Recent trends in business ethics along with growing attacks upon unions, suggest that employee rights will be a major social concern for business managers during the next decade. However, in most of the discussions of employee rights to date, the very meaning and legitimacy of such rights are often uncritically taken for granted. In this paper, we develop an account of employee rights and defend this conception against what we take to be the strongest in-principle objections to it.

This book develops a novel approach to distributive justice by building a theory based on a concept of desert. As a work of applied political theory, it presents a simple but powerful theoretical argument and a detailed proposal to eliminate unmerited inequality, poverty, and economic immobility, speaking to the underlying moral principles of both progressives who already support egalitarian measures and also conservatives who have previously rejected egalitarianism on the grounds of individual freedom, personal responsibility, hard work, or economic efficiency. By using an agnostic, flexible, data-driven approach to isolate luck and ultimately measure desert, this proposal makes equal opportunity initiatives both more accurate and effective as it adapts to a changing economy. It grants to each individual the freedom to genuinely choose their place in the distribution. It provides two policy variations that are perfectly economically efficient, and two others that are conditionally so. It straightforwardly aligns outcomes with widely shared, fundamental moral intuitions. Lastly, it demonstrates much of the above by modeling four policy variations using 40 years of survey data from the Panel Study of Income Dynamics. (shrink)

In order to follow this request, not only must one know geometry, which treats linear magnitudes; one must also know the relations between geometry and the art which treats kinds. The problem of the first cut in the line is the problem of determining what ratio of (...) two parts of a line is the same as the ratio of the two kinds: visible and thinkable. In order to solve this problem, a procedure seems to be needed for deciding when a ratio of magnitudes, a geometric ratio, is the same as a ratio of kinds, or at least what ratio of magnitudes is the same as the ratio of visible to thinkable. Frankfurt’s “Alternate Possibilities and Moral Responsibility” made an important intervention into the literature on moral responsibility via a classical Frankfurt-type example, arguing that “the principle of alternate possibilities” is false. This paper argues that classical Frankfurt-type examples fail due to the use of agentic counterfactual interventions who lack agency. Using finite state machines to illustrate, I show the models that classical Frankfurt-type examples must use and why they are incongruent with leeway incompatibilist beliefs—the motivating interlocutor for classical Frankfurt-type examples. I (...) then argue that returning agency to the agentic counterfactual intervention also returns alternate possibilities to the actual sequence of events, undermining a core premise of Frankfurt’s. On the State of Nature and On the Sovereignty of the People are Maistre's most comprehensive treatment of Rousseau's ideas and his most sustained critique of the ideological foundations of the revolution. On the State of Nature, a detailed critique of Rousseau's Discourse on the Origin and Foundations of Inequality, focuses on Rousseau's belief in the natural goodness of man; On the Sovereignty of the People, a critique of Social Contract, explores Rousseau's theory of popular sovereignty. In Maistre's eyes Rousseau (...) encouraged the socially destructive individualism that lay at the heart of the French Revolution. However, the essays reveal some surprising ambiguities in the relationship between two seminal thinkers who are usually thought of as polar opposites, suggesting that Maistre's vision was more akin to Rousseau's than he would have admitted. Against Rousseau offers valuable insights into the evolution of Maistre's counter-revolutionary ideas during the crucial years of 1792-97 and illustrates his remarkable insights into society and politics. Although often neglected, An Examination of the Philosophy of Bacon is crucial to understand the epistemological basis for Maistre's critique of modern science as well as his criticisms of other aspects of Enlightenment thought. Given Maistre's stature in the history of conservative thought, his critique of Bacon remains significant for what it tells us about Maistre's own thought, what it reveals about attitudes toward science in his time, and what it contributes to issues that are still debated today. The work (...) also showcases Maistre's polemical skills and his powerful prose style. Richard Lebrun's annotated translation includes Maistre's complete text, an extensive introduction that places the work in context and provides a critical exposition and assessment of Maistre's criticisms of Bacon, biographical notes on persons cited or mentioned by Maistre, and a bibliography. Differences between Maistre's manuscript and the printed text, first published fifteen years after the author's death, are noted, and Maistre's numerous citations have been identified, verified, and translated, making this the only authoritative and fully accurate edition of the work in either French or English. Written and set on the banks of the Neva, St Petersburg Dialogues is a startlingly relevant analysis of the human prospect at the end of the twentieth century. As the literary critic George Steiner has