This essay advances and defends two claims: (a) that rights cannot be inalienable and (b) that even if they could be, this would not be morally justifiable.

Yehoshua Bar-Hillel (1915-1975) was one of the leading intellectuals of Israel and of the world. His work ranged over mathematics, applied logic, communication theory, analytic philosophy, philosophy of science, and linguistics. Creative, patient, attentive, and critical, Bar-Hillel was a superb philosopher. In addition, how humane he was may be learned from the memorial tributes to him which initiate this volume. Bar-Hillel was born in Vienna, and came to Israel, then Palestine, in 1933. He took his M. A. (...) (1938) and Ph. D. (1949) at the Hebrew University of Jerusalem, where his subsequent career continued, as Research Fellow (1949-53), Senior Lecturer in Philosophy (1953-58), Associate Professor of Philosophy (1958-61), and Professor of Logic and Philosophy of Sci ence (1961-75). He was often abroad as visiting professor (Berkeley, 1960- 61; Michigan, 1965; La Jolla, 1966-67; Konstanz, 1971; Berlin, 1972), or as a research scholar, notably at the M. lT. Research Laboratory for Elec tronics during the early 1950's. Bar-Hillel was the Secretary and guiding spirit of the Organizing Committee for the 3rd International Congress for Logic, Methodology and Philosophy of Science, held in Jerusalem in 1964. During 1966-68, he was President of the Division of Logic, Method ology and Philosophy of SCience of the International Union of History and Philosophy of Science, and in 1967 President of the International Union. From 1963 he was a Member of the Israel Academy of Sciences and Humanities. (shrink)

There is an important distinction between a person's ’initial genetic endowment’ and his ’post‐conception inputs’ such as nutrition and education. From a left‐libertarian perspective that views persons as self‐owning, children have an enforceable claim that parents should provide adequate ’post‐conception’ inputs. Moreover, with the revolution in genetic science, it is now possible to effect genetic changes without altering identity. If so, children can, in principle, claim a right against ’genetic‐disablement’.

“Does the existence of unequal social and economic starting points in life nullify capitalism's claims to justice?” Notice is hereby given that this essay's answer to this question is an unequivocal “maybe.” For it is a banal but true claim that everything depends upon what is meant by capitalism, justice and life's starting point. And it is a less banal but no less true claim that their meanings are opaque or controversial or both. In what follows I shall devote little (...) attention to the question of what justice is and shall simply presume that it is best characterized by historical entitlement theory. The last part of the essay discusses the notion of life's starting point and vacillates over what it would mean for one such point to be equal to another. Hence, the bulk of my argument is taken up with exploring what capitalism must be like to conform to historical entitlement theory. And my conclusion will be that, insofar as capitalism respects every person's right of self-ownership, its claims to justice require that no one be denied one type of equal payment – a payment which might be rendered at each life's starting point. In this article I examine what I term epistemic arguments against epistocratic dictatorships against the background of Harry Frankfurt’s claim that truth is a fundamental governing notion, and some key reflections of Václav Havel and Leszek Kolakowski. Some of the key epistemic arguments offered by Karl Popper, Robert A. Dahl and Ross Harrison are outlined and endorsed. They underscore the insurmountable problems involved in choosing and maintaining a state of allegedly perfectly wise and efficient rulers. Such rule by virtue of (...) supposed supreme knowledge and expertise denies a truthful recognition of the inevitable fallibility of the state, and of government policies. Moreover, the repression of both citizens’ commitment to truthfulness and their attempts at political falsification will necessarily render dictatorships both continually prone to error and inevitably oppressive. Fallibilistic epistemology is thus seen as a formidable philosophical arsenal for anti-totalitarian and democratic thought, alongside ethical and historical arguments against dictatorship. (shrink)

Susan M. Turner has argued that the use of animal analogs ought to be considered categorically unethical on deontological, or rights-grounds, and that some but not all animal analogs are unethical on utilitarian grounds. I claim, on the contrary, that the use of most, if not all animal analogs can be justified from both the utilitarian and animal rights perspectives. Indeed, I believe that a convincing case is to be made for the thesis that animal analogs ought to be promoted (...) actively, on ethical grounds. I hold this to be true of both food and clothing replacement analogs, although I agree with Turner’s categorical condemnation of secondhand animal skin. I also hold that the general question of the preference for animal analogs over their original flesh and skin-based inspirations raises important questions about the relationship between ethics and aesthetics. I examine these in sympathy with the moderate aestheticist claims that some degree of distinction between these two spheres of value is desirable, and that the sublimation of powerful and problematical urges is normally preferable to their suppression. This essay argues that a liberalism that avoids legal moralism – that is neutral between rival conceptions of the good – cannot embrace intervention in commercial transactions, but is thereby precluded neither from identifying some such transactions as exploitative nor from redressing them by other means.

The Global Fund is a mechanism for the global application of the Left Libertarian conception of distributive justice. As a form of luck egalitarianism, this conception confers upon each person an entitlement to an equal share of all natural resource values, since natural resources - broadly, geographical sites - are objects for the production of which no person is responsible. Owners of these sites, i.e. states, are liable to a 100% Global Fund tax on their unimproved value: that is, their (...) gross market value minus the value of the improvements added to them by human effort. It is argued that the revenue yielded by this tax would be correspondingly reduced by a further tax on the use of natural resources. (shrink)

The traditional Lockean account of a state's territorial rights construes them as arising from, and coextensive with, the property rights of whichever set of landowners mutually contract to form that state. The coherence of this individualistic account has recently been challenged by Cara Nine. I argue that the reasons offered in support of that incoherence charge are unpersuasive.

Despite its phenomenal success since its inception in the early nineteen-nineties, the evidence-based medicine movement has not succeeded in shaking off an epistemological critique derived from the experiential or tacit dimensions of clinical reasoning about particular individuals. This critique claims that the evidence-based medicine model does not take account of tacit knowing as developed by the philosopher Michael Polanyi. However, the epistemology of evidence-based medicine is premised on the elimination of the tacit dimension from clinical judgment. This is demonstrated through (...) analyzing the dichotomy between clinical and statistical intuition in evidence-based medicine’s epistemology of clinical reasoning. I argue that clinical epidemiology presents a more nuanced epistemological model for the application of statistical epidemiology to the clinical context. Polanyi’s theory of tacit knowing is compatible with the model of clinical reasoning associated with clinical epidemiology, but not evidence-based medicine. (shrink)

This study focuses on how Israeli Arab citizens perceive their media representations on Israeli television and why they consume television broadcasts even though they are marked mostly by negative representations. A new concept – “Communication Boundary Situation” – a development of Jaspers’ “Boundary Situation” theory, is the theoretical framework for the article. The empirical data was collected by conducting semi-structured in-depth interviews. The findings point to different attitudes among the interviewees towards their representation in various television genres, in particular, in (...) advertising as compared to satire and drama. The suggested theoretical framework and its empirical implementation might be useful in examining how various minorities perceive their media representations in other countries. (shrink)
