The aim of this paper is to elaborate on the phenomenological approach to expertise as proposed by Dreyfus and Dreyfus and to give an account of the extent to which their approach may contribute to a better understanding of how athletes may use their cognitive capacities during high-level skill execution. Dreyfus and Dreyfus's non-representational view of experience-based expertise implies that, given enough relevant experience, the skill learner, when expert, will respond intuitively to immediate situations with no recourse to deliberate actions (...) or mental representations. The paper will subsequently outline some implications and consequences of such an approach and will also examine to what extent Dreyfus and Dreyfus's skill model is capable to resist different attacks that have been made against their view, and in particular regarding the practical application of their approach to the skill domain of competitive sport. Medicine is facing wide-ranging challenges concerning the so-called medically unexplained disorders. The epidemiology is confusing, different medical specialties claim ownership of their unexplained territory and the unexplained conditions are themselves promoted through a highly complicated and sophisticated use of language. Confronting the outcome, i.e. numerous medical acronyms, we reflect upon principles of systematizing, contextual and social considerations and ways of thinking about these phenomena. Finally we address what we consider to be crucial dimensions concerning the landscape of unexplained “matters”; fatigued (...) being, pain-full being and dys-ordered being, all expressive momentums of an aesthetic of resistance. Reading Anna Karenina by Leo Tolstoy takes many hours. The duration varies a lot depending on the reader's pace, but reading literature, just as listening to music, takes a considerable amount of time. This article examines the early modern household's importance for producing experimental knowledge through an examination of the Halifax household of Margery and Henry Power. While Henry Power has been studied as a natural philosopher within the male-dominated intellectual circles of Cambridge and London, the epistemic labour of his wife, Margery Power, has hitherto been overlooked. From the 1650s, this couple worked in tandem to enhance their understanding of the vegetable world through various paper technologies, from books, paper slips and recipe (...) notebooks to Margery's drawing album and Henry's published Experimental Philosophy. Focusing on Margery's practice of hand-colouring flower books, her copied and original drawings of flowers and her experimental production of ink, we argue that Margery's sensibility towards colour was crucial to Henry's microscopic observations of plants. Even if Margery's sophisticated knowledge of plants never left the household, we argue that her contribution was nevertheless crucial to the observation and representation of plants within the community of experimental philosophy. In this way, our article highlights the importance of female artists within the history of scientific observation, the use of books and paperwork in the botanical disciplines, and the relationship between household science and experimental philosophy. In this essay, I study the contested role of magnification as an observational strategy in the generation theories of William Harvey and René Descartes. During the seventeenth century, the grounds under the discipline of anatomy were shifting as knowledge was increasingly based on autopsia and observation. Likewise, new theories of generation were established through observations of living beings in their smallest state. But the question formed: was it possible to extend vision all the way down to the first points of (...) life? Arguing that the potential of magnification hinged on the metaphysics of living matter, I show that Harvey did not consider observational focus on the material composition of blood and embryos to be conducive to knowledge of living bodies. To Harvey, generation was caused by immaterial, and thus in principle invisible, forces that could not be magnified. Descartes, on the other hand, believed that access to the subvisible scale of natural bodies was crucial to knowledge about their nature. This access could be granted through rational introspection, but possibly also through powerful microscopes. The essay thus ends with a reflection on the importance of Cartesian corpuscularianism for the emergence of microscopical anatomy in seventeenth-century England. (shrink)

It is often claimed that medical professionals are subject to conflicting duties in their role morality. Some hold that the overridden duty taints the professional and generates a patient claim to a form of moral compensation. This paper challenges such a ‘compensation view’ of conflict and argues that it misleadingly makes the role morality into a personal contract between professional and patient. Two competing views are therefore considered. The ‘unity view’ argues that there are no real conflicts between professional duties. (...) Hence, there can be no residual duties that are impossible to discharge and no special claim on the part of the patient. It is argued that this fails because the institutional nature of the role morality requires us to accept possibility of conflict. The paper articulates and defends a third view, where conflict triggers a professional duty of restitution. This duty is not a matter of making amends for a previous wrong, but rather a matter of rebuilding a trusting relationship that has been damaged due to blameless circumstances. (shrink)

