O presente artigo tem como finalidade apresentar um panorama geral acerca da realidade pastoral da região metropolitana de Campinas. Como todos os grandes centros urbanos, Campinas exibe uma condição bastante complexa, repleta de contradições, belezas e desafios. Jesus, como homem histórico, sensível e inserido nas realidades de seu tempo, respondeu também às situações de sua época e nos dá pistas para respondermos de modo satisfatório aos fiéis de nosso tempo. Neste artigo, para a atividade eclesial diante de tais realidades metropolitanas, (...) são enumeradas sugestões, assumidas em nosso sétimo Plano de Pastoral Orgânica da Arquidiocese, no que diz respeito às atuações de pastorais, movimentos e outros organismos. Dessa forma, visamos, na práxis de Jesus de Nazaré, tornar os pobres protagonistas de suas vidas no exercício da evangelização, na realidade pastoral em que vivemos. (shrink)

The main objective of this work is to understand the daily practices of user management in post-reformist devices in the Brazilian mental health field. Through Foucault's genealogical work on government practices, understood as forms of conducting the behavior of others, it is possible to open a possible field for the study of the practices of psi knowledge, considering them as forms of management that act by through the free and natural acts of individuals. More specifically, our goal is to examine (...) day-to-day practices on some reformist devices such as CAPS through user files. Basically, two driving models have been found in the new devices: 1) Cases with frank intervention of production of commitments and agreements with users, seeking the entry of this to varied activities and political leadership ; 2) Cases with little response from the user, in which the forms of conduction are implemented by policies of inclusion of family members and close reference characters in the management of the patient's life. The question of the subject seems to occupy much of the current psychiatric/psychological landscape. Some theoreticians affirm that the subject or the self is an imaginary fiction, not a substantial entity in whose structure causes of psychological disorders and their respective antidotes are latent. “Subject,” they continue, “is what the vernacular speech says it is, that is, a self-reference marker that indexes human organisms’ sensory/motor singularity.” This marker, however, has nothing in common with a supposed metaphysical ethereal substrate, made up (...) of particles such as will, freedom, autonomy, ineffable consciousness, reason, emotions, desires, beliefs, judgments, aspirations, or interests. Arguing for the theoretical importance of the concept of “subject” or “self” on behalf of the “psychiatric/psycho-pathological thinking” is justified in so far as, as Costa, Bezerra Jr., and Gama say, “this is still an indispensable concept for understanding the conditions for the gestation and functioning of psychological life.” In what sense are these concepts “indispensable?”All the hints suggest them as necessary complements for neurobiological investigations to become useful for clinical employment. Las naciones y pueblos indígenas presentan preocupantes índices respecto a la salud, así como otras carencias como la pérdida de sus tierras, la alimentación, la educación y, en general, el ejercicio de sus derechos, consagrados por organizaciones internacionales como la ONU y la OMS-OPS. En Ecuador, de acuerdo con el orden jurídico constitucional, se han instrumentado políticas de salud que incluyen el lineamiento general de un enfoque intercultural de la atenciónprimaria que incorpora los saberes y prácticas ancestrales. This paper examines undergraduate business students' perception of corporate social responsibility in cases in which they have not attended any specific course either dealing with CSR or providing training in ethics. A survey was conducted of 535 Spanish business students as future managers. The results show that the stakeholders' perspective deserves a huge attention for those students considering what the keys of business success are. Significant differences in perception were nevertheless identified when a multifactorial analysis was undertaken. Female students are (...) more concerned about CSR issues. The maximization of value for shareholders is less valued by second- and third-year students than by first-year ones. The findings point to a number of important orientations for the future development of university curriculum. (shrink)

