The principle of omnia sunt interpretanda refers to the derivational conception and derivational theory of interpretation. The principle appears in disputes concerning the role of a judge in the process of interpretation, and this has produced an effect that Polish theory of law is currently getting closer to the conceptions presented in the American debate on activism and textualism. In the practice of jurisdiction, the principle of omnia sunt interpretanda is mostly invoked outside theoretical (...) context. It becomes a manifestation of a new dimension of judicial independence, namely an independent authority over the meaning of legal text. In the following paper the legal cultures and legal theories involved in the dispute are being disclosed in order to put in question the possibility of achieving a clear result of interpretation against a background of a crisis of the relations between law and law-making state, which manifests itself in the peculiar process of legal institutions becoming autonomous in relation to state institutions. In this context, the aforementioned principle constitutes the manifestation of the way in which courts come up with a new definition of the role of the third (sui generic) power. The certain organizational requirements placed upon the courts (especially the SAC and provincial administrative courts) are being scrutinized in order to find out in which mode it is possible to at least reduce the degree of inconsistency of the results of interpretation. Here, the attempt to organize a community of judges for the activities of legal interpretation undertaken by them plays a crucial role. (shrink)

The paper addresses a contemporary Polish debate on the limits and functions of juristic interpretation of law. After presenting the main theses and features of Jerzy Wróblewski’s clarificative theory of juristic interpretation and Maciej Zieliński’s derivational theory of juristic interpretation, the author critically discusses various arguments used in the debate. Finally, a tentative solution of the controversy, based on the criticism of Zieliński’s conception of legal norm, is proposed. : It is often argued that while Kant grounds practical freedom in the idea of transcendental or absolute freedom in the Dialectic of the First Critique, he would have explicitly dissociated these concepts in the Canon. For, in contradiction with the Dialectic, Kant claims in the Canon that through experience we know practical freedom to be one of the natural causes and that the transcendental freedom could be left aside as irrelevant. These claims are usually interpreted in the (...) light of the socalled “patchwork theory” as evidence of an inconsistency between the two sections of the First Critique and of a defense of a mere comparative, compatibilistic or even psychological concept of freedom by Kant in the Canon. In contradistinction to this widespread interpretation, I intend to provide an alternative interpretation of the Canon by showing that the concept of practical freedom contained in it is a genuinely incompatibilistic one and that this section can be reconciled with the Dialectic. As a conceptual approach in art practice, the female body has represented both a cultural barrier and a source of inspiration throughout art history. The adoption of the female body as an art theme is prevalent across many different artistic movements, using varying conceptual approaches. Women struggle against paradigms of inferiority to this day, though their individual cultural identity varies according to their society’s beliefs and customs – for example, many contemporary Middle Eastern cultures and customs are based on a (...) patriarchal past, when men wielded power over women. Women all over the world experience subjugation to varying degrees in the fields of employment, education, sexuality and reproductive choice. The female body in Middle Eastern societies is a red line that artists are not allowed to cross. Though many Middle Eastern civilizations have dealt freely with the female body, as can be seen in the paintings and sculptures of ancient Egypt, many social and religious factors made the female body taboo in most Middle Eastern cultures. However, on close scrutiny of modern art history in Middle Eastern and Islamic countries, we can identify outstandingly courageous female artists who succeeded in breaking the rules. They chose to express themselves through their own own form of art as an expression of freedom. They chose to use their own bodies as an art medium, which made them pioneers in their countries, and many female artists followed their example. Media art has flourished in Arab countries since the 1990s, especially in Egypt. Many of these female artists distinguished themselves as pioneers, aligning themselves with new art forms and challenging the prevailing stereotypical notion of the female artist at that time. This new mode of female self-expression and identity has developed over time and remains an ongoing process in the twenty-first century. This article considers how Middle Eastern female media artists have struggled to transform stereotypes of women by using their own