    A defense of employee rights.Joseph R. Des Jardins & John J. McCall - 1985 - Journal of Business Ethics 4 (5):367-376.
Recent trends in business ethics along with growing attacks upon unions, suggest that employee rights will be a major social concern for business managers during the next decade. However, in most of the discussions of employee rights to date, the very meaning and legitimacy of such rights are often uncritically taken for granted. In this paper, we develop an account of employee rights and defend this conception against what we take to be the strongest in-principle objections to it.

Chance, Merit, and Economic Inequality: Rethinking Distributive Justice and the Principle of Desert.Joseph de la Torre Dwyer - 2019 - Springer Verlag.
This book develops a novel approach to distributive justice by building a theory based on a concept of desert. As a work of applied political theory, it presents a simple but powerful theoretical argument and a detailed proposal to eliminate unmerited inequality, poverty, and economic immobility, speaking to the underlying moral principles of both progressives who already support egalitarian measures and also conservatives who have previously rejected egalitarianism on the grounds of individual freedom, personal responsibility, hard work, or economic efficiency. How to Divide the Divided Line.Gregory des Jardins - 1976 - Review of Metaphysics 29 (3):483-496.
"TAKE A LINE cut in two unequal sections, one for the kind that is seen, the other for the kind that is thought, and go on and cut each section in the same ratio". In order to follow this request, not only must one know geometry, which treats linear magnitudes; one must also know the relations between geometry and the art which treats kinds. The problem of the first cut in the line is the problem of determining what ratio of (...)

A Fundamental Failure of Frankfurt’s Agentic Counterfactual Intervention: No Agency.Joseph de la Torre Dwyer - 2020 - Philosophia 49 (2):633-642.
Frankfurt’s “Alternate Possibilities and Moral Responsibility” made an important intervention into the literature on moral responsibility via a classical Frankfurt-type example, arguing that “the principle of alternate possibilities” is false. This paper argues that classical Frankfurt-type examples fail due to the use of agentic counterfactual interventions who lack agency. Using finite state machines to illustrate, I show the models that classical Frankfurt-type examples must use and why they are incongruent with leeway incompatibilist beliefs—the motivating interlocutor for classical Frankfurt-type examples. I (...)

Against Rousseau: On the State of Nature and on the Sovereignty of the People.Joseph de Maistre - 1996 - Mcgill-Queen's University Press.
On the State of Nature and On the Sovereignty of the People are Maistre's most comprehensive treatment of Rousseau's ideas and his most sustained critique of the ideological foundations of the revolution. On the State of Nature, a detailed critique of Rousseau's Discourse on the Origin and Foundations of Inequality, focuses on Rousseau's belief in the natural goodness of man; On the Sovereignty of the People, a critique of Social Contract, explores Rousseau's theory of popular sovereignty. In Maistre's eyes Rousseau (...)

An Examination of the Philosophy of Bacon: Wherein Different Questions of Rational Philosophy Are Treated.Joseph de Maistre & Richard A. Lebrun - 1998 - Mcgill-Queen's University Press.
Although often neglected, An Examination of the Philosophy of Bacon is crucial to understand the epistemological basis for Maistre's critique of modern science as well as his criticisms of other aspects of Enlightenment thought. Given Maistre's stature in the history of conservative thought, his critique of Bacon remains significant for what it tells us about Maistre's own thought, what it reveals about attitudes toward science in his time, and what it contributes to issues that are still debated today. The work (...)

St Petersburg Dialogues: Or Conversations on the Temporal Government of Providence.Joseph de Maistre - 1993 - Mcgill-Queen's University Press.
Written and set on the banks of the Neva, St Petersburg Dialogues is a startlingly relevant analysis of the human prospect at the end of the twentieth century. As the literary critic George Steiner has remarked, "the age of the Gulag and of Auschwitz, of famine and ubiquitous torture,... nuclear threat, the ecological laying waste of our planet, the leap of endemic, possibly pandemic, illness out of the very matrix of libertarian progress" is exactly what Maistre foretold. In the Dialogues (...)

