In this article, we extend the research on the public interest to non-audit engagements performed by accounting firms and public accountants. Our thesis is that non-audit engagements, as private goods, require a distinct approach to the public interest than auditing. We suggest that a public value perspective can be used conceptually to provide substantial criteria for designing non-audit engagements conducive to public value creation and greater accountability. We illustrate the applicability and consequences of a public value perspective by analyzing and (...) contrasting the decision of two judicial opinions deciding whether Deloitte and the lead partner of a consulting engagement failed to act in the public interest in engineering the sale of collapsed British carmaker MG Rover. We advocate for a significant change in ethical codes of conduct by defining public interest obligations, not only in terms of professional attributes, but also in terms of outcomes. Our approach also suggests a requirement regarding planning a non-audit engagement, including establishing a public value proposition detailing the planned nature of the engagement, and extent of the assessment of the intended public value creation. We discuss the aspirational function of codes of conduct to provide accountability other than in terms of technical output, and to maintain the legitimacy and purpose of the profession. (shrink)

Dans le domaine du placement d’enfants, la loi de 1996 préconisant le maintien de la communauté de vie des frères et sœurs est souvent comprise comme une injonction sine qua non. Cet article se fait l’écho des observations d’une équipe pluridisciplinaire (éducateurs, psychologue, psychanalyste) engagée depuis de longues années dans l’accueil familial qui dévoilent, à travers une analyse à la fois quantitative et clinique, une réalité qui vient nuancer cet impératif. Les auteurs montrent que, dans un certain nombre de cas, (...) le maintien de la communauté de vie de la fratrie contribue à l’entretien de la pathologie des liens familiaux et à l’aliénation du sujet. A partir de là on discerne, certes, l'Erre perfection pure, mais surtout l'immatérialité de la connaissance, sans laquelle l'amour perd toute sa profondeur, et qui est le fondement de notre ressemblance à Dieu. C'est dire assez à quel point la foi suppose cette philosophie. Ces pages veulent s'adresser aux non-spécialistes, tout en essayant de répondre aux exigences de rigueur d'un esprit critique. Marie Durand n’est pas très connue en dehors du monde protestant. Elle a passé 38 ans emprisonnée dans la Tour de Constance à Aigues-Mortes parce que son frère était un pasteur clandestin du xviiie siècle. Elle est surtout connue depuis le livre de Benoît en 1884. Mais c’est au début du xxe siècle qu’elle devient une personnification de la résistance pacifique au nom des droits de la conscience et de la tolérance et qu'elle accède à un statut d'héroïne. Cela (...) permet aussi à la Réforme un renouveau moral et spirituel. La référence à Marie Durand s'accentue en 1945 et culmine lors des cérémonies de 1968. La vie d’Antoine-Jean Solier, protestant rouergat établi à Marseille comme négociant à la fin du xviiie siècle, a été scandée par l’écriture. Au fil de ses textes autobiographiques se révèle le for privé d’un homme pourtant peu enclin aux confidences. Le fils, le frère, le mari et le père s’expriment sous sa plume au gré des circonstances, esquissant le portrait complexe d’un être à la charnière de deux époques et de deux sensibilités. Porteur d’une tradition familiale construite sur de fortes (...) solidarités, tant professionnelles que confessionnelles, Antoine-Jean appartient aussi à cette génération des Lumières ouverte sur l’individu, dont la relation au divin se détend au profit d’une sensibilité plus humaniste. Ses écrits témoignent ainsi de toute l’ambiguïté de la relation à l’autre, selon le statut, le genre ou la place de chacun au sein de sa famille. (shrink)