In this article I argue that there are two different types of understanding: the understanding we get from explanations, and the understanding we get from unification. This claim is defended by first showing that explanation and unification are not as closely related as has sometimes been thought. A critical appraisal of recent proposals for understanding without explanation leads us to discuss the example of a purely classificatory biology: it turns out that such a science can give us understanding of the (...) world through unification of the phenomena, even though it does not give us any explanations. The two types of understanding identified in this paper, while strictly separate, do have in common that both consist in seeing how the individual phenomena of the universe hang together. Explanations give us connections between the phenomena through the asymmetric, ‘vertical’ relation of determination; unifications give us connections through the symmetric, ‘horizontal’ relation of kinship. We then arrive at a general definition of understanding as knowledge of connections between the phenomena, and indicate that there might be more than two types of understanding. (shrink)

The distinction between the body schema and the body image has become the stock in trade of much recent work in cognitive neuroscience and philosophy. Yet little is known about the interactions between these two types of body representations. We need to account not only for their dissociations in rare cases, but also for their convergence most of the time. Indeed in our everyday life the body we perceive does not conflict with the body we act with. Are the body (...) image and the body schema then somehow reshaping each other or are they relatively independent and do they only happen to be congruent? On the basis of the study of bodily hallucinations, we consider which model can best account for the body schema/body image interactions. (shrink)

I propose and defend a proof-based account of legal exceptions. The basic thought is that the characteristic behaviour of exceptions is to be explained in terms of the distinction, relative to some given decision-type C in some decision-making context, between two classes of relevant facts: those that may, and those that may not, remain uncertain if a token decision C is to count as correctly made. The former is the class of exceptions. A fact F is an exception relative to (...) some decision-type C, I claim, if (i) the ascertainment of F is sufficient for a token decision C not to count as correctly made, and (ii) the ascertainment of the negation of F is not necessary for a token decision C to count as correctly made. I also recuperate, reconstruct and discuss some of HLA Hart’s early views on defeasible judicial decisions. These two projects are closely connected: the latter is a vehicle for the former. (shrink)

The minimal God exemplifies essential omnipotence, omniscience, and moral perfection, but none of the other properties of the traditional God. I examine the consequences of the minimal God in augmented S5, S4, and Kρσ. The metaphysical consequences for the minimal God in S5 include the impossibility that God—or any other object—might acquire, lose, or exchange an essential property. It is impossible that an essentially divine being might become essentially human, for instance. The epistemological consequences include the impossibility of agnosticism—it is (...) impossible that P(◻︎FG |E) = P(~◻︎FG| E). Indeed, every weaker forms of agnosticism are also impossible—it is impossible that P(◻︎FG |E) = n, n(0 < n < 1). The metaphysical and epistemological consequences for the minimal God in S4 are equally untenable. I show that we can avoid all of these unwelcome epistemological consequences for the minimal God in Kρσ. But Kρσ has some extraordinary metaphysical consequences for the minimal God. This article develops a conceptual framework for regulating Artificial Intelligence (AI) that encompasses all stages of modern public policy-making, from the basics to a sustainable governance. Based on a vast systematic review of the literature on Artificial Intelligence Regulation (AIR) published between 2010 and 2020, a dispersed body of knowledge loosely centred around the “framework” concept was organised, described, and pictured for better understanding. The resulting integrative framework encapsulates 21 prior depictions of the policy-making process, aiming to achieve gold-standard societal (...) values, such as fairness, freedom and long-term sustainability. This challenge of integrating the AIR literature was matched by the identification of a structural common ground among different approaches. The AIR framework results from an effort to identify and later analytically deduce synthetic, and generic tool for a country-specific, stakeholder-aware analysis of AIR matters. Theories and principles as diverse as Agile and Ethics were combined in the “AIR framework”, which provides a conceptual lens for societies to think collectively and make informed policy decisions related to what, when, and how the uses and applications of AI should be regulated. Moreover, the AIR framework serves as a theoretically sound starting point for endeavours related to AI regulation, from legislation to research and development. As we know, the (potential) impacts of AI on society are immense, and therefore the discourses, social negotiations, and applications of this technology should be guided by common grounds based on contemporary governance techniques, and social values legitimated via dialogue and scientific research. For some of us, the defeasibility theory of knowledge remains the most plausible approach to the Gettier Problem. Epistemological fashion and faded memories notwithstanding, persuasive objections to the theory are very hard to find. The most impressive of those objections to the theory that have hitherto gone unanswered are examined and rejected here. These are objections put forward by Richard Feldman, Richard Foley, and John Turri. While these are all interesting, the objection recently put forward by Turri is, we think, (...) by far, the most serious threat to the theory that we have seen in a long time. A successful reply to it requires a surprising amount of care, as it turns out. If tenable, Turri's objection deals a devastating blow to the theory developed by Roderick Chisholm, Keith Lehrer, Peter Klein, Marshall Swain, Risto Hilpinen, John Pollock, and Paul Moser, among others. Under scrutiny, however, the threat proves illusory. It results from inattention to a crucial, but relatively subtle, aspect of.. (shrink)

