Marilena chaui, pensadora contemporânea do teológico-político.Douglas Ferreira Barros - 2017 - Cadernos Espinosanos 37:125-145.

A questão (...)

This article presents Jean Bodin’s critic to the juridic approach of the laws and the idea of justice in his time. Firstly, it presents Bodin’s opposition to the glossators of the Roman Law. Secondly, it defends that Bodin considers the method as a tool that could make it possible to achieve an exact knowledge of the principles of the law. Finally, it deals with Bodin’s approach to the knowledge of the law as scientific knowledge. In this sense, the article try (...)

The aim of this paper was to present ongoing research on the social representations relating to ritalin in Brazil between 1998 and 2008. Over this period, there was a considerable increase in ritalin usage and expansion of its use to purposes other than therapeutic use. Ritalin has been used not only for treating attention disorders, but also to enhance cognitive functions in healthy individuals. The research has developed through two fields of investigation with different methodologies. In the first field, Brazilian (...)

However, the putative links between biomarkers of mental health and immune efficiency in exercising subjects have been scarcely investigated. The aim of this study was to verify the effect of a 14-week combined chair-based exercise program on salivary steroid hormones and anti-microbial proteins, functional fitness, and MWB indexes in pre-frail older women.MethodsThe participant women were randomly divided into the exercising group and the non-exercising (...)

Learning to See with Different Eyes: A Nietzschean Challenge to Multicultural Dialogue.Douglas W. Yacek - 2014 - Educational Theory 64 (2):99-121.
Empathy is a necessity in our multicultural world. Modern democratic societies are home to communities with the most diverse religious, political, and moral convictions, and these convictions often directly, even perilously, contradict one another. Educational theorists differ on how empathy can be taught in the face of these contradictions. Does proper pedagogical action entail an attempt to teach students to understand the other, to see their world through the eyes of the other? Or is such an attempt doomed to fail, (...)

This book provides a systematic analysis of many common argumentation schemes and a compendium of 96 schemes. The study of these schemes, or forms of argument that capture stereotypical patterns of human reasoning, is at the core of argumentation research. Surveying all aspects of argumentation schemes from the ground up, the book takes the reader from the elementary exposition in the first chapter to the latest state of the art in the research efforts to formalize and classify the schemes, outlined (...)

Think tanks are especially active in setting frames for what constitutes politically and socially acceptable ways of thinking about economic activity and the rights or obligations of corporations. Their operation and influence has been acknowledged and analysed in political science and policy analysis, but in organization and (...)

: Errors in science range along a spectrum from those relatively local to the phenomenon (usually easily remedied in the laboratory) to those more conceptually derived (involving theory or cultural factors, sometimes quite long-term). One may classify error types broadly as material, observational, conceptual or discoursive. This framework bridges philosophical and sociological perspectives, offering a basis for interfield discourse. A repertoire of error types also supports error analytics, a program for deepening reliability through strategies for regulating and probing error.

This paper proposes an argumentation-based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes, which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of (...)

Appeal to Expert Opinion: Arguments From Authority.Douglas Neil Walton - 1997 - University Park, PA, USA: Pennsylvania State University Press.
A new pragmatic approach, based on the latest developments in argumentation theory, analyzing appeal to expert opinion as a form of argument. Reliance on authority has always been a common recourse in argumentation, perhaps never more so than today in our highly technological society when knowledge has become so specialized—as manifested, for instance, in the frequent appearance of "expert witnesses" in courtrooms. When is an appeal to the opinion of an expert a reasonable type of argument to make, and when (...)

The Super Bowl and the Ox-Phos Controversy: "Winner-Take-All" Competition in Philosophy of Science.Douglas Allchin - 1994 - PSA: Proceedings of the Biennial Meeting of the Philosophy of Science Association 1994:22 - 33.
Several diagrams and tables from review articles during the Ox-Phos Controversy serve as an occasion to assess the nature of competition in models of theory choice in science. Many models follow "Super-Bowl" principles of polar, either-or, winner-take-all competition. A significant alternative highlighted by this episode, however, is the differentiation of domains. Incommensurability and the partial divergence of overlapping domains serve both as signals and context for shifting frameworks of competition. Appropriate strategies may thus help researchers diagnose the status of competition (...)

The new model he develops, drawing on methods of argumentation theory that are gaining wide acceptance in computing fields like artificial intelligence, can be used to identify, analyze, and evaluate specific types of legal argument. In contrast with approaches that rely on deductive and inductive logic and (...)

    Formalizing Informal Logic.Douglas Walton & Thomas F. Gordon - 2015 - Informal Logic 35 (4):508-538.
This paper presents a formalization of informal logic using the Carneades Argumentation System, a formal, computational model of argument that consists of a formal model of argument graphs and audiences. Conflicts between pro and con arguments are resolved using proof standards, such as preponderance of the evidence. CAS also formalizes argumentation schemes. Schemes can be used to check whether a given argument instantiates the types of argument deemed normatively appropriate for the type of dialogue.

The notion of burden of proof and its companion notion of presumption are central to argumentation studies. This book argues that we can learn a lot from how the courts have developed procedures over the years for allocating and reasoning with presumptions and burdens of proof, and from how artificial intelligence has built precise formal and computational systems to represent this kind of reasoning. The book provides a model of reasoning with burden of proof and presumption, based on analyses of (...)

Argumentation, which can be abstractly defined as the interaction of different arguments for and against some conclusion, is an important skill to learn for everyday life, law, science, politics and business. The best way to learn it is to try it out on real instances of arguments found in everyday conversational exchanges and legal argumentation. The introductory chapter of this book gives a clear general idea of what the methods of argumentation are and how they work as tools that can (...)
