This paper discusses the method when an argument is refuted by a parallel argument since the flaw of the parallel argument is clearly displayed. The method is explicated, examined and compared with two other general methods.

Frühgeborene im Grenzbereich der Lebensfähigkeit befinden sich in einer prognostischen Grauzone. Das bedeutet, dass deren Prognose zwar schlecht, aber nicht hoffnungslos ist, woraus folgt, dass nach Geburt lebenserhaltende Behandlungen nicht obligatorisch sind. Die Entscheidung für oder gegen lebenserhaltende Maßnahmen ist wertbeladen und für alle Beteiligten enorm herausfordernd. Sie sollte eine zwischen Eltern und Ärzt*innen geteilte Entscheidung sein, wobei sie unbedingt mit den Präferenzen der Eltern abgestimmt sein sollte. Bei der pränatalen Beratung der Eltern legen die behandelnden Ärzt*innen üblicherweise numerische Schätzungen (...) der Prognose vor und nehmen in der Regel an, dass die Eltern ihre Behandlungspräferenzen davon ableiten. Inwieweit probabilistische Daten die Entscheidungen der Eltern in prognostischen Grauzonen tatsächlich beeinflussen, ist noch unzureichend untersucht. In der hier vorliegenden Arbeit wird eine Studie reflektiert, in welcher die Hypothese geprüft wurde, dass numerisch bessere oder schlechtere kindliche Prognosen die Präferenzen werdender Mütter für lebenserhaltende Maßnahmen nicht beeinflussen. In dieser Studie zeigte sich, dass die elterlichen Behandlungspräferenzen eher von individuellen Einstellungen und Werten als von Überlegungen zu numerischen Ergebnisschätzungen herzurühren scheinen. Unser Verständnis, welche Informationen werdende Eltern, die mit einer extremen Frühgeburt konfrontiert sind, wünschen und brauchen, ist noch immer unvollständig. Bedeutende medizinische Entscheidungen werden keineswegs nur rational und prognoseorientiert gefällt. In der vorliegenden Arbeit wird diskutiert, welchen Einfluss der Prozess der Entscheidungsfindung auf das Beratungsergebnis haben kann und welche Implikationen sich aus den bisher vorliegenden Studienergebnissen ergeben – klinisch-praktisch, ethisch und wissenschaftlich. Scientific realists have argued that the truth(likeness) of our theories provides the only explanation for the success of science. I consider alternative explanations proposed by antirealists. I endorse Leplin's contention that neither van Fraassen's Darwinist explanation nor Laudan's methodological explanation provides the sort of explanatory alternative which is called for in this debate. Fine's suggestion--that the empirical adequacy of our theories already explains their success--is more promising for antirealists. Leplin claims that this putative explanation collapses into realism on one reading (...) and into vacuity on another reading. But his analysis conflates three doctrines into two, and one of the three avoids both realism and vacuity. (shrink)

Empirical research is largely supportive of the assertion of instrumental stakeholder theory that a positive relationship exists between “managing for stakeholders” and firm performance. However, despite considerable debate on the subject, the amount of variation across firm investments in stakeholders (stakeholder management performance) has not been adequately investigated. We address this gap using a sample of more than eighteen thousand firm-level observations over ten years. We find evidence to support an inverted U–shaped relationship between variation in stakeholder management performance and (...) Tobin’sq, suggesting that firms that have some imbalance in their stakeholder management, but not too much, perform best. We discuss the implications of our study for instrumental stakeholder theory and managerial practice. (shrink)

John Horty has proposed an approach to reasoning with ought-propositions which stands in contrast to the standard modal approach to deontic logic. Horty’s approach is based on default theories as known from the framework of Default Logic. It is argued that the approach cannot be extended beyond the most simple kinds of default theories and that it fails in particular to account for conditional obligations. The most plausible ways of straightening out the defects of the approach conform to a simple (...) theory of default reasoning in standard deontic language. (shrink)