remarked, "the age of the Gulag and of Auschwitz, of famine and ubiquitous torture,... nuclear threat, the ecological laying waste of our planet, the leap of endemic, possibly pandemic, illness out of the very matrix of libertarian progress" is exactly what Maistre foretold. In the Dialogues (...) Maistre addressed a number of topics which are discussed briefly or not at all in his other works already available in English. These include an apologetic for traditional Christian beliefs about providence, reflections on the social role of the public executioner and the "divinity" of war, a critique of John Locke's sensationalist psychology, meditations on prayer and sacrifice, and a mini-course on "illuminism." The literary form is that of the "philosophical conversation" -- one that allowed Maistre to be deliberately provocative and to indulge his taste for paradox, a "methodical extravagance" that he judged particularly appropriate for the eighteenth-century salon. Translator and editor Richard Lebrun provides a full scholarly edition of this classic work, complete with an introduction, chronology, critical bibliography, and generous explanatory notes. The Dialogues will be of interest to scholars of literary history as well as the history of ideas. (shrink)

Paradoxically, the political success of human rights is often taken to be its philosophical failing. From US interventions to International NGOs to indigenous movements, human rights have found a place in diverse political spaces, while being applied to disparate goals and expressed in a range of practices. This heteronomy is vital to the global appeal of human rights, but for traditional moral and political philosophy it is something of a scandal. This paper is an attempt to understand and theorize human (...) rights on the terrain of the social actors who put them to use, particularly radical activists that have a more critical relationship to human rights. Attempting to avoid the philosophical pathology of demanding that the world reflect our conception of it, we base our reflection on the ambiguous, and potentially un-patterned, texture of human rights practice—taking seriously the idea that human rights express a relationship of power, importantly concerned with its legitimate arrangement and limitation. In both the philosophical literature and human rights activism, there seems to be a consensus on basic rights as undeniable moral principles of political legitimacy. This use of human rights is contrasted with radical social movements that reject this conception of rights as ideological and illegitimate, making specific reference to the Zapatista movement (Chiapas, Mexico) and the Landless Peasant Movement of Brazil (MST, from the Portuguese Movimento dos trabalhadores rurais Sem Terra), which are critical of the human rights discourse, but also make strategic use of the idea and offer alternative articulations of political legitimacy. ABSTRACT This paper discusses the respective contributions to development ethics made by Louis-Joseph Lebret (1897–1966) and his pupil and successor Denis Goulet (1931–2006). Sections 2 and 3 present steps in the emergence of a field of development ethics, and introduce the work of Lebret and Goulet, noting similarities and contrasts. Sections 4 and 5 clarify different senses and forms of ‘development ethics’, to then discuss who might be called ‘father of development ethics’. Lebret had devised a field of human (...) economics and in the 1950s called for an ethics of development, which he began to sketch. His work made significant advances, especially if development ethics is seen as an interdisciplinary policy-oriented field rather than as a subdiscipline in philosophical ethics. In the 1960s, Goulet went on to outline development ethics as a philosophical subdiscipline and to articulate various themes. In his later work though, while always speaking of a ‘discipline’ of development ethics but mostly meaning disciplined investigation, Goulet largely pursued, as had Lebret, a path toward a policy-oriented field of ‘practical ethics’, not a (sub)disciplinary path in a conventional academic sense. Es geht vornehmlich um fundamentale Aporien der Ontologie und der Naturphilosophie, wie die Frage nach der Interdependenz ideeller Prinzipien und wahrnehmbarer Phänomene oder die Plausibilität der Teleologie als methodisches Prinzip der Naturerklärung. Theophrast analysiert und bewertet die geläufigen konkurrierenden Lösungsvorschläge und zeigt ihre (...) Defizite unerbittlich auf: ein Stück synoptischer Metaphysikkritik, das an zeitgenössische Typen der Dekonstruktion erinnert. Der Text hat seinen Wert als Dokument für den Übergang von einer konstruktiven zu einer eher skeptischen, in Teilen sogar destruktiven Phase der klassischen griechischen Tradition und zeigt exemplarisch, vor allem am Verhältnis der theophrastschen zur aristotelischen "Metaphysik", wie sehr die jeweiligen philosophischen Positionen sich in Abhängigkeit von der jeweiligen Rezeption vorgängiger Rezeptionsprozesse entwickelten. Die erstmals mit einer deutschen Übersetzung erscheinende kritische Edition dieses philosophiehistorischen Schlüsseltextes hat das Ziel, diese Bedeutung des bislang zu wenig beachteten Dokuments aus der Schule des Aristoteles sichtbar zu machen. While COVID-19 has generated a massive burden of illness worldwide, healthcare workers (HCWs) have been disproportionately exposed to SARS-CoV-2 coronavirus infection. During the so-called ‘first wave’, infection rates among this population group have ranged between 10% and 20%, raising as high as one in every four