Over the last couple of decades, oocyte donation has become common, important, and sometimes lucrative. Women who donate eggs are often offered fees, though ostensibly only to offset their expenses and limited to no more than $10,000, following recommendations adopted by the fertility industry. Is the industry adhering to its recommendations? A study of advertisements published in college newspapers raises questions.

The view that species are individuals, as developed by Ghiselinand Hull, has been touted as explaining the role of type specimens intaxonomy. The kinship of this explanation with the Kripke-Putnam theoryof names has long been recognized. In light of this kinship, however,Hull's account of type specimens can be seen to entail two relatedinscrutability problems – unreasonable limits placed on the natureand extent of biological knowledge. Philosophical writing on the welfare state has taken a defensive turn in recent years, largely in response to two related phenomena: the re-emergence of pro-market ideologies in the larger political culture and the imperiled condition of real world welfare states in a global economy in which national governments have diminishing capacities for shaping the social and economic lives of their citizens. But thanks in part to the tireless advocacy of Philippe Van Parijs, an even more radically redistributive form of public (...) provision than the welfare state has come onto the intellectual agenda—and the political agenda too, at least in Belgium and the Netherlands. Van Parijs proposes that all citizens be accorded an unconditional “basic income grant” as large as is compatible with the need to generate as much wealth as possible for redistribution. By now, this idea has many defenders. It also boasts a genealogy extending back to such writers as Tom Paine, François Huet, Edward Bellamy and G. D. H. Cole. But Van Parijs has become its best-known and most adept philosophical proponent, and this book represents his most sustained effort to date to investigate its normative foundations. (shrink)

This bold and unabashedly utopian book advances the thesis that Marx's notion of communism is a defensible, normative ideal. However, unlike many others who have written in this area, Levine applies the tools and techniques of analytic philosophy to formulate and defend his radical, political programme. The argument proceeds by filtering the ideals and institutions of Marxism through Rousseau's notion of the 'general will'. Once Rousseau's ideas are properly understood it is possible to construct a community of equals who share (...) some vision of a common good that can be achieved and maintained through cooperation or coordination that is at once both voluntary and authoritative. The book engages with liberal theory in order to establish its differences from Rousseauean-Marxian political theory. This provocative book will be of particular interest to political philosophers and political scientists concerned with Marxism, socialist theory and democratic theory. (shrink)

It is universally agreed that involuntary unemployment is an evil for unemployed individuals, who lose both income and the non-pecuniary benefits of paid employment, and for society, which loses the productive labor that the unemployed are unable to expend. It is nearly as widely agreed that there is at least a prima-facie case for alleviating this evil – for reasons of justice and/or benevolence and/or social order. Finally, there is little doubt that the evils of involuntary unemployment cannot be adequately (...) addressed in contemporary societies without state intervention – whether through monetary or fiscal policies, cash payments or other subsidies to the unemployed, direct provision of employment by the state, or some combination of these measures. In keeping with other recent efforts, Fodor's CONCEPTS focuses on the metaphysics of conceptual content, bracketing such epistemological questions as, "How can we know the contents of our concepts?" Fodor's metaphysical account of concepts, called "informational atomism," stipulates that the contents of a subject's concepts are fixed by the nomological lockings between the subject and the world. After sketching Fodor's "what else?" argument in support of this view, we offer a number of related criticisms. All point to the same conclusion: (...) Capitalizing on the hype surrounding stem cell research, numerous clinics around the world offer “stem cell therapies” for a variety of medical conditions. Despite questions about the safety and efficacy of these interventions, anecdotal evidence suggests a relatively large number of patients are traveling to receive these unproven treatments — a practice called “stem cell tourism.” Because these unproven treatments pose risks to individual patients and to legitimate translational stem cell research, stem cell tourism has generated substantial policy concern and (...) inspired attempts to reduce these risks through the development of guidelines for patients and medical practitioners. This paper examines the roles and responsibilities of physicians in patients' home countries with respect to patients' decisions to try unproven stem cell therapies abroad. Specifically, it examines professional guidance from two organizations — the American Medical Association and the International Society for Stem Cell Research — and assesses physicians' professional and legal obligations to patients considering unproven stem cell therapies. Then, drawing on qualitative interviews conducted with patients who traveled abroad for unproven stem cell treatments, it explores the roles that physicians actually play in patients' decisions and compares these actual roles with their professional and legal responsibilities. The paper concludes with a discussion of strategies to help improve the guidance physicians provide to patients considering unproven treatments. (shrink)