Philosophers, Activists, and Radicals: A Story of Human Rights and Other Scandals. [REVIEW]Joseph Hoover & Marta Iñiguez De Heredia - 2011 - Human Rights Review 12 (2):191-220.
Paradoxically, the political success of human rights is often taken to be its philosophical failing. From US interventions to International NGOs to indigenous movements, human rights have found a place in diverse political spaces, while being applied to disparate goals and expressed in a range of practices. This heteronomy is vital to the global appeal of human rights, but for traditional moral and political philosophy it is something of a scandal. This paper is an attempt to understand and theorize human (...)

Comparing two pioneers of development ethics: Louis-Joseph Lebret and Denis Goulet.Montserrat des GasperCulebro Juárez - 2021 - Journal of Global Ethics 17 (2):260-278.
ABSTRACT This paper discusses the respective contributions to development ethics made by Louis-Joseph Lebret (1897–1966) and his pupil and successor Denis Goulet (1931–2006). Sections 2 and 3 present steps in the emergence of a field of development ethics, and introduce the work of Lebret and Goulet, noting similarities and contrasts. Sections 4 and 5 clarify different senses and forms of ‘development ethics’, to then discuss who might be called ‘father of development ethics’. Lebret had devised a field of human (...)

Über das Wesen der menschlichen Freiheit.Friedrich Wilhelm Joseph Schelling - 2011 - Meiner, F.

Should healthcare workers be prioritised during the COVID-19 pandemic? A view from Madrid and New York.Diego Real de Asua & Joseph J. Fins - 2022 - Journal of Medical Ethics 48 (6):397-400.
While COVID-19 has generated a massive burden of illness worldwide, healthcare workers (HCWs) have been disproportionately exposed to SARS-CoV-2 coronavirus infection. During the so-called ‘first wave’, infection rates among this population group have ranged between 10% and 20%, raising as high as one in every four COVID-19 patients in Spain at the peak of the crisis. Now that many countries are already dealing with new waves of COVID-19 cases, a potential competition between HCW and non-HCW patients for scarce resources can (...)

What is Orientation Not in Thinking?: Aesthetics, Epistemology, and the “Kantian Circle”.Joseph J. Tinguely - 2013 - In Stefano Bacin, Alfredo Ferrarin, Claudio La Rocca & Margit Ruffing (eds.), Kant und die Philosophie in weltbürgerlicher Absicht. Akten des XI. Internationalen Kant-Kongresses. Boston: de Gruyter. pp. 273-286.
In this presentation I take a close look at Kant’s notion of “orientation” as it arises in a minor essay of 1786 in order to show how this relatively obscure moment forces us to reconsider the central division between epistemology and aesthetics. What makes Kant’s notion orientation difficult to place in a critical system that separates conceptually grounded cognition from the affective nature of aesthetics is that orientations turn out to be claims to knowledge which can not be had without (...)

Phases of a Pandemic Surge: The Experience of an Ethics Service in New York City during COVID-19.Joseph J. Fins, Inmaculada de Melo-Martín, C. Ronald MacKenzie, Seth A. Waldman, Mary F. Chisholm, Jennifer E. Hersh, Zachary E. Shapiro, Joan M. Walker, Nicole Meredyth, Nekee Pandya, Douglas S. T. Green, Samantha F. Knowlton, Ezra Gabbay, Debjani Mukherjee & Barrie J. Huberman - 2020 - Journal of Clinical Ethics 31 (3):219-227.
When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...)

    Hempel Versus Sellars on Explanation.Joseph C. Pitt - 1980 - Dialectica 34 (2):95-120.
SummaryHempel's Deductive‐Nomological model of explanation is compared to Sellars' brand of essentialism. The source of their differences is shown to lie in their views on the explanatory role of inductively based generalizations. An adequate explanation requires a reasoned account of why an empirical generalization fails. On Sellars' view this entails concentrating on the nature of the things whose behavior is in question. We thereby remove ourselves from the misleading positivist methodology in which one counterinstance renders a generalization uninteresting. It is (...)

Translating ethical theories into clinical practice presents a perennial challenge to educators. While many suggestions have been put forth to bridge the theory-practice gap, none have sufficiently remedied the problem. We believe the ascendance of hospital medicine, as a dominant new force in medical education and patient care, presents a unique opportunity that could redefine the way clinical ethics is taught. The field of hospital medicine in the United States is comprised of more than 50,000 hospitalists—specialists in inpatient medicine—representing the (...)
