A common objection to sense-datum theories of perception is that they cannot give an adequate account of the fact that introspection indicates that our sensory experiences are directed on, or are about, the mind-independent entities in the world around us, that our sense experience is transparent to the world. In this paper I point out that the main force of this claim is to point out an explanatory challenge to sense-datum theories.

The controversy over brain death and the dead donor rule continues unabated, with some of the same key points and positions starting to see repetition in the literature. One might wonder whether some of the participants are talking past each other, not all debating the same issue, even though they are using the same words (e.g., “death”). One reason for this is the complexity of the debate: It’s not merely about the nature of human life and death. The disjunctive theory of perception claims that we should understand statements about how things appear to a perceiver to be equivalent to statements of a disjunction that either one is perceiving such and such or one is suffering an illusion (or hallucination); and that such statements are not to be viewed as introducing a report of a distinctive mental event or state common to these various disjoint situations. The report estimated almost 50,000 deaths per year nationally due to medical mistakes, making it a leading cause of death. IOM speculated (...) that more than half of the deaths related to medical error are preventable. The IOM report shocked the public and medical professionals alike, sparking a national discussion of how to make the health care system safer. This multifaceted issue has profound implications for all aspects of health care, from the very personal--e.g., the relationship of caregiver and patient--to the societal--e.g., a nation's responsibility to its citizens.On 15 May 2000, the University of Pittsburgh Medical Center hosted an ethics conference devoted to the topic of medical mistakes. The goal was to bring together experts from various disciplines, before an audience of both providers and patients, to discuss medical mistakes and their implications. In this issue of the Kennedy Institute of Ethics Journal, we present selected papers resulting from that conference. These papers reflect not only the original oral presentations, but also much of the discussion those presentations generated. Three key perspectives on the ethics of medical mistakes are offered: historical, legal, and institutional.Rosa Lynn Pinkus offers a revealing historical perspective on the ethics of medical mistakes. In analyzing the history of mistake reporting in neurosurgery, she shows how the notion of a mistake developed only as the notion of a standard of practice emerged. Although much of managed care is directed toward systematically fostering a standard of care, this pursuit is relatively new in health care. One might speculate that as more standards are created, mistakes--defined as deviations from standard practice--must increase. If deviation from standard practice is overly castigated, however, then needed innovation in practice may be stifled. Interestingly, as Pinkus discusses, medical malpractice suits quickly followed the emergence of practice standards, driving the initial open reporting of mistakes underground. [End Page 115]Taking up the issue of medical malpractice, Thomas May and Mark Aulisio consider the ramifications of the current malpractice system for mistake prevention. The current system, they argue, while failing to adequately achieve its purported goals of deterring medical mistakes and compensating victims, itself creates a climate that deters the open reporting of mistakes by engendering fear and shame in clinicians. According to May and Aulisio, this failure to report medical mistakes openly has serious ramifications. Chief among these is the inability to do root cause analysis of mistakes, and then, where possible, to implement safeguards to minimize the occurrence of future mistakes. Ultimately, both the prevention of medical mistakes and the goals of malpractice litigation itself will be better served if substantial malpractice reform is undertaken.Andy Thurman argues that even in the current climate institutions ought to have a policy (and practice) of admitting to and openly reporting medical mistakes. Thurman argues that doing so not only is the right thing to do, but is also in the interest of institutions. Interestingly, he contends that failing to admit and openly report mistakes is both at odds with the mission of health care institutions and puts them at higher risk of litigation, and liability. In light of this, Thurman then suggests an institutional process for handling medical mistakes.Michael DeVita concedes that disclosing mistakes is widely supported by the health professionals' principles of ethics, but argues that there are a number of factors that conspire to make doing so a very difficult task. This article defends the Fixed Point Thesis: that it is always a rational mistake to have false beliefs about the requirements of rationality. The Fixed Point Thesis is inspired by logical omniscience requirements in formal epistemology. It argues to the Fixed Point Thesis from the Akratic Principle: that rationality forbids having an attitude while believing that attitude is rationally forbidden. It then draws out surprising consequences of the Fixed Point Thesis, for instance that certain kinds of a priori justification are (...) indefeasible and that misleading all-things-considered evidence about rational requirements is impossible. Finally, the Fixed Point Thesis is applied to defend the Right Reasons position on peer disagreement, according to which an agent who has drawn the correct conclusion from her evidence should retain belief in that conclusion even in the face of disagreeing peers. Disjunctivism about perceptual appearances, as I conceive of it, is a theory which seeks to preserve a naïve realist conception of veridical perception in the light of the challenge from the argument from hallucination. The naïve realist claims that some sensory experiences are relations to mind-independent objects. That is to say, taking experiences to be episodes or events, the naïve realist supposes that some such episodes have as constituents mind-independent objects. In turn, the disjunctivist claims that in a case of (...) veridical perception like this very kind of experience that you now have, the experiential episode you enjoy is of a kind which could not be occurring were you having an hallucination. The common strategy of arguments from hallucination set out to show that certain things are true of hallucinations, and hence must be true of perceptions. For example, it is argued that hallucinations must have non-physical objects of awareness, or that such states are not relations to anything at all, but are at best seeming relations to objects. In insisting that veridical perceptual experience is of a distinct kind from hallucination, the disjunctivist denies that any of these conceptions of hallucination challenges our conception of veridical perceptions as relations to mind-independent objects. More specifically, I assume that the disjunctivist advocates naïve realism because they think that this position best articulates how sensory experience seems to us to be just through reflection. If the disjunctivist is correct in this contention, then anyone who accepts the conclusion of the argument from hallucination must also accept that the nature of sensory experience is other than it seems to us to be. In turn, one may complain that any such error theory is liable to lead to sceptical consequences. A Humean scepticism about the senses launches a challenge about our knowledge of the world through questioning the conception we have of what sense experience is, and how it can provide knowledge of the world. Michael G. Titelbaum presents a new Bayesian framework for modeling rational degrees of belief—the first of its kind to represent rational requirements on agents who undergo certainty loss.

