This study presents findings from an ontological and contextual determination of the concept of dignity. The study had a caritative and caring science perspective and a hermeneutical design. The aim of this study was to increase caring science knowledge of dignity and to gain a determination of dignity as a concept. Eriksson’s model for conceptual determination is made up of five part-studies. The ontological and contextual determination indicates that dignity can be understood as absolute dignity, the spiritual dimension characterized by (...) responsibility, freedom, duty, and service, and relative dignity, characterized by the bodily, external aesthetic dimension and the psychical, inner ethical dimension. Hans Kelsen est, sans conteste, le juriste le plus important de ce siècle. Il n'y a pas une seule question de théorie juridique qu'on puisse traiter aujourd'hui sans examiner d'abord l'analyse qu'il en fait, mais son œuvre ne concerne pas seulement le droit et la philosophie du droit ; elle touche aussi la philosophie politique, l'épistémologie, l'éthique ou la logique. Sa théorie du droit représente, à côté du réalisme, l'une des deux branches du juspositivisme moderne, connue sous le nom de (...) normativisme et que lui-même appelait " Théorie pure du droit ". Elle se donne comme une théorie scientifique qui se borne à décrire son objet, le droit positif, et qui donc est " pure " de tout jugement de valeur. La pureté ne concerne toutefois que la méthodologie. Le droit, lui, n'est nullement pur, car il exprime des choix moraux et politiques. La doctrine kelsenienne pure apparaît ainsi doublement politique : d'une part, elle se donne pour tâche de mettre en évidence la fonction idéologique du droit ; d'autre part, dans la mesure où elle analyse les dispositifs juridiques comme des moyens au service de certaines fins, elle peut servir de fondement à une véritable technologie juridique. C'est cette technologie que Kelsen prétendait appliquer à la politique et qui fonde aussi bien son travail de constituant - il est le père de la Constitution autrichienne et de la première Cour constitutionnelle - que ses écrits sur la démocratie. La Théorie générale du droit et de l'Etat présente à cet égard un intérêt exceptionnel. Elle a été écrite aux Etats-Unis, où Kelsen s'était réfugié au début de la Seconde Guerre mondiale. Comme le souligne Stanley L. Paulson dans son introduction, elle constitue une étape marquante dans l'évolution de sa pensée entre le néokantisme des origines et l'empirisme des derniers écrits. C'est aussi une présentation claire, systématique et concentrée de l'ensemble de sa doctrine et c'est le seul ouvrage de Kelsen qui porte à la fois sur les conditions de possibilité d'une science empirique du droit, sur la théorie générale du droit au sens strict - l'analyse structurale de tous les ordres juridiques possibles - et sur la théorie générale de l'Etat - l'analyse des concepts constitutifs de tout Etat possible. This commentary contributes to philosophical reflection on the growing challenge of digital distraction and the value of attention in the digital age. It clarifies the nature of the problem in conceptual and historical terms; analyzes “freedom of attention” as an organizing ideal for moral and political theorizing; considers some constraints of political morality on coercive state action to bolster users’ attentional resources; comments on corporate moral responsibility; and touches on some reform ideas. In particular, the commentary develops a response to (...) an anti-paternalistic line of argument rooted in Mill’s Harm Principle that would oppose state regulation on the grounds that securing attentional capacities is a matter of personal responsibility alone. The commentary engages throughout with James Williams’s recent work on the attention economy by identifying areas of agreement and difference. (shrink)