bodies as an artistic element, and how they have expressed the concept of freedom through their self-body image. Indeed, Ian Barbour's well-known typology defining four canonical modes of the science-religion relationship—conflict, independence, dialogue, and integration—has played an organizing role but has not satisfied everyone.3 Although our purpose here is not to recapitulate these discussions, it might be helpful to mention an issue that frequently arises within them: whether Barbour's classification is necessarily exhaustive, and in particular, if what he understands by "integration" is really the perfect culmination of a link that could connect science and faith. Thus, some authors prefer to speak of [End Page 71] "interaction," "compatibility," or "articulation" to describe this relationship, either replacing or superimposed upon Barbour's integration modality.4We believe that at least part of this series of controversies results from the lack of fundamental definitions and distinctions. "Science" is not univocal but an analogous term, since it can be predicated both from extremely diverse disciplines and also from a cognitive act, a habit, or a corpus of knowledge.5 On the other hand, "faith," "religion," and "theology" have neither identical meanings nor even an analogous epistemic scope in different religious traditions. All this outlines a problem whose many edges cannot be enclosed within the margins of a categorization, however nuanced.This article aims to illustrate the complexity of the relationship between science, philosophy, and theology, using as a case study the contribution of contemporary embryology and developmental biology to theological reflection on the Incarnation of Jesus Christ. We begin by examining some theological hypotheses that, using the biological knowledge and speculations of their time, attempt to deepen our understanding of the mystery of the incarnate Word. Next, we propose an interpretation of the conception of Jesus Christ, in which the facts contributed by biology could enrich, and perhaps illuminate, certain aspects of theological reflection. In this essay I offer an interpretative reading of the first chapter in the two canonical works, the Zhuang-zi and the Lao-zi, and argue that there is an inner connection between the first chapters of the two books. My presupposition is that what Zhuang-zi has argued in "Xiao Yao You" is the theme of the relativity of the position of the human world, which is in accord with the mystery of Dao presented at the beginning of the Lao-zi. Therefore, (...) there are two opposite directions running in the Daoist philosophy in Lao-zi and Zhuang-zi: the first one is from this world (worlds) to Dao; the second one is from Dao to the worlds. While the first emphasizes the relativity of the point of views of the worldly beings, the second shows the mystery of Dao. This can be seen as a hermeneutical circle. (shrink)

There is a widespread impression that General Relativity, unlike Quantum Mechanics, is in no need of an interpretation. I present two reasons for thinking that this is a mistake. The first is the familiar hole argument. I argue that certain skeptical responses to this argument are too hasty in dismissing it as being irrelevant to the interpretative enterprise. My second reason is that interpretative questions about General Relativity are central to the search for a quantum theory of gravity. (...) Recent advances in the technology of creating chimeras have evoked controversy in policy debates. At centre of controversy is the fear that a substantial contribution of human cells or genes in crucial areas of the animal’s body may at some point render the animal more humanlike than any other animals we know today. Authors who have commented on or contributed to policy debates specify that chimeras which would be too humanlike would have an altered moral status and threaten our notion (...) of ‘human dignity’. This setting offers a productive opportunity to test the notion of human dignity and to emphasize some of its weaknesses as an ethical tool. Limiting chimerism experiments on the basis of whether or not it undermines or challenges human dignity implies a clear demarcation of those characteristics which are typically, and importantly, human. Evidence of our evolutionary ties and behavioral similarities with other animals seem to annul all attempts to define the uniquely human properties to which human dignity may be attributed. Hence, it has been suggested that the particular moral status associated with humans cannot be explained for beyond an intuitive basis. In what follows, we will argue that the difficulties inherent in the notion of human dignity lie not in the impossibility to acquire a list of properties which are unique to humans, but rather in the difficulty to demonstrate the moral relevance of these properties, and particularly the relevance of their being human. We offer an alternative interpretation of the concept of dignity which is not necessarily related to being human. (shrink)