Accounts of analogical inference are usually categorized into four broad groups: abductive, deductive, inductive and sui generis. The purpose of this paper is to defend a sui generis model of analogical inference. It focuses on the sui generis account, as developed by Juthe [2005, 2009, 2015, 2016] and Botting’s [2017] criticism of it. This paper uses the pragmadialectical theory of argumentation as the methodological framework for analyzing and reconstructing argumentation. The paper has two main points. First, that Juthe’s arguments against (...) a deductive interpretation of prima facie analogy argumentation remain unaffected by Botting’s criticism, which means that many of the reasons against deductive reformulation of analogy argumentation still stand. The additional argument, which Botting himself brings up, that a deductive interpretation cannot account for the cumulative effect of analogies, just provides further reason to reject deductivism. The second main point of this paper is that an inductive interpretation of analogical inference also fails. There are constitutional differences between inductive and analogical inference that cannot be bridged. The result is a firm defense of the sui generis view of analogical inference. (shrink)

Instead, it is to prepare the reader to analyze and advance the theoretical literature in any tradition. The traditional way to study theoretical psychology is to take up one approach after another--behavioral, psychoanalytic, cognitive, and so on. A good theoretician should be able to contribute to the study of psychoanalytic theory as readily as to behavioral theory. The skills required are the same. Instead of covering a sequence of theories, therefore, the book is organized around types of theoretical activities. It is not a work in theoretical psychology; it is a book about theoretical psychology. It also confronts psychologists' underestimation of the variety and the significance of theoretical work. With each proposition P we associate a set of proposition (a hyperproposition) which determines the order in which one may retreat from accepting P, if one cannot fully hold on to P. We first describe the structure of hyperpropositions. Then we describe two operations on propositions, subtraction and merge, which can be modelled in terms of hyperpropositions. Subtraction is an operation that takes away part of the content of a proposition. Merge is an operation that determines the maximal consistent content (...) of two propositions considered jointly. My topic is extraterrestrial intelligence. Following current conventions, I use the abbreviation ‘ETI’ to stand for three related concepts: the abstract idea of extraterrestrial intelligence, individuals who are both extraterrestrial and intelligent, and the hypothesis that there are ETIs. SETI is the search for ETIs, and CETI is the attempt to communicate with ETIs. In this paper, I will try to answer the two most basic questions in extraterrestrial studies. First, what is the status of the ETI hypothesis? In the (...) light of what we know, how likely is it that there are ETIs? Secondly, what is the value of pursuing SETI? Are the expected epistemic and pragmatic payoffs sufficient to warrant an extensive search? The first, substantive question is discussed in Section 2, Section 3 and Section 4. The second, ‘program evaluation’ question is the subject of Section 5 and Section 6. But first we'll take a brief look at some of the early history of the topic. (shrink)

The biinterpretability conjecture for the r.e. degrees asks whether, for each sufficiently large k, the [Formula: see text] relations on the r.e. degrees are uniformly definable from parameters. We solve a weaker version: for each k ≥ 7, the [Formula: see text] relations bounded from below by a nonzero degree are uniformly definable. As applications, we show that Low 1 is parameter definable, and we provide methods that lead to a new example of a ∅-definable ideal. Moreover, we prove that (...) automorphisms restricted to intervals [d, 1], d ≠ 0, are [Formula: see text]. We also show that, for each c ≠ 0, can be interpreted in [0, c] without parameters. We consider motivations for acknowledging that people participate in multiple levels of economic agency. One of these levels is characterized in terms of subjective utility to the individual; another, frequently observed, level is characterized in terms of utility to social groups with which people identify. Following Bacharach, we describe such groups as ‘teams’. We review Bacharach’s theory of such identification in his account of ‘team reasoning’. While this conceptualization is useful, it applies only to processes supported by deliberation. As this (...) is only one of a range of causal mechanisms underlying behaviour by humans and other strategic agents, a more general account is desirable. We then argue that Stirling’s account of ‘conditional games’ achieves the desired generalization. (shrink)

Most professionals have the arduous task of managing their own dual loyalty: in one contextual relationship, they are members of a profession while simultaneously they are employed as members of a locally established organisation. This sense of a dual loyalty has to be taken into account when professional bureaucracies develop ethics programmes. This article focuses on universities. Accounting for the dual loyalty of academic professionals, it is the objective of the study to contribute to the most appropriate ethics programmes in (...) such an academic context. Based on a review of the literature, we identify which ethical issues commonly emerge in educational and research activities. Then we offer a conceptual analysis of the conditions required for each different strategy of ethics management. We argue that none of the four theoretically derived strategies is applicable solely on its own. For universities it is most promising to design ethics programmes based on the guiding values of the academic community, including integrity measures for universities and corrective measures for students. The argument developed in this article is assumed to be widely applicable in assessing the appropriateness of ethics management strategies in other professional settings. (shrink)