This chapter explores the place of remorse in Sophie de Grouchy’s moral theory, as presented in her 1798 work, Letters on Sympathy, which was originally published with her translation of Adam Smith’s Theory of Moral Sentiments. I argue that, for Grouchy, a cultivated sense of remorse weakens our self-conceit by drawing our attention to the ways in which we harm others, even for seemingly justifiable reasons. In so doing, we are led to recognize the equal standing of others, which gives (...) rise to the “sentiment of natural equality.” This “sentiment of natural equality” places a check on our norms and institutions and allows for the potential of moral progress. While Grouchy frames the Letters as a commentary on Smith’s writings, her discussion of remorse, equality, and moral progress shows her to be a bold and original thinker, and one worth taking seriously. One issue within conspiracy theory theory is whether, or to what extent, our central concept – – should map on to the common, lay sense of the term. Some conspiracy theory theorists insist that we use the term as everyday people use it. So, for example, if the term has a pejorative connotation in everyday parlance, then academic work on the concept should reflect that. Other conspiracy theory theorists take a more revisionist approach, arguing instead that while their use of (...) the theoretical concept should bear some relation to its use in natural language, it need not follow it subserviently. I argue that elements of this debate mirror related debates that were prominent in the philosophy of mind in the 1980s over folk psychology and eliminative materialism (debates that continue today, such as within the philosophy of perception and theories over how to individuate the senses). Then, there was a debate over whether the concepts of commonsense psychology, such as or, should be treated as theoretical posits, and hence open to significant revision or elimination, or whether they were instead the targets of explanation. During public health crises including the COVID-19 pandemic, resource scarcity and contagion risks may require health systems to shift—to some degree—from a usual clinical ethic, focused on the well-being of individual patients, to a public health ethic, focused on population health. Many triage policies exist that fall under the legal protections afforded by “crisis standards of care,” but they have key differences. We critically appraise one of the most fundamental differences among policies, namely the use of criteria to categorically exclude (...) certain patients from eligibility for otherwise standard medical services. We examine these categorical exclusion criteria from ethical, legal, disability, and implementation perspectives. Focusing our analysis on the most common type of exclusion criteria, which are disease-specific, we conclude that optimal policies for critical care resource allocation and the use of cardiopulmonary resuscitation (CPR) should not use categorical exclusions. We argue that the avoidance of categorical exclusions is often practically feasible, consistent with public health norms, and mitigates discrimination against persons with disabilities. (shrink)

Researchers have studied the athletes' dual careers with the aim of helping them to combine the sport and the academic–vocational sphere. Most of this research has addressed the study–sport combination, but there is a lack of studies on the work–sport combination. The main objective of this research was to explore the subjective perceptions of Spanish elite athletes when attempting to combine their careers as professional athletes with a second profession or trade. Further, this study aims to identify the access to (...) facilitating resources and the perception of obstacles and barriers to the development of a dual career. A qualitative approach was chosen to address these research questions. Interpretative phenomenological analysis was carried out on a sample of 18 elite athletes, and the data were collected using semi-structured interviews based on a set of superordinate and subordinate categories. The results showed that the athletes interviewed possessed valuable resources such as the transference of sports values to the work sphere. However, important barriers were highlighted such as the perception of sport institutions as absent entities in the work–sport combination. Thus, the study of this type of dual career seems to be one of the challenges facing the interested scientific community for the coming years. (shrink)

Othering is the construction and identification of the self or in-group and the other or out-group in mutual, unequal opposition by attributing relative inferiority and/or radical alienness to the other/out-group. The notion of othering spread from feminist theory and post-colonial studies to other areas of the humanities and social sciences, but is originally rooted in Hegel’s dialectic of identification and distantiation in the encounter of the self with some other in his “Master-Slave dialectic”. In this paper, after reviewing the philosophical (...) and psychological background of othering, I distinguish two kinds of othering, “crude” and “sophisticated”, that differ in the logical form of their underlying arguments. The essential difference is that the former is merely self-other distantiating, while the latter – as in Hegel’s dialectic – partially depends on self-other identification. While crude othering is closer to the paradigmatic notion of othering, sophisticated othering is closer to Hegel’s, but so is quasi-othering, which is nearly identical in form to sophisticated othering, but which misses the defining feature of othering – attributing relative inferiority and/or radical alienness. Because Hegel’s dialectic applies to any encounter of an interpreting self with some other, sophisticated or quasi-othering is at least potentially a very common occurrence in the interpretation of others, especially of those who do not belong to the in-group. However, although othering is usually undesirable, the Hegelian varieties can provide a “mirror”, which can be used as a tool to improve understanding of both the other and the interpreting self, and the malignant aspects of othering can be avoided through charity. In part I of this paper, I argue that #MeToo testimony increases epistemic value for the survivor qua hearer when experiences like hers are represented by others; for society at large when false but dominant narratives about sexual violence and sexual harassment against women are challenged and replaced with true stories; and for the survivor qua teller when her true story is believed. In part II, I argue that the epistemic significance of #MeToo testimony compels us to consider the tremendous (...) and often unappreciated costs to the individual tellers, and the increased credibility they are owed in virtue thereof. The Zhuangzi offers quite a few stories that centre on performance: a bellstand maker who selects wood to create wonderful bellstands; a ferryman who steers through rough waters; a cicada catcher who uses a stick, as if it were his hand, to catch cicadas; and a wheelmaker who, in using his chisel, feels it in his hand and responds with his heart. What is the role of the stick, for the cicada catcher, and the chisel, for the wheelmaker? What do (...) these masters know? I situate these questions within the intellectual context of the Zhuangzi, highlighting the text’s opposition to prevailing conceptions of a flourishing life. I draw on recent debates in extended mind and cognition to suggest that they offer interesting ways of understanding the knowledgeable practices of these masters. The frameworks and vocabulary of extended mind allow me to bring out how and why the Zhuangzi’s examples of mastery are apt and insightful reasons for rejecting the then current views on good government. The dialogue benefits both Chinese and Western traditions: the examples in the Zhuangzi help to diversify contemporary Western philosophy’s understanding of knowledge. (shrink)

