Current understanding of Mill as a founding father of liberalism is a Cold War creation. Discarding this conception opens the way to a general reassessment of his thought: who was the historical Mill? He did not define himself as liberal and there is no simple template. Most obviously he is a pluralist, defined by a plural heritage received through his father. This framework permitted great creativity in political and social theory, but it was diffuse. The one clear unifying theme is (...) a unique conception of a hierarchy of intellect founded on the inexorable accumulation of positive knowledge. The one important exception to this is political economy. What stands out overall is his individuality, where Mill embodies his own ideal. So apart from political economy, where he could be identified in more conventional terms, his nineteenth-century legacy was personal and incalculably diffusive rather than doctrinaire. Architectural style is a medium for the promotion of cultural identities and cohesion. South Asian Association for Regional Cooperation nations provide a prism through which all forms of vernacular architecture can be viewed. This study is presented through the lens of the soul of the eye coupled with the power of technological probing. This synthesis affords a most appealing and lyrical exploration of the course of the development of cities within the SAARC nations. It showcases research results combining the above (...) stated synergy—starting from some of SAARC’s sophisticated historic cultures, cultures that ebbed and flowed along its shores and valleys. This paper shall touch upon unique cultural roots stretching back to the Dravidian civilization that flourished over 3500 years ago and also look at the grouping of houses within the Indus Valley Civilization in Lothal and the Sarasvati Valley Civilization in Kalibangan. The sensitivity underlying SAARC architecture and its traditions are seen in many communal settlements, profoundly so in the Indian subcontinent and in Sri Lanka. The paper shall showcase two specific, but nevertheless, distinct styles of communal functioning within unique architectural strongholds in the ancient Ratnagiri University in Odisha, India, and also touch upon a unique blend of styles of landscape architecture in Sri Lanka. The overarching emphasis of this study is that throughout SAARC’s history, architecture has been creatively adopted to the need of its users and the characteristics of its climate and location. It has always fulfilled the needs and nourished the spirit of its people, promoting cultural cohesion even today. In this context, it is interesting to explore traditional techniques of vernacular architecture in houses in Andhra, Tamil Nadu and Kerala. The common thread linking mass housing in Lothal, Kalibangan, Anuradhapura and Ratnagiri about 2 millennia ago, with present day housing patterns, is in the application of sustainable building practices using intelligent building forms, fabric and orientation. This paper explores this commonality from a modern perspective using CFD. As the SAARC countries still struggle to get a fuller understanding of their unique ecology and the complexity of their diverse cultures, revisiting the architectural legacy of their indigenous societies might prove insightful. The need for this revisit becomes even more relevant in the wake of the Paris Agreement and more recently the Kigali Agreement. The discourse on providing indoor thermal comfort to the SAARC people cannot be decoupled from the climate change story—heating, ventilation and cooling consume a large amount of energy and have a deep underlying link with the targets set at Paris and Kigali. The onus will be on a large number of stakeholders to meet these targets—engineers, architects, manufacturers, policy-makers, researchers and consumers. This paper aims at reminding the stakeholders of the richness and the usefulness of their vernacular architecture in upholding the ideal of sustainability. (shrink)

This paper presents an attempt to bridge the gap between logical and cognitive treatments of strategic reasoning in games. There have been extensive formal debates about the merits of the principle of backward induction among game theorists and logicians. Experimental economists and psychologists have shown that human subjects, perhaps due to their bounded resources, do not always follow the backward induction strategy, leading to unexpected outcomes. Recently, based on an eye-tracking study, it has turned out that even human subjects who (...) produce the outwardly correct ‘backward induction answer’ use a different internal reasoning strategy to achieve it. The paper presents a formal language to represent different strategies on a finer-grained level than was possible before. The language and its semantics help to precisely distinguish different cognitive reasoning strategies, that can then be tested on the basis of computational cognitive models and experiments with human subjects. The syntactic framework of the formal system provides a generic way of constructing computational cognitive models of the participants of the Marble Drop game. (shrink)

The literature on the democratic legitimacy of judicial review and also on institutionalizing deliberative democracy neglects the possibility of employing juries rather than judges to determine bill-of-rights matters. This neglect is unfortunate, for there are findings emerging especially from deliberative polling that support the feasibility of such juries. Such feasibility would raise a new countermajoritarian concern with judicial review. The argument supporting this new concern also casts fresh light on the traditional countermajoritarian concern.