In this chapter, we explore the role of habit in giving shape to conscious experience and importantly to our pre-reflective awareness of ourselves which includes the sense of mineness that accompanies our conscious experience. For the most part, discussions in philosophy of mind and phenomenology concerning pre-reflective self-awareness are focused on determining the relationship between phenomenal consciousness and selfhood. For this reason perhaps, the existence of pre-reflective self-awareness is usually appealed to as evidence for a form of selfhood that appears (...) within conscious experience as a component of its synchronic unity. In this chapter, however, we will concern ourselves with the pre-reflective sense of ourselves that appears in conscious experience as it pertains to the diachronic unity of the self—that is the sense of a unitary self as existing over the course of multiple episodic experiences. Our aim is to provide a phenomenological account of the relationship between the minimal, pre-reflective sense of self and what is often termed the ‘narrative self.’ We will argue that habits play a role in preserving the significance of our past in our present experience and in unifying our experience as a self for whom the world is present across disparate episodes of experience. Different people reason differently, which means that sometimes they reach different conclusions from the same evidence. We maintain that this is not only natural, but rational. In this essay we explore the epistemology of that state of affairs. First we will canvass arguments for and against the claim that rational methods of reasoning must always reach the same conclusions from the same evidence. Then we will consider whether the acknowledgment that people have divergent rational reasoning methods should undermine one’s confidence (...) in one’s own reasoning. Finally we will explore how agents who employ distinct yet equally rational methods of reasoning should respond to interactions with the products of each others’ reasoning. We find that the epistemology of multiple reasoning methods has been misunderstood by a number of authors writing on epistemic permissiveness and peer disagreement. (shrink)

Listening to someone from some distance in a crowded room you may experience the following phenomenon: when looking at them speak, you may both hear and see where the source of the sounds is; but when your eyes are turned elsewhere, you may no longer be able to detect exactly where the voice must be coming from. With your eyes again fixed on the speaker, and the movement of her lips a clear sense of the source of the sound will (...) return. This ‘ventriloquist’ effect reflects the ways in which visual cognition can dominate auditory perception. And this phenomenological observation is one that you can verify or disconfirm in your own case just by the slightest reflection on what it is like for you to listen to someone with or without visual contact with them. Comparisons, and by that I mean the hunt for essential similarities or at least serious family resemblances, between the ethical views of Western and non-Western thinkers have been a staple of comparative philosophy for quite some time now. Some of these comparisons, such as between the views of Aristotle and Confucius, seem especially apt and revealing. However, I’ve often wondered whether Western “ethical theory”—virtue ethics, deontology, or consequentialism—is always the best lens through which to approach non-Western ethical thought. For many, the case of the Exxon Valdez oil spill has become a symbol of unethical corporate behavior. Had Exxon’s managers not callously pursued their own interests at the expense of the environment and other parties, the accident would not have happened. In this paper, we (1) present a short case study of the Valdez incident; (2) argue that many analyses of the case either ignore or fail to give sufficient weight to the uncertainties managers often face when they make (...) decisions; and (3) propose a framework for moral management grounded in principles of communicative ethics, moral dialogue, and in the non-traditional ideas of many current management and behavioral decision theorists. From this view, the moral manager is not expected to know the “correct” answer to every ethical issue, but rather to participate responsibly in an open dialogue with other interested parties. Begins by explaining then proving a generalized language dependence result similar to Goodman's "grue" problem. I then use this result to cast doubt on the existence of an objective evidential favoring relation (such as "the evidence confirms one hypothesis over another," "the evidence provides more reason to believe one hypothesis over the other," "the evidence justifies one hypothesis over the other," etc.). Once we understand what language dependence tells us about evidential