The purpose of this study was to map the distribution of publications on plagiarism among higher educational institutions in sub-Saharan Africa (SSA). Studies reviewed were based on 171 plagiarism related publications within a decade (2012–2022). Findings revealed that most plagiarism related articles were published in 2016. Additionally, a majority of the studies (53) were from Nigeria and Ghana (23). Most of the articles focused on students’ and faculty’s awareness of plagiarism, and institutional prevention of plagiarism, but were rather marginal on (...) challenges involved in preventing plagiarism, as well as effects of plagiarism. Dominant forms of plagiarism were self-plagiarism, branded plagiarism and commission plagiarism. However, major causes of plagiarism comprised easy access to digital information and resources; poor supervision of students; pressure on academics to publish for promotion; and insufficient skills development regarding ethical academic writing. Additionally, plagiarism preventive software and policies on plagiarism were the main ways of preventing plagiarism. Finally, in fighting plagiarism, higher educational institutions in SSA encountered challenges such as lack of well-trained academic experts to detect and report plagiarism cases; reluctance on the part of technical administrative staff to investigate works for traces of plagiarism; and low plagiarism detection skills from project supervisors. The purpose of this book is to discuss some critical components of Albert Shanker's work in American education, first as a teacher, then as president of the AFT. This is done in the context of the developments that took place in the United States since 1902 and the formation of the AFT in 1916. It focuses on the elements of leadership that were critical to the development of the United States from that time to the present. It presents these developments (...) in the context of Shanker's involvement since 1964. It also focuses on the dynamics of human relations cast in institutional settings. In doing so it presents features of a nation as it struggled with economic, social, and political issues that make society what it is. This discussion is done as a reflection of the need to strengthen democracy. The relations that Shanker has had with other people and organizations forms a critical component of the study. (shrink)

BackgroundTo limit selective and incomplete publication of the results of clinical trials, registries including ClinicalTrials.gov were introduced. The ClinicalTrials.gov registry added a results database in 2008 to enable researchers to post the results of their trials as stipulated by the Food and Drug Administration Amendment Act of 2007. This study aimed to determine the direction and magnitude of any change in publication proportions of registered breast cancer trials that occurred since the inception of the ClinicalTrials.gov results database.MethodsA cross-sectional study design (...) was employed using ClinicalTrials.gov, a publicly available registry/results database as the primary data source. Registry contents under the subcategories ‘Breast Neoplasms’ and ‘Breast Neoplasms, Male’ were downloaded on 1 August 2015. A literature search for included trials was afterwards conducted using MEDLINE and DISCOVER databases to determine publication status of the registered breast cancer trials.ResultsNearly half (168/340) of the listed trials had been published, with a median time to publication of 24 months (Q1 = 14 months, Q3 = 42 months). Only 86 trials were published within 24 months of completion. There was no significant increase in publication proportions of trials that were completed before the introduction of the results database compared to those completed after (OR = 1.00, 95 % CI =.61 to 1.63; adjusted OR = 0.84, 95 % CI =.51 to 1.39). Characteristics associated with publication included trial type (observational versus interventional adjusted OR =.28, 95 % CI =.10 to.74) and completion/termination status (terminated versus completed adjusted OR =.22, 95 % CI =.09 to.51).ConclusionsLess than a half of breast cancer trials registered in ClinicalTrials.gov are published in peer-reviewed journals. If observation is ‘theory-laden’, how can there be ‘observationally equivalent theories’? How can the observations ‘laden’ by one theory be ‘the same as’ those ‘laden’ by another? The answer might lie in the expressibility of observationally equivalent theories in a common mathematical formalism.