By what he calls the material-aesthetic, he opens up a fresh direction in our experience and understanding of plastic through the correspondence that plastic as a material brings with the aesthetic that it inspires and figures"-.

The concern of this paper is to critique the political conception of nationalism as a theory of the nation-state. The basic point of the critique is that when the interests of the nation and the principles of the state coincide there emerges a fierce sense of national identity which endangers moral indifference to outsiders, the people within and outside the national boundary, without remorse. Here the attempt to uphold national identity is something more than nationhood. Besides involving territorial identity, common (...) language, custom and culture essential to the idea of a “nation,” it also upholds the consciousness of these as determining separate rights and allegiances, the idea of attachment to a nation and its interests. Such a consciousness can emerge only on the adoption of certain populist ideas such as racism, ethnicity and even such popular elusive myths as the “greatness” of a nation, the urge for the maintenance of “national character,” etc. Such “nationalist xenophobia” leads to the intensification of the distinction between the “own” and the “other,” “national” and the “alien,” the “citizen” and the “migrant” leading to “ethnic disharmony,” “colour bias,” hatred and suspicion of persons with whom one has lived closely as neighbours for decades. The most popular is the economic discourse of the “migrants” putting the “nationals” out of work. All this has its toll on multi-culturalism and humanitarian concerns. Many affluent nations have become cold to human misery, suffering and deaths from wars, terrorism, acute poverty, political persecution, environmental degradation, etc. This has created an “existential” crisis for millions of people on earth. According to the Navya Naiyāyikas, inference is the knowledge, which is produced out of consideration. But what is to be understood by the term ‘consideration’ or ‘parāmarśa’? According to them, parāmarśa or consideration is the factor through the operation of which the inferential conclusion can be attained. Parāmarśa has been defined as the knowledge of the existence of the hetu or reason in the pakṣa or subject, which reason is characterized by its being concomitant with the sādhya, the knowledge in (...) the form of parāmarśa is actually caused by the knowledge of invariable concomitance of probans (hetu) with the probandum (sādhya) and the knowledge of the existence of the hetu in the subject (pakṣa). It has been said by Viśvanātha that the cognition of the existence of probans or hetu in the subject of inference along with the cognition of the prabans or hetu as pervaded by sādhya is called parāmarśa (pakṣasya vyāpyavṛttitvadhīḥ parāmarśa ucyate). The invariable co-existence in the form ‘where there is smoke, there is fire’ is known as vyāpti or invariable concomitance. Here the invariable coexistence (avyabhicārī sāhacarya) between the probans and probandum (i.e., smoke and fire) is the definition of vyāpti. The term ‘co-existence’ means remaining in the same locus of the probans with the probandum, which is not the counter positive of the absolute negation existing in the locus of the hetu. To Gangeśa, the knowledge of the co-existence of the probans and probandum along with the absence of the knowledge of deviation of the probans is the cause of ascertaining vyāpti. Repeated observations, of course, sometimes act as a promoter (prayojaka) in ascertaining vyāpti by removing the doubt of deviation. The doubt of deviation can be removed sometimes by Tarka or sometimes by the absence of the collocation of causes of doubt, which is called svataḥsiddhaḥ. Gangeśa admits sāmānyalakṣaṇā as a pratyāsatti in ascertaining vyāpti between smoke-in-general and fire-in-general. To him, the super-normal connection through universal (sāmānyalakṣaṇā pratyāsatti) has got a prominent role in ascertaining vyāpti. If somebody challenges about the validity of the syllogistic argument in the form “The mountain is fiery as it possesses smoke” (parvato vahnimān dhūmāt), the philosophers of Nyāya and Navya-nyāya persuasion will justify the same with the help of five constituents (avayava-s). The process is called parāthānumāna (syllogistic argument for making others understand). The constituents of a syllogism are proposition (pratijňā), reason (hetu), example (udāharaṇa), application (upanaya), and conclusion (nigamana). (shrink)