favoring, our options are an implausibly strong conception of (...) the a priori, a hard externalism on which agents are unable to determine what their evidence favors, or a subjectivist view that makes evidential favoring relative to features of the agent. Can self-locating beliefs be relevant to non-self-locating claims? Traditional Bayesian modeling techniques have trouble answering this question because their updating rule fails when applied to situations involving contextsensitivity. This essay develops a fully general framework for modeling stories involving context-sensitive claims. The key innovations are a revised conditionalization rule and a principle relating models of the same story with different modeling languages. The essay then applies the modeling framework to the Sleeping Beauty Problem, showing that when Beauty awakens her degree (...) of belief in heads should be one-third. This demonstrates that it can be rational for an agent who gains only self-locating beliefs between two times to alter her degree of belief in a non-self-locating claim. (shrink)

In der vorliegenden Arbeit soll die These mitsamt den sich aus ihr ergebenden Konsequenzen etabliert werden, dass die Disziplin Gerechtigkeitstheorie durch Entwicklungen in der Disziplin Erkenntnistheorie in dem Sinne beeinflusst wird, dass erstere sich von letzterer Anregungen im grundsätzlichen methodischen Vorgehen holt. Diese These soll sowohl unter Bezug auf allgemeine Argumente plausibilisiert als auch durch eine Rekonstruktion gerechtigkeitstheoretischer Ansätze aus erkenntnistheoretisch informierter Perspektive am konkreten Material belegt werden. Eine Konsequenz, die sich aus dieser These ableiten lässt, ist die Vorhersage, dass (...) die beiden bis anhin vorherrschenden Paradigmen innerhalb der Gerechtigkeitstheorie - Neoaristotelismus und Neokantianismus - nur schwer in der Lage sein werden, ihre jeweilige Schwäche, nämlich Kulturrelativismus respektive leeren Universalismus, zu überwinden, weil diese Schwäche eine notwendige Folge aus ihrer Anlehnung an die ihnen jeweils zugrunde liegende Erkenntnistheorie darstellt und somit auf basaler Ebene der Theorie verortet ist. Eine andere Konsequenz besteht darin, dass es auf Basis dieser These möglich wird, zwei aktuelle, bislang aber nur selten miteinander assoziierte gerechtigkeitstheoretische Ansätze, die sich beide gegen die vorherrschenden Paradigmen wenden - nämlich der Ansatz Amartya Sens und derjenige Axel Honneths -, als ein und derselben philosophischen Theorietradition zugehörig auszuweisen: dem Pragmatismus. Unter explizitem Anschluss an selbige Theorietradition sollen diese beiden gerechtigkeitstheoretischen Ansätze zudem zu einem Ansatz weiterentwickelt werden, der als "Gerechtigkeitstheorie als historischer Experimentalismus" bezeichnet wird. The Sleeping Beauty Problem attracts so much attention because it connects to a wide variety of unresolved issues in formal epistemology, decision theory, and the philosophy of science. The problem raises unanswered questions concerning relative frequencies, objective chances, the relation between self-locating and non-self-locating information, the relation between self-location and updating, Dutch Books, accuracy arguments, memory loss, indifference principles, the existence of multiple universes, and many-worlds interpretations of quantum mechanics. Gleichzeitig zu der in den letzten Jahren geringer werdenden Akzeptanz des globalen Kapitalismus ist eine kritische Philosophie der Arbeit wieder erstarkt, die nach den normativen Anforderungen fragt, denen moderne Arbeitsformen Rechnung zu tragen haben. Diese Philosophie der Arbeit soll hier in begrifflicher Hinsicht durch eine Anbindung an empirische Untersuchungen zu den Erfahrungen der Arbeiter weitergeführt werden. Der Blick auf diese empirischen Untersuchungen macht eine neue Art von Entfremdung evident – hier genannt: Entfremdung von sozialen Kontakten. Auf dieser empirischen Erkenntnis und (...) auch auf deren wissenschaftstheoretischen Implikationen basierend argumentiert der Aufsatz für eine Erweiterung von Axel Honneths Theorie der Arbeit. Abstract. Richard Feldman’s Uniqueness Thesis holds that “a body of evidence justifies at most one proposition out of a competing set of proposi- tions”. The opposing position, permissivism, allows distinct rational agents to adopt differing attitudes towards a proposition given the same body of evidence. We assess various motivations that have been offered for Uniqueness, including: concerns about achieving consensus, a strong form of evidentialism, worries about epistemically arbitrary influences on belief, a focus on truth-conduciveness, and consequences for peer disagreement. (...) We argue that each of these motivations either misunderstands the commitments of permissivism or is question-begging. Better understanding permissivism makes it a much more plausible position.