Bohr’s reply to Einstein, Podolsky, and Rosen’s argument for the incompleteness of quantum theory is notoriously difficult to unravel. It is so diffcult, in fact, that over 60 years later, there remains important work to be done understanding it. Work by Fine , Beller and Fine , and Beller goes a long way towards correcting earlier misunderstandings of Bohr’s reply. This essay is intended as a contribution to the program of getting to the truth of the matter, both historically and (...) philosophically. In a paper of this length, a full account of Bohr’s reply is impossible, and so I shall focus on one issue where it seems further clarification is required, namely, Bohr’s attempt to illustrate EPR’s argument by means of a thought experiment. In addition, I shall attempt to clarify a few other points which, however minor, have apparently contributed to misunderstandings of Bohr’s position. As the title of this paper suggests, an account of these few points does not constitute an account of Bohr’s reply, but it is an important step in that direction. (shrink)

‘Seeing is believing’ perhaps means that some visual experience provides good evidence for some claims that go beyond the content of the experience. Intuition—intellectual ‘seeming’—does not provide similarly good evidence, at least not for metaphysical claims, or so I shall argue. In §2, I sketch the conception of ‘metaphysics’ that is in use here, a conception that leads naturally to a problem about what counts as evidence in metaphysics. Some have suggested that intuition counts. In §3 I raise some doubts (...) (but not radical skeptical doubts) about intuition. These doubts are directed specifically at Bealer’s (1998) account of philosophical intuition. In §4 I will consider an argument in favor of the appeal to rational intuition as evidence in philosophy, and suggest that the argument is circular. I conclude §4 with some additional doubts about intuition, focused on whether intuitions could ever be ‘calibrated’. (shrink)

This article is a response to a call for a study of international criminal law as an economic phenomenon, going beyond addressing administrability, commensurability, and interpersonal comparison of utility, band instead focusing on problems of institutional choice. This approach differs from the typical methods of normative and descriptive scholarship of international criminal law. An institution like the International Criminal Court can be usefully examined as an international public good, and as such offering little incentives for states such as the United (...) States of America to join as they can enjoy benefits without costs. This article examines the economic basis for the US non-participation in the ICC and grapples with future prospectives. (shrink)

Drawing on constructionist theory, this study examines how the media portrayed five public reporting events initiated by the Fair Labor Association (FLA), considering whether the coverage encourages or discourages companies from undertaking a reporting initiative as part of their ethical management. Media coverage was limited but generally favorable across all five events. Coverage frequently included claims made by FLA spokespersons and provided basic facts about the organization and its activities. Extensive detail about labor violations found by monitors was often included. (...) Additional media coverage centered around themes of public reporting and transparency, an assessment of the FLA’s work, brand accountability and responsibility of corporations with regard to working conditions and labor standards, and specifics about the factory monitoring and partnering with factories and NGOs that is necessary to achieve change. Counter-claims brought question to the FLA’s efforts. Explanations about why the social condition exists were fairly limited, and thus, provided little insight into how the problems might be resolved. We discuss managerial implications regarding public reporting initiatives and media coverage, particularly regarding the countering effects of positive coverage and diminishing news stories. Questions concerning the aims and aspirations, criteria of success and even proper delineation of the subject matter of theories of law have given rise to some of the most intractable and contentious debates in contemporary legal philosophy. In this article, I outline my vision of the remit and character of legal philosophy, with particular emphasis on the methodological approach with which I am most concerned in my own work, and which I refer to here as ‘indirectly evaluative legal philosophy’. I (...) do so partly in response to some vehement criticisms of, and, in my view, significant mischaracterisations of, IELP and cognate approaches to theorising about law, which feature in some recent jurisprudential debates. My position supports a pluralistic methodological outlook which emphasises disciplinary and sub-disciplinary complementarity as an alternative to the febrile adversarialism sometimes afflicting our discipline. Is the quantum-logic interpretation dead? Its near total absence from current discussions about the interpretation of quantum theory suggests so. While mathematical work on quantum logic continues largely unabated, interest in the quantum-logic interpretation seems to be almost nil, at least in Anglo-American philosophy of physics. This paper has the immodest purpose of changing that fact. I shall argue that while the quantum-logic interpretation faces challenges, it remains a live option. This essay looks to re-evaluate sculptor Richard Serra’s famous claim that “to remove the work is to destroy it.” Using OOO, and particularly Graham Harman’s interpretation of Martin Heidegger’s tool analysis, in order to analyze the now famous moment when Tilted Arc was de-installed from Federal Plaza, Manhattan in 1989, this paper argues that the work was not in fact destroyed but rather that its ontological autonomy was even more absolutely revealed in that moment as such. Although it is the (...) case that art objects and sites are prone to discursive co-construction and evaluation, it is this analysis’ claim that they both are possessive of a deep, substantive form also, a form resistant to appropriation. Tilted Arc therefore revealed something even more insidious and dangerous to those who opposed it than the power of art to speak back to its surroundings. Rather, it uncovered the substantive objecthood of the site itself. (shrink)