Prey-catching behavior (PCB) in frogs and toads has been the focus of intense neuroethological research from the mid-twentieth century to the present and epitomizes some major themes in science and philosophy during this period. It reflects the movement from simple reflexology to more complex views of instinctive behavior, but it also displays a neural reductionism that denies subjectivity and individual agency The present article engages contemporary PCB research but provides a philosophically more promising picture of it based on Whitehead's nonreductionist (...) "philosophy of organism," which proposes that the flow of events from stimulus to response in organisms of all kinds is mediated by "the intervening touch of mentality " This approach resolves some basic mind-body and mind-nature issues that have long bedeviled modern philosophy and presents an image of a postmodern frog for a constructively postmodern science. In the paper ‘COVID-19 vaccine boosters for young adults: a risk–benefit assessment and ethical analysis of mandate policies at universities,’ Bardoshet alargued that college mandates of the COVID-19 booster vaccine are unethical. The authors came to this conclusion by performing three different sets of comparisons of benefits versus risks using referenced data and argued that the harm outweighs the risk in all three cases. In this response article, we argue that the authors frame their arguments by comparing values that are (...) not scientifically or reasonably comparable and that the authors used values that represent grossly different risk profiles and grouped them into a set of figures to create an illusion of fair comparisons. We argue that absent the falsely skewed portrayals of a higher level of risk over benefit in their misrepresented figures, the five ethical arguments they presented completely fall apart. (shrink)

Several scholars have recognized the limitations of theories of moral reasoning in explaining moral behavior. They have argued that moral behavior may also be influenced by moral identity, or how central morality is to one’s sense of self. This idea has been supported by findings that people who exemplify moral behavior tend to place more importance on moral traits when defining their self-concepts (Colby & Damon, 1995). This paper takes the next step of examining individual variation in a construct highly (...) associated with immoral behavior — psychopathy. In Study 1, we test the hypothesis that individuals with a greater degree of psychopathic traits have a weaker moral identity. Within a large online sample, we found that individuals who scored higher on a measure of psychopathic traits were less likely to base their self-concepts on moral traits. In Study 2, we test whether this reduced sense of moral identity can be attributed to differences in moral judgment, which is another factor that could influence immoral behavior. Our results indicated that the reduced sense of moral identity among more psychopathic individuals was independent of variation in moral judgment. These results suggest that individuals with psychopathic traits may display immoral behavior partially because they do not construe their personal identities in moral terms. (shrink)

Biologists and philosophers have offered differing concepts of biological race. That is, they have offered different candidates for what a biological correlate of race might be; for example, races might be subspecies, clades, lineages, ecotypes, or genetic clusters. One thing that is striking about each of these proposals is that they all depend on a concept of population. Indeed, some authors have explicitly characterized races in terms of populations. However, including the concept of population into concepts of race raises three (...) puzzles, all having to do with time. In this paper, I extend the causal interactionist population concept (CIPC) by introducing some simple assumptions about how to understand populations through time. These assumptions help to shed light on the three puzzles, and in the process show that if we want to understand races in terms of populations, we will need to revise our concept(s) of race. Cultural narratives shape how we think about the world, including how we decide when the end of life begins. Hospice care has become an integral part of the end‐of‐life care in the United States, but as it has grown, its policies and practices have also imposed cultural narratives, like those associated with the “six‐month rule” that the majority of the end of life takes place in the final six months of life. This idea is embedded in policies for a range (...) of care practices and reimbursement processes, even though six months is not always a meaningful marker. In the case of people living with advanced dementia, six months is both too early in the trajectory to facilitate conversations and too late in the trajectory to ensure decision‐making capacity. This essay encourages scholars and policy‐makers to consider how cultural narratives may limit what they think is possible in care for people living with dementia. (shrink)

