It is a subject to which we all do give thought, not only with the force majeure of professional philosophising, but in our personal lives; however, in trying to sort the subject out a little, and it is one about which both our literature and our thinking are notoriously muddled, I fear I (...) may rather have generated confusion than diminished it. In attempting by a somewhat roundabout method to clarify a little the sort of question, though scarcely, I am afraid, the sort of answer, that is appropriate to such thought, it has, perhaps inevitably, seemed necessary to consider in almost as much detail the more fashionable subject of Pleasure; and here too, with less excuse, the points I wish to make are abbreviated and unashamedly oversimplified. In this text, Austin Hayden Smidt analyzes an oft-overlooked text by Jean-Paul Sartre in order to ground a logical framework for exploring this problem.

Résumé L’imaginaire est une catégorie plastique qui renvoie à des conceptions préscientifiques, aux fictions politiques et juridiques, aux croyances religieuses, aux stéréotypes ou préjugés, sans se confondre avec tous ces objets. Notion imprécise et fourre-tout, l’imaginaire serait inutile pour saisir avec rigueur les objets du monde : il relèverait du subjectif et de l’insaisissable. Pourtant, l’imaginaire a bien un contenu, des structures et dévoile une visée de la conscience. En se fondant sur les écrits de Castoriadis, et notamment la distinction (...) imaginaire instituant et imaginaire institué, on propose d’utiliser cette notion comme un outil méthodologique d’analyse du droit. L’imaginaire n’est d’ailleurs pas étranger à la théorie du droit, principalement américaine, et notamment au sein de l’Université de Yale. Elle recoupe les préoccupations du courant des Cultural Legal studies, où l’on retrouve des auteurs tels que Paul Kahn, David Nelken, Austin Sarat et Jonathan Simon, etc. Le droit constituant une représentation du réel, l’usage de l’imaginaire doit chercher à saisir les significations profondes des normes juridiques, leur de manière de structurer notre pensée et les luttes qu’elles engendrent pour imposer des vérités toujours renégociables. The subject of this paper, Excuses, is one not to be treated, but only to be introduced, within such limits. It is, or might be, the name of a whole branch, even a ramiculated branch, of philosophy, or at least of one fashion of philosophy. I shall try, therefore, first to state what the subject is, why it is worth studying, and how it may be studied, all this at a regrettably lofty level: and then I shall illustrate, in more (...) congenial but desultory detail, some of the methods to be used, together with their limitations, and some of the unexpected results to be expected and lessons to be learned. Much, of course, of the amusement, and of the instruction, comes in drawing the coverts of the microglot, in hounding down the minutiae, and to this I can do no more here than incite you. But I owe it to the subject to say, that it has long afforded me what philosophy is so often thought, and made, barren of -- the fun of discovery, the pleasures of co-operation, and the satisfaction of reaching agreement. A recent development in biology has been the growing acceptance that holobionts, entities comprised of symbiotic microbes and their host organisms, are widespread in nature. There is agreement that holobionts are evolved outcomes, but disagreement on how to characterize the operation of natural selection on them. The aim of this paper is to articulate the contours of the disagreement. I explain how two distinct foundational accounts of the process of natural selection give rise to competing views about evolutionary individuality.

For this second edition, the editors have returned to Austin's original lecture notes, amending the printed text where it seemed necessary.

Among mycologists, questions persist about what entities should be treated as the fundamental units of fungal populations. This article articulates a coherent view about populations of heterokaryotic fungi and the individuals that comprise them. Using Godfrey-Smith’s minimal concept of a Darwinian population, I argue that entities at two levels of the biological hierarchy satisfy the minimal concept in heterokaryotic fungi: mycelia and nuclei. I provide a preliminary answer to the question of how to understand the relation between these two populations. (...) The influence of J. L. Austin on contemporary philosophy was substantial during his lifetime, and has grown greatly since his death, at the height of his powers, in 1960. Philosophical Papers, first published in 1961, was the first of three volumes of Austin's work to be edited by J. O. Urmson and G. J. Warnock. Together with Sense and Sensibilia and How to do things with Words, it has extended Austin's influence far beyond the circle who knew (...) him or read the handful of papers he published in journals. A 62-year-old female with Huntington’s disease presented after a suicide attempt. Her advance directive stated that she did not want intubation or resuscitation, which her family acknowledged and supported. Despite these directives, she was resuscitated in the emergency department and continued to state that she would attempt suicide again. Her suicidality in the face of a chronic and advancing illness, and her prolonged consistency in her desire to take her own life, left careproviders wondering how to provide ethical, respectful care (...) to this patient. Tension between the ethical principles of autonomy and beneficence is central in this case. The patient’s narrative demonstrated that her suicide was an autonomous decision, free from coercion or disordered thinking from mental illness. Beneficence then would seem to necessitate care aligned with the patient’s desire to end her life, which created ethical uneasiness for her family and careproviders. The case highlights several end-of-life ethical considerations that have received much recent attention. With ongoing discussions about the legalization of aid in dying across the country, caregivers are challenged to understand what beneficence means in people with terminal illnesses who want a say in their death. This case also highlights the profound moral distress of families and careproviders that arises in such ethically challenging scenarios. (shrink)

