Ronald Coase is usually considered anything but a methodologist. Thus, it is not surprising that, in the introduction to "How Should Economists Choose?", which is the only paper Coase wrote on a methodological topic, he readily confessed his relative ignorance of philosophy of science, candidly observing that "Words like epistemology do not come tripping from my tongue" (HSEC, 6). However, given the importance of this Nobel Prize winner's contribution to the renewal of theoretical thinking in economics, everyone (...) should admit that his infrequent reflections on methodology, however crude they might look to methodologists, undoubtedly merit close consideration. Whatever methodological clarification these reflections might procure, it is surely worthwhile briefly to analyze them, with the hope of understanding a little better some dimensions of Ronald Coase's way of thinking and, more specifically, of emphasizing some implications of the close relationship between his methodological views and his radical conception of the market. With this in mind, I will first illustrate how far these methodological views seem, at first glance, to be dominated by a fundamental commitment to a straightforward realism; I will then show that they are instead subordinated, in a more complex way, to what I have just called Coase's radical conception of the market and, in conclusion, I will point out some questions raised by this situation. Ronald Coase has been a vigorous critic of mainstream economic theory, arguing that it is unrealistic and that a good theory is realistic. The attributes "realistic" and "unrealistic" appear in three senses at least in Coase: one related to narrow ness and breadth; another related to abstracting from particularities (and the issue of "blackboard economics"); and the third related to correspondence with the legal. This essay explores the detailed argument of the Coase Theorem, as found in Ronald Coase’s “The Problem of Social Cost” and subsequently defended by Coase in The Firm, the Market, and the Law. Fascination with the Coase Theorem arises over its apparently unassailable counterintuitive conclusion that the imposition of legal liability has no effect on which of two competing uses of land prevails, and also over the general difficulty in tying down an unqualified statement of (...) the theorem. Instead of entering the debate over what exactly the theorem holds, this article suggests that the core of Coase’s reasoning is flawed and to the extent that any version of the theorem relies upon this reasoning it can be disproved. It is further suggested that a version of the theorem which avoided the need for Coase’s core argument by focusing on “the efficiency thesis” at the expense of “the invariance thesis” would be insufficiently significant to merit the status of a theorem; and that, in any event, Coase’s reasoning does not sustain an efficient outcome. The heart of the essay comprises the allegation of an error made by Coase when he transferred his core argument to the context of economic rents. The essay commences by considering and modelling the nature of the counter-intuitive thrust to the Coase Theorem, which is used to trace the development of Coase’s reasoning, and ultimately to expose the flaw it contains. Ancillary observations are made on the relationship between the Coasean analysis of characteristically legal problems and the conditions of general market equilibrium, and the theoretical status of law-and-economics. ABSTRACT Ken Hanly's recent article in this Journal (Vol. 9, No. 1, 1992) takes issue with Ronald Coase's approach to resolving problems of externalities, as set forth in his classic paper ‘The Problem of Social Cost’. I argue that Hanly's discussion of Coase misinterprets or inappropriately rejects certain aspects of Coase's analysis, specifically, with regard to the reciprocal nature of externalities and the economic role of government. The resolution of externality problems is presented as an issue (...) of selective normative choice as to whose interests are to count; neither efficiency nor morality claims are uniquely dispositive of the issue. He received B.A. degrees from both Harvard College and Oxford University, and an LL.B. from Harvard Law School and clerked for Judge Learned Hand. He was (...) associated with a law firm in New York (Sullivan and Cromwell) and was a professor of law at Yale University Law School from 1962-1969. He has been Professor of Jurisprudence at Oxford and Fellow of University College since 1969. While available to a multitude, routine health precautions and basic, nonspecialized medical services are lacking in many societies. This may in part be the outcome of attitudinal distortions, not only at the national and global levels, but fundamentally within the patient-physician encounter. Demands for a disturbance-free subsistence clash with values of power and control within health-care sub-systems resulting in an overall neglect of primary needs and a distribution of medical services that benefits select groups. True needs are misrepresented and an (...) intensification of particular services does not fulfill one's duties toward those who realize little or no services at all. The entire institutional system of medicine requires a rebalancing of rights, intentions and outcomes, beginning with the correlative experiences of patient and physician. (shrink)

Saul Kripke is struck by a skeptical argument which he says is neither Wittgenstein’s nor his own. I call this new skeptic “Saul Wittgenstein”. SW’s conclusion is that there is no such thing as following a rule. My first aim is to show that Kripke misunderstands the Investigations when he says it offers a “skeptical solution” to SW’s paradox. Wittgenstein’s view of philosophy commits him to a dissolution of the paradox. I show next that LW’s writing contains an implicit dissolution (...) of it. Finally, I point out the main lesson to be derived from Kripke’s discussion--namely, that there is nothing which is common and peculiar to what we call following a rule. (shrink)

El ser humano no sólo tiene que sobrevivir sino lograr la fundamental biopsicosocial realización tanto individual como colectiva. Por lo tanto, es imperativo, recuperar al Otro, al necesitado, dentro del discurso y, sobre todo, en la acción política, mirando al Otro como un fin en sí mismo, y no como un medio. Este es el origen y debe volver a ser la finalidad primordial de la política interna y externa de cada gobierno. Para ello, la reflexión filosófica nos proporciona nuevas perspectivas para reestructurar la realidad, cambiando, y mejorando, las escalas de valores y nuestro modo de actuar. La postpandemia nos plantea un único objetivo, el restaurar y reactivar las verdaderas relaciones intersubjetivas, rehumanizando al hombre, es decir, volviendo a la raíz de la esencia de toda sociedad, que no es otra que el ser humano mismo, como un fin en sí mismo. No se podrá lograr de manera inmediata, por lo tanto es fundamental recanalizar todas las herramientas e instituciones políticas hacia y para el bienestar del hombre, sin devastar su entorno, donde la reflexión filosófica es primordial para construir un nuevo mundo. One of the more powerful impressions created by vision is that of a coherent, richly-detailed world where everything is present simultaneously. Indeed, this impression is so compelling that we tend to ascribe these properties not only to the external world, but to our internal representations as well. But results from several recent experiments argue against this latter ascription. For example, changes in images of real-world scenes often go unnoticed when made during a saccade, flicker, blink, or movie cut. This "change (...) blindness" provides strong evidence against the idea that our brains contain a picture-like representation of the scene that is everywhere detailed and coherent. (shrink)