This article calls for a rethinking of critical sociology. Representing classical critical sociology, the Bourdieusian paradigm illustrated domination, but its negative foundation removed actors’ power, privileging sociological knowledge as capable of identifying (social) transcendental categories of thought. Latour’s constructivism challenged this privilege, giving actors the political power of aggregating collectives around their common concerns at the cost of emphasizing domination and critique. We propose a critical approach that evades a transcendental perspective reliant on pure negation, producing a more positive critical (...) sociology founded on processualist phenomenological and pragmatic perspectives, principally Merleau-Ponty and Dewey. Actors and researchers can collectively ruminate on their perspectives and concerns to challenge power structures and transform their worlds. At the center of this is the social-mien, a creative reimagination of habitus. A brief discussion of the protests and scholarship surrounding the Notre-Dame-des-Landes activists’ practice of democracy highlights the utility of the approach and serves as a model for future application. Some commentators have condemned Kant’s moral project from a feminist perspective based on Kant’s apparently dim view of women as being innately morally deficient. Here I will argue that although his remarks concerning women are unsettling at first glance, a more detailed and closer examination shows that Kant’s view of women is actually far more complex and less unsettling than that attributed to him by various feminist critics. My argument, then, undercuts the justification for the severe feminist critique of Kant’s (...) moral project. (shrink)

Me voilà donc en situation de commenter le bras de fer entre un personnage de légende, difficile à débusquer de son trou et (...) plus difficile encore à confesser, et son poursuivant, notre auteur, l'œil pétillant, la plume déliée......"De l'embarras de démêler le vrai de l'apparence et le bonheur des peuples de l'asservissement". Il ne s'agit pas d'un inédit soudain découvert de l'auteur des Discours, seulement des interrogations du lecteur au sortir d'un tête-à-tête avec Machiavel, dont Christian Soleil, avec une maîtrise éprouvée, a été l'animateur inspiré et diligent. La rencontre a-t-elle été fructueuse? Il me semble. Le compte-rendu de celle-ci, sous la forme d'une biographie commentée, répond à une curiosité conséquente à un long pèlerinage en milieu trouble, non en la satisfaisant, mais en l'excitant davantage. Car il est dans le rôle de l'écrivain de susciter des interrogations et des résistances plutôt que de livrer un produit à consommer en l'état. Naviguant sur un fleuve dont les eaux tumultueuses sont semées d'écueils, Christian Soleil a écrit un livre qui marquera à la fois par une recherche poussée et méthodique, une construction intellectuelle très élaborée, une langue familière et noble. In the Philippines, all transplant centers are mandated by the Department of Health (DOH) to have a Hospital Transplant Ethics Committee (HTEC) to ensure that donations are altruistic, voluntary and free of coercion/commercial transactions. This study was undertaken primarily to describe the organizational and functional profile of existing HTECs and identify areas for improvement. This is a descriptive cross‐sectional study. There was variation in their logistical arrangements (support from hospital, filing systems, office spaces), operations (length and frequency of meetings, number (...) of referrals) and membership (composition, qualifications, occupation, training). The approval rate for donor‐recipient pairs is high with the majority of cases made by living non‐related donors. Appropriate reasons were cited for rejection. The perception of HTECs is that they are competent and confident in their decision‐making. However, there is a need to standardize HTEC composition, provide operating procedures and additional training which can be done by the DOH. (shrink)

Rosalind Hursthouse The daughter of a pacifist rector who answered "No!" when his congregation asked him "Is everything in the bible true?", perhaps Mary Midgley was destined to become a philosopher. Yet few would have thought this inquisitive, untidy, nature-loving child would become "one of the sharpest critical pens in the west." This is her remarkable story. Probably the only philosopher to have been in Vienna on the eve of its invasion by Nazi (...) Germany in 1938 and dance in Trafalgar Square on VE day seven year later, she studied philosophy at Oxford in the same year as Iris Murdoch, Elizabeth Anscombe and Philippa Foot, all of whom became close friends. Midgley tells us in vivid and humorous fashion how they cut a swathe through the arid landscape of 1950s British philosophy, writing and arguing - often with each other - about the grand themes of character, beauty and the meaning of rudeness while the spectral figure of Ludwig Wittgenstein hovered in the background. She also charts the highs and lows of philosophy and academia in Britain. On joining the Reading philosophy department on £400 a year in 1949, she doubled its staff complement. But her many years at Newcastle University - where Mike Brearley, who later captained England at cricket, also used to teach - were rewarded with the closure of the philosophy department in the 1980s. The mother of three children, her journey is also one of a woman who in the 1950s and 1960s was fighting to combine a professional career with raising a family. In startling contrast to many of the academic stars of her generation, we learn that Midgley nearly became a novelist and started writing philosophy only when in her fifties, suggesting that Minerva's owl really does fly at dusk. Plainly told like her philosophy, this is an elegiac and moving account of friendships found and lost, bitter philosophical battles and of a profound love of teaching all too rarely acknowledged today. This paper criticizes Langton's speech act account of MacKinnon's claim about (the subordinating force of) pornography and offers a different account of how speech might enact harmful norms and thus constitute harm.