Stem cell science, using both embryonic and a variety of tissue-specific stem cells, is advancing rapidly and offers promise to improve medical care in the future. Yet, with the notable exception of hematopoietic stem cell transplantation, a long-established approach to treating certain cancers of the blood system, this promise is long term and most stem cell research focuses on basic scientific questions or the collection of pre-clinical data. Although some clinical trials are underway, most are focused on safety, and novel (...) effective therapy is likely a long way off. Despite the preliminary nature of most stem cell research, however, numerous clinics around the world offer stem cell “therapies” to patients today outside the context of a clinical trial. Although the number of patients who have received these stem cell-based interventions is unknown, anecdotal reports suggest a substantial population of patients is willing to try them, despite unresolved questions about their safety and efficacy. Contemporary process metaphysics has achieved a number of important results, most significantly in accounting for emergence, a problem on which substance metaphysics has foundered since Plato. It also faces trenchant problems of its own, among them the related problems of boundaries and individuation. Historically, the quest for ontology may thus have been largely responsible for the persistence of substance metaphysics. But as Plato was well aware, an ontology of substantial things raises serious, perhaps insurmountable problems for any account of our (...) epistemic access to such things. Physical things are subject to change, and as such, they are poor objects of knowledge—if knowledge is to be more reliable than mere opinion. There is a reading of Plato’s Theaetetus on which knowledge may be understood as a relation between an epistemic subject and a logos, where logoi are intrinsically dialectical, and where dialectic is a kind of intersubjective activity. Insofar as this epistemology may be attributed to Plato, the project of this paper is Platonic in spirit. It is also, in a sense, Kantian, in that it divorces ontology from the search for things-in-themselves, redirecting our attention from things to objects: epistemic objects. Such objects can be understood, as Maurice Merleau-Ponty proposed, as shared by multiple subjects by virtue of their participation in an intersubjective world, constituted by what Shaun Gallagher calls participatory sense-making. On an epistemology constructed in this way, the fact that both epistemic objects and their subject are mutable is no obstacle to knowledge. Far-from-equilibrium systems are forever mutable; at thermodynamic equilibrium, there would be neither subject, nor object. Epistemic objects, on this picture, are metastable loci of interactive potential. (shrink)

Nineteenth and twentieth century philosophies of science have consistently failed to identify any rational basis for the compelling character of scientific analogies. This failure is particularly worrisome in light of the fact that the development and diffusion of certain scientific analogies, e.g. Darwin’s analogy between domestic breeds and naturally occurring species, constitute paradigm cases of good science. It is argued that the interactivist model, through the notion of a partition epistemology, provides a way to understand the persuasive character of compelling (...) scientific analogies without consigning them to an irrational or arational context of discovery. The recent publication by Wylie et al. is reviewed, demonstrating that the p53 protein regulates the movement of transposons. While this work presents genetic evidence for a piRNA‐mediated p53 interaction with transposons in Drosophila and zebrafish, it is herein placed in the context of a decade or so of additional work that demonstrated a role for p53 in regulating transposons and other repetitive elements. The line of thought in those studies began with the observation that transposons damage DNA and p53 (...) regulates DNA damage. The presence of transposon movement can increase the rate of evolution in the germ line and alter genes involved in signal transduction pathways. Transposition can also play an important role in cancers where the p53 gene function is often mutated. This is particularly interesting as recent work has shown that de‐repression of repetitive elements in cancer has important consequences for the immune system and tumor microenvironment. (shrink)

