    On the Exclusionary Scope of Razian Reasons.J. J. Moreso - 2024 - Ratio Juris 37 (2):148-160.
This article attempts to illustrate the originality, depth, and farsightedness of Joseph Raz's conception, especially his idea that legal norms provide us with protected reasons to act, that is, with first-order reasons to behave as they prescribe, and with second-order, exclusionary reasons not to act for reasons against what they prescribe. But the article also highlights some aspects that raise doubts in my mind, especially with regard to the scope of these exclusionary reasons. This in two ways: by asking, on (...)

This paper intends to show that it is possible to take convincingly into account the platitudes which underlie our moral practice. It deals with the articulation of an indirect strategy to answer the arguments of moral scepticism: if we can generate a conceptual space that takes such platitudes into account, perhaps we could ignore the sceptic doubts.Several metaethical conceptions can ecumenically carry out this task. Particularly, even if moral realism implies cognitivism and objectivism, moral objectivism –the plausibility of rational agreement (...)

  9. On Deontic Truth and Values.J. J. Moreso - 2017 - Crítica. Revista Hispanoamericana de Filosofía 49 (146):61-74.
This article analyzes the thesis of ethical relativism, as defended by Alchourrón and Bulygin. These authors offer, on the one hand, a suggestive conception according to which the question “what are our obligations?” is equivalent to thinking about what is to be done; on the other hand, they defend a relativist conception of ethics. They present three objections to constructivist accounts of ethics that are not relativist: a) the argument of the burden of the proof; b) a version of the (...)

    On relevance and justification of legal decisions.J. J. Moreso - 1996 - Erkenntnis 44 (1):73 - 100.
The author discusses a question related to a certain aspect of justification of legal decisions, often so-called internal justification-a legal decision is internally justified if and only if it can be deduced from the norm(s) applicable to the case, and from the statement(s) describing the facts of the case. According to this notion, infinite irrelevant logical consequences are justified. To avoid this counterintuitive conclusion, the author analyzes three notions of relevance: Sperber-Wilson's notion, Anderson-Belnap's notion, and Schurz's notion. The author presents (...)

The Aristorcracy of All: Gargarella or the Constitutionalism of Equality.J. J. Moreso - 2017 - Revista Latinoamericana de Filosofía Política 6 (1).
In this comment to the brilliant book on the Constitutionalism in Latin-America, Gargarella, it is accepted that perhaps is the equality the empty promise among the ideals of constitutionalism in this region of the world. It is also accepted that an important part of the reason for this absence of equality lies in the institutional design, in the engine room of the Constitution, concretely in an hypertrophy of presidentialism. A complementary suggestion is added: the ideal of a constitutional democracy presupposes (...)

Moreso, Veronica Rodriguez-Blanco, Antonino Rotolo, Giovanni Sartor, Burkhard Schafer, Chiara Valentini, Bart Verheij, Douglas Walton & Wojciech Załuski (eds.) - 2011 - Dordrecht, Netherland: Springer Verlag.
This handbook offers a deep analysis of the main forms of legal reasoning and argumentation from both a logical-philosophical and legal perspective. These forms are covered in an exhaustive and critical fashion, and the handbook accordingly divides in three parts: the first one introduces and discusses the basic concepts of practical reasoning. The second one discusses the main general forms of reasoning and argumentation relevant for legal discourse. The third one looks at their application in law as well as at (...)

In this book, I present the results of an investigation which began with an extended stay at Oxford's Balliol College during the first half of 1995. My visit to Oxford was made possible by a grant from the Spanish Ministerio de Educaci6n y Ciencia. My sincere thanks go to Joseph Raz who served as my supervisor in Oxford. For several points of the present study, conversations with Timothy Endicott in Oxford were also of great help. The book is part of (...)

Myself, Only Moreso: Conditions for the Possibility of Transreligious Theology.J. R. Hustwit - 2016 - Open Theology 2:236-241.
Transreligious theologians are posed with a number of difficult questions. First, how can I understand the beliefs and practices of a worldview I do not share? Then, once I begin to construct and synthesize truth claims, how normative are the source traditions? Finally, how do we transreligious theologians judge truth claims as better and worse? By offering answers to these questions using a model of critical interreligious appropriation, we may find a basis for a critical transreligious theology that avoids naïve (...)

In this article I try to refute the so-called "libertarian" theory of free will, and to examine how our conclusion ought to modify our common attitudes of praise and blame. In attacking the libertarian view, I shall try to show that it cannot be consistently stated. That is, my dscussion will be an "analytic-philosophic" one. I shall neglect what I think is in practice an equally powerful method of attack on the libertarian: a challenge to state his theory in such (...)

    The Riddle of Human Emotional Crying: A Challenge for Emotion Researchers.Ad J. J. M. Vingerhoets & Lauren M. Bylsma - 2016 - Emotion Review 8 (3):207-217.
Until now, adult crying has received relatively little interest from investigators, whereas in the popular media there are many strong claims about crying (e.g., crying brings relief) of which the scientific basis is not clear. In this review, we provide an overview of the current state of the scientific literature with respect to crying. We identify gaps in knowledge and propose questions for future research. The following topics receive special attention: Ontogenetic development, antecedents, individual and gender differences, and the intra- (...)

Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers a sustained (...)

    Tape 5: Peter Abelard.J. J. Walsh - unknown
In twelfth-century Europe schools flourished in many centres. There were schools in monasteries and cathedrals, primarily for the education of monks and priests but often open also to laymen. In Italian towns, especially, there were lay schools teaching law and commercial skills to fee-paying students. In France, especially, also in England and other countries, there were schools for feepaying students of the liberal arts. The traditional list of the liberal arts included seven: grammar, logic and rhetoric (the "trivium"), and arithmetic, (...)