Plato famously promised to complement the Sophist and the Statesman with another work on a third sort of expert, the philosopher--but we do not have this final dialogue. Mary Louise Gill argues that Plato promised the Philosopher, but did not write it, in order to stimulate his audience and encourage his readers to work out, for themselves, the portrait it would have contained. The Sophist and Statesman are themselves members of a larger series starting with the Theaetetus, Plato's investigation of (...) knowledge, and the whole series relies on the Parmenides, the second part of which presents a philosophical exercise, introduced as the first step in a larger philosophical program. Gill contends that the dialogues leading up to the missing Philosopher, though they reach some substantive conclusions, are philosophical exercises of various sorts designed to train students in dialectic, the philosopher's method; and that a second version of the Parmenides exercise, closely patterned on it, spans parts of the Theaetetus and Sophist and brings the philosopher into view. This is the exercise about being, the subject-matter studied by Plato's philosopher. Plato hides the pieces of the puzzle and its solution in plain sight, forcing his students (and modern readers) to dig out the pieces and reconstruct the project. Gill reveals how, in finding the philosopher through the exercise, the student becomes a philosopher by mastering his methods. She shows that the target of Plato's exercise is internally related to its pedagogical purpose. (shrink)

Rae Langton and Jennifer Hornsby argue that there may be a free-speech argument against pornography, if pornographic speech has the power to illocutionarily silence women: women's locution ‘No!’ that aims to refuse unwanted sex may misfire because pornography creates communicative conditions where the locution does not count as a refusal. Central to this is the view that women's speech lacks uptake, which is necessary for illocutionary acts like that of refusal. Alexander Bird has critiqued this view by arguing that uptake (...) is not necessary for the illocutionary act of refusal. The Hornsby-Langton view, then, is philosophically indefensible. Here I defend the philosophical cogency of the Hornsby-Langton approach. (shrink)

The unity of aesthetic and teleological judgment, the third and earlier Critiques, is based on Kant′s discovery of a “heuristic method” for applying judgments regarding sense phenomena to abstract thought, a “second attention” which enables an “idea of the whole”. Synthetic judgment, basis for cognition and human action, depends on efficacy of non-empirical insights: the transcendental standpoint, “regulative” ideas, consciousness of “ought” and the reality of freedom, universality of natural mechanism, the principle of “fortuitous” purposiveness. The activity of reflective judgment (...) in the encounter with the beautiful, sublime, living, and two paradigmatic types of explanation, inspired by Spinoza′s distinction of extensio and cogitatio, permit Kant to bridge the gap between freedom and necessity, theoretical knowledge and morality. Science as Salvation discusses the high spiritual ambitions which tend to gather round the notion of science. Officially, science claims only the modest function of establishing facts. Yet people still hope for something much grander from it--namely, the myths by which to shape and support life in an increasingly confusing age. Our faith in science is abused by some scientists whose adolescent fantasies have spilled over into their professional lives. Salvation, immortality, mastery of the universe, humans without bodies, and intelligent (...) self-reproducing computers are just some of the notions and speculations that are now found--not on the pages of science fiction--but on the pages of science itself. The danger is that these concepts are given to a myth-hungry public who turn to science now that religion has lost its ability to create myth. Science as Salvation discusses the function and meaning of such fantasies. Midgley examines the need for and the use of myth in science, and how science and religion are related. She argues that we need to develop a realistic understanding of scientific imagination and its importance. Taking them seriously as symptoms of a genuine myth-hunger, it suggests that the proper function of science may need to include wider perspectives, which would make it plain that such desperate, compensatory dramas are unnecessary. A leader in the modern commentary on ethics and philosophy, Mary Warnock casts a critical eye over her life and times.