The standard position on moral perfection and gratuitous evil makes the prevention of gratuitous evil a necessary condition on moral perfection. I argue that, on any analysis of gratuitous evil we choose, the standard position on moral perfection and gratuitous evil is false. It is metaphysically impossible to prevent every gratuitously evil state of affairs in every possible world. No matter what God does—no matter how many gratuitously evil states of affairs God prevents—it is necessarily true that God coexists with (...) gratuitous evil in some world or other. Since gratuitous evil cannot be eliminated from metaphysical space, the existence of gratuitous evil presents no objection to essentially omnipotent, essentially omniscient, essentially morally perfect, and necessarily existing beings. In this paper, I argue that unification is neither necessary nor sufficient for explanation. Focusing on the versions of the unificationist theory of explanation of Kitcher and of Schurz and Lambert, I establish three theses. First, Kitcher’s criterion of unification is vitiated by the fact that it entails that every proposition can be explained by itself, a flaw that it is unable to overcome. Second, because neither Kitcher’s theory nor that of Schurz and Lambert can solve the problems of asymmetry (...) and accidental generalizations, it follows that unification is not sufficient to ground explanation. Third, some good explanations are disunifying, which entails that unification is not necessary for explanation either. (shrink)

Those of us who have followed Fred Dretske’s lead with regard to epistemic closure and its impact on skepticism have been half-wrong for the last four decades. But those who have opposed our Dretskean stance, contextualists in particular, have been just wrong. We have been half-right. Dretske rightly claimed that epistemic status is not closed under logical implication. Unlike the Dretskean cases, the new counterexamples to closure offered here render every form of contextualist pro-closure maneuvering useless. But there is a (...) way of going wrong under Dretske’s lead. As the paper argues, Cartesian skepticism thrives on closure failure in a way that is yet to be acknowledged in the literature. The skeptic can make do with principles which are weaker than the familiar closure principles. But I will further claim that this is only a momentary reprieve for the skeptic. As it turns out, one of the weaker principles on which a skeptical modus tollens must rest can be shown false. (shrink)

Contra un presunto naturalismo de la filosofía de Nietzsche, este artículo reconstruye la noción nietzscheana de vida al hilo del tema de la interpretación. Se pretende mostrar que para este autor el problema de la vida excede todo marco estrictamente biologicista y se orienta en cambio hacia una dimensión ontológica, en tanto la interpretación representa la actividad configuradora de sentido, mediante la cual todo ser vivo genera y sostiene su realidad. El análisis de este proceso lleva a identificar varios niveles (...) de desarrollo de esta vida interpretante: la forma de vida meramente natural, la vida simbólica propia de los seres humanos y, en último término, la vida del conocimiento como forma de vida genuinamente filosófica. Desde este planteamiento diferenciado de la actividad interpretativa se pueden arrojar nuevas luces sobre la noción nietzscheana de perspectivismo. (shrink)

Half a century later, a Dretskean stance on epistemic closure remains a minority view. Why? Mainly because critics have successfully poked holes in the epistemologies on which closure fails. However, none of the familiar pro-closure moves works against the counterexamples on display here. It is argued that these counterexamples pose the following dilemma: either accept that epistemic closure principles are false, and steal the thunder from those who attack classical logic on the basis of similarly problematic cases—specifically, relevance logicians and (...) like-minded philosophers—or stick with closure and surrender to relevantist claims of failure in truth-preservation aimed at classical rules of inference. Classicist closure advocates find the promise of a way out of the dilemma in the works of Roy Sorensen and John Hawthorne. The paper argues against their pro-closure move and renews Robert Audi’s call for a theory of closure-failure. (shrink)