The central unifying element in the philosophy of Peter Browne is his theory of analogy. Although Browne's theory was originally developed to deal with some problems about religious language, Browne regards analogy as a general purpose cognitive mechanism whereby we substitute an idea we have to stand for an object of which we, strictly speaking, have no idea. According to Browne, all of our ideas are ideas of sense, and ideas of sense are ideas of material things. Hence we can (...) conceive of spiritual things – including even our own spirit – only by analogy. One interesting application Browne makes of his theory is an account of how concepts such as knowledge can be correctly applied to beings that have no intrinsic properties in common, such as non-human animals, humans, angels, and God. I argue that this is best understood as what, in the contemporary literature, is known as a ‘multiple realizability’ problem and that Browne's solution to this problem has important similarities to functionalist theories in recent philosophy of mind. Gender scholars argued that gendered organizations theory needs updating as organizational logic has shifted amid neoliberal workplace transformations. This qualitative case study of a high-tech firm reveals how features of the traditional work logic remain resilient. I analyze the gendered implications of a high-tech startup restructuring and going public, finding the flexible organization to bureaucratize, implementing specialized jobs and a hierarchy with standardized career ladders. Going public creates conflicting gendered logics that place women at a structural disadvantage, relegating them to (...) low-status, narrow jobs while simultaneously demanding masculine ideal worker norms of visibility and self-promotion. Despite networking, women experience job insecurity and a glass ceiling, while men are assumed ideal workers and advance. By tracing one high-tech firm’s restructuring from a startup to public company, I demonstrate how the collision of new and traditional workplace logics perpetuates gender inequalities. (shrink)

Skilful expertise is grounded in practical, performative knowledge-how, not in detached, spectatorial knowledge-that, and knowledge-how is embodied by habitual dispositions, not representation of facts and rules. Consequently, as action control is a key requirement for the intelligent selection, initiation, and regulation of skilful performance, habitual action control, i.e. the kind of action control based on habitual dispositions, is the true hallmark of skill and the only veridical criterion to evaluate expertise. Not only does this imply that knowledge-that does not make (...) your actions more skilful, but it also implies that it makes them less skilful. This thesis, that I call Radical Habitualism, finds a precursor in Hubert Dreyfus. His approach is considered extreme by most philosophers of skill & expertise: an agent –says Dreyfus– does not perform like an expert when they lack the embodied dispositions necessary to control their action habitually or when they stop relying on such dispositions to control their actions. Thus, one cannot perform skilfully if their actions are guided by representations (isomorphic schemas, explicit rules, and contentful instructions), as the know-that that they convey disrupts or diminishes the agent’s habitual engagement with the task at hand. In defence of Radical Habitualism, I will argue that only the contentless know-how embedded in habitual dispositions fulfils (i) the genetic, (ii) the normative, and (iii) the epistemic requirements of skilful performance. I will examine the phenomenological premises supporting Dreyfus’ approach, clarify their significance for a satisfactory normative and explanatory account of skilful expertise, and rebut the most common objections raised by both intellectualists and conciliatory habitualists, concerning hybrid actions guided by a mix of habitual and representational forms of control. In revisiting Dreyfus anti-representationalist approach, I will particularly focus on its epistemological implications, de-emphasizing other considerations related to conscious awareness. (shrink)

Not so long ago, the idea that analytic philosophers would be taking panpsychism seriously would have been hard to believe. That is because in its early, logical positivist, stage, the analytic movement earned the reputation of being militantly anti-metaphysical. But analytic philosophy has come a long way since the heyday of logical positivism; and, in fact, the dialectic of recent debates on the mind–body problem among analytic philosophers has pushed many of them in the direction of panpsychism. In this paper, (...) I want to explain how this has come about and take a look at some of the versions of panpsychism that have emerged. This will involve running through a quick history of debates on the mind–body problem since about 1960, focusing on how panpsychism has been proposed as a promising, though not unproblematic, way of breaking an apparent impasse that has emerged between more standard physicalist and dualist theories of mind. Along the way, I will also have occasion to comment on the prospects of panpsychism as a respectable scientific theory and how a number of scientists stand on this. (shrink)

A biblical approach to reconciling God’s sovereignty with creaturely responsibility should avoid the extremes of global occasionalism and completely autonomous creatures. This paper evaluates the standard intermediary solutions offered by conservationists and concurrentists. It argues that while each contributes insights which a satisfactory account should retain, none is fully adequate. Even Leibniz’s sophisticated response, which accounts for providence, miracles, and moral responsibility, unacceptably abridges creaturely power to implement decisions. My alternative proposal seeks to explain how creatures can retain full responsibility (...) for their actions even though God reserves the right to override creaturely power with His greater power. In the 1950s and 1960s, prominent institutional economists in the United States offered what became the orthodox theory on the obstacles to commercializing scientific knowledge. According to this theory, scientific knowledge has inherent qualities that make it a public good. Since the 1970s, however, neoliberalism has emphasized the need to convert public goods to private goods to enhance economic growth, and this theory has had global impacts on policies governing the generation and diffusion of scientific research and innovation. We critique (...) the foundational conceptualizations of scientific knowledge as either public or private by examining Germany’s treatment of scientific outputs as club goods. We then compare the relative impacts on social welfare of distinct United States and German approaches to food and agricultural research and innovation. We conclude with reflections on how these findings might contribute to a democratic debate on how best to manage scientific knowledge to enhance social welfare. (shrink)