What do Jerry Fodor and Bas van Fraassen, the archetypical scientific realist and his antirealist shadow, have in common? They’re both defenders of the theory-observation distinction. It isn’t surprising that a realist and an antirealist should agree about something; but it is curious that van Fraassen’s and Fodor’s defenses of the theory-observation distinction play diametrically opposite roles in their philosophical agendas. Van Fraassen needs it to support his antirealism; Fodor wants it in support of his realism. Van Fraassen needs the (...) distinction in order to protect antirealism from the charge of incoherence. Antirealists wish to ascribe a more exalted status to the observational import of a theory than to its nonobservational claims. Van Fraassen’s version of the antirealist thesis is that belief in observational claims is rationally warranted under some logically and nomologically possible conditions, whereas belief in theoretical claims is never warranted. This identifies the species of antirealism at issue as epistemic antirealism. This position would be a nonstarter if the observational import couldn’t be distinguished from the rest. And, in fact, denying the coherence of the theory-observation distinction has been a popular realist gambit in the debate about scientific realism. (shrink)

The causal/explanatory exclusion argument is one of the principal weapons against the possibility of mental causes/explanations having genuine causal/explanatory power. I argue that the causal and the explanatory versions of the exlusion argument should be distinguished. There are really two arguments, one of them perhaps successful, the other one not.

A theory of intergenerational justice consists in the study of the moral and political status of the relations between present and past or future people, more specifically, of the obligations and entitlements they can potentially generate. The challenges that justify talking about responsibilities between generations are myriad. And the disputes they prompt can focus on the past just as much as on the present, even though the fact that the human species has reached a state of technological progress that enables (...) it to have an irredeemable impact on the planet and perhaps even endanger future human existence tends to make concerns about the future more pressing. Debates on intergenerational justice are twofold. The first revolves around the issue of whether claims of justice across generations whose members' lifetimes do not necessarily overlap could be justified. And the second revolves around the specific conception of justice in play, that is, around the nature of the standard that must be applied as well as around the identification of the contents of the duties that present generations supposedly have vis-à-vis past or future generations. This survey article depicts the conceptual and argumentative framework in which these debates are set. It aims to outline certain of the main features shared by the most influential contemporary theories of intergenerational justice, and the problems inherent in them. It concludes by suggesting that, even though the idea of succeeding generations is merely an abstraction, there are specific empirical states of affairs that require different theoretical responses to intergenerational justice. C'est pour contrer les effets néfastes de cette financiarisation de l'économie que le mouvement de la finance socialement responsable s'est développé, (...) ses tenants utilisant les leviers économiques, en l'occurrence de nombreux fonds de placement, pour faire pression sur les décideurs et les orienter vers des avenues plus responsables. Ce livre présente le regard d'un philosophe et d'une sociologue sur ce mouvement. Les auteurs définissent les origines de la finance socialement responsable, pour ensuite exposer ses pratiques et ses stratégies, dresser un portrait de ses principaux acteurs et proposer des pistes de réflexion sur la dimension éthique de la finance ainsi que des outils pertinents aux pratiques des financiers. Il s'agit d'une introduction indispensable à tous ceux qui souhaitent s'initier au mouvement de la finance socialement responsable et qui recherchent des avenues éthiques en matière de développement économique. In Nietzsche and Zen: Self-Overcoming without a Self, André van der Braak juxtaposes Nietzsche with four influential representatives of the Buddhist Zen tradition: Nagarjuna, Linji, Dogen, and Nishitani. In doing so, he reveals Nietzschean philosophy as a philosophy of continuous self-overcoming, in which even the notion of "self" is overcome, and allows a greater understanding of Nietzsche through the lens of Zen and vice versa. This treatment will be useful to Nietzsche scholars, continental philosophers, and comparative philosophers.

