In this article, we articulate and defend a contextual approach to political theory. According to what we shall call ‘iterative contextualism’, context has two important roles to play in determining what is required by justice. First, it is through the exploration and evaluation of multiple contexts that general principles are devised, revised and refined. Second, significant weight should be given to the norms to be found in specific contexts because the people affected by those norms strongly identify (...) with them. Having said this, the application of general principles to particular contexts may still result in recommendations which deviate to some degree from the prevailing norms. In this case, we shall argue that although justice requires something other than what local norms say, what is required is likely to be intimated by the relevant context. Thus, whilst considerations of identification act as significant constraints on iterative contextualists’ thinking, the idea of intimations provides them with an important resource. (shrink)

Political theory is contextualist when factual claims about context are part of the justification of normative political judgments. There are different kinds of contextualism depending on whether context is relevant for the formulation and justification of political principles, whether principles themselves are contextually specific, or whether context is only relevant for the application of principles. An important challenge to contextualism is the problem of critical distance: how can theories ensure a critical perspective if facts (...) about the context to be evaluated are also part of the justification for the normative judgments? Tariq Modood and Simon Thompson have defended what they call iterative contextualism, which combines elements of all three kinds of contextualism in an attempt to avoid the problem of critical distance. In this paper, I argue that one approach to normative political theory, namely contextualism, can benefit from a specific kind of historical inquiry, namely genealogy, because the latter provides a solution to a deep-seated problem for the former. This problem consists in a lack of critical distance and originates from the justificatory role that contextualist approaches attribute to contextual facts. I compare two approaches to genealogical reconstruction, namely the historiographical method pioneered by Foucault and the hybrid method (...) of pragmatic genealogy as practiced by Bernard Williams, arguing that they both ensure an increase in critical distance while preserving contextualism’s distinctiveness. I also show, however, that only the latter provides normative action-guidance and can thus assist the contextualist theorist in the crucial task of discerning how far certain contextual facts deserve their justificatory role. I prove this point by showing how a pragmatic genealogy of the practice of punishment can inform the contextualist’s reflection about the role this practice should play in a transitional scenario, i.e. in the set of circumstances societies go through in the aftermath of large-scale violence and human rights violations. Starting from the ‘Dewey Lectures’, Rawls presents his conception of justice within a contextualist framework, as an elaboration of the basic ideas embedded in the political culture of liberal-democratic societies. But how are these basic ideas to be justified? In this article, I reconstruct and criticize Rawls’s strategy to answer this question. I explore an alternative strategy, consisting of a genealogical argument of a pragmatic kind – the kind of argument provided by authors like Bernard Williams, Edward Craig and (...) Miranda Fricker. I outline this genealogical argument drawing on Rawls’s reconstruction of the origins of liberalism. Then, I clarify the conditions under which this kind of argument maintains vindicatory power. I claim that the argument satisfies these conditions and that pragmatic genealogy can thus partially vindicate the basic ideas of liberal-democratic societies. (shrink)

Many political theorists of multiculturalism describe their theories as “contextualist.” But it is unclear what “contextualism” means and what difference it makes for political theory. I use a specific prominent example of a multiculturalist discussion, namely Tariq Modood’s argument about “moderate secularism,” as a test case and distinguish between different senses of contextualism. I discuss whether the claim that political theory is contextual in each sense is novel and interesting, and whether contextualism (...) is a distinct feature of political theory of multiculturalism. I argue that the forms of contextualism which concern the scope and methodology of political theory are sensible, but not novel or distinctive of multiculturalism. I then discuss the more controversial forms of contextualism, which I call political and theoretical contextualism. Finally, I apply the distinctions to Modood’s argument. I argue that it is not a form of theoretical contextualism and that theoretical contextualism would in fact undermine arguments for multiculturalist policies of accommodation. (shrink)

This article traces the development of contextualist methodology in the study of the history of political thought/political theory after WWII. It argues that the so-called ‘Cambridge School’, often regarded as the core of historicist contextualism, arose during the 1950s and 1960s in response to dilemmas that were largely internal to (the history of) political philosophy as it was practiced in Britain in an academic culture dominated by analytic philosophy. This first stage of contextualist theorizing, usually (...) associated with Laslett, Skinner and Pocock, was highly influential, but it also contributed to the formation of a new set of problems. These were connected to the diversification and internationalization of the historicist contextualist study of political thought after the 1960s. The ‘second stage’ of contextualist theorizing was shaped by post-analytic and post-modernist impulses among others. Because of the variety of philosophical and conceptual commitments on notions central to the field such as ‘political thinking’, ‘politics’, or ‘power’, it is unlikely that the present historicist contextualist approaches would come to share a unified methodology or theory of historical interpretation. The tension between reason and power has a long and illustrious history in political theory. In his magnum opus of legal and political theory, "Between Facts and Norms," Jürgen Habermas presents his most complex, sophisticated, and ambitious attempt to confront this tension. My thesis in this article is that though Habermas’s political theory thematizes the tension between reason and power in a way that is initially quite promising, he ultimately forecloses that tension in the (...) direction of a rationality that has been conceptually and methodologically purified of the strategic power relations that pervade social reality. His attempt to insulate his Arendtian notion of communicative power (which he conceptualizes in BFN as a force of legitimation) from strategic power is not only unattainable in practice, I argue, but conceptually incoherent. This should compel him not to abandon his normative theoretical and political agenda, I suggest, but to defend it in a more contextualist way than he has been willing to do up until now. (shrink)