The psychological effects of aesthetic education have often been discussed, and major studies such as Michael Parsons’s inquiry into art understanding show that the development of understanding works of visual art is influenced by education.1 His findings show that the way people talk about art can be structured in five stages of development according to the model of Jean Piaget’s theory of cognitive development. After the traumatic Danish defeat in the 1864 war with Prussia and Austria, Germany was regarded as the arch enemy and not unexpectedly mostDanes sided against the Central Powers in the public debate. This was not least the case amongst the national-conservative politicians, intellectuals and artists. The author then proceeds to examine Habermas's position regarding Rawls's discourse on norm formation. La philosophie du droit a pour fonction d’assister la réflexion sur le monde du juridique, sur « le droit qui se fait », sur la doctrine juridique et notre façon de l’écrire, et sur l’appréciation (ou l’indifférence, l’hostilité, etc.) qu’un individu distancié peut éprouver à l’égard du droit et des juristes. Elle assiste et elle participe en examinant notre façon d’opérationnaliser les sources du droit, de forger des arguments pouvant être juridiques, d’évaluer les narrations qui se présentent au droit, d’examiner (...) la pertinence de la doctrine, notre façon de pratiquer le droit et de faire des jugements judiciaires. Elle ne réside de toute évidence pas « en haut » et elle ne « surplombe » pas l’écriture de la doctrine. Elle ne se glorifie pas en distribuant (en toute incompétence) l’étiquette de « scientificité » au bon candidat, que celui-ci soit auteur d’un article, d’un livre ou d’une théorie. Admettons plutôt lucidement que la philosophie du droit ne donne pas de certificat de « scientificité » et que toute revendication en ce « sens » n’a pas de « sens ». (shrink)

Some fundamental aspects of the lived body only become evident when it breaks down through illness, weakness or pain. From a phenomenological point of view, various breakdowns are worth analyzing for their own sake, and discussing them also opens up overlooked dimensions of our bodily constitution. This book brings together different approaches that shed light on the phenomenology of the lived body—its normality and abnormality, health and sickness, its activity as well as its passivity. The contributors integrate phenomenological insights with (...) discussions about bodily brokenness in philosophy, theology, medical science and literary theory. Phenomenology of the Broken Body demonstrates how the broken body sheds fresh light on the nuances of embodied experience in ordinary life and ultimately questions phenomenology’s preunderstanding of the body. Are professional roles bound by the norms of ordinary morality? This article begins with a discussion of two existing models that give contrary answers to this question; the practice model detaches professional ethics from ordinary morality, while the translation model denies any real divergence. It is argued that neither model can give a satisfying account of how professional roles ground distinct claims that are morally authoritative. The promise model is articulated and defended, wherein the obligations of professional roles are grounded (...) in an act of self-binding by the profession; the public is the promisee, and thereby entitled to make role-dependent claims. This model retains a connection to ordinary morality, but does not reduce role authority to individual conscience. Legitimate promises bind the role holder even in the face of moral disagreement. The discretionary powers of welfare state professionals are in tension with the requirements of the democratic Rechtsstaat. Extensive use of discretion can threaten the principles of the rule of law and relinquish democratic control over the implementation of laws and policies. These two tensions are in principle ineradicable. But does this also mean that they are impossible to come to grips with? Are there measures that may ease these tensions? We introduce an understanding of discretion that adds an epistemic dimension (...) (discretion as a mode of reasoning) to the common structural understanding of discretion (an area of judgment and decision). Accordingly we distinguish between structural and epistemic measures of accountability. The aim of the former is to constrain discretionary spaces or the behaviour within them while the aim of the latter is to improve the quality of discretionary reasoning. The focus in this article is on epistemic measures that are internally related to the main characteristic of accountability, namely justified use of discretionary power. (shrink)

A certain reading of Descartes, which we refer to as ‘the embodied Descartes’, is emerging from recent scholarship on L’Homme, in keeping with the interpretive trend which emphasizes Descartes’s identity as a natural philosopher. This reading complicates our understanding of Descartes’s philosophical project: far from strictly separating human minds from bodies, the embodied Descartes keeps them tightly integrated, while animal bodies behave in ways quite distinct from those of other pieces of extended substance. Here, we identify three categories of embodiment (...) in contemporary readings of Descartes’s physiology: bodily health and function, embodied reflex and memory, and embodied cognition. All present more or less strong versions of the embodied Descartes. Together, they constitute a compelling reading of a Cartesian natural philosophy that, if not expressly antidualist, is an awfully long way from the canonical picture. (shrink)

Insistant sur quelques thèmes clés, l'auteur se penche, dans un premier temps, sur la critique formulée à l'encontre du modèle d'autonomie politique et individuelle développé par Rawls. Dans un deuxième temps, il examine la position habermasienne à l'égard du discours deformation des normes élaboré par Rawls. Cette étude fait ressortir certaines lacunes (...) de la théorie rawlsienne au regard du monde contemporain et propose une approche alternative tenant davantage compte de Vintersubjectivité et de la démocratie.