The theory of the firm initially developed by Ronald Coase has made explicit the political nature of firms by putting hierarchy at the heart of the economic process. Theories of workplace democracy articulate this intuition in the normative terms of the conditions under which this political power can be legitimate. This paper presents an organizational theory of workplace democracy, and contends that the democratization of firms requires that we take their organizational dimension explicitly into account. It thus construes (...) democracy as an organizational principle and juxtaposes it to market, hierarchy, and norm-compliance as rival principles for the organization of economic activities. Attempts to construe democracy as an organizational principle with unique features in the tradition of transaction-cost economics are discussed before proposing an innovative solution based on an updated version of grid/group cultural theory of politics, adjusted to accommodate the basic requirements of democratic theory. Politics in America are polarized and trivialized, perhaps as never before. In Congress, the media, and academic debate, opponents from right and left, the Red and the Blue, struggle against one another as if politics were contact sports played to the shouts of cheerleaders. In Dangerous Minds, Ronald Beiner traces the deeper philosophical roots of such far-right ideologues as Richard Spencer, Aleksandr Dugin, and Steve Bannon, to the writings of Nietzsche and Heidegger—and specifically to the aspects of their thought that express revulsion for the liberal-democratic view of life.

While the notion of the mind as information-processor--a kind of computational system--is widely accepted, many scientists and philosophers have assumed that this account of cognition shows that the mind's operations are characterizable independent of their relationship to the external world. Existential Cognition challenges the internalist view of mind, arguing that intelligence, thought, and action cannot be understood in isolation, but only in interaction with the outside world. Arguing that the mind is essentially embedded in the external world, Ron McClamrock provides (...) a schema that allows cognitive scientists to address such long-standing problems in artificial intelligence as the "frame" problem and the issue of "bounded" rationality. Extending this schema to cover progress in other studies of behavior, including language, vision, and action, McClamrock reinterprets the importance of the organism/environment distinction. As consumer lifestyles have changed over recent decades, people have increasingly turned to meals prepared away from home. A major consequence of this shift in eating patterns has been a concomitant rise in obesity rates worldwide. Research has consistently documented that consumers tend to make less healthy choices when purchasing prepared meals away from home. In part, this can be attributed to inadequate information at the time of purchase; both nutrition experts and lay consumers tend, for example, to underestimate calories (...) in food purchased away from home and thus portion sizes tend to be larger. Thus, by requiring restaurants and other purveyors of prepared foods to provide the calorie content and other nutrition information at the point of purchase, consumers should be able to make more informed decisions and public health should be improved. The often maligned Affordable Care Act (i.e., “Obamacare”) addressed this issue in a mandate calling for compulsory nutrition labeling of prepared foods at the point of sale. In response to this effort, conservatives in Congress introduced the “Common Sense Nutrition Disclosure Act” (CSNDA) which, if enacted, would have effectively eviscerated the menu labeling provisions mandated by the Affordable Care Act. The stated rationale behind this legislation: to protect small business and prevent job loss resulting from overly‐burdensome federal regulations. This article provides a historical look at the evolution of federally mandated menu labeling in the United States with particular emphasis on opposition to its passage. The position is taken such that this legislation is beneficial, warranted, and long overdue, and its opposition, as reflected in the CSNDA, points to the need for new metrics when evaluating public policy. The problem of providing mandated medical care has become commonplace as correctional systems in the United States struggle to manage unprecedented increases in its aging prison population. This study explores older incarcerated women’s perceptions of prison health care policies and their day-to-day survival experiences. Aggregate data obtained from a sample of 327 older women residing in prison facilities in five Southern states were used to identify a baseline of health conditions and needs for this vulnerable group. With an average of (...) 4.2 chronic health conditions, frequently histories of victimization, and high rates of mental health issues, the women’s experiences of negotiating health care was particularly challenging. By incorporating the voices of older women, we expose the contradictions, dilemmas, and obstacles they experience in their attempts to obtain health care. It is clear from the personal accounts shared that, despite court mandates, penal harm practices such as delaying or denying medical treatment as well as occasional staff indifferences are common in women’s prisons. With older women having the greatest need for health care, an age- and gender-sensitive approach is recommended. (shrink)

This paper is designed to do three things while discussing the challenge of ethical behavior in organization. First, it discusses some reasons why unethical behavior occurs in organization. Secondly, the paper highlights the importance of organizational culture in establishing an ethical climate within an organization. Finally, the paper presents some suggestions for creating and maintaining an ethically-oriented culture.

My thesis is that biology is most plausibly regarded as a universal, as distinct from a provincial, science. First, I develop the general notion of a provincial science, formulate three criteria for applying the concept, and present brief examples illustrating their use. Second, I argue that a consideration of population genetics as a characteristic example of a basic biological theory strengthens the prior presumption that biology is not a provincial science. Finally, I examine two arguments to the effect that biology (...) is a provincial science. The first concerns biology's exclusively terrestrial evidence base, the second the logical character of its laws. I introduce considerations that weaken the persuasiveness of the first argument and then show that the second one rests upon a false premise and so should be rejected. (shrink)
