In legal academia it is highly controversial how to ‘be original’ in legal research. This article will try to maintain an attitude of tolerance in not promoting or discrediting one particular methodology. Instead, it will identify four different ways of ‘being original’. Perhaps the most common approach is to deal with ‘micro-legal questions’. Many legal academics also pursue research in ‘macro-legal questions’. Less common but growing is the importance of ‘scientific legal research’ and research in ‘non-legal topics’.

The bifocal stance theory (BST) focuses on cultural evolution without alluding to associated processes in linguistic evolution and language use. The authors briefly comment on language acquisition but leave underexplored the applicability of BST to linguistic evolution, to changes of language representations, and to possible consequences for constructing social identity, based on, for example, collective resilience processes within language communities.

Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

This daily diary study examined the within-person coupling between four emotion regulation strategies and both subjective well-being and perceived stress in daily life of geriatric nurses. Participants (N = 89) described how they regulated their emotions in terms of cognitive reappraisal and suppression. They also indicated their subjective well-being and level of perceived stress each day over three weeks. At the within-person level, cognitive reappraisal intended to increase positive emotions was positively associated with higher subjective well-being and negatively associated with (...) perceived stress. Suppression of the expression of positive emotions was negatively associated with subjective well-being and positively associated with perceived stress. However, cognitive reappraisal intended to down-regulate negative emotions and suppression as a strategy to inhibit the expression of negative emotions were not associated with daily well-being or perceived stress. Off-days were rated as days with higher subjective well-being and lower perceived stress in contrast to working days. At the between-person level, individuals who reported more daily negative affect reported increased suppression of positive emotions, corroborating the within-person findings. Moreover, findings indicated that nurses with more years of experience in the job reported higher subjective well-being and less perceived stress. These results provide insights into important daily emotional processes of geriatric nurses, both at workdays and in their leisure time. (shrink)

Eye behavior is increasingly used as an indicator of internal versus external focus of attention both in research and application. However, available findings are partly inconsistent, which might be attributed to the different nature of the employed types of internal and external cognition tasks. The present study, therefore, investigated how consistently different eye parameters respond to internal versus external attentional focus across three task modalities: numerical, verbal, and visuo‐spatial. Three eye parameters robustly differentiated between internal and external attentional focus across (...) all tasks. Blinks, pupil diameter variance, and fixation disparity variance were consistently increased during internally directed attention. We also observed substantial attentional focus effects on other parameters (pupil diameter, fixation disparity, saccades, and microsaccades), but they were moderated by task type. Single‐trial analysis of our data using machine learning techniques further confirmed our results: Classifying the focus of attention by means of eye tracking works well across participants, but generalizing across tasks proves to be challenging. Based on the effects of task type on eye parameters, we discuss what eye parameters are best suited as indicators of internal versus external attentional focus in different settings. (shrink)