The master narrative of Apartheid South Africa created a specific identity for white boys and men and, together with this identity, a very particular role and place within the South African context. This identity was exemplified in the men who were conscripted into the military from 1967 until 1994, and who participated in operations on the border regions of Namibia and Angola as well as within local townships in the war of liberation against apartheid and minority rule. Many veterans have (...) been left grappling not only with the traumas associated with combat but also with the loss of their identities as war heroes in a country under changed political control. As a result, many of their personal stories and experiences of combat have been silenced by society at large and also, to varying degrees, within their own families, the Church, and among the younger generation who have grown up under a different dispensation. The conflict between vacillating narratives of villains who fought on the wrong side of history and victims of a closed socialisation system has supported the identity struggle faced by many veterans today. Against this backstory, this article explores the effects of storytelling as a trauma release using a narrative approach.Contribution: This article offers a contribution to the use of storytelling in pastoral conversations as a trauma release for untold stories. This insight links to the focus and scope of the journal as a pastoral narrative approach has been used under the umbrella of Practical Theology. (shrink)

Ethicist assumptions about the causes and solutions of environmental problems are widely held within environmental philosophy. It is typically assumed that an important cause of problems are the attitudes towards the natural environment held by individuals and that problems can be solved by getting people to adopt a more ethical orientation towards the environment. This article analyses and criticises these claims. This paper examines Judith Shklar’s Legalism in light of the paradox that emerges clearly from a law-based approach to international crises that ought to be evaluated on the basis of whether the judicial initiative—the cases examined are primarily drawn from ad hoc UN Security Council tribunals—promote, in Shklar’s words, “decent politics.” The question of whether this notion is exclusively related to liberalism, and whether it may run contrary to the role of defense counsel in such trials—deeply anchored in the liberal (...) tradition of the protection of individual liberty, and yet confronted to the politics of international criminal law and international relations, however theorized—is fundamental, as “decent politics” compete with the legalistic imperatives of the defense, and the liberal foundation of the legal systems from which UN trials have emerged. Legalism provides a theoretical thread to examine the emergence of international criminal trials as well as the relation between the universality of law and history and the politics of memory, which figure prominently as political phenomena in these trials, but which may run contrary to the liberalism inherent in the legalist form. Stapp's attempt to derive Bell's Inequality from a weak locality condition while retaining indeterminism, requires careful scrutiny to ensure unambiguous definitions and valid reasoning. Such scrutiny reveals that the argument is fallacious. This result is obtained without commitment to any particular formal analysis of truth conditions for counterfactuals nor to conditions for world similarity.