A recent theory provides a unified cross-linguistic analysis of the interpretations that are assigned to expressions for disjunction, Negative Polarity Items, Free Choice Items, and the non-interrogative uses of wh-phrases in languages such as Mandarin Chinese. If this approach is on the right track, children should be expected to demonstrate similar patterns in the acquisition of these linguistic expressions. Previous research has found that, by age four, children have acquired the knowledge that both the existential indefinite renhe “any” and wh-words (...) in Mandarin Chinese are interpreted as Negative Polarity Items when they are bound by downward entailing operators, but the same expressions are interpreted as Free Choice Items when they are bound by deontic modals or by the Mandarin adverbial quantifier dou “all”. The present study extends this line of research to the Mandarin disjunction word huozhe. A Truth Value Judgment Task was used to investigate the possibility that disjunction phrases that are bound by the adverbial quantifier dou generate a conjunctive interpretation in the grammars of Mandarin-speaking 4-year-old children. The findings confirmed this prediction. We discuss the implications of the findings for linguistic theory and for language learnability. (shrink)

In this paper I critically discuss and, in the end, reject Morgan’s Canon, a popular principle in comparative psychology. According to this principle we should always prefer explanations of animal behavior in terms of lower psychological processes over explanations in terms of higher psychological processes, when alternative explanations are possible. The validity of the principle depends on two things, a clear understanding of what it means for psychological processes to be higher or lower relative to each other and a (...) justification of a general preference for explanations that refer to lower psychological abilities. However, I argue that we cannot spell out the idea of a psychological scale in a way that claim is satisfied. I start with the discussion of different interpretations of the notion of a psychological scale. In Sect. 3, I discuss different possible strategies to justify any of those interpretations and argue that all of them fail. Finally, in Sect. 4, I generalize the argument for all possible interpretations of Morgan’s Canon and propose an alternative strategy: We should base our interpretations of animal behavior on more general principles such as evidential support and explanatory power, as followed in other scientific domains. The Qur’an has been transmitted as both a written text and an oral recital. This has led to the development of a reading tradition that permits numerous different vocalisations to be made upon the basic skeletal text of the established ʿUthmānī codex. Ibn al-Jazarī chose ten early readers whom he felt were most representative of this tradition and whose readings are treated as canonical up until this day. One of these, the Kufan linguist al-Kisāʾī has been characterised in the literature (...) as more focused on the grammar of the Qur’an than his reader peers. This article explores al-Kisāʾī’s process of ikhtiyār when deciding between various possible readings. The sample for analysis consists of Kisāʾī’s tafarrudāt, the approximately fifty cases in which his reading differs from the other nine readers. By comparing his reading with the comments of early scholars of Qur’anic linguistics, especially his near-contemporary al-Farrāʾ, it is possible to construct a typology of the suspected principal reasons for al-Kisāʾī’s tafarrudāt. Not only are many of these based on grammatical preferences, but they demonstrate a significant degree of consistency. Furthermore, analysis of a cluster of readings with implications for the interpretation of the sharīʿa provides evidence for a subtle exegetical dimension to al-Kisāʾī’s work as a reader-grammarian. Bossi, A. and S. Valentini, An intuitionistic theory of types with assumptions of high-arity variables, Annals of Pure and Applied Logic 57 93–149. After an introductory discussion on Martin-Löf's Intuitionistic Theory of Types , the paper introduces the notion of assumption of high-arity variable. Then the original theory is extended in a very uniform way by means of the new assumptions. Some improvements allowed by high-arity variables are shown. The main result of the paper is a normal form theorem for (...) HITT. The detailed proof follows a computability method ‘a la Tait’. The main consequences of the normal form theorem are: the consistency of HITT, which also implies the consistency of ITT, and the computability of any judgement derived within HITT. Besides that, a canonical form theorem is shown: to any derivable judgement we can associate a canonical one whose derivation ends with an introductory rule. The standard disjunction and existential properties follow. Moreover, by using the computational interpretation of types it immediately follows that the execution of any proved correct program terminates. (shrink)