The article presents and analyzes different approaches of U.S. bioethicists in comprehending the Nazi medical crimes after 1945. The account is divided into two sections: one dealing with discussions on research ethics and the Nuremberg Code up until the 1970s and the other ranging from the 1970s to the present and highlighting bioethics' engagement with Nazi analogies. The portrayal of different bioethical scholars, institutions, and documents—most notably Henry K. Beecher, Jay Katz, the Belmont Report, the Hastings Center, Arthur L. Caplan, (...) and Robert M. Veatch—provides a nuanced interpretation of the motives that bioethicists held and the strategies that they applied to establish an understanding of the Nazi medical crimes and their relation to contemporary bioethical issues. In this, the different approaches shared a common goal: To integrate the Nazi medical crimes into an ethical framework by means of selective acknowledgments and representation of their history. Political philosophy is mostly what I do, and in one way or another, it’s organized around ideas about justice. Often, my work focuses on problems that are present in public political discourse, which then I try to approach by offering a solution to them that is tied to philosophically acceptable foundations. For a few years now, my work has been concerned with building a constructive theory of the “grounds of justice” at the global level. The book that is in the (...) process of emerging is called "The Grounds of Justice: An Inquiry about the State in Global Perspective," and is under contract with Princeton University Press. Since I've been working on this project for a while, and since I have been presenting bits and pieces of it at numerous conferences and colloquia, I'm putting the first thirteen chapters up here, so that people who are interested in this work can see how it all fits together. This paper, a contribution to “micro set theory”, is the study promised by the first author in [M4], as improved and extended by work of the second. We use the rudimentarily recursive functions and the slightly larger collection of gentle functions to initiate the study of provident sets, which are transitive models of $\mathsf{PROVI}$, a subsystem of $\mathsf{KP}$ whose minimal model is Jensen’s $J_{\omega}$. $\mathsf{PROVI}$ supports familiar definitions, such as rank, transitive closure and ordinal addition—though not ordinal multiplication—and Shoenfield’s unramified (...) forcing. Providence is preserved under directed unions. An arbitrary set has a provident closure, and the extension of a provident $M$ by a set-generic $\mathcal{G}$ is the provident closure of $M\cup\{\mathcal{G}\}$. The improvidence of many models of $\mathsf{Z}$ is shown. The final section uses similar but simpler recursions to show, in the weak system $\mathsf{MW}$, that the truth predicate for $\dot{\varDelta}_{0}$ formulæ is $\Delta_{1}$. (shrink)

Recent arguments claim that behavioral science has focused – to its detriment – on the individual over the system when construing behavioral interventions. In this commentary, we argue that tackling economic inequality using both framings in tandem is invaluable. By studying individuals who have overcome inequality, “positive deviants,” and the system limitations they navigate, we offer potentially greater policy solutions.

Psychometrically sound instruments that assess temporal dynamics of creative abilities are limited. The Ambulatory Battery of Creativity is designed to assess creative ideation performance multiple times in everyday life and was proven to capture the intra-individual dynamic of creative abilities reliably and validly. The present ambulatory study aimed to replicate and extend the psychometric evidence of the novel ABC. Sixty-nine participants worked on the ABC during a 5-day ambulatory assessment protocol. Each day, participants completed six randomly presented items of the (...) verbal and the figural ABC. Matching previous psychometric analyses, the results indicated good between-person and good within-person reliability. Furthermore, evidence for between-person and within-person validity of the ABC was obtained. Performance in the verbal and the figural ABC were interrelated and correlated with an independent measure of creative potential. The verbal ABC was further associated with openness, self-reported creative behavior, creative activities, and creative achievements, thus providing additional evidence of construct validity, especially for the verbal ABC. Finally, the verbal and the figural ABC yielded convincing within-person validity: Longer response times and higher subjective originality ratings were associated with more original ideas. This replication and extension of the ABC’s psychometric properties indicates that it enables a reliable and valid assessment of moment-to-moment fluctuations of creative ideation abilities in everyday life, which may facilitate the investigation of exciting new research questions related to dynamic aspects of creative ability. Moreover, under an additional assumption, they proved that this generic extension preserves all strong partition cardinals. This forcing thus produces a model$M[\mathcal {U}]$, where$\mathcal {U}$is a Ramsey ultrafilter, with many properties of the original modelM. This begged the question of how important the Ramseyness (...) of$\mathcal {U}$is for these results. In this paper, we show that several classes of$\sigma $-closed forcings which generate non-Ramsey ultrafilters have the same properties. Such ultrafilters include Milliken–Taylor ultrafilters, a class of rapid p-points of Laflamme,k-arrow p-points of Baumgartner and Taylor, and extensions to a class of ultrafilters constructed by Dobrinen, Mijares, and Trujillo. We continue [21] and study partition numbers of partial orderings which are related to /fin. In particular, we investigate Pf, be the suborder of /fin)ω containing only filtered elements, the Mathias partial order M, and , ω the lattice of partitions of ω, respectively. We show that Solomon's inequality holds for M and that it consistently fails for Pf. We show that the partition number of is C. We also show that consistently the distributivity number of ω is smaller (...) than the distributivity number of /fin. We also investigate partitions of a Polish space into closed sets. We show that such a partition either is countable or has size at least D, where D is the dominating number. We also show that the existence of a dominating family of size 1 does not imply that a Polish space can be partitioned into 1 many closed sets. (shrink)