In this overview, I begin by situating De-Moralizing Gay Rights within the field of queer studies/queer theory. I then delineate the book’s principal arguments. The book critically interrogates three sets of distortions in 21st century public discourse on LGBT+ rights in the United States. The first relates to the critique of pinkwashing, often advanced by scholars who claim to be proponents of a radical politics. I suggest that this critique sometimes suffers from analytical overreach. The second concerns a recent US (...) Supreme Court decision, Obergefell v. Hodges (2015), a judgment that established marriage equality across the 50 states. I argue that this judgment mobilizes the Court’s endorsement of two elements of homonormativity: amatonormativity and repronormativity. Instead of endorsing homonormativity, the Court should have employed an approach based on decisional minimalism. The third distortion occurs in Kenji Yoshino’s theorization of the concept of gay covering. Yoshino’s calls to dismantle cultural demands for gay covering turn out, I argue, to constitute an oppressive command to ‘gay-flaunt.’. (shrink)

A fundamental issue in philosophy of perception is to understand the nature of experience and the relation of the experience with objects or states of affairs that is experienced. A prominent philosophical issue here is posed by the possibility of hallucinatory experiences, which are subjectively indistinguishable from veridical perception for the experiencer. The philosophical views in this matter can be grouped into three major positions on the basis of the nature of the subjective experience and relation of the subjective experience (...) with the object. These are the sense-data theories—which consider that the objects of perception are mental entities; the representative theories—according to which perception is a representation of the objects in the external world; and the naïve realist theories—which proclaim that the external objects are constitutive of the very perceptual experience and not a representation of it. Naïve realism claims it is the defence of common-sense notion regarding experience i.e. how experience seems to the experiencer upon introspective reflection on it. This position has a growing number of proponents in philosophy especially in the last two decades. But it also entails radical departure of established philosophical views regarding the nature of experience, the phenomenal character of experience, and the experiencer–object relation. In this paper, we critically examine naïve realism from two crucial aspects pertaining to it—the question of introspection being basis of naïve realist thesis, and the notion of primacy of perception over non-veridical forms of experiences. We find that there are significant problems which weaken the naïve realist thesis. (shrink)

How do people reason about their opponent in turn-taking games? Often, people do not make the decisions that game theory would prescribe. We present a logic that can play a key role in understanding how people make their decisions, by delineating all plausible reasoning strategies in a systematic manner. This in turn makes it possible to construct a corresponding set of computational models in a cognitive architecture. These models can be run and fitted to the participants’ data in terms of (...) decisions, response times, and answers to questions. We validate these claims on the basis of an earlier game-theoretic experiment about the turn-taking game “Marble Drop with Surprising Opponent”, in which the opponent often starts with a seemingly irrational move. We explore two ways of segregating the participants into reasonable “player types”. The first way is based on latent class analysis, which divides the players into three classes according to their first decisions in the game: Random players, Learners, and Expected players, who make decisions consistent with forward induction. The second way is based on participants’ answers to a question about their opponent, classified according to levels of theory of mind: zero-order, first-order and second-order. It turns out that increasing levels of decisions and theory of mind both correspond to increasing success as measured by monetary awards and increasing decision times. Next, we use the logical language to express different kinds of strategies that people apply when reasoning about their opponent and making decisions in turn-taking games, as well as the ‘reasoning types’ reflected in their behavior. Then, we translate the logical formulas into computational cognitive models in the PRIMs architecture. Finally, we run two of the resulting models, corresponding to the strategy of only being interested in one’s own payoff and to the myopic strategy, in which one can only look ahead to a limited number of nodes. It turns out that the participant data fit to the own-payoff strategy, not the myopic one. The article closes the circle from experiments via logic and cognitive modelling back to predictions about new experiments. (shrink)

I dedicate this essay to the memory of the late Wolfgang Mommsen—the subject would have been congenial to him. It is one of a series of offshoots from a central project: a scholarly edition of Max Weber's Protestant Ethic with commentary. When I first told Prof. Mommsen of my plan in 1994 he looked me full in the face and gave a characteristic growl: “All that work!” Here was a man who knew what he was about. My thanks to Ross (...) McKibbin and Keith Tribe for reading this paper in draft. The article begins by examining Max Weber's relations with Lujo Brentano, much the most important “precursor” to Weber in the field of economics. In particular, Brentano conducted a form of parallel inquiry into the rise of ‘the spirit of capital’ in England 35 years before Weber looked for the origins of “spirit” of capitalism there, and the contrast between these two ideas casts much light both on Brentano and on Weber's Protestant Ethic. This personal history leads into a broader history of the transition in German economic thought between the 1860s – the formative decade for Brentano but also the era of Marx's Capital – and that of Weber's generation coming to maturity c.1890. Marx and Weber remain the two great canonical thinkers and original minds; but any authentic historical comparison between Marx and Weber must take in Brentano. This paper is about the uses of language which the Oxford philosopher of language, J.L. Austin excluded from theoretical consideration in his William James Lectures delivered in 1955 and posthumously published as How to Do Things with Words. Uses of language, such as dramatic, poetic or comedic, are said by Austin to be non-serious, deviant and parasitic upon the everyday normal ordinary language. This leaves literature out of consideration as an etiolation. Derrida, who is not merely a trained philosopher but (...) also one of the finest literary critics of our day, fails to agree with Austin. In his “Signature, Event, Context”, and Limited Inc, he criticizes Austin of “totalization” and “idealization” of the norm or the standard; his inability to see that the parasitic is necessarily inbuilt in the standard. This paper is an attempt at seeing how far Derrida is justified in his critique as there is much that is common between his and Austin’s approaches towards language. (shrink)