This article sets out to show that Wittgenstein and Freud have exerted a considerable - though narrow - influence on Bourdieu’s sociology. But their influence also pervades the theoretical development of two other currents that have emerged in French sociology in the last few years, and that were developed by L. Boltanski and L. Thévenot on the one hand, and B. Lahire on the other. Although they do not make it explicit, the advocates of these two currents have nevertheless been (...) influenced by Wittgenstein and Freud. Thus Boltanski has drawn on Wittgenstein to develop a sociology which gives primacy to the social actor’s interpretation of his or her situation through lay theorizing. Lahire’s work clearly pays a debt to Freud with his psychological sociology. It would therefore be interesting, in the first instance, to tease out how Wittgenstein and Freud, respectively, have influenced these two systems to demonstrate that they can indeed be used to generate new sociological currents, other than Bourdieu’s own. This would then allow us to explore how they could be used to fill any gaps in Bourdieu’s work, thus giving the latter renewed relevance and staunching its stagnating tendencies. Ultimately, this analysis aims to show how Wittgenstein’s and Freud’s theoretical influences can lead the way towards a theoretical synthesis between Bourdieu’s critical sociology, Boltanski’s social actor theory and Lahire’s psychological sociology. Currently, these three currents operate independently of each other, without any kind of dialogue. And yet, far from being incompatible, these sociologies offer opportunities for exploring how they might complement and mutually enrich each other. (shrink)

Plato and his Predecessors considers how Plato represents his philosophical predecessors in a late quartet of dialogues: the Theaetetus, the Sophist, the Politicus and the Philebus. Why is it that the sophist Protagoras, or the monist Parmenides, or the advocate of flux, Heraclitus, are so important in these dialogues? And why are they represented as such shadowy figures, barely present at their own refutations? Should we feel inadequate when we fail to be healthy, balanced, and well-adjusted? Is it realistic or even desirable to strive for such an existential equilibrium? Condemning our current cultural obsession with cheerfulness and "positive thinking," Mari Ruti calls for a resurrection of character that honors our more eccentric frequencies and argues that sometimes a tormented and anxiety-ridden life can also be rewarding. Ruti critiques the search for personal meaning and pragmatic attempts to normalize human beings' unruly and idiosyncratic natures. (...) Exposing the tragic banality of a happy life commonly lived, she instead emphasizes the advantages of a lopsided life rich in passion and fortitude. She also shows what matters is not our ability to evade existential uncertainty but our courage to meet adversity in such a way that we do not become irrevocably broken. We are in danger of losing the capacity to cope with complexity, ambiguity, melancholia, disorientation, and disappointment, Ruti warns, leaving us feeling less "real" and less connected and unable to process a full range of emotions. Heeding the call of our character means acknowledging the marginalized, chaotic aspects of our being, and it is precisely these creative qualities that make us inimitable and irreplaceable. (shrink)

The chapter provides a critical survey of English-language feminist work in aesthetics since the early 1970s. The aim is to focus on those areas of feminist inquiry that have most significantly affected philosophical aesthetics in the analytic tradition: the development of a new self-conception of the discipline that sees the philosophy of art and aesthetics as a theoretical enterprise with its own political content and political consequences, one deeply enmeshed in a patriarchal view of the world.

Herbert Fingarett's achievements range from his assault upon the misconceived 'disease theory' of alchoholism, through social philosophy, philosophy of law, and philosophical psychology, to Chinese studies and Confucian thought. Fingarette's major works include 'The Self in Transformation' (1963), 'Self-Deception' (1969), 'Confucius---The Secular as Sacred' (1972), and 'The Meaning of Criminal Insanity' (1972). His Book, 'Heavy Drinking: The Myth of Alchoholism as a Disease' (1988), transformed the public debate on alchohol treatment and made Fingarette the target of an intense barrage of (...) abuse and vituperation from entrepreneurs in the alchohol-treatment industry. 'Rules, Rituals, and Responsibilities' contains Fingarette's intellectual autobiography, nine papers by leading scholars on different aspects of Fingarette's thought, and Fingarette's response to each of these papers.
