The following frank comments on the subject of analysis, though they obviously represent a preliminary examination af some of the problems that emerge between philosophical analysis and phenomenology as the two major trends in contemporary philosophy, are conceived by the present author in a much broader manner than the mere confrontation of two apparently opposing schools of thought. Due to the emergent nature of these themes, some adagio, others allegro, it has been impossible to arrange them in the usual systematic (...) manner. Whatever in these comments is "offensive" to either phenomenologist or analyst derives from the fact that this is only a preliminary study, in which the author is orienting himself and preparing for more systematic and thorough-going dialogue with sympathetic analyst friends and phenomenologist critics. What is presented here to friend, foe, and general philosophical reader, is a selection of themes that have puzzled me greatly. I offer them without any of the usual excuses and with the hope that to some extent this discussion may bring philosophers together, so that we can begin to lind the common ground, on which to make our contribution to contemporary thought the more truly convincing. Twentieth century philosophers introduced the distinction between “objective rightness” and “subjective rightness” to achieve two primary goals. The first goal is to reduce the paradoxical tension between our judgments of what is best for an agent to do in light of the actual circumstances in which she acts and what is wisest for her to do in light of her mistaken or uncertain beliefs about her circumstances. The second goal is to provide moral guidance to an agent who may be (...) uncertain about the circumstances in which she acts, and hence is unable to use her standard moral principle directly in deciding what to do. This paper distinguishes two important senses of “moral guidance”; proposes criteria of adequacy for accounts of subjective rightness; canvasses existing definitions for “subjective rightness”; finds them all deficient; and proposes a new and more successful account. It argues that each comprehensive moral theory must include multiple principles of subjective rightness to address the epistemic situations of the full range of moral decision-makers, and shows that accounts of subjective rightness formulated in terms of what it would reasonable for the agent to believe cannot provide that guidance. Explaining the maintenance of communicative behavior in the face of incentives to deceive, conceal information, or exaggerate is an important problem in behavioral biology. When the interests of agents diverge, some form of signal cost is often seen as essential to maintaining honesty. Here, novel computational methods are used to investigate the role of common interest between the sender and receiver of messages in maintaining cost-free informative signaling in a signaling game. Two measures of common interest are defined. These quantify (...) the divergence between sender and receiver in their preference orderings over acts the receiver might perform in each state of the world. Sampling from a large space of signaling games finds that informative signaling is possible at equilibrium with zero common interest in both senses. Games of this kind are rare, however, and the proportion of games that include at least one equilibrium in which informative signals are used increases monotonically with common interest. Common interest as a predictor of informative signaling also interacts with the extent to which agents’ preferences vary with the state of the world. Our findings provide a quantitative description of the relation between common interest and informative signaling, employing exact measures of common interest, information use, and contingency of payoff under environmental variation that may be applied to a wide range of models and empirical systems. © 2013 Godfrey-Smith, Martínez. Originally published in 1980. What is time? How is its structure determined? The enduring controversy about the nature and structure of time has traditionally been a diametrical argument between those who see time as a container into which events are placed, and those for whom time cannot exist without events. This controversy between the absolutist and the relativist theories of time is a central theme of this study. The author's impressive arguments provide grounds for rejecting both these theories, firstly by (...) establishing that 'empty' time is possible, and secondly by showing, through a discussion of the structure of time which involves considering whether time might be cyclical, branching, beginning or non-beginning, that the absolutist theory of time is untenable. This book then advances two new theories, and succeeds in shifting the traditional debate about time to a consideration of time as a theoretical structure and as a theoretical framework. (shrink)