Scriven’s paradox of predictability arises from the combination of two ideas: first, that everything in a deterministic universe is, in principle, predictable; second, that it is possible to create a system that falsifies any prediction that is made of it. Recently, the paradox has been used by Rummens and Cuypers to argue that there is a fundamental difference between embedded and external predictors; and by Ismael to argue against a governing conception of laws. The present paper defends a new diagnosis (...) of the roots of the paradox. First, it is argued that the unpredictability has to be understood in the light of Turing’s famous results about computability, in particular his proof that there is no solution to the ‘halting problem.’ This allows us to see that previous analyses of the paradox were either mistaken or not fully adequate. Second, the sense of paradox that nevertheless remains is traced to the idea that rational behaviour is not dependent on contingent environmental circumstances: that it is always up to us to engage in activities such as rational prediction or rational belief. The paradox of predictability teaches us that this idea, natural though it may be, is mistaken. (shrink)

Nick Trakakis and Yujin Nagasawa criticise the argument in Almeida and Oppy . According to Trakakis and Nagasawa, we are mistaken in our claim that the sceptical theist response to evidential arguments from evil is unacceptable because it would undermine ordinary moral reasoning. In their view, there is no good reason to think that sceptical theism leads to an objectionable form of moral scepticism. We disagree. In this paper, we explain why we think that the argument of Nagasawa and (...) Trakakis fails to overthrow our objection to sceptical theism. (shrink)

Successful accounts of analogy in law have two burdens to discharge. First, they must reflect the fact that the conclusion of an argument by analogy is a normative claim about how to decide a certain case. Second, they must not fail to accord relevance to the fact that the source case was authoritatively decided in a certain way. We argue in the first half of this paper that the common view of the structure of analogical arguments in law cannot overcome (...) these hurdles. Two apparently mutually exclusive ideas about the relation between contrastive and non-contrastive explanations can be found in the literature. According to contrastivists, all explanation is contrastive explanation and the supposed existence of non-contrastive explanations can be revealed to be an illusion. According to non-contrastivists, on the other hand, contrastive explanation can be fully analysed in terms of non-contrastive explanation, and is thus not of fundamental importance. In the current article, I discuss the main arguments in favour of and against each (...) of the two positions. This discussion leads to the idea that contrastive explanations are to be understood as parts of a bigger, more complete non-contrastive explanation; but that all actual explanations explain only a limited set of contrasts. I conclude that, once the relation between contrastive and non-contrastive explanations is understood correctly, there remains no substantial issue to divide contrastivism and non-contrastivism. In this paper we respond to criticisms by Michael Bergmann and Michael Rea in their “In Defense of Sceptical Theism : A Reply to Almeida and Oppy,” Australasian Journal of Philosophy 83.