In this paper we propose to argue for two claims. The first is that a sizeable group of epistemological projects – a group which includes much of what has been done in epistemology in the analytic tradition – would be seriously undermined if one or more of a cluster of empirical hypotheses about epistemic intuitions turns out to be true. The basis for this claim will be set out in Section 2. The second claim is that, while the jury is (...) still out, there is now a substantial body of evidence suggesting that some of those empirical hypotheses are true. Much of this evidence derives from an ongoing series of experimental studies of epistemic intuitions that we have been conducting. A preliminary report on these studies will be presented in Section 3. In light of these studies, we think it is incumbent on those who pursue the epistemological projects in question to either explain why the truth of the hypotheses does not undermine their projects, or to say why, in light of the evidence we will present, they nonetheless assume that the hypotheses are false. In Section 4, which is devoted to Objections and Replies, we’ll consider some of the ways in which defenders of the projects we are criticizing might reply to our challenge. Our goal, in all of this, is not to offer a conclusive argument demonstrating that the epistemological projects we will be criticizing are untenable. One of the greatest merits of Dr. Sherover's excellent book is that it enables us to see Heidegger's thought- in one direction, at least- as an organic outgrowth from his reading of Kant. It thus helps to remove on common misapprehension that Heidegger's thought is odd, idiosyncratic, and not rooted- as in fact it is- in the mainstream of philosophy. Dr. Sherover is able to remove this misunderstanding in great part through the admirable clarity of his exposition; he has succeeded (...) in conveying Heidegger's most abstruse points into plain and understandable English, and so has overcome the formidable barrier of terminology that has blocked so many Heideggerian interpreters. This book is in fact the clearest exposition that I have read of Heidegger's thought at one states of its development. But beyond this valuable job of clarification, by bringing the light of Heidegger to bear upon Kant, this book is also a significant contribution to Kantian scholarship. And that means, of course, a contribution to philosophy itself. (shrink)

Is it possible to establish a line of research that brings Gabriel Marcel and Jean-Paul Sartre closer together? With this article, we will positively support this idea, by distancing ourselves from the overly rigid interpretations that exclusively focus on antinomic elements sliding into a reductionist and nowadays “canonical” presentation of the relationship between these philosophers. Beyond the undeniable and, fortunately, unmediated differences between the two philosophers, this article aims to investigate their positions regarding the concept of “relationship”. In doing so, (...) we will highlight how Gabriel Marcel’s “coesse” and Jean-Paul Sartre’s “being-for-others” have numerous points of contact that place both philosophers, beyond their personal positions in the religious sphere, within the common ground of “existentialism”. How far has the Darwinian revolution come? To what extent have evolutionary ideas penetrated into the social sciences and humanities? Are the “science wars” over? Or do whole blocs of disciplines face off over an unbridgeable epistemic gap? To answer questions like these, contributors to top journals in 22 disciplines were surveyed on their beliefs about human nature, culture, and science. More than 600 respondents completed the survey. Scoring patterns divided into two main sets of disciplines. Genetic influences were emphasized (...) in the evolutionary social sciences, evolutionary humanities, psychology, empirical study of the arts, philosophy, economics, and political science. Environmental influences were emphasized in most of the humanities disciplines and in anthropology, sociology, education, and women's or gender studies. Confidence in scientific explanation correlated positively with emphasizing genetic influences on behavior, and negatively with emphasizing environmental influences. Knowing the current actual landscape of belief should help scholars avoid sterile debates and ease the way toward fruitful collaborations with neighboring disciplines. (shrink)
