Can parents who choose not to vaccinate their children be held legally liable for any harm that results? The state of laboratory and epidemiological understanding of a disease such as measles makes it likely that a persuasive causal link can be established between a decision to not vaccinate, a failure to take appropriate precautions to isolate a non-vaccinated child who may have been exposed to measles from highly vulnerable persons, and a death. This paper argues that, even if a parent (...) chooses to not vaccinate a child under a state law permitting exemptions, that decision does not create complete protection against liability for the adverse consequences of that choice. Consider this hypothetical scenario involving a choice not to vaccinate a child. Ms. S has a niece who is autistic. The girl's parents are suspicious that there is some relationship between her autism and her Measles Mumps and Rubella vaccination. They have shared their concerns with Ms. S. She then declines to have her own daughter, Jinny S., vaccinated with the MMR vaccine. To bypass the state's mandatory vaccination requirement, Ms. S claims a state-legislated philosophical exemption, whereby she simply attests (...) to the fact that she is opposed to vaccinating her daughter due to a conscientiously held belief. At the age of four, Jinny goes on a trip by airplane to Germany with her mother. After returning to the United States, she attends daycare despite having some mild cold symptoms. Part of the appeal of the biological approach to personal identity is that it does not have to countenance spatially coincident entities. But if the termination thesis is correct and the organism ceases to exist at death, then it appears that the corpse is a dead body that earlier was a living body and distinct from but spatially coincident with the organism. If the organism is identified with the body, then the unwelcome spatial coincidence could perhaps be avoided. It is (...) argued that such an identification would be a mistake. A living organism has a different part/whole relationship and persistence conditions than the alleged body. A case will be made that the concept ‘human body’ is a conceptual mess, vague in an unprincipled manner, and that an eliminativist stance towards dead bodies is the appropriate response. Allied health professionals play an integral role in providing safe, affordable care to communities in need. Laws that define the permissible scope of practice for these professionals may take full advantage of these providers and may unnecessarily restrict safe and effective care. Nurse practitioners in many states may provide care independent of a physician; research reveals that this care is safe, affordable and accessible. Yet hurdles exist that prevent communities from securing the full benefit of NPs in independent practice. The (...) scope of independent practice for allied dental providers varies greatly across the country, often including stringent supervision requirements. Emerging approaches to allowing allied dental providers to practice independently in certain settings or with dentist supervision via telemedicine and creating the intermediate provider, the dental therapist, may increase access to safe, affordable dental care. Research on the impact of laws that allow broader independent practice by NPs to ferret out the hurdles to full implementation of the spirit of such laws is needed. That research could support expanded independent scope for allied dental providers and other allied health care providers. (shrink)

On one common reading, Kant's epistemology involves an "all-Or-Nothing" principle: the mind achieves either objective knowledge or nothing at all. But then we cannot account for dreams. L w beck maintains that the categories also function in non-Veridical contexts (including dreams), But do not serve to distinguish these from veridical contexts. In this innovative study, Lea David critically investigates the relationship between human rights and memory, suggesting that, instead of understanding human rights in a normative fashion, human rights should be treated as an ideology. Conceptualizing human rights as an ideology gives us useful theoretical and methodological tools to recognize the real impact human rights has on the ground. David traces the rise of the global phenomenon that is the human rights memorialization agenda, termed 'Moral Remembrance', and explores what (...) happens once this agenda becomes implemented. Based on evidence from the Western Balkans and Israel/Palestine, she argues that the human rights memorialization agenda does not lead to a better appreciation of human rights but, contrary to what would be expected, it merely serves to strengthen national sentiments, divisions and animosities along ethnic lines, and leads to the new forms of societal inequalities that are closely connected to different forms of corruptions. Liberal thinkers of the eighteenth and nineteenth centuries were alert to the political costs and human cruelties involved in European colonialism, but they also thought that European expansion held out progressive possibilities. In Progress, Pluralism, and Politics David Williams examines the colonial and anti-colonial arguments of Adam Smith, Immanuel Kant, Jeremy Bentham, and L.T. Hobhouse. Williams locates their ambivalent attitude towards European conquest and colonial rule in a set of tensions between the impact of colonialism on European states, the (...) possibilities of progress in distant and diverse places, and the relationship