Slovenian epistemology is characterised by an idiosyncratic canon, based on three fundamental authors: Gaston Bachelard, Alexandre Koyré, and Thomas Kuhn. What binds this canon together is the attitude that the history of science should be viewed as a history of radical breaks or revolutions in scientific thought. The drawback of such an anthology of authors is not only that it is outdated, but that, from the position of this canon, it is difficult to discern the problems stemming (...) from the approach to history of science it endorses. In order to highlight the blind spots of Slovenian epistemology, I examine a different interpretative trajectory of the notion of scientific revolution in the United Kingdom and the United States. The methodological program, which focuses on revolutionary breakthroughs in scientific ideas, is thus re-evaluated by considering its strategic role in the institutionalisation of the history of science as a discipline. The event that marked the translation of French epistemology into English history of science were the lectures of the delegates from the Soviet Union at the Second International Congress of the History of Science and Technology in 1931. In post-war Anglo-American history of science, the concept of scientific revolution was adopted as a means of excluding Marxist studies of science – which had spread under the influence of the Soviet delegation – from the realm of acceptable discourse. I demonstrate how the Cold War historiography of science introduced a divide between the “internal” and “external” factors of scientific development, and their supposed synthesis in the work of Thomas Kuhn. Finally, I review the critiques that the sociology of scientific knowledge levelled at the story of the Scientific Revolution and point out the importance of these controversies for current epistemological research. The ELSI Program: Closing the Loop was an interpretive policy study undertaken to identify how the research and the researchers funded through the program to study the ethical, legal, and social implications of mapping the human genome contributed to the construction of a public policy agenda. The stated goals of this federal grant program, known as ELSI and administered through the National Center for Human Genome Research within the National Institutes of Health, was to maximize the benefits and minimize the (...) harms of the genetic information developed as a result of the government supported genomic research. The purpose of the research project was to generate meaning and understanding regarding the social constructions of this community of researchers. Specifically, identifying themes in the process and outcomes of the research activity was intended to inform future public policy actions, thereby, closing the loop on the reflexive activity generated by the ELSI Program. The activities of the sixty-four researchers granted awards between 1990 and 1993 comprised the core sample for the study. The research process was embedded in a constructivist philosophy and the design included participant observation and an analysis of textual materials generated by the grantees. Data included periodical articles, authored and edited books, videos, popular print and visual media materials, conference papers and presentations, forum reports, interviews, and materials generated by the researcher in the process of the research--notes and analytic memos. Data analysis was an interpretive synthesis of a content analysis, contextual analysis, grounded theory coding categories, and the reflexive process of the researcher. ;The phenomena under investigation were the interactional activities of the ELSI group of researchers through which meaning was shaped on the ethical, legal, and social implications of genomic mapping. A theoretical model of the constructions of the researchers as developed included two core categories: "Framing Academic Constructions" and "Institutionalizing the Myth". The ELSI researchers used a variety of strategies, including rhetorical questioning, professional blocking and impersonalizing, plying a trade, and academic time in generating constructions. The research and researchers contributed to institutionalizing a myth of a genome through strategies that included being the expert, narrowing the focus, and marveling. The consequence of these social interactions was a process of "Making Points Not Meaning", participation in symbolic activities that generated few issues for the public policy agenda. The constructions of the policy study were then situated in the context of the discipline of public administration and policy studies. Significant to the impact of the research findings was understanding how the cooptation of these researchers might effect an health care delivery system dominated by commercial interests such as biotechnology and managed care organizations. The study concluded with a discussion of how situated knowledge constructions, social epistemology, interdisciplinarity, and interpretive research methods might contribute to enhanced credibility in public policy actions. In general, they continue to ignore the immense body of knowledge and perspectives that Women's Studies have produced in recent decades. In this sense, it begins by presenting the general features of the hermeneutic problematic (...) and the theme of Conflict of Interpretations, and then showing its proven