Natural law has long been considered the traditional source of Roman Catholic canon law. However, new scholarship is critical of this approach as it portrays the Catholic Church as static, ahistorical, and insensitive to cultural change. In its attempt to stem the massive loss of effectiveness being experienced by canon law, the church has to reconsider its theory of legal foundation, especially its natural law theory. Church Law in Modernity analyses the criticism levelled at the church and puts forward solutions (...) for reconciling church law with modernity by revealing the historical and cultural authenticity of all law, and revising the processes of law making. In a modern church, there is no way of thinking of the law without the participation of the faithful in legislation. Diversity is both an unavoidable aspect of twenty-first century living and a powerful challenge to older philosophical traditions that still assume as normatively universal a set of values, ways of thinking, institutions, and habits of living that emerged within earlier eras of more homogeneous cultures, less developed technologies, and more accepted forms of linguistic, legal, religious, economic, political, and military domination. Within recent years, new styles of philosophical discourse, including deconstruction, postmodernism, feminism, post-colonialism, and critical race theory, have persuasively challenged (...) these universalistic assumptions to reveal the important human differences they marginalize. Experience-based appreciation of the mutually educative potential of diverse standpoints as well as sober concern about the perils of our present times have led many thinkers to look for contemporary forms of pragmatism and cosmopolitanism as hospitable intellectual gathering places for urgently needed cross-difference conversations that may reflect and give substance to shared visions of democratic diversity. Conditionals pervade every aspect of our thinking, from the mundane and everyday such as ‘if you eat too much cheese, you will have nightmares’ to the most fundamental concerns as in ‘if global warming isn’t halted, sea levels will rise dramatically’. Many decades of research have focussed on the semantics of conditionals and how people reason from conditionals in everyday life. Here it has been rather overlooked how we come to such conditionals in the first place. In many cases, they (...) are learned through testimony: someone warns us about the ill-effects of cheese. The Netherlands is one of the few countries where euthanasia is legal under strict conditions. This study investigates whether Dutch newspaper articles use the term ‘euthanasia’ according to the legal definition and determines what arguments for and against euthanasia they contain. We did an electronic search of seven Dutch national newspapers between January 2009 and May 2010 and conducted a content analysis. Of the 284 articles containing the term ‘euthanasia’, 24% referred to practices outside the scope of the law, mostly (...) relating to the forgoing of life-prolonging treatments and assistance in suicide by others than physicians. Of the articles with euthanasia as the main topic, 36% described euthanasia in the context of a terminally ill patient, 24% for older persons, 16% for persons with dementia, and 9% for persons with a psychiatric disorder. The most frequent arguments for euthanasia included the importance of self-determination and the fact that euthanasia contributes to a good death. The most frequent arguments opposing euthanasia were that suffering should instead be alleviated by better care, that providing euthanasia can be disturbing, and that society should protect the vulnerable. Of the newspaper articles, 24% uses the term ‘euthanasia’ for practices that are outside the scope of the euthanasia law. Typically, the more unusual cases are discussed. This might lead to misunderstandings between citizens and physicians. Despite the Dutch legalisation of euthanasia, the debate about its acceptability and boundaries is ongoing and both sides of the debate are clearly represented. (shrink)

In their article ‘Consent-GPT: is it ethical to delegate procedural consent to conversational AI?’, Allen et al 1 explore the ethical complexities involved in handing over parts of the process of obtaining medical consent to conversational Artificial Intelligence (AI) systems, that is, AI-driven large language models (LLMs) trained to interact with patients to inform them about upcoming medical procedures and assist in the process of obtaining informed consent.1 They focus specifically on challenges related to accuracy (4–5), trust (5), privacy (5), (...) click-through consent (5) and responsibility (5–6), alongside some pragmatic considerations (6). While the authors competently navigate these critical issues and present several key perspectives, we posit that their discussion on trust in what they refer to as ‘Consent-GPT’ significantly underestimates one vital factor: the interpersonal aspect of trust. The debate over environmental, health, and safety regulation has reached a new crescendo in the 104th Congress. So impassioned is the debate on occasion, and so high the feelings, that even the tools of regulatory analysis have become part of the combat.To some, the term cost-benefit analysis, for example, is virtually a swearword, a nefarious tool used by big business to undermine regulations aimed at benefiting the people at large. To others, it is the mechanism for achieving more effective regulation (...) at less cost.This new book on the subject of reforming regulation is aimed at increasing the light and turning down the heat. It consists of an introduction and nine chapters written by scientists, public policy analysts, and economists on various aspects of regulation and regulatory analysis.The book advances the latest knowledge and evidence on risk analysis, cost-benefit analysis, and related techniques for improving regulation--all based on experience and data accumulated over the quarter century since regulation in the areas of environment, health, and safety became a major player on the governmental stage. The strengths and limitations of those analytical tools are an important part of the portrait that is painted, but a common thesis is that, properly used, the tools can be helpful in getting better regulatory results. It is virtuous for individual and collective agents to be tolerant. However, toleration is difficult, both in practice and in conceptualization. Firstly, given that toleration can be understood in various ways (Walzer 1997, Forst 2007), it seems that to determine what is the proper conception of toleration would be controversially difficult. Here I shall suggest one particular conception of toleration is more suitable than others. This conception allows, as I shall explain, us to better understandthe difficulties of toleration. Thus, this (...) particular conception of toleration should lead us to see what is more adequate for dealing with the difficulties of toleration. To be more precise, I shall argue for a political conception of toleration, which different from the attitudinal conception of toleration as being indifferent, or the ethical conception of toleration as respect. There is the suggestion of toleration as recognition (Galeotti 2002). These alternative understandings of toleration do not provide better diagnoses of the difficulties of toleration. The political conception of toleration is intended to be grounded on some moral considerations, notpragmatic purpose. It is political in that it recognizes the fact that toleration is essentially practiced to deal with a power relationship among the parties of toleration. Where these is no such power relationship, as I shall argue, there is no issue of toleration. Secondly, this proposed conception of toleration is political in the sense that it shall not deal with differences coming from, to use John Rawls’s phrase, the fact of pluralism by adopting any comprehensive doctrine such as an ethics of respect or recognition. Projective contents, which include presuppositional inferences and Potts's conventional implicatures, are contents that may project when a construction is embedded, as standardly identified by the FAMILY-OF-SENTENCES diagnostic. This article establishes distinctions among projective contents on the basis of a series of diagnostics, including a variant of the family-of-sentences diagnostic, that can be applied with linguistically untrained consultants in the field and the laboratory. These diagnostics are intended to serve as part of a toolkit for exploring projective contents across languages, thus (...) allowing generalizations to be examined and validated crosslinguistically. We apply the diagnostics in two languages, focusing on Paraguayan Guaraní, and comparing the results to those for English. Our study of Paraguayan Guaraní is the first systematic exploration of projective content in a language other than English. Based on the application of our diagnostics to a wide range of constructions, four subclasses of projective contents emerge. The resulting taxonomy of projective content has strong implications for contemporary theories of projection, which were developed for the projective properties of particular subclasses and fail to generalize to the full set of projective contents.
