In September 2003, we released the first results of a national community attitude tracking study about child abuse and child protection. At that time, we concluded that as a community, violence against children was tolerated. The community did not understand or appreciate the seriousness, size and cost of child abuse in Australia. There was evidence that child abuse was not viewed as an important challenge facing children in Australia. A second study conducted in 2006 found that nothing much had changed, (...) indeed community engagement with the issue of child abuse may have even deteriorated. A third study in 2010 found that the community actively avoids the problem of child abuse rating it less concerning than high petrol prices. In 2021, 18 years after the first report was published, we have concluded again that child abuse remains out of sight and out of mind as a community concern. This article describes the findings of this fourth iteration of our survey and analyses the implications for ensuring that individuals are more engaged and committed to taking action to preventing child abuse and/or protecting children from violation. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

Over the last few decades, multiple studies have examined the understanding of participants in clinical research. They show variable and often poor understanding of key elements of disclosure, such as expected risks and the experimental nature of treatments. Did the participants in these studies give valid consent? According to the standard view of informed consent they did not. The standard view holds that the recipient of consent has a duty to disclose certain information to the profferer of consent because valid (...) consent requires that information to be understood. The contents of the understanding and disclosure requirements are therefore conceptually linked. In this paper, we argue that the standard view is mistaken. The disclosure and understanding requirements have distinct grounds tied to two different ways in which a token of consent can be rendered invalid. Analysis of these grounds allows us to derive the contents of the two requirements. It also implies that it is sometimes permissible to enroll willing participants who have not understood everything that they ought to be told about their clinical trials. (shrink)

This paper provides a sketch of a fresh conception of the “metaphysics” of culture and a sense of its conceptual power and advantages, based on a post-Darwinian account of the artifactual, hybrid nature of a person, chiefly in terms of (what I treat as terms of art) Bildung (“external” and “internal”), Sittlichkeit (both descriptive and normative), and interpretation (diversely manifested in different sectors of inquiry). I consider the (“metaphysical”) relationship between membership in the species Homo sapiens sapiens and functioning as (...) a person the generic distinction of human cultures (enlanguaged cultures), which I call Intentionality (that is, whatever is culturally significant or significative); and the bearing of the thesis on familiar philosophical quarrels and theory of the sciences. There is a growing body of empirical evidence which shows that infants and non-human primates have the ability to represent the mental states of other agents, i.e. that they possess a Theory of Mind. We will argue that this evidence also suggests that infants and non-human primates possess the concept of truth, which, as we will explain, is good news for primitivists about truth. First, we will offer a brief overview of alethic primitivism, focusing on Jamin Asay’s conceptual version of (...) the view. Next, we will survey relevant work on Theory of Mind which indicates that children younger than two and non-human primates are able to attribute false beliefs. Then, we will bring these false-belief data to bear on Asay’s form of primitivism, arguing that the data support two of the four distinctive theses of this view and offering some remarks about the empirical evaluability of the two remaining theses. We hope that our discussion will help to bridge the gap between psychological and philosophical inquiry and that it will encourage further empirical research on the cognitive significance of the concept of truth for humans and other thinking creatures. The target articles by Dixon (2012), Scarantino (2012), and Mulligan and Scherer (2012) explore the nature of emotion from philosophical and psychological perspectives. I discuss how neuroscience can also contribute to debates about the nature of emotion. I focus on the aspects of emotion that usually fall within the topic of basic emotions, but conclude that we may need to revise how we conceive and study these kinds of emotional states in relation to the brain.

Belief storage is often modeled as having the structure of a single, unified web. This model of belief storage is attractive and widely assumed because it appears to provide an explanation of the flexibility of cognition and the complicated dynamics of belief revision. However, when one scrutinizes human cognition, one finds strong evidence against a unified web of belief and for a fragmented model of belief storage. Using the best available evidence from cognitive science, we develop this fragmented model into (...) a nascent theory of the cognitive architecture of belief storage. (shrink)

Jennifer Hornsby has defended the Reasons-Knowledge Thesis : the claim that \-ing because p requires knowing that p, where the ‘because’ at issue is a rationalising ‘because’. She defends by appeal to the thought that it provides the best explanation of why the subject in a certain sort of Gettier case fails to be in a position to \ because p. Dustin Locke and, separately, Nick Hughes, present some modified barn-façade cases which seem to constitute counterexamples to and undermine Hornsby’s (...) way of motivating it by rendering their alternative Reasons-Explanation Thesis a better explanation of Hornsby’s datum. This paper defends and Hornsby’s argument for it against those objections. First, I point out that their supposedly intuitive verdict about the relevant barn-façade cases is not as intuitive as they think. Second, I point out that even if we share the intuition: we have strong reason to doubt the verdict anyway. And finally, I point out that since is independently implausible, the two problems can be tackled anyway. (shrink)