contribution to the development of Women's Studies and defending its possible contribution to enhancing their integration into canons. Word order alternation has been described as one of the most productive information structure markers and discourse organizers across languages. Psycholinguistic evidence has shown that word order is a crucial cue for argument interpretation. Previous studies about Spanish sentence comprehension have shown greater difficulty to parse sentences that present a word order that does not respect the order of participants of the verb's lexico-semantic structure, irrespective to whether the sentences follow the canonical word order of the language or not. This (...) difficulty has been accounted as the cognitive cost related to the miscomputation of prominence status of the argument that precedes the verb. Nonetheless, the authors only analyzed the use of alternative word orders in isolated sentences, leaving aside the pragmatic motivation of word order alternation. By means of an eye-tracking task, the current study provides further evidence about the role of information structure for the comprehension of sentences with alternative word order and verb type, and sheds light on the interaction between syntax, semantics and pragmatics. We analyzed both “early” and “late” eye-movement measures as well as accuracy and response times to comprehension questions. Results showed an overall influence of information structure reflected in a modulation of late eye-movement measures as well as offline measures like total reading time and questions response time. However, effects related to the miscomputation of prominence status did not fade away when sentences were preceded by a context that led to non-canonical word order of constituents, showing that prominence computation is a core mechanism for argument interpretation, even in sentences preceded by context. Heidegger's Being and Time is often interpreted as an important contribution to the canon of Existentialist philosophy. This popular interpretation is due largely to the theme of "authenticity" that is carefully developed in Division II. Here, Heidegger explains how we, as human beings, can temporarily sever ourselves from our bondage to a "fallen" public world by owning up to the anxious awareness of our inevitable death. It is in resolutely facing death that we can become individuals for the first (...) time and see through the illusions of stability and comfort that our roles in public life offer us. As "beings-towards-death" we can soberly come to grips with our finitude and bring this awareness back into our everyday lives, realizing and accepting that there is no security or permanence to our existence.But this existentialist interpretation fails to acknowledge the fundamental role that historicity plays in Heidegger's conception of authenticity. The experience of anxiety that can motivate us to authenticity and resoluteness is only initially an individuating experience. Our historicity determines the structure of our existence in such a way that the authentic human being is never an isolated individual . Human beings can never rebel against or overcome their own socio-cultural and historical world because they are always already interwoven to a specific historical situation. In this paper I will attempt to explain the relevance of historicist authenticity as a critical response to the common, existentialist interpretation. I will focus on the crucial role that one's historical background, in the sense of community and heritage, has on Heidegger's interpretation of authenticity. (shrink)

W. Baude’s and S.E. Sachs’s paper entitled “The Law of Interpretation” is a fascinating survey of a plethora of cases from the American common law system. The main conclusion of the article is extremely interesting from both philosophical and practical points of view. Namely, the authors claim that there exists something additional in the law that has not been identified before, and this is the law of interpretation. This law of interpretation is claimed to be a set of both written (...) and unwritten rules, including the canons of construction. However, a closer look at the examples provided by Baude and Sachs throughout their paper proves some nonhomogenous nature of the unwritten rules of the law of interpretation. I claim that this nonhomogeneity comes precisely from different, more fundamental facts to which these unwritten rules of interpretation are related. Moreover, I argue that the elements of the law of interpretation that are indeed incorporated into the law are in fact scarce, and I investigate the reasons for this state of affairs. Two main reasons are analyzed—the nature of context and the structure of all-things-considered moral arguments. (shrink)