In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. Elle s'expose volontiers à traverser le cours des sciences, à inscrire son histoire dans le contrepoint de leurs développements. Quand il se veut ainsi passeur de savoirs, le philosophe expérimente des concepts qui filtrent des interprétations, établissent des relations inattendues, modifient des approches trop abstraites : le temps, l'infini, la matière, le cosmos. L'enquête astrophysique ou (...) les recherches sur le cerveau offrent autant d'occasions de mises en perspective propices à la pédagogie que d'invitations à reconstituer le tissu des idées qui fondent la culture et les idéaux de nos sociétés. Même s'il analyse parfois des méthodes et des paradigmes scientifiques, ce livre ne relève pas de la philosophie des sciences telle que l'Université en définit la discipline. Il entend surtout questionner les conceptions scientifiques du monde qui justifient, transforment ou bouleversent nos croyances, nos comportements et aussi nos décisions. Eukaryogenesis is widely viewed as an improbable evolutionary transition uniquely affecting the evolution of life on this planet. However, scientific and popular rhetoric extolling this event as a singularity lacks rigorous evidential and statistical support. Here, we question several of the usual claims about the specialness of eukaryogenesis, focusing on both eukaryogenesis as a process and its outcome, the eukaryotic cell. We argue in favor of four ideas. First, the criteria by which we judge eukaryogenesis to have required a genuinely (...) unlikely series of events 2 billion years in the making are being eroded by discoveries that fill in the gaps of the prokaryote:eukaryote “discontinuity.” Second, eukaryogenesis confronts evolutionary theory in ways not different from other evolutionary transitions in individuality; parallel systems can be found at several hierarchical levels. Third, identifying which of several complex cellular features confer on eukaryotes a putative richer evolutionary potential remains an area of speculation: various keys to success have been proposed and rejected over the five-decade history of research in this area. Fourth, and perhaps most importantly, it is difficult and may be impossible to eliminate eukaryocentric bias from the measures by which eukaryotes as a whole are judged to have achieved greater success than prokaryotes as a whole. Overall, we question whether premises of existing theories about the uniqueness of eukaryogenesis and the greater evolutionary potential of eukaryotes have been objectively formulated and whether, despite widespread acceptance that eukaryogenesis was “special,” any such notion has more than rhetorical value. The model of atonement presented in Anselm of Canterbury's Cur Deus Homo has aroused a host of worries from theologians. The gist of their criticism is that Anselm inscribes redemptive violence into theology and thus encourages passive acquiescence to abusive power structures or even licenses the violence of abusers. Some suggest that the way forward would be to jettison Anselm's account and develop alternatives that are not liable to the same abuses. This paper argues that while alternatives may be desirable, (...) Cur Deus Homo looms so large in theological imaginations as to defy jettisoning. We should instead try to perform better readings. This paper presents a close reading of this text as a monastic meditation on mortality oriented less toward resolving a problem of systematic theology than drawing readers into a renewed experience of devotion to God. To do that, Anselm works to rewrite the meaning of human mortality, making it less about the necessity of losing one's life and more about the possibility of a gift of death. The ethical paradigm that emerges is far from a complete moral vision, but is still more alluring than the one about which Anselm's contemporary critics worry. (shrink)

Abstract In Restoring the Lost Constitution, Randy Barnett defends the idea that judges should interpret the U.S. Constitution according to its original public meaning, for in his view the Constitution, rightly understood, satisfies the appropriate normative criterion for determining when a constitution is legitimate and should be followed. As it turns out, however, even if the Constitution did mean what Barnett says it does, it would not meet his criterion of legitimacy, and therefore should not be followed. Moreover, Barnett is (...) just as guilty of reading certain clauses out of the Constitution as are his critics. Given the lack of a persuasive reason to follow the original Constitution consistently, judges must turn to sources of authority other than the Constitution in deciding constitutional cases. In defending a new framework for incorporating metacognitive debiasing strategies into critical thinking education, Jeffrey Maynes draws on ecological rationality theory to argue that in felicitous environments, agents will achieve greater epistemic success by relying on heuristics rather than more ideally rational procedures. He considers a challenge presented by Mercier and Sperber’s “interactionist” thesis that individual biases contribute to successful group reasoning. I argue that the challenge can be met without assuming an individualist ideal of the critical thinker as a (...) solitary reasoner. Focusing on cognitive laziness and myside bias, I then argue that a more complete reckoning with the implications of interactionism about reasoning will require us to transcend individualism more fully to embrace the selection, design, regulation, and navigation of dialogic environments as central pedagogical aims of critical thinking education. Using a Solomon four-group design, we investigate the effect of a case-based critical thinking intervention on students’ critical thinking skills. We randomly assign 31 sessions of business classes to four groups and collect data from three sources: in-class performance, university records, and Internet surveys. Our 2 × 2 ANOVA results showed no significant between-subjects differences. Contrary to our expectations, students improve their critical thinking skills, with or without the intervention. Female and Caucasian students improve their critical thinking skills, but males (...) and non-Caucasian do not. Positive performance goals and negative mastery goals enhance and decrease improvements of their CTA scores, respectively. ACT and age are related to pre- and post-test. Gender is related to pre-test. GPA is related to post-test. Results shed light on the Pygmalion effect, the Galatea effect, ability, motivation, and opportunity as signals for human capital, and business ethics. (shrink)

The Province of Jurisprudence Determined (1832) is a classic of nineteenth-century English jurisprudence, a subject on which Austin had a profound impact. His book is primarily concerned with a meticulous explanation of most of the core concepts of his legal philosophy, including his conception of law, his separation of law and morality, and his theory of sovereignty. The transparency of visual experience is a widely held and important thesis in the philosophy of perception. Critical discussion of transparency has focused on visual experiences, such as the experience of visual blur that are taken to be counter examples to transparency. Here, I consider a novel objection to transparency that does not depend on intuitions about examples. The objection is that if transparency is true then we cannot explain our ability to think about our visual experiences as such.