between universalism and cultural pluralism. In so doing he reveals some of the central ambiguities that characterize the ways that liberal thought has dealt with the reality of an illiberal world. Of particular importance are appeals to various forms of universal history, attempts to mediate between the claims of identity and the reality of difference, and the different ways of thinking about the achievement of liberal goods in other places. Pointing to key elements in still ongoing debates within liberal states about how they should relate to illiberal places, Progress, Pluralism, and Politics enriches the discussion on political thought and the relationship between liberalism and colonialism. NP.Between 1755, (...) when he received the venia legendi, and 1796, when he ended his teaching activity, Kant taught logic some 30 times. In accordance with the requirements of the Prussian ministry of culture, his course lectures were built around a recognized text, G. F. Meier's 1752 Auszug aus der Vernunftlehre. Kant did not merely present Meier's views, however, but commented on and criticized these as he thought appropriate; his own copy of Meier was full of marginal notes and interleaved with notes on separate bits of paper. When in 1799 he entrusted G. B. Jäsche with this material for the compiling of a logic text, the thought was presumably of a Kantian logic organized around Meier's framework.Since logic plays such a prominent role in the Critical philosophy, one would expect the Jäsche logic to be viewed as an important tool for the interpretation of the Critical philosophy. But dissatisfaction with it was evident right from its original publication in 1800, and later scholars were even more negative (in 1913 Erich Adickes referred to it [End Page 603] as "the contrivance [Machwerk]... that Jäsche published under the name of Kant's logic," Erich Adickes, quoted in Ak. XXIV.960). And in fact, as Pinder's careful and detailed introduction points out, the nature and origin of the Jäsche logic presented a serious problem for Wilhelm Dilthey's organization of the now-standard Akademie-Ausgabe (Kants gesammelte Schriften, herausgegeben von der königlich preussischen [now: deutschen] Akademie der Wissenschaften. Berlin: de Gruyter, 1902- Cited as "Ak.").Dilthey conceived of four divisions of the Akademie-Ausgabe: Kant's published writings, his correspondence, his literary remains ("handschriftlicher Nachlass") and his lectures ("Vorlesungen"). Where, exactly, did the Jäsche logic belong? Kant had himself compiled a similar text from his lecture notes on anthropology, and this text was published in the first division (in volume VII). But did the Jäsche logic count as Kant's work? It was indeed authorized by Kant and based on Kant's own lecture notes; but these notes themselves were to be published in the Nachlass division. Furthermore, as it turned out, Jäsche had also employed manuscripts compiled from the lectures themselves, and these were to be published in the Vorlesungen division. This would not include his own transcription, as Erdmann had conjectured. It turns out Jäsche never heard Kant lecture on logic—he was never in Königsberg when they were being held! (xxvi, n. 29). The resulting controversies delayed the publication of the Jäsche logic in vol. IX from 1908 until 1923, after the 1914 publication in the Nachlass division of the notes on which it was based.Dilthey's projected Vorlesungen division itself was called into question by Benno Erdmann, Dilthey's successor as Akademie-Ausgabe general editor. Erdmann recognized the questionable nature of the Jäsche logic and the other compilations, but considered Dilthey's aim for a "critically secured" edition of the lecture manuscripts as "hopeless." Still, interest in the manuscripts resulted in their piecemeal publication independently of the Akademie-Ausgabe, and when the Nachlass division's publication had been completed in 1955, the Vorlesungen division was resurrected. Vol. XXIV (in two parts) appeared in 1966; it contained the logics Blomberg, Philippi, Pölitz, Busolt, Dohna-Wundlacken and the Vienna logic, the short logic Herder, and fragments of the lost logics Hintz and Hoffmann. Kant holds that the a human subject's free causation, as well as the deliberations and decision preceeding it, are literally timeless. This paper tries to defend this doctrine of timeless agency by first distinguishing three senses of "cause", then showing the relationship between cause and time-determination in the theoretical philosophy, and finally relating the timelessness of free agency to the status of the representations of perception. The result is that whereas agency has no time in isolation, it may borrow enough (...) time for its purposes from the theoretical realm. Kant meint, daß die freie Verursachung durch ein menschliches Subjekt, genauso wie die Überlegungen und die Entscheidung, die ihr vorausgehen, buchstäblich zeitlos sind. Der Beitrag versucht, diese Lehre von einem zeitlosen Handeln zu verteidigen. Zunächst wird zwischen drei verschiedenen Bedeutungen von "Ursache" unterschieden. Most commentators (especially guyer and allison) assume kant's position on inner sense to follow the lockean model, With inner sense preceding outer sense. In a previous paper I argued that outer sense was primary. Here, On the basis of the newly discovered leningrad fragment and other texts, I argue that the establishment of temporal order requires outer-Sense priority, But in its use, Inner sense can be prior. I close with some remarks on embodiment.