In this major contribution to the study of the Chinese classics and comparative religion, John Henderson uses the history of exegesis to illuminate mental patterns that have universal and perennial significance for intellectual history. Henderson relates the Confucian commentarial tradition to other primary exegetical traditions, particularly the Homeric tradition, Vedanta, rabbinic Judaism, ancient and medieval Christian biblical exegesis, and Qur'anic exegesis. In making such comparisons, he discusses some basic assumptions common to all these traditions--such as that the classics or scriptures (...) are comprehensive or that they contain all significant knowledge or truth and analyzes the strategies deployed to support these presuppositions. As shown here, primary differences among commentarial or exegetical traditions arose from variations in their emphasis on one or another of these assumptions and strategies. Henderson demonstrates that exegetical modes of thought were far from arcane: they dominated the post-classical/premodern intellectual world. Some have persisted or re-emerged in modern times, particularly in ideologies such as Marxism. Written in an engaging and accessible style, Scripture, Canon, and Commentary is not only a challenging interpretation of comparative scriptural traditions but also an excellent introduction to the study of the Confucian classics. Life appears to be a natural property of matter, but the problem of its origin only arose after early scientists refuted continuous spontaneous generation. There is no chance of life arising ‘all at once’, we need the standard scientific incremental explanation with large numbers of small steps, an approach used in both physical and evolutionary sciences. The necessity for considering both theoretical and experimental approaches is emphasized. After describing basic principles that are available (including the Darwin-Eigen cycle), the search for (...) origins is considered under four main themes. These are the RNA-world hypothesis; potential intermediates between an RNA-world and a modern world via the evolution of protein synthesis and then of DNA; possible alternatives to an RNA-world; and finally the earliest stages from the simple prebiotic systems to RNA. The triplicase/proto-ribosome theory for the origin of the ribosome is discussed where triples of nucleotides are added to a replicating RNA, with the origin of a triplet code well-before protein synthesis begins. The length of the code is suggested to arise from the early development of a ratchet mechanism that overcomes the problem of continued processivity of an RNA-based RNA-polymerase. It is probable that there were precursor stages to RNA with simpler sugars, or just two nucleotides, but we do not yet know of any better alternatives to RNA that were likely to arise naturally. For prebiotic stages (before RNA) a flow-reactor model is suggested to solve metabolism, energy gradients, and compartmentation simultaneously – thus the intense interest in some form of flow reactor. If an autocatalytic cycle could arise in such a system we would be major steps ahead. The most likely physical conditions for the origin of life require further clarification and it is still unclear whether the origin of life is more of an entropy (information) problem (and therefore high temperatures would be detrimental), rather than a kinetic problem (where high temperatures may be advantageous). In _Interpreting Interpretation_, William E. Rogers searches for a model for literary education. This model should avoid both of two undesirable alternatives. First, it should not destroy any notion of discipline in the traditional sense, terminating in the stance of Rorty's "liberal ironist." Second, it should not regard literary education as an attempt to cause students to ingest a pre-determined mix of facts and cultural values, terminating in the stance of E. D. Hirsch's "cultural literate." From the semiotics of C. (...) S. Peirce, Rogers develops the notion of interpretive system. The interpretive system called textual hermeneutics is used to interpret interpretation. From that perspective, the world looks like a text. Applying the principle rigorously allows an articulation of the problematic relations among interpretation, philosophy, and language itself. _Interpreting Interpretation_ clarifies the conception of textual hermeneutics as an ascetic discipline by showing the consequences of this conception for interpreting canonical texts and for humanities education in general. Discussions of poetry by Robert Frost and by John Ashbery illustrate how this conception applies to an analysis of literary texts. Ultimately, the book offers a Peircean alternative to the educational theories implied in the pragmatism of John Dewey and of Richard Rorty. Rogers provides a new vocabulary for talking about what people are doing when they read, write, speak, and hear interpretive statements about texts. The new vocabulary acknowledges the great difficulty of "teaching texts" in the face of postmodern anxieties about pluralism, relativism, or nihilism. It emerges historically as a repudiation of Jewish legalism and Talmud law, where the rite (...) of circumcision encodes the subject’s entry into law as an “allegiance to the absolute Writing,” or the “relationship between the human subject and the logical place of the Other” [110–11; see also “les juifs”]. In this shift, one understanding of writing is displaced by another: the material inscription of the letter, as an incommunicable limit or