What are the aims of legal philosophy? Which questions should it seek to address? How should legal philosophers approach and engage with their subject-matter, and what constraints are incumbent on them as they do so? What are the criteria of success of theories of law, and how do we know if they have been met? Can there be progress in legal philosophy? In Elucidating Law, Julie Dickson addresses these and other questions concerning the methodology, or the philosophy, of legal (...) philosophy and offers her own distinctive response to them. The book advocates that legal philosophers should espouse an approach that Dickson terms 'Indirectly Evaluative Legal Philosophy.' This distinctive approach can facilitate legal philosophers' understanding of aspects of the nature of law, whilst avoiding prematurely or inappropriately regarding law as inherently morally valuable. There is a lack of writing on the issue of the education rights of people with disabilities by authors of any theoretical persuasion. While the deficiency of theory may be explained by a variety of historical, philosophical and practical considerations, it is a deficiency which must be addressed. Otherwise, any statement of rights rings out as hollow rhetoric unsupported by sound reason and moral rectitude. This paper attempts to address this deficiency in education rights theory by postulating a communitarian theory (...) of the education rights of people with disabilities. The theory is developed from communitarian writings on the role of education in democratic society. The communitarian school, like the community within which it nests, is inclusive. Schools both reflect and model the shape of communitarian society and have primary responsibility for teaching the knowledge and virtues which will allow citizens to belong to and function within society. Communitarians emphasise responsibilities, however, as the corollary of rights and may require the individual good to yield to the community good when the hard cases arise. The article not only explains the basis of the right to an inclusive education, therefore, but also engages with the difficult issue of when such a right may not be enforceable. (shrink)

It is a rare patient who always does everything healthcare providers advise. Sometimes no harm comes from this; sometimes good does. But occasionally, great harm comes from not listening, as when it results in patients returning time and again for costly and invasive treatments of, say, infections, valve replacements, pressure ulcers, and so forth. No class of patients arouses more anger and resentment in healthcare providers, who often put out a call to invoke some version of the three strikes rule (...) and refuse care. And if the patients are also unemployed substance abusers who live in a local park, impolite or dangerous to staff, disruptive to other patients, and have intimidating visitors, the call to say “No” is louder. Can care ever be refused? If so, when? These are the questions we take up in this article. The answers we provide were developed as part of a Paraplegics and Quadriplegics with Pressure Ulcers Project carried out at Vancouver Hospital and Health Sciences Centre. Following an established usage, we refer to patients who exhibit a cluster of the above characteristics, the dominant one of which is a reluctance to heed medical advice, as “noncompliant patients.” This term is offensive to some, but the politically correct lexicon does not provide any alternative which is as short and clear or substantially different. We use the term as a convenient way of referring to a familiar class of patients and without any imputation of blame. (shrink)

Research suggests that the explicit reasoning we offer to ourselves and to others is often rationalization, that we act instead on instincts, inclinations, stereotypes, emotions, neurobiology, habits, reactions, evolutionary pressures, unexamined principles, or justifications other than the ones we think we’re acting on, then we tell a post hoc story to justify our actions. I consider two benefits of rationalization, once we realize that rationalization is sincere. It allows us to work out, under practical pressure of rational consistency, which are (...) good reasons to act on. Rationalization also prompts us to establish meaningful patterns out of merely permissible options. (shrink)

This paper proposes a logic, motivated by modal interpretations, in which every quantum mechanics propositions has a truth-value. This logic is completely classical, hence violates the conditions of the Kochen-Specker theorem. It is shown how the violation occurs, and it is argued that this violation is a natural and acceptable consequence of modal interpretations. It is shown that despite its classicality, the proposed logic is empirically indistinguishable from quantum logic.

I consider the fact that there are a number of interesting ways to ‘reconstruct’ quantum theory, and suggest that, very broadly speaking, a form of ‘instrumentalism’ makes good sense of the situation. This view runs against some common wisdom, which dismisses instrumentalism as ‘cheap’. In contrast, I consider how an instrumentalist might think about the reconstruction theorems, and, having made a distinction between ‘reconstructing’ quantum theory and ‘reinventing’ quantum theory, I suggest that there is an adequate instrumentalist approach to the (...) theory that invokes both. Various theorists contend that we may live in a computer simulation. David Chalmers in turn argues that the simulation hypothesis is a metaphysical hypothesis about the nature of our reality, rather than a sceptical scenario. We use recent work on consciousness to motivate new doubts about both sets of arguments. First, we argue that if either panpsychism or panqualityism is true, then the only way to live in a simulation may be as brains-in-vats, in which case it is unlikely that (...) we live in a simulation. We then argue that if panpsychism or panqualityism is true, then viable simulation hypotheses are substantially sceptical scenarios. We conclude that the nature of consciousness has wide-ranging implications for simulation arguments. (shrink)
