rather concerned about wrongheaded, trendy applications of his theories by American literary scholars, who often misunderstand his work because they simply do not know the intellectual landscape to which it relates. Reading such conference paper titles as “Cross‐Dressing for Success: The Scramble for Symbolic Power in Tabitha Sweeney’s Female Quixotism,” Bourdieu confessed his fear of being taken as simply the French intellectual flavor of the month, one whose theory is used simply as grist for the American academy’s industrious mills of literary interpretation.He ultimately decided to send the following text to be read at the conference in his absence. It treats, with polite frankness, his worries about being misinterpreted through importation into the American theoretical field with its peculiar conception of French philosophy; Bourdieu’s paper situates these particular worries within a more general account of “allodoxic”distortions caused by the international travel of theory; but it also tries to prevent further misunderstanding by offering a brief contextualization of his theory and a brief summary of his method of analysis through fields. Depuis la revolution scientifique du XVIIe siecle, la science est tourmentee par le sens a donner a sa propre entreprise. Plusieurs tentatives pour fonder l'intelligibilite de la nature sur les structures pretendument immuables de la raison ont echoue. Mais l'echec philosophique est a la mesure du succes aveuglant des connaissances scientifiques, qui n'ont plus que faire du scrupule de principe. Kant n'est-il pas un des avocats les plus eminents de ce scrupule tombe en desuetude? Face au divorce consomme entre physique (...) et metaphysique, il restait a se demander, avec Kant, ce que la raison a a gagner si chacune se force malgre tout a parler le langage de l'autre. Effort douloureux mais riche d'enseignement: si la physique est poussee dans cet horizon de la metaphysique qui lui est etranger, elle retrouve le moyen de s'aventurer dans une reflexion sur son propre point de depart. Reflexion qui hante encore la science aujourd'hui, meme si c'est a son insu. Dans ce premier geste il doit y avoir quelque chose de definitif: seule la philosophie kantienne de la nature nous met vraiment aux prises avec lui.