cut, is supplanted by the fantasy of what Legendre calls a “living writing,” a writing “in the heart” that promotes an ideal of perfect communication in which nothing is lost, in which meaning is lodged in an absolute Other who guarantees all knowledge. In his words, “we belong to a culture in which a mystically alienated human body stands in the place of the absolute book. The state has emerged from this structure.... This article intends to be a simple guide to understand how Hoppe built the Argumentation Ethics. In my early studies of libertarian ideas, and of Argumentation Ethics in particular, I could not find a unique text that would explain how Hoppe put the necessary bricks together to build the Ethics. As I was curious about this issue, I assumed others would also like to know it. To write this article, I reviewed the main literature on Argumentation Ethics, starting with Kinsella’s (...) Concise Guide [9]. Then, I interviewed Stephan Kinsella and Prof. Walter Block. Finally, I synthesized the main ideas from the literature and the interviews elaborating an interpretative model, presented in this article. (shrink)

Individual researchers may interpret responsible conduct of research (RCR) in various ways, especially given the diversity of research personnel in modern science. Therefore, understanding individuals’ RCR-related misconceptions is important, as it can help RCR instructors customize their lessons to target learners’ incorrect and incomplete ideas. In this vein, this study aimed to explore whether Taiwanese and American graduate students differ in their perceptions and misconceptions regarding RCR-related concepts and, if so, to determine these differences. A diagnostic assessment, the Revised RCR (...) Reasoning Test (rev-RCRRT), was developed to pursue the intended goal. The rev-RCRRT is a two-tier test capable of diagnosing whether a student’s justifications of ethical acceptance in relation to specific RCR-related concepts are based on incorrect or incomplete ideas of RCR. The current results indicated that, first, participating graduate students’ test performances dropped drastically between the first- and second-tier items, suggesting that they were able to judge the ethical acceptability of given RCR-specific scenarios but lacked the advanced knowledge required to explain their judgments. Second, in general, American students achieved significantly better scores on the rev-RCRRT than Taiwanese students. Third, the two groups held different RCR-related misconceptions centered around various RCR topics. Specifically, Taiwanese students’ misconceptions involved concepts related to authorship, piecemeal publication, and human-subject protection. However, American students sometimes misjudged the issues regarding duplicate submissions and publication and the reproducibility of research and replication of ideas. In summary, through a cross-national comparative method, this study not only suggests that graduate students from different national backgrounds interpret RCR differently but also provides substantial evidence for the employment of a two-tier test approach in RCR-specific contexts. The implications of the current findings for future research and the utility of using two-tier tests in RCR instruction are also discussed in this article. (shrink)

This article examines Wilfrid Sellars's views on the epistemic status of philosophical propositions. It suggests that according to Sellars philosophical propositions are normative and practically oriented. They do not form a theory for the description of reality; their function is, rather, that of motivating actions which aim at changing reality. The article argues that the role of philosophical propositions can be illuminated if they are understood as a special kind of (proposed) “material” rules of inference, provided that the latter are (...) construed as being firmly entrenched in practice. To this end, a distinction between “theoretical” and “practical” anomalies is drawn to better elucidate—and in some cases criticize and further expand—Sellars's position on the relation between the theoretical and practical dimensions of philosophical activity. In this connection, the Weberian notion of the “disenchantment of the world” is used to throw light on the relation between these two dimensions. (shrink)

The classical Greeks give us a substance ontology grounded in ‘being qua being’ or ‘being per se’ (to on he on) that guarantees a permanent and unchanging subject as the substratum for the human experience. With the combination of eidos and telos as the formal and final cause of independent things such as persons, this ‘substance’ necessarily persists through change. This substratum or essence includes its purpose for being, and is defining of the ‘what-it-means-to-be-a-thing-of-this-kind’ of any particular thing in setting (...) a closed, exclusive boundary and the strict identity necessary for it to be this, and not that.In the Yijing 易經 or Book of Changes we find a vocabulary that makes explicit cosmological assumptions that are a stark alternative to this substance ontology, and provides the interpretive context for the Confucian