In this round table response, we discuss some of the problems inherent in insisting on specific consent for an activity that needs to happen rapidly as part of a package of care. The Human Tissue Authority consider that specific consent is mandatory to assess which antibiotics are appropriate on the neonatal unit, but this insistence may actually limit the autonomy which consent aims to promote. While genetic testing to determine which child will react adversely to particular antibiotics has been available (...) clinically for several years, the research proposed here is to assess whether improving the speed of testing allows decisions to be made before treatment starts. Insisting on specific consent before this activity can take place is likely to delay appropriate care in some cases. On admission to the neonatal unit, the unwell infant is routinely subjected to a range of investigations and treatments. A person with parental responsibility will usually be asked to provide consent to undertake treatments for children who do not have capacity to give consent themselves.1 For the acutely unwell child, consent will usually be sought for a package of care: the urgent nature of neonatal medicine often requires clinicians to make many decisions without explicit consent. Doctors must always act in a child’s best interests: their decisions need to protect the health and well-being of a child and hold the child’s welfare paramount in accordance with the Children Act and General Medical Council guidelines.1 2 Thus, for example, ventilation might be initiated, sedation provided, antibiotics commenced or diagnostic investigations requested without separate consent conversations or …. BackgroundImplementation science research, especially when using participatory and co-design approaches, raises unique challenges for research ethics committees. Such challenges may be poorly addressed by approval and governance mechanisms that were developed for more traditional research approaches such as randomised controlled trials.DiscussionImplementation science commonly involves the partnership of researchers and stakeholders, attempting to understand and encourage uptake of completed or piloted research. A co-creation approach involves collaboration between researchers and end users from the onset, in question framing, research design and delivery, (...) and influencing strategy, with implementation and broader dissemination strategies part of its design from gestation. A defining feature of co-creation is its emergent and adaptive nature, making detailed pre-specification of interventions and outcome measures impossible. This methodology sits oddly with ethics committee protocols that require precise pre-definition of interventions, mode of delivery, outcome measurements, and the role of study participants. But the strict requirements of ethics committees were developed for a purpose – to protect participants from harm and help ensure the rigour and transparency of studies. We propose some guiding principles to help square this circle. First, ethics committees should acknowledge and celebrate the diversity of research approaches, both formally and informally ; without active support, their members may not understand or value participatory designs. Second, ground rules should be established for co-design applications and communicated to committee members and stakeholders. Third, the benefits of power-sharing should be recognised and credit given to measures likely to support this important goal, especially in research with vulnerable communities. Co-design is considered best practice, for example, in research involving indigenous peoples in New Zealand, Australia and Canada. (shrink)

Most theorists working on moral obligations to refugees conceive of western states as innocent bystanders with duties to aid refugees if they can do so at little cost to themselves. This paper challenges this dominant theoretical framing of global displacement by highlighting for the first time certain practices of western states in response to refugee flows such as border violence, detention, encampment and containment which may make us question whether states who engage in such practices are indeed innocent. This paper (...) provides the first normative analysis of these practices by seeking to classify them as either doing or allowing harm and invoking the fundamental moral imperative central to core common moral commitments - not to harm innocent people - to suggest that certain western states are not merely failing to aid refugees and allowing harm to come to them, but are instead responding to their calls for aid by harming them. Recent research on consumer social responsibility highlights the need to examine psychological drivers of environmentally‐friendly consumption choices in a global context. This article investigates consumers’ willingness to pay (WTP) more for environmentally‐friendly products across 28 European Union (EU) countries, using a sample of 21,514 consumers. A multigroup structural equation modeling analysis reveals significantly different patterns and relationships, in how (a) subjective knowledge about the product's environmental impact, (b) environmental product attitudes, and (c) the perceived importance of the products’ environmental impact (...) influence consumers’ WTP more for environmentally‐friendly products across countries. The hypothesized model predicts WTP for 20 out of 28 countries and the findings show that a “one‐size‐fits‐all” approach is inadequate in capturing the heterogeneity of EU consumers. Hosfstede's cultural dimensions of uncertainty tolerance and individualism explain differences in WTP for environmentally‐friendly products across EU countries. Power is an inescapable aspect of all socialrelationships, and inherently is neither goodnor evil. Doctors need power to fulfil theirprofessional obligations to multipleconstituencies including patients, thecommunity and themselves. Patients need powerto formulate their values, articulate andachieve health needs, and fulfil theirresponsibilities. However, both parties canuse or misuse power. The ethical effectivenessof a health system is maximised by empoweringdoctors and patients to develop `adult-adult'rather than `adult-child' relationships thatrespect and enable autonomy, accountability,fidelity and humanity. Even in adult-adultrelationships, conflicts and complexitiesarise. Lack of (...) concordance between doctors andpatients can encourage paternalism but may bebest resolved through negotiated care. Afurther area of conflict involves the `doubleagency' of doctors for both patients and thecommunity. Empowerment of all players is notalways possible but is most likely where eachparty considers and acknowledges power issues. (shrink)