Comparative political theory is at best an embryonic and marginalized endeavor. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. Empirical political theory has grown in importance. In empirical political theory, attention to data is part of the evaluative step. A concern was raised that being attentive to the content of political science data implies that such attentiveness would limit the normative contours of empirical political theory, and will create a status-quo bias. This concern has been called the ‘problem of critical distance’. One way to appraise the significance of this problem is to (...) examine the work done by empirical political theorists such as Anderson (on racial integration), Wenar (on international trade), and Carens (on immigration). All three scholars suggest radical policies that differ from existing institutions and rules. The likelihood that a theory will suffer from the problem of critical distance will depend on the type of usage of data by a given theorist, her/his normative standpoint, and the manner in which they coalesce or differ. This article argues for greater realism in political theory with respect to judgements about what politicians ought to do and how they ought to act. It shows that there are major problems in deducing what a given politician should do from the value commitments that are common to liberalism and it makes a case for recognizing the major role played by the context of action and particular agent involved. It distinguishes political virtue from moral virtues and argues (...) that the ‘decisionist’ features of political agency render evaluation a partly post hoc process. The article advocates a version of political realism that is rooted in an understanding of the distinctive character of political rule and that provides the basis for a contextualist but non-relativist account of ‘what is to be done’. In this paper, I present the beginnings of a resemblance theory of representation. I start by surveying the contemporary philosophical debate surrounding musical representation and reveal that its main interlocutors share a conception of artistic representation as a mode of meaningful communication. I then show how conceiving of artistic representation in this way severely limits music’s possibilities as a medium for representation. Next, I propose an alternative conception of representation that, despite its widespread acceptance outside of the philosophy of (...) art, has been largely denigrated within it: namely, that representation fundamentally depends on structural resemblance. Finally, I demonstrate how conceiving of artistic representation as grounded upon structural resemblances, rather than as a mode of meaningful communication, provides us with a more accurate picture of both (a) how music represents and (b) how we perceive and appreciate musical representations. This dissertation defends the place of representation in music. Music’s status as a representational art has been hotly debated since the War of the Romantics, which pitted the Weimar progressives (Liszt, Wagner, &co.) against the Leipzig conservatives (the Schumanns, Brahms, &co.) in an intellectual struggle for what each side took to be the very future of music as an art. I side with the progressives, and argue that music can be and often is a representational medium. Correspondence (or resemblance) theories (...) of representation, such as the one I offer, have been much maligned in philosophy since the 1960s. Most theories assimilate representation under “meaning,” which has usually been thought to belong primarily to language. As a result, representational content has been taken to be purely conventional in the way that sentential meaning is. People want to know what music “means,” and these theories interpret this as “what does it refer to?” or “what propositions does it express?” I argue that propositional communication is only one (small) part of the issue. Once we overcome the bias of conceiving of musical works as essentially linguistic items, speech acts (performed) or sentence tokens (written), we can begin to take music on its own terms to discover how it represents—one way in which it “means.” The first step is to “naturalize” music’s representational content. Influenced by recent discussions in the philosophies of mind and science, I argue in Chapter 1 that composers represent extra-musical objects, events, and states of affairs through their works by exploiting antecedent relations (such as similarities in pitch, timbre, and structure) in order to secure reference to them. In Chapter 2, I survey and respond to the main challenges that those skeptical of music’s representational possibilities would raise against my theory of musical representation. In Chapter 3, I explore a number of ways through which music has been claimed to represent in order to show how my theory accounts for these diverse phenomena better than its conventionalist rivals, both in terms of the metaphysics and the epistemology. Chapter 4 extends this discussion by offering an account of how we perceive, understand, appreciate, and interpret sophisticated musical representations. In the last two centuries, our world would have been a safer place if philosophers such as Rousseau, Marx, and Nietzsche had not given intellectual encouragement to the radical ideologies of Jacobins, Stalinists, and fascists. Maybe the world would have been better off, from the standpoint of sound practice, if philosophers had engaged in only modest, decent theory, as did John Stuart Mill. Yet, as Ronald Beiner contends, the point of theory is not to think safe thoughts; the (...) point is to open intellectual horizons. In recent decades, a ‘realist’ alternative to ideal theories of politics has slowly taken shape. Bringing together philosophers, political theorists, and political scientists, this countermovement seeks to reframe inquiry into politics and political norms. Among