COVID-19 patients in Spain at the peak of the crisis. Now that many countries are already dealing with new waves of COVID-19 cases, a potential competition between HCW and non-HCW patients for scarce resources can (...) still be a likely clinical scenario. In this paper, we address the question of whether HCW who become ill with COVID-19 should be prioritised in diagnostic, treatment or resource allocation protocols. We will evaluate some of the proposed arguments both in favour and against the prioritisation of HCW and also consider which clinical circumstances might warrant prioritising HCW and why could it be ethically appropriate to do so. We conclude that prioritising HCW’s access to protective equipment, diagnostic tests or even prophylactic or therapeutic drug regimes and vaccines might be ethically defensible. However, prioritising HCWs to receive intensive care unit (ICU) beds or ventilators is a much more nuanced decision, in which arguments such as instrumental value or reciprocity might not be enough, and economic and systemic values will need to be considered. In this presentation I take a close look at Kant’s notion of “orientation” as it arises in a minor essay of 1786 in order to show how this relatively obscure moment forces us to reconsider the central division between epistemology and aesthetics. What makes Kant’s notion orientation difficult to place in a critical system that separates conceptually grounded cognition from the affective nature of aesthetics is that orientations turn out to be claims to knowledge which can not be had without (...) an irreducible aesthetic or “felt” discrimination. So what is philosophically at issue in examining Kant’s notion of orientation is the question of whether there are indeed some features of objects or states of affairs which are not properly recognized prior to or independently of feeling a certain way about them. In other words, are our feelings epistemologically relevant? The official Kantian answer is, of course, a resounding “no”. By reconstructing the logic of “orientation” as deployed in the 1786 essay I show where the attempt to separate cognition from feelings leads into a vicious “Kantian Circle”. This logical circularity anticipates similar problems in the third critique’s explanation of beauty and life. I end by returning to the notion of “orientation” in order to suggest a way out of this “Kantian Circle”. (shrink)

When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Aprs une existence triomphale de plus d'un sicle, le marxisme aborde l'ge des dceptions et des reniements. La tragdie du marxisme rappelle celle du Pre Goriot et du Roi Lear; il est reni par ses enfants. Or si le marxisme est peut-tre moribond, la dialectique se porte, en revanche, comme un charme; elle (...) reste (Sartre l'a bien vu) l'instrument incontournable de toute dmystification idologique. Ce n'est certes pas sans bonne raison que le stalinisme avait la dialectique en horreur. Le but des tudes runies dans ce volume est de contribuer la sauvegarde de ce chargement prcieux qui surnage, non sans difficult, aprs le terrible naufrage du marxisme politique et conomique. SummaryHempel's Deductive‐Nomological model of explanation is compared to Sellars' brand of essentialism. The source of their differences is shown to lie in their views on the explanatory role of inductively based generalizations. An adequate explanation requires a reasoned account of why an empirical generalization fails. On Sellars' view this entails concentrating on the nature of the things whose behavior is in question. We thereby remove ourselves from the misleading positivist methodology in which one counterinstance renders a generalization uninteresting. Translating ethical theories into clinical practice presents a perennial challenge to educators. While many suggestions have been put forth to bridge the theory-practice gap, none have sufficiently remedied the problem. We believe the ascendance of hospital medicine, as a dominant new force in medical education and patient care, presents a unique opportunity that could redefine the way clinical ethics is taught. The field of hospital medicine in the United States is comprised of more than 50,000 hospitalists—specialists in inpatient medicine—representing the (...) fastest growing subspecialty in the history of medicine, and its members have emerged as a dominant new force around which medical education and patient care pivot. This evolution in medical education presents a unique opportunity for the clinical ethics community. Through their proximity to patients and trainees, hospitalists have the potential to teach medical ethics in real time on the wards, but most hospitalists have not received formal training in clinical ethics. We believe it is time to strengthen the ties between hospital medicine and medical ethics, and in this article we outline how clinical ethicists might collaborate with hospitalists to identify routine issues that do not rise to the level of an “ethics consult,” but nonetheless require an intellectual grounding in normative reasoning. We use a clinical vignette to explore how this approach might enhance and broaden the scope of medical education that occurs in the inpatient setting: A patient with an intra-abdominal abscess is admitted to the academic hospitalist teaching service for drainage of the fluid, hemodynamic support, and antimicrobial therapy. During the initial encounter with the hospitalist and his team of medical students and residents, the patient reports night sweats and asks if this symptom could be due to the abscess.