According to standard comparativist views, death is bad insofar as it deprives someone of goods she would otherwise have had. In The Ethics of Killing, Jeff McMahan argues against such views and in favor of a gradualist account according to which how bad it is to die is a function of both the future goods of which the decedent is deprived and her cognitive development when she dies. Comparativists and gradualists therefore disagree about how bad it is to die at (...) different ages. In this paper I examine two prominent criticisms of gradualism and show that both misconstrue McMahan. I develop a related criticism that seems to show that a gradualist cannot coherently relate morbidity and mortality. This criticism also fails, but has an instructive implication for how policy-makers setting priorities for health care investments should regard choices between life-saving interventions and interventions against non-fatal diseases in the very young. In 1818 Laplace proposed that the Academie des Sciences in Paris set up a prize to be awarded to whoever succeeded in constructing lunar tables based solely on the law of universal gravity. In 1820 the prize was awarded to Carlini and Plana and Damoiseau by a committee of which Laplace was a member. But Laplace strongly criticized the Carlini-Plana approach to the lunar theory. A dispute ensued that is reconstructed on the basis of hitherto unknown letters exchanged between Carlini-Plana (...) and Laplace, and on the basis of papers published in Connaissance des temps and in Zach's Correspondance. After the exchanges, public and private, between Carlini-Plana and Laplace, the latter concluded that the results of the Italian astronomers and those arrived at by Damoiseau following the method of his Mecanique Celeste were fairly close, and that the purpose of the Academie in establishing the prize had been reasonably fulfilled. In “Reliabilism Leveled” Jonathan Vogel (2000) provides a strong case against epistemic theories that stress the importance of tracking/sensitivity conditions. A tracking/sensitivity condition is to be understood as some version of the following counterfactual: (T) ~p oÆ ~Bp (T) says that s would not believe p, if p were false. Among other things, tracking is supposed to express the external relation that explains why some justified true beliefs are not knowledge. Champions of the condition include Robert Nozick (1981) and, more (...) recently, Keith DeRose (1995). To my knowledge, the earliest formulation of the counterfactual condition is found in Fred Dretske’s conclusive reasons condition (1971), which says, s would not have had the reason that she does for believing p, if p were false. Vogel contends that any such counterfactual condition on knowledge will render the theory of knowledge too strong. He believes that there is at least some possible reflective knowledge that cannot satisfy the counterfactual--viz., the possible knowledge that one does not believe falsely that p. The alleged impossibility of such reflective knowledge is taken by Vogel to be a decisive objection to the tracking theories advocated by Dretske, Nozick, DeRose1 and others. The criticism finds its roots in Vogel’s earlier work (1987), and recurs in papers by Ernest Sosa (2002, 1996). Sosa suggests that the externalist idea behind tracking is on target, but that Nozick’s counterfactual is a misbegotten regimentation of the idea. In its place Sosa offers his own counterfactual “safety” condition, which he feels properly captures the externalist idea. Sosa’s counterfactual is not the topic of this paper. I mention it only to point out that the criticism that constitutes the subject of my investigation is meant to do a lot of work. In Sosa’s 1 case the criticism is meant to motivate his own counterfactual analysis, and in Vogel’s case the criticism promises to be a silver bullet against a theory that has recently found renewed life in the work of Keith DeRose.. Joseph Margolis, known for his considerable contributions to the philosophy of art and aesthetics, pragmatism, and American philosophy, has focused primarily on the troublesome concepts of culture, history, language, agency, art, interpretation, and the human person or self. For Margolis, the signal problem has always been the same: how can we distinguish between physical nature and human culture? How do these realms relate? _The Cultural Space of the Arts and the Infelicities of Reductionism_ identifies a conceptual tendency that can (...) be drawn from the work of the twentieth century's best-known analytic philosophers of art: Arthur Danto, Richard Wollheim, Kendall Walton, Nelson Goodman, Monroe Beardsley, Noël Carroll, and Jerrold Levinson, among others. This trend threatens to impoverish our grasp and appreciation of the arts by failing to do justice to the culturally informed nature of the arts themselves. Through his analysis, Margolis sets out to retrieve an adequate picture of the essential differences between physical nature and human culture—particularly through language, history, meaning, significance, the emergence of the human self or person, and the essential features of human life—all to explain how such difference bears on our perception of paintings and literature. Clearly argued and provocatively engaging, Margolis's work reestablishes what is essential to a productive encounter with art. (shrink)

In this article we will study the pronominal system in Ortonese, which belongs to the central-southern Italo-Romance languages. The analysis we propose is contrastive: we will compare the data with the Italian to highlight their differences in terms of some morphosyntactic aspects. We will examine, the stressed and unstressed personal pronouns, emphasizing the placement of the combined pronouns with the compound tenses. Then, we will focus on the rest of the pronouns, such as demonstratives, possessives, quantifiers and indefinites, also pointing (...) out the uses of the clitics “ci” and “ne” and the presence of the pronoun “nome”, which does not exist in Italian. A partir de la reflexión de Foucault sobre el proceso de transformación y dislocación de la norma de la esfera del comando heterónomo y trascendente y su redefinición en términos de inmanencia y constitución social, el artículo propone repensar la definición de sujeto político y jurídico en las nuevas relaciones de poder que caracterizan la governance global. El objetivo específico es la definición del espacio público y el significado de la agency de subjetividad que ya no se puede referir al (...) sujeto pleno de la narrativa jurídico-política moderna. Se trata de reflexionar sobre la capacidad de los actores políticos para distanciarse de las áreas de normalidad y regularidad y, en consecuencia, para atribuir a las formas y a los espacios, definidos por el derecho y por la política, diferentes significados y nuevas direcciones. Por lo tanto, cuestionamos el ambiente tranquilizador y protegido del ejercicio de los derechos, como en las teorías de la democracia deliberativa basadas en el reconocimiento e inclusión del otro, para dirigir nuestra mirada a los efectos de las prácticas concretas de libertad que definen al sujeto como sujeto político. Una dialéctica, en última instancia, entre el momento normativo y la continua reelaboración de sus ámbitos que redefinen en términos de flexibilidad los modelos de subjetivación, clasificación e identificación, redirigiéndose a formas plurales de subjetivación política y jurídica producidas por la colocación heterogénea de individuos que cruzan el espacio público.