the hallmarks of this endeavor are a moral psychology that includes the passions and emotions; a robust conception of political possibility and rejection of utopian thinking; the belief that political conflict — of values as well as interests — is both (...) fundamental and ineradicable; a focus on institutions as the arenas within which conflict is mediated and contained; and a conception of politics as a sphere of activity that is distinct, autonomous, and subject to norms that cannot be derived from individual morality. For political realists, a ‘well-ordered society’ is rarely attainable; a modus vivendi without agreement on first principles is often the only practical possibility. Not only will ‘full compliance’ never be achieved, but also it is an assumption that yields misleading accounts of political norms. While realists offer a number of compelling criticisms of ideal theory, there are some lacunae in their stance. It is not yet clear whether realism constitutes a coherent affirmative alternative to idealism. Nor have realists clarified the extent of conflict that is consistent with political order as such. And because both sides accept ‘ought implies can’ as a constraint on the validity of political norms, much of the debate between realists and idealists revolves around deep empirical disagreements that are yet to be clarified. This article discusses hitherto unexplored aspects of Quentin Skinner's work on the history of political thought by offering a critical appraisal of the medieval section of Skinner's Foundations of Modern Political Thought. The article investigates and critically assesses Skinner's study of the medieval 'classics' with a specific focus on his interpretation of the fourteenth-century political thinker Marsilius of Padua. In particular, the paper demonstrates that Skinner's analysis of Marsilius' political ideas is at odds with his own (...) methodology. It also contends that Skinner's emphasis on the intellectual- linguistic context as a starting point for the interpretation of major political writers of the past downplays the normative value of Marsilius' political theory and is, in the end, a narrow interpretation of the overall scope of Marsilius' Defensor pacis. Moral and political philosophers are increasingly using empirical data to inform their normative theories. This has sparked renewed interest into questions concerning the relationship between facts and principles. A recent attempt to frame these questions within a broader approach to normative theory comes from David Miller, who has on several occasions defended ‘contextualism’ as the best approach to justice. The concept of recognition, and its relationship to the way we theorise identity and justice, has emerged as part of an important debate in contemporary political and social theory. With contributions from Nancy Fraser and international commentators, this new collection examines key theoretical and practical problems of 'recognition' in politics. In this article, I chart some recent developments in the linguistic contextualist philosophy of history defended by Quentin Skinner. I attempt to identify several shifts in the way in which Skinner's position has been presented and justified, focusing particularly on his embrace of anti-foundationalism, his focus on rhetoric rather than speech-acts and his concern to recast contextualism as compatible with other interpretive approaches. In the final section, I reject the notion - suggested by Skinner and others - that a (...) contextualist philosophy of history might constitute a distinct form of political theorizing in itself. Normative political theorists frequently compare hypothetical scenarios for the purpose of identifying reasons to prefer one kind of institution to alternatives. We examine three types of "unfair" comparisons and the reasoning errors associated with each. A theorist makes an _obscure comparison_ when one (or more) of the alternatives under consideration is underspecified; a theorist makes a _mismatched comparison_ when they fail to hold fixed the relevant contextual factors while comparing alternatives; and a theorist makes an _irrelevant comparison_ when they (...) compare alternatives assuming contextual factors that differ in important respects from those they "should" assume given their theoretical aims. There has been a resurgence of Darwinian naturalism in political theory, as manifested in the recent work of political scientists such as Roger D. Masters, Robert J. McShea, and James Q. Wilson. They belong to an intellectual tradition that includes not only Charles Darwin but also Aristotle and David Hume. Although most political scientists believe Darwinian social theory has been refuted, their objections rest on three false dichotomies: facts versus values, nature versus freedom, and nature (...) versus nurture. Rejecting these dichotomies would allow the social sciences to be linked to the natural sciences through Darwinian biology. (shrink)

This book studies the work of John Stuart Mill in order to answer the question: what is political theory? Looking at what political theorists have written about this subject leads to the conclusion that they have different ways of defining political theory, resulting in different readings of political theory. In defense of this argument, Reading Mill includes three different readings of the works of John Stuart Mill and identifies a fourth type of (...) class='Hi'>political theorist unlikely to read Mill. When it comes to the question with which the book began, the only answer is that political theory is not one but four possible practices. This means that there are four different ways of reading a political theorist and reading political theory. The book calls for political theorists to recognize the value of their different ways of understanding political theory and, as a result, to tolerate their differences where they cannot celebrate them.