Sentences such as "The author started the book" are indeterminate because they do not make explicit what the subject (the author) started doing with the object (the book). In principle, indeterminate sentences allow for an infinite number of interpretations. One theory, however, assumes that these sentences are resolved by semantic coercion, a linguistic process that forces the noun "book" to be interpreted as an activity (e.g., writing the book) or by a process that interpolates this activity information in the resulting (...) enriched semantic composition. An alternative theory, pragmatic, assumes classical semantic composition, whereby meaning arises from the denotation of words and how they are combined syntactically, with enrichment obtained via pragmatic inferences beyond linguistic-semantic processes. Cognitive neuroscience studies investigating the neuroanatomical and functional correlates of indeterminate sentences have shown activations either at the ventromedial pre-frontal cortex or at the left inferior frontal gyrus. These studies have supported the semantic coercion theory assuming that one of these regions is where enriched semantic composition takes place. Employing fMRI, we found that indeterminate sentences activate bilaterally the superior temporal gyrus, the right inferior frontal gyrus, and the anterior cingulate cortex, more so than control sentences ("The author wrote the book"). Activation of indeterminate sentences exceeded that of anomalous sentences ("…drank the book") and engaged more left- and right-hemisphere areas than other sentence types. We suggest that the widespread activations for indeterminate sentences represent the deployment of pragmatic-inferential processes, which seek to enrich sentence content without necessarily resorting to semantic coercion. According to Paul Draper and Ryan Nichols the practice of philosophy of religion—and especially its theistically committed practitioners—regularly violate norms of rationality, objectivity, and impartiality in the review, assessment, and weighing of evidence. (Draper and Nichols, 2013). We consider the charge of epistemic partisanship and show that the observational data does not illustrate a norm-violating form of inquiry. The major oversight in the charge of epistemic partiality is the epistemically central role of prior probabilities in determining the significance of incongruent (...) evidence. We argue that reasonably divergent views on the likelihood of theism on incongruent evidence can also account for differences in significance. We conclude that it is an epistemic requirement that committed theists regard incongruent evils as much less significant evidence against theism than do lukewarm theists, agnostics, or atheists. Differences in the significance of evidence quite properly reflect differences in commitments to theism. (shrink)

Husserl's two notions of "definiteness" enabled him to clarify the problem of imaginary numbers. The exact meaning of these notions is a topic of much controversy. A "definite" axiom system has been interpreted as a syntactically complete theory, and also as a categorical one. I discuss whether and how far these readings manage to capture Husserl's goal of elucidating the problem of imaginary numbers, raising objections to both positions. Then, I suggest an interpretation of "absolute definiteness" as semantic completeness and (...) argue that this notion does not suffice to explain Husserl's solution to the problem of imaginary numbers. Woodward’s interventionist theory of causation is beset by a problem of circularity: the analysis of causes is in terms of interventions, and the analysis of interventions is in terms of causes. This is not in itself an argument against the correctness of the analysis. But by requiring us to have causal knowledge prior to making any judgements about causation, Woodward’s theory does make it mysterious how we can ever start acquiring causal knowledge. We present a solution to this problem by (...) showing how the interventionist notion of causation can be rationally generated from a more primitive agency notion of causation. The agency notion is easily and non-circularly applicable, but fails when we attempt to capture causal relations between non-actions. We show that the interventionist notion of causation serves as an appropriate generalisation of the agency notion. Furthermore, the causal judgements based on the latter generally remain true when rephrased in terms of the former, which allows one to use the causal knowledge gained by applying the agency notion as a basis for applying Woodward’s interventionist theory. We then present an overview of relevant empirical evidence from developmental psychology which shows that our proposed rational reconstruction lines up neatly with the actual development of causal reasoning in children. This gives additional plausibility to our proposal. The article thus provides a solution to one of the main problems of interventionism while keeping Woodward’s analysis intact. (shrink)

The book discusses the structure, content, and evaluation of cosmological arguments. The introductory chapter investigates features essential to cosmological arguments. Traditionally, cosmological arguments are distinguished by their appeal to change, causation, contingency or objective becoming in the world. But none of these is in fact essential to the formulation of cosmological arguments. Chapters 1-3 present a critical discussion of traditional Thomistic, Kalam, and Leibnizian cosmological arguments, noting various advantages and disadvantages of these approaches. Chapter 4 offers an entirely new approach (...) to the cosmological argument - the approach of theistic modal realism. The proper explananda of cosmological arguments on this approach is not change, causation, contingency or objective becoming in the world. The proper explananda is the totality of metaphysical reality - all actualia and all possibilia. The result is the most compelling and least objectionable version of the cosmological argument. Forsyth’s (1980) Ethics Position Questionnaire and Hunt et al.’s (1989) Corporate Ethical Value Questionnaire are used to examine the ethical ideologies of senior managers from organizations listed in the Australian Stock Exchange. The results indicate how corporate ethical values, religion, gender, and age are related to the idealism and relativism of senior Australian managers. After discussing the results, limitations of the study are offered. Finally, managerial implications are provided and recommendations for future research are given.