The authors expand Connell's concept of frontier masculinity to interpret articles from the Anchorage Daily News as an alternative way to understand Alaska's shifting wolf policies. Originally, state policies were shaped by frontier masculinity and characterized by claims of sportsmen's rights to kill wolves. With the reinstitution of an aggressive wolf-eradication project, Alaska policy makers retooled frontier masculinity. This altered form of masculinity, retro frontier masculinity, is (...) constructed at the state level and deploys new strategic emphases: vilifying opponents as feminized sissies, casting wolf hunters as paternalist protectors, reifying the masculine family provider role, and framing the issue as fundamentally about competition. In 1997 and 1998, the American secular philosopher Richard Rorty published a set of predictions about the twenty-first century ranging from the years 2014-95. He predicted, for instance, the election of a "strong man" in the 2016 presidential race and the proliferation of gun violence starting in 2014. He labels the years from 2014-44 the darkest years of American history, politics, and society. From 2045-95, Rorty thinks his own vision for "social hope" will be implemented within American society--a vision that (...) includes charity (in the Pauline sense), solidarity, and sympathy. Rorty considers himself a leftist, liberal, and a philosopher of hope. So why would a philosopher of hope predict such darkness and despair? In The Dark Years? Philosophy, Politics, and the Problem of Predictions philosopher and political theorist Jacob L. Goodson explains the fullness of Rorty's predictions, the problem of making predictions within the social sciences, and the reasons why even Rorty's vision for life after the "dark years" fails us on the standards of hope. One of the most lasting contributions of Marr's posthumous book is his articulation of the different “levels of analysis” that are needed to understand vision. Although a variety of work has examined how these different levels are related, there is comparatively little examination of the assumptions on which his proposed levels rest, or the plausibility of the approach Marr articulated given those assumptions. Marr placed particular significance on computational level theory, which specifies the “goal” of a computation, its appropriateness for (...) solving a particular problem, and the logic by which it can be carried out. The structure of computational level theory is inherently teleological: What the brain does is described in terms of its purpose. I argue that computational level theory, and the reverse-engineering approach it inspires, requires understanding the historical trajectory that gave rise to functional capacities that can be meaningfully attributed with some sense of purpose or goal, that is, a reconstruction of the fitness function on which natural selection acted in shaping our visual abilities. I argue that this reconstruction is required to distinguish abilities shaped by natural selection—“natural tasks” —from evolutionary “by-products”, rather than merely demonstrating that computational goals can be embedded in a Bayesian model that renders a particular behavior or process rational. The purpose of this paper is to explore the spiritually formative experiences of fifteen female seminary spouses who participated in a phenomenological research study. Graduate theological education is not limited to married, male students. Seminaries are diverse educational institutions that equip married and single students, as well as men and women from every country in the world for gospel ministry. Because of this broad population in theological education, the qualitative proposals in this essay are not generalizable to all schools, students, (...) and settings equally, but the perspectives of these seminary spouses are useful in cultivating a robustly holistic education for students who are married during their academic pursuits. It is the intent here to explore how theology can crossover from the academy to the home so that it is experienced in marriage. The goal then is to equip students, professors, and administrators to actively nurture the faith formation of the second-person of the ministry dyad. In order for these stakeholders to understand how to nurture this faith formation of the seminary spouse, we must first hear and understand the experiences of these wives as they share their reflections on these formational years as a part of their husband's education. This volume of new essays showcases contemporary ideas on how to interpret the Tractatus and throws new light on some of its most challenging passages.

Este artículo se propone examinar la caracterización ficcional de la mujer filósofa durante el siglo XVIII, concentrándose en la novela Histoire de Juliette, ou les prospérités du vice de Donatien Alphonse François de Sade. Sostendremos como hipótesis que las heroínas filósofas de Histoire de Juliette se habrían construido a base de la exaltación de la figura de la hetaira de la Grecia Clásica. Analizaremos dos referencias a las hetairai que aparecen en la obra: la caracterización de Clairwil, una de las (...) tutoras libertinas de Juliette, y la participación de Aspasia, Phryné y Lais como parte del séquito de libertinas de la protagonista de la novela.