In the domain of legal information retrieval, an important challenge is to compute similarity between two legal documents. Precedents play an important role in The Common Law system, where lawyers need to frequently refer to relevant prior cases. Measuring document similarity is one of the most crucial aspects of any document retrieval system which decides the speed, scalability and accuracy of the system. Text-based and network-based methods for computing similarity among case reports have already been proposed in prior works but (...) not without a few pitfalls. Since legal citation networks are generally highly disconnected, network based metrics are not suited for them. Till date, only a few text-based and predominant embedding based methods have been employed, for instance, TF-IDF based approaches, Word2Vec and Doc2Vec based approaches. We investigate the performance of 56 different methodologies for computing textual similarity across court case statements when applied on a dataset of Indian Supreme Court Cases. Among the 56 different methods, thirty are adaptations of existing methods and twenty-six are our proposed methods. The methods studied include models such as BERT and Law2Vec. It is observed that the more traditional methods that rely on a bag-of-words representation performs better than the more advanced context-aware methods for computing document-level similarity. Finally we nominate, via empirical validation, five of our best performing methods as appropriate for measuring similarity between case reports. Among these five, two are adaptations of existing methods and the other three are our proposed methods. (shrink)

This paper presents four theorems that connect continuity postulates in mathematical economics to solvability axioms in mathematical psychology, and ranks them under alternative supplementary assumptions. Theorem 1 connects notions of continuity (full, separate, Wold, weak Wold, Archimedean, mixture) with those of solvability (restricted, unrestricted) under the completeness and transitivity of a binary relation. Theorem 2 uses the primitive notion of a separately continuous function to answer the question when an analogous property on a relation is fully continuous. Theorem 3 provides (...) a portmanteau theorem on the equivalence between restricted solvability and various notions of continuity under weak monotonicity. Finally, Theorem 4 presents a variant of Theorem 3 that follows Theorem 1 in dispensing with the dimensionality requirement and in providing partial equivalences between solvability and continuity notions. This collected volume of essays examines fusion theory and demonstrates how the theory can be applied to the reading of various works of Indian English novelists.

This paper studies the relationship between personal stock donation by top executives and board of directors (insiders) of publicly traded corporations and their personal tax, shareholders' returns, and social responsibility. The study finds evidence that the timing of stock donations is driven by personal tax gain. The study further shows, comparing stock gift corporations relative to their non‐stock gift cohorts, that personal stock gifts are associated with lower short‐term and long‐term stock returns to shareholders. This implies that stock donation driven (...) by insiders' personal gain adversely affects shareholder wealth. However, the likelihood and intensity of insiders to make personal stock donation is reduced when firms have strong corporate social responsibility (CSR). Agency theory explains insiders' opportunistic behavior, stakeholder theory is also supported by evidence that stock donation is negatively related to CSR, and stewardship theory offers a different view to explain the rationale behind insiders' stock donation and shareholders' reactions to stock gifts. Unlike previous studies that consider the Chicago Board of Options Exchange implied volatility index, we examine long memory and fractality in the universe of nine CBOE volatility indices. Using daily data from October 5, 2007, to October 5, 2020, covering calm and crisis periods, we find evidence of long memory and fractality in all indices and a change in the degree of volatility persistence, which points to inefficiency. The long memory of the SKEW index is strong before the onset of (...) three crisis periods, but eases afterwards. The findings provide new insights that matter to investment decisions and trading strategies. (shrink)