This study analyzes 435 oocyte donor recruitment advertisements to assess whether entities recruiting donors of oocytes to be used for in vitro fertilization (IVF) procedures include a disclosure of risks associated with the donation process in their advertisements. Such disclosure is required by the self-regulatory guidelines of the American Society for Reproductive Medicine (ASRM) and by law in California for advertisements placed in the state. We find very low rates of risk disclosure across entity types and regulatory regimes, although risk (...) disclosure is more common in advertisements placed by entities subject to ASRM's self-regulatory guidelines. Advertisements placed in California are more likely to include risk disclosure, but disclosure rates are still quite low. California-based entities advertising outside the state are more likely to include risk disclosure than non-California entities, suggesting that California's law may have a modest “halo effect.” Our results suggest that there is a significant ethical and policy problem with the status quo in light of the known and unknown risks of oocyte donation and the importance of risk disclosure to informed consent in the context of oocyte donation. In vitro fertilization using donated oocytes has proven to be an effective treatment option for many prospective parents struggling with infertility, and the usage of donated oocytes in assisted reproduction has increased markedly since the technique was first successfully used in 1984. Data published by the Centers for Disease Control and Prevention on the use of assisted reproductive technologies in the United States indicate that approximately 12% of all ART cycles in the country now use donated oocytes. The increased use (...) of oocyte donation in the United States has prompted discussion regarding risks associated with the process and how best to ensure the safety of oocyte donors.Physical risks associated with oocyte donation include bleeding, infection, ovarian hyperstimulation syndrome and a potential, although unconfirmed, increased risk of developing various forms of cancer, such as uterine, colon, breast, ovarian, and endometrial cancers. Almost since their publication, the writings of Michel de Montaigne have provided rich fodder for the work of scholars in myriad disciplines. Philosophers have considered Montaigne's views on skepticism; historians have examined his views on the Indians; deconstructionists and literary scholars have examined Montaigne's view of the self; and, political scientists have touched on his arguments for toleration. However, because each of these projects has been done largely in isolation, most scholars have failed to see the relationships between the various (...) aspects of Montaigne's thought. Alan Levine, in Sensual Philosophy, unites Montaigne's thought for the first time, ably and convincingly demonstrating the significant role Montaigne played in establishing the liberal ethos in the West. In exploring Montaigne's grounding for liberalism, Levine considers Montaigne's conceptualization of skepticism and its relationship to toleration. He argues that Montaigne's theories of self ground his idea of toleration without leaving it open to the corrosive charges of relativism and nihilism. Levine also articulates the importance of Montaigne's thought for contemporary conceptions of personal freedom, individuality, subjectivity, and self-creation by bringing him into dialogue with modern and postmodern political theorists such as Heidegger, Nietzsche, and Richard Rorty. This lively book persuades those who might be tempted by postmodernism that they should turn to Montaigne instead. (shrink)

It is argued that a chief obstacle to a naturalistic explanation of the origins of mind is human exceptionalism, as exemplified in the 17th century by Descartes, and in the 20th century by Noam Chomsky. As an antidote to human exceptionalism we turn to the account of aesthetic judgment in Darwin’s Descent of Man, according to which the mental capacities of humans differ from those of lower animals only in degree, not in kind. Thoroughgoing naturalistic explanation of these capacities is (...) made easier by shifting away from the substance-metaphysical implications of the search for an account of mind, toward a dispositional account of the origins of mindfulness. In vitro fertilization using donated oocytes is an important medical technique that provides the only option for some infertile patients to have children. The technique remains ethically contentious, however, and, as a result of this controversy, different oversight approaches have been developed in countries around the world. This paper examines the oversight and practice of oocyte donation in Canada, the United Kingdom and the United States to examine how policy choices have influenced the development and use of this medical technology. Examining per capita utilization of oocyte donation in these three countries provides evidence that supply-side policies—specifically policies affecting the compensation of potential oocyte donors—have substantially influenced the use of this technology. These results should provide useful insight for policymakers developing or revising oocyte donation policies. (shrink)

Twentieth century philosophy of science has been dominated by a view of language with a strong prejudice against psychology, even while empirical psychology has moved away from the nineteenth century philosophical psychology against which the prejudice was originally directed. This legacy is shown to dominate even in recent Kripke‐inspired efforts toward new theories of meaning. Its influence is argued to undermine prospects for making sense of such phenomena as scientific progress. Avoiding this consequence requires that we pursue a psychologically informed (...) theory of meaning. (shrink)

It is widely held that in the eighteenth and nineteenth and centuries history came into its own as a proper object of scientific scrutiny, and that the work of Darwin and Marx was decisive in this regard. We readily concede the revolutionary character of Darwinism and Marxism in relation to earlier accounts of natural and human history. And we agree too, as is widely supposed, that there are important conceptual affinities joining Darwin's theory of evolution and Marx's theory of history. (...) However, it has not been sufficiently appreciated how these theories differ-precisely in the sense they count as historical. Evolutionary theory and historical materialism exemplify different strategies for making history an object of theoretical investigation. By reflecting on these differences, we can gain some purchase on the kind of theory historical materialism is and appreciate the very special sense in which Marx did indeed construct an historical theory. We believe that the professional responsibility of bioscience and biotechnology professionals includes a social responsibility to contribute to the resolution of ethically fraught policy problems generated by their work. It follows that educators have a professional responsibility to prepare future professionals to discharge this responsibility. This essay discusses two pilot projects in ethics pedagogy focused on particularly challenging policy problems, which we call “fractious problems”. The projects aimed to advance future professionals’ acquisition of “fractious problem navigational” skills, a set of (...) skills designed to enable broad and deep understanding of fractious problems and the design of good policy resolutions for them. A secondary objective was to enhance future professionals’ motivation to apply these skills to help their communities resolve these problems. The projects employed “problem based learning” courses to advance these learning objectives. A new assessment instrument, “Skills for Science/Engineering Ethics Test”, was designed and administered to measure the success of the courses in doing so. This essay first discusses the rationale for the pilot projects, and then describes the design of the pilot courses and presents the results of our assessment using SkillSET in the first pilot project and the revised SkillSET 2.0 in the second pilot project. In our essay ‘What’s Historical About Historical Materialism?’, we drew two contrasts between the Darwinian theory of evolution (ET) and the Marxist theory of historical materialism (HM).1 We described the former as a ‘micro-theory’ and the latter as a ‘macro-theory’. We also argued that, in Darwinian theory, evolution is driven by exogenous forces, specifically, by natural selection induced by environmental factors; whereas historical materialism sees the transformation of a society from feudalism to capitalism and then to socialism as a consequence (...) of an endogenous process, involving ‘contradictions’ between forces and relations of production and class struggle. Nolan has taken issue with both of these contrasts; his view is that the two theories are more similar than our account allows. (shrink)