Elizabeth Anscombe’s classic paper Causality and Determination claims that causation can be perceived. It also defends causal singularism, the idea that the causal relation is fundamentally between the particular cause and effect, and does not depend on regularities holding elsewhere in the universe. But does the former furnish an argument for the latter? The present paper analyses a special type of causal experience involving emotional reactions to present stimuli; for instance, being frightened by a spider. It argues that such experiences (...) are strongly local, in the sense that they justify belief in a local causal relation independently of our knowledge about events elsewhere in the universe. If this analysis is correct, Humean regularity theories of causation are false; and all other non-singularist theories of causation face a difficult explanatory challenge. This means that the case for causal singularism comes out considerably strengthened. (shrink)

Sometimes Strauss argues as if he thought it possible to understand man without raising questions about his relations to other things, and hence about his place in the whole. But when they are viewed in their broader context, such arguments are seen not to be his final word. Man's humanity cannot be understood in its own terms alone. The human soul differs from everything else in that it is "... open to the whole and therefore more akin to the whole (...) than anything else is." In ordinary usage, "whole" implies completeness and autonomy. But the openness of the soul--i.e., of a part--to the whole can only mean that the whole is open to itself. The whole is, then, not, in the ordinary sense of the term, whole. Nor is the soul which is "open" to it. Stripped of myths, "... the human soul is... more akin to the whole than anything else is" because neither of them is whole. The same conclusion follows when one tries to understand the definition of the philosopher as the man animated by quest for knowledge of the whole. Qua philosopher he knows neither that there is a whole, nor what it might be if there were one. To define the philosopher as the man who knows that he does not know only paraphrases the difficulty. It does not solve it. For "know" is here used equivocally. The same equivocation is at play in the comment "... one cannot know that one does not know without knowing what one does not know". Admittedly "knowledge of ignorance is not ignorance." The philosopher believes and perhaps divines more than he actually knows. All men do. The essential difference between the philosopher and other men may well consist in the fact that the philosopher distinguishes more conscientiously than do others between what he knows and what he believes, and that he strives more single-mindedly than do they to transform as large a share of his beliefs as possible into knowledge. He may conceivably at some point be said to have reached the stage where his aspirations have become reasoned expectations. But that is as far as he can possibly go as long as he remains a philosopher and has not become a wise man or a god. Until and unless the philosopher knows, in the strong sense of the term, he can no more decide whether his aspirations could be fulfilled than he can swim before getting wet. (shrink)