This paper addresses longstanding debates around changing patterns of farm ownership and structure on the North American plains. Over the last 150 years, the agrifood system has been transformed by a process of capitalist penetration through which non-farm capital has appropriated key links in the ‘food chain’. Today, large, often transnational corporations dominate in the provision of farm inputs, as well as in food processing, distribution, and retailing. The paradox for food system scholars has been that primary food production (i.e., (...) farming) has generally remained in the hands of independent, family-based operations, especially in the grains sector. This paradox has generated a substantial literature on the barriers to capitalist penetration in agriculture. I revisit these debates in light of two recent trends. First, I highlight the emergence of a class of farm family entrepreneurs comprised of very large, albeit family-owned, grain farming operations, in Saskatchewan. I provide a case study of a vertically integrated, family-based mega-farm to illustrate. Second, I discuss the implications of the launch of One Earth Farms, a corporate farming entity embodying altogether new strategies of land use, labor, and ownership. Structured as a partnership between a Toronto-based investment firm and nine First Nations bands, One Earth Farms brings together the interests of private investors who increasingly view agriculture as a profitable resource sector, and aboriginal communities hoping to redress the historical marginalization of First Nations farming. I interpret the significance of these new avenues of corporatization for “family farms” and prairie agricultural development. (shrink)

O ceticismo semântico é uma posição filosófica que nega que regras, por si mesmas, podem determinar o que deve ser feito. A solução para o problema de explicar como afinal é possível a existência do significado linguístico é dada através de comunidades de falantes. Kripke defende esta visão das coisas, especialmente com relação às reflexões de Wittgenstein sobre o assunto. Eu argumento, em primeiro lugar, que o ceticismo semântico é uma posição equivocada por não entender bem um ponto central do (...) problema, que foi esclarecido por Wittgenstein: regras e aplicações corretas das mesmas estão relacionadas internamente. Entender bem isso requer, no entanto, clareza sobre o que é uma regra. Contra Malcolm procuro mostrar, num segundo momento, a importância que tem em Wittgenstein a concepção dinâmica das regras: só será uma regra e uma formulação· da mesma o que funcionar como guia, como padrão, como critério, num conjunto de práticas e técnicas. Conceber regras desta maneira permite que se compreenda o que é ver a linguagem de uma maneira normativista. Ao final, procuro esclarecer melhor como as regras têm força normativa dentro de práticas e técnicas que supõem, sem embargo, condições de normalidade. Argumento, contudo, que estas condições não são o que dá força às regras tout court. (shrink)

RESUMO Neste texto argumento que a filosofia moral de Hume tem uma base realista num sentido específico. Os sentimentos "peculiares" da moralidade, as formas morais de dor e prazer na contemplação das ações, sentimentos e caracteres dos outros, estão assentados sobre uma base pertencente à nossa sensibilidade que envolve o fato bruto da realidade da dor e do prazer. Argumento que a ênfase de Hume na "praticalidade" da moral não está a serviço prioritariamente de um projeto filosófico de explicação do (...) fenômeno moral, mas remete ao fundamento realista da moralidade em sentimentos humanos: "coisas" sentidas por seres humanos a respeito de outros seres humanos. Embora com implicações para a discussão tradicional sobre a ontologia moral de Hume, minha análise procura mostrar que o fundamento encontrado responde, de acordo com a orientação empirista em filosofia, a uma pergunta anterior sobre o que é real quando estão em jogo os interesses práticos de nossas vidas, por oposição aos teóricos. ABSTRACT I argue that Hume's moral philosophy is, basically, realist in that the "peculiar" sentiments constituting morality, the moral forms of pain and pleasure in the contemplation of actions, sentiments and characters are based on our sensibility as it reveals the brute realities of pain and pleasure. I argue that the place of pride Hume gives to the "practicality" of morals is not primarily in the service of the explanation of the moral phenomenon, it concerns rather the realist grounding of morality in the human sentiments: what we feel in regard to other human beings. In spite of the implications to the traditional discussion about Hume's morals ontology, my analysis aims to show that such a grounding answers, in tandem with the empiricist commitments of Hume's philosophy, the previous question about what is real when what concerns us are the practical interests of our lives, not merely the theoretical ones. O Ideal do Reino dos Fins – apresentado por Kant com vistas à introdução de uma fórmula do Imperativo Categórico ‒ é muitas vezes interpretado como o elemento social do qual a teoria moral do autor careceria. Seres humanos seriam agentes morais concebidos como membros legisladores de uma ordem social possível. Contra essa interpretação argumentarei que a dimensão social introduzida pela concepção técnica desse Ideal é propriamente racional, apresentando uma exigência normativa genuinamente cosmopolita, que, não obstante, confere à teoria os (...) recursos para o tratamento moral adequado da sociabilidade de facto da agência moral, pois, afinal, as condições de nossa agência efetiva são sociais.