Oocyte donation raises conflicts of interest and commitment for physicians but little attention has been paid to how to reduce these conflicts in practice. Yet the growing popularity of assisted reproduction has increased the stakes of maintaining an adequate oocyte supply and minimizing conflicts. A growing body of professional guidelines, legal challenges to professional self-regulation, and empirical research on the practice of oocyte donation all call for renewed attention to the issue. As empirical findings better inform existing conflicts and their (...) potential harms, we can better attempt to reduce these conflicts. To that end, the article first describes the nature of conflicts in oocyte donation and relevant regulations and professional guidelines. We then describe studies on conflicts at four phases of oocyte donation: recruitment, screening, stimulation, and post-stimulation monitoring. Next we consider three models for conflict reduction in medicine generally: improved professional self-regulation, outright restriction like Stark anti-referral laws, or the use of conflict mediators, like in living organ donation. We ultimately conclude that improved professional self-regulation is a reasonable starting place for oocyte donation. (shrink)

For more than two decades, C. B. Macpherson has waged a relentless campaign to expose and critize the ‘possessive individualist’ assumptions of classical and liberal democratictheory. This new book —a collection of essays, including several not previously published —gives a clear focus to this campaign and provides the fullest expression to date of its positive side: the elaboration of a social philosophy incorporating liberal values but free from possessive individualist assumptions. What is defective in the assumptions is less the internal (...) theoretical problems they generate than that they have become historically outmoded. For Macpherson, liberal democracy is historically — even politically — inadequate, before it is theoretically inadequate. It is inadequate for us — now — because it rests on assumptions we no longer need, assumptions that have ceased to be historically progressive. However, liberal democracy is not, as surgeons would say, beyond operation. On Macpherson's view, nearly everything that is attractive in liberal theory can be salvaged. Much as what we now call ‘the Marxism of the Second International’ long ago passed from the scene, the Age of ‘Western Marxism’ has apparently come to an end. Internal theoretical developments, changes in intellectual culture and, above all, political circumstances have joined together to hasten the demise of this episode in the history of radical theory. It would be instructive to trace the trajectory of Western Marxism, and to reflect on the political conditions for its decline. In both Western (...) and Eastern Europe, Marxian politics has been in crisis at least since the watershed year of 1968, and in disarray for more than a decade. Western Marxism has always been joined programatically to currents within these political movements and has suffered grave, indeed fatal, damage in consequence. But it is not my intention to reflect on the vicissitudes of Western Marxism here. What follows will consider instead a style of theorizing that has effectively superceded Western Marxism, just as Western Marxism earlier replaced the Marxism of the Second International. This new kind of radical theory is widely designated—approvingly by some, disparagingly by others—‘analytical Marxism.’. (shrink)

Penelope Maddy's original solution to the dilemma posed by Benacerraf in his 'Mathematical Truth' was to reconcile mathematical empiricism with mathematical realism by arguing that we can perceive realistically construed sets. Though her hypothesis has attracted considerable critical attention, much of it, in my view, misses the point. In this paper I vigorously defend Maddy's account against published criticisms, not because I think it is true, but because these criticisms have functioned to obscure a more fundamental issue that is well (...) worth addressing: in general -- and not only in the mathematical domain -- empiricism and realism simply cannot be reconciled by means of an account of perception anything like Maddy's. But because Maddy's account of perception is so plausible, this conclusion raises the specter of the broader incompatibility of realism and empiricism, which contemporary philosophers are frequently at pains to forget.