Na obra, a autora analisa detidamente alguns pensadores ligados à tradição alemã pós-Hegel: Heinrich Heine, Berthlod Auerbach, Moses Hess, Karl Marx, Johann Jacoby, Jakob Stern e Gueorgui Plekhanov. Seu foco é o modo como todos esses utilizaram o pensamento de Espinosa para compreender a noção de atividade e a possibilidade de transformação social. Espinosa era fundamental para o tema, pois seu (...) pensamento permitiria unir a ação humana à sua completa determinação frente à necessidade presente na natureza, duas ideias indispensáveis para um século no qual a ciência se desenvolvia rapidamente e para um país que acabara de presenciar as revoluções nas terras vizinhas. Matysik, então, nos oferece a oportunidade de entender a riqueza do espinosismo, dadas as inúmeras possibilidades de interpretação das obras do filósofo neerlandês, utilizadas tanto para fins revolucionários quanto reformistas. Além disso, a partir da segunda metade do livro, a autora nos convoca para discutir as relações entre a filosofia da completa determinação e os movimentos com raízes no socialismo marxista, apresentando os principais problemas que surgiam - e ainda surgem - para os autores que buscavam traçar tal conexão. Recent interest in the idea that there can be scientific understanding without explanation lends new relevance to Duhem's notion of natural classification. According to Duhem, a classification that is natural teaches us something about nature without being explanatory. However, Duhem's conception of naturalness leaves much to be desired. In this paper, I argue that we can measure the naturalness of classification by using an amended version of the notion of unification as defined by Schurz and Lambert. If this thesis is (...) correct, it both leads to a better conceptual understanding of scientific understanding, and also gives the nascent literature on this topic some much-needed precision. On the face of it, On Tyranny is a straightforward commentary on Xenophon's dialogue Hiero or Tyrannicus. As such it is a very model of thoroughness and learning. It amply repays careful study, and it goes a long way toward explaining Strauss's influence in training a generation of scholars. The dialogue proper takes up just under 20 pages. Its analysis runs to 90-odd pages, followed by another 30 pages of tightly packed notes that are largely devoted to parallels between the (...) Hiero, Xenophon's teaching as a whole, and the teachings of Plato, of Aristotle and, to a lesser extent, of Cicero. What at first appears as an exercise in textual analysis soon reveals itself as a much broader undertaking: the delineation of the main features of classical political philosophy. Strauss does not mean to deny that differences in perspective, procedure, and even conclusions separate the major representatives of classical political philosophy. He does want to maintain, however, that their agreements are more fundamental than are their differences. But even this is incidental to his main purpose: to understand classical political philosophy for the guidance it might provide in understanding the great moral and political problems that confront us here and now. He conceives of these problems in large measure as the consequence of modern philosophy, of what he calls "the modern project." But modern philosophy cannot be understood on its own terms alone any more than it can be understood by directly confronting it with the phenomena. For it does not owe its most characteristic features to such a confrontation. It owes them, rather, to the fact that, from its very outset, it defined itself in explicit contrast to classical philosophy. Modern philosophy is essentially derivative. It presupposes the tradition it opposes. Classical philosophy, and in particular classical political philosophy, on the other hand "... belongs to the fertile moment when all political traditions were shaken, and there was not yet in existence a tradition of political philosophy." Hence "only in the light of the quarrel between the ancients and the moderns can modernity be understood. By rediscovering the urgency of this quarrel we return to the origins of modernity." It further follows from this line of reasoning that the quarrel must be re-kindled if we are once again to gain access to the phenomena themselves. To this end historical studies become necessary which do not presuppose that the whole issue has, for all intents and purposes, been settled in favor of the moderns. The most basic and most constant assumption of Strauss's historical studies is, therefore, the assumption that classical philosophy is truer than are any of the teachings that criticize or reject it. The passion and the inventiveness with which he defends this assumption sufficiently prove that he does not put it forward merely for reasons of method or of rhetoric. Yet it seems to fall short of being his settled belief. By stressing his agreements with the ancients and his disagreements with the moderns, by holding the moderns responsible for the great problems that face us while calling for a restoration of classical political philosophy, he fosters the impression that his own views coincide fully with those of classical political philosophy. But even if classical political philosophy spoke with a single clear voice, the fact remains that "no competent man of our age would regard as simply true the complete teaching of any thinker of the past." Presumably only someone who thinks himself competent would issue such a warning. (shrink)

Our paper has three parts. In Part 1, we discuss John Gardner’s thesis that the non-elliptical ascription of agency to law is a necessary and irreducible part of any adequate explanation of the activities of legal officials. We consider three explananda which might conceivably necessitate this ascription, and conclude that none in fact does so. In Part 2, we discuss two other theses of Gardner’s: that it makes no sense to ascribe to law the claim that there are legal obligations (...) , and that law’s claim is the claim that there are moral obligations . We take issue with Gardner’s arguments for , and suggest that is unwarranted in the absence of an argument that law makes any claims at all. In Part 3, we briefly argue that, insofar as it issues requirements, there are certain claims that law cannot but make. We conclude that if Gardner is right that law’s claims are those of certain of its officials, it is law-making and not law-applying officials who make law’s claim. (shrink)

I examine the difficulties involved in the Aristotelian proposal to identify the knowledge of “what it is” and “why it is”, in order to better understand the outlines that delimit it. I propose that the connections by which Aristotle links definition and explanation, and hence essence and cause, depend on the mutual convertibility between nominal expressions and predicative sentences.