canons by locating them within a holistic, organic, and ecological worldview. To provide a meaningful contrast with this fundamental assumption of on or ‘being’ we might borrow the Greek notion of zoe or ‘life’ and create the neologism ‘zoe-tology’ as ‘the art of living’. This cosmology begins from ‘living’ (sheng 生) itself as the motive force behind change, and gives us a world of boundless ‘becomings’: not ‘things’ that are, but ‘events’ that are happening, a contrast between an ontological conception of the human ‘being’ and a process conception of what I will call human ‘becomings’. In recent years, researchers and practitioners have increasingly paid attention to food waste, which is seen as highly unethical given its negative environmental and societal implications. Waste recovery is dependent on the creation of connections along the supply chain, so that actors with goods at risk of becoming waste can transfer them to those who may be able to use them as inputs or for their own consumption. Such waste recovery is, however, often hampered by what we call ‘circularity holes’, (...) i.e., missing linkages between waste generators and potential receivers. A new type of actor, the digital platform organization, has recently taken on a brokerage function to bridge circularity holes, particularly in the food supply chain. Yet, extant literature has overlooked this novel type of brokerage that exploits digital technology for the transfer and recovery of discarded resources between supply chain actors. Our study investigates this actor, conceptualized as a ‘circularity broker’, and thus unites network research and circular supply chain research. Focusing on the food supply chain, we adopt an interpretive inductive theory-building approach to uncover how platform organizations foster the recovery of waste by bridging circularity holes. We identify and explicate six brokerage roles, i.e., connecting, informing, protecting, mobilizing, integrating and measuring, and discuss them in relation to extant literature, highlighting novelties compared to earlier studies. Cloth, $29.95.Contemporary philosophy in America tends to regard epistemological questions as the most fundamental of the discipline, but Susan Neiman's Evil in Modern Thought sets itself against this assumption in an attempt to sketch "an alternative history of (...) philosophy." "It's possible to begin to worry about the difference between appearance and reality because... a dream is so vivid that you want to grasp one of its objects for a moment or two of sleepy half-consciousness," Neiman writes, but then "you wake up in your bed, slap your face if you have to... " (5). The problem of evil, in stark contrast to such skeptical speculations, is far more urgent and trenchant; it is "the place where philosophy begins, and threatens to stop" (ibid.). Moreover, the problem of evil, far from being merely a theological quandary, actually forms a link between metaphysics and epistemology by starkly posing questions about the intelligibility of the world: Why are things like that? wants the answer Because it's best that way. For the early modern period, these questions centered on the "theodicy" debates focused by the catastrophic Lisbon earthquake of 1755, while for us the holocaust threatens to explode all our hopes and expectations for the possibility of a world that is as it should be. Having studied astronomy under the guidance of learned Jews from Toledo, Alfonso scandalously remarked "If I had been of God's counsel at the Creation, many things would have been ordered better" (15). Serving as a paradigm of blasphemy for half a millennium, Alfonso's boast also expresses the inevitable dismay that must accompany the delighted wonder at natural order exploited by the argument from design: while Creation is surely miraculous in its manifestation of seemingly intelligent structure, it is just as surely astonishing that so much of that structure seems so wantonly destructive. Can this really be the best of all possible worlds if innocent lives are cut short by cruel diseases or natural disasters while vicious villains prosper into comfortable old age?! Alfonso's remark serves Neiman as a leitmotif around which she orders central figures in the canon of western philosophy into two camps: those who struggled to reconcile natural evil with God's goodness or with reason (Leibniz, Pope, Rousseau, Kant, Hegel and Marx), and those who skeptically condemned reason by appealing to "brute appearances" (Bayle, Voltaire, Hume, Sade and Schopenhauer). Because the very categories of natural and moral evil tend to break down as a result of the development of psychology as a "science of nature" (to the extent that human motives are regarded as natural processes subject to empirical explanation, they cease to manifest a unique ontology), Nietzsche and Freud fall outside the philosophical canon thus construed—although Neiman's discussion of these two thinkers is perhaps the most compelling of the book.No new interpretive ground is broken in the resulting exegesis of western philosophical history, but Neiman's treatment of each of these figures is intelligent and skillful.