This paper examines how and why information moved or failed to move within transatlantic botanical networks in the late eighteenth century. It addresses the problem of how practitioners created relationships of trust, and the difficulties they faced in transferring reputations between national contexts. Eighteenth-century botany was characteristically cross-cultural, cosmopolitan and socially diverse, yet in the 1770s and 1780s the American Revolutionary Wars placed these attributes under strain. The paper analyses the British and French networks that surrounded the Philadelphian plant hunter (...) William Young, to show how botanists and plant collectors created and maintained connections with each other, especially when separated by geographical and cultural distance. It highlights in particular the role played by commercial plant traders, and demonstrates how practitioners used objects to transmit social as well as scholarly information. The transnational circulation of information and knowledge in the Enlightenment was determined by culturally specific judgements about trust, confidence, communication and risk. Despite the prominent role played by material culture within these networks, scholars continued to place high value on face-to-face contact as a means of judging the trustworthiness and cooperation of their agents. This book is devoted to the reintroduction of the remarkable approach to sociological inquiry developed by Harvey Sacks. Sacks's original analyses - concerned with the lived detail of action and language-in-interaction, discoverable in members' actual activities - demonstrated a means of doing sociology that had previously seemed impossible. In so doing, Sacks provided for highly technical, detailed, yet stunningly simple solutions to some of the most trenchant troubles for the social sciences relating to language, culture, meaning, knowledge, action, and social (...) organisation. In this original collection, scholars working in a range of different fields, including sociology, human geography, communication and media studies, social psychology, and linguistics, outline the ways in which their work has been inspired, influenced, and shaped by Sacks's approach, as well as how their current research is taking Sacks's legacy forward in new directions. As such, the collection is intended to provide both an introduction to, and critical exploration of, the work of Harvey Sacks and its continued relevance for the analysis of contemporary society. Both the theory that traumatic childhood memories can be repressed, and the reliability of the techniques used to retrieve these memories are challenged in this paper. Questions are raised about the robustness of the theory and the literature that purports to provide scientific evidence for it. Evidence to this end is provided by the demographic and qualitative results of a research study conducted by the authors which surveyed New Zealand families in which one member had accused another (or others) of (...) sexual abuse on the basis of recovered memories. It is shown that a number of these allegations involve very low probability events. Since memory repression theory is not currently scientifically substantiated it is argued that care needs to be taken in the mental health, legal and insurance compensation arenas. Memories recalled during therapy may be treated as metaphorical but, in the absence of corroborative evidence, should not be considered factually true. Clinicians who wish to use memory recovery techniques should inform patients of their experimental and controversial nature, point out potential adverse effects, and obtain consent before proceeding. Realism as an explanatory theory of science (faded realism) is not convincing. However, neither "internal realism" nor instrumentalism are plausible. Assuming common sense realism a non-explanatory form of scientific realism (modest realism) can be defended. Modest realism has affinities with Fine's NOA. To NOA it adds a descriptive thesis about scientific progress towards truth or verisimilitude. In addition it adds a concern with purely philosophical issues which arise in reflections on the nature of science. However, there is little to say (...) about truth over and above what is conveyed by Tarski/Davidson semantics. (shrink)

The constructionist thesis of history states, in general, that the historian must construct a theory to explain the past. Some, including Leon Goldstein, attempt to push this formulation beyond a description of historical methodology. They argue that since the real past is inaccessible to present observation, the real past can have no relevance for historiography. The distinctions made between the present, the real past, and the historical past generate problems with the concepts of past and present knowledge, theoretical infrastructure and (...) experience, verification and truth, conflicting historical theories, and observation and knowledge. Goldstein's formulation of the constructionist thesis assumes the conflicting positions that experiential perception is paradigmatic of all methods of acquiring knowledge, and that knowledge is itself a kind of experience. As well as conflicting with commonsense views, his thesis is internally incoherent. (shrink)

Part of the baths regulations preserved on a bronze plaque, engraved more or less identically on each side, from the copper mine at Vipasca, Lusitania. The manager is to wash, clean and grease the waterheating vats once a month. Such vats, as mentioned by Vitruvius in his discussion of public baths , were three in number: aena supra hypocausim tria sunt componenda. They were sizeable articles: Propertius seems to see himself tortured in one: Veneris torrebar aeno. The greasing was to (...) keep aerugo, copper rust, at bay; for this purpose Cato in general recommends amurca, lees of olive oil: ahena omnia amurca unguito…et aerugo non erit molesta; and also for greasing axles amurca axem unguito. For bronze tablets exposed to the weather such as the numerous public records on temple walls and the like Pliny recommends olive oil: aera…robiginem celerius trahunt…nisi oleo perunguantur. The phrase e recenti which occurs in both versions of the text is unexampled, and the CIL editors suggest that it means ex integro, afresh. However I am inclined to think that the engraver had a faulty copy in front of him and we should read adipe recenti. (shrink)
