Zusammenfassung Die enge Widerspruchslösung in Österreich erlaubt eine postmortale Organspende bei fehlendem Widerspruch zu Lebzeiten, da von einer mutmaßlichen Zustimmung ausgegangen wird. Liegt kein Eintrag im Widerspruchsregister vor, wird die Familie zum mutmaßlichen Willen der verstorbenen Person befragt. Um die praktische Umsetzung der Widerspruchslösung in Österreich zu beschreiben, sollen relevante Aspekte der Angehörigengespräche und die Rolle der Familie im Entscheidungsprozess zur postmortalen Organspende identifiziert werden. Es wurden insgesamt zehn leitfadengestützte Expert:inneninterviews mit Ärzt:innen und Pflegepersonen an einer österreichischen Krankenanstalt durchgeführt, die (...) mithilfe der qualitativen Inhaltsanalyse nach Mayring unter Anwendung von MAXQDA ausgewertet wurden. Herausforderungen beim Ermitteln des mutmaßlichen Patient:innenwillens im Angehörigengespräch können aufgrund von unterschiedlichen Kulturen/Religionen, Uneinigkeit und Entscheidungsunfähigkeit in der Familie aufgrund von Trauer und der Schwierigkeit der Angehörigen, das Hirntodkonzept zu begreifen, entstehen. Daher ist eine gute Vorbereitung, ausreichend Zeit, interdisziplinäre Zusammenarbeit, das Schaffen von Vertrauen und professionelle Gesprächsführung sowie das Eingehen auf Fragen und Bedürfnisse von Angehörigen durch Ärzt:innen und Pflegepersonen in einem geeigneten Setting notwendig. Die Kommunikation mit Angehörigen bezüglich einer postmortalen Organspende ist sowohl für das Gesundheitspersonal als auch die Familie belastend. Anhand der Ergebnisse wird die Anwendung des Kommunikationsleitfadens der Gesundheit Österreich mit Erweiterung um die Information zur Gesetzeslage sowie regelmäßige Kommunikationsschulungen des Gesundheitspersonals empfohlen. Zudem wird eine flächendeckende Information der Bevölkerung zur Förderung der intrafamiliären Diskussion gefordert. (shrink)

Military physicians are often perceived to be in a position of ‘dual loyalty’ because they have responsibilities towards their patients but also towards their employer, the military institution. Further, they have to ascribe to and are bound by two distinct codes of ethics, each with its own set of values and duties, that could at first glance be considered to be very different or even incompatible. How, then, can military physicians reconcile these two codes of ethics and their distinct professional/institutional (...) values, and assume their responsibilities towards both their patients and the military institution? To clarify this situation, and to show how such a reconciliation might be possible, we compared the history and content of two national professional codes of ethics: the Defence Ethics of the Canadian Armed Forces and the Code of Ethics of the Canadian Medical Association. Interestingly, even if the medical code is more focused on duties and responsibility while the military code is more focused on core values and is supported by a comprehensive ethical training program, they also have many elements in common. Further, both are based on the same core values of loyalty and integrity, and they are broad in scope but are relatively flexible in application. While there are still important sources of tension between and limits within these two codes of ethics, there are fewer differences than may appear at first glance because the core values and principles of military and medical ethics are not so different. Diese kurzen Beispiele geben einen Eindruck davon, wie vielfältig die Verfahren sind, mit denen der epitomierende Autor seiner Aufgabe der Verkürzung einer literarischen Vorlage gerecht zu werden sucht. Die Raffungen und Verknappungen finden auf allen Ebenen des Ausdrucks statt, sprachlich, syntaktisch, inhaltlich durch Zusammenfügung von Szenen. Auf der anderen Seite wird große Sorgfalt darauf verwandt, den Leser in diesen Prozess mit einzubeziehen. Dies geschieht auf zunächst scheinbar divergierenden Wegen. Einerseits erhält der Leser implizite und explizite Hinweise auf das verkürzende Vorgehen. (...) Andererseits gibt es auch Passagen, insbesondere die Anfangsverse, in denen dem Leser suggeriert wird, mit einer wörtlichen Wiedergabe des griechischen Originals in lateinischer Sprache konfrontiert zu sein, deren Tempo dann aber bald rapide beschleunigt wird. Die Technik des ‚vertere‘ steht also dem Verkürzen als verwandt, aber doch verschieden, im selben Werk gegenüber. Es lässt sich also an diesem häufig als Schulübung abqualifizierten Stück aus neronischer Zeit Grundsätzliches beobachten, sowohl für die epische Technik und deren Beurteilung durch die antiken poetischen Epitomatoren selbst, als auch für den geistigen Vorgang des Zusammenfassens und Resümierens. Deshalb möchte ich Scaffais Behauptung, die „Ilias Latina“ sei nicht eigentlich eine systematische Epitome, sondern eine freie Überarbeitung des homerischen Gedichts, nicht zustimmen, sondern bin zuversichtlich, dass Wirkungsabsicht und Wirkung einer solchen ‚poetischen Kurzfassung‘ sich gerade am Beispiel dieses Textes einleuchtend demonstrieren lassen. Theoretical and empirical research on stakeholder behavior tends to focus on specific actions or responses in the context of the organization–stakeholder relationship. Despite increased efforts to look beyond the dyadic organization–stakeholder relationship, research still favors the perspective of the focal organization. The taken-for-granted assumption of the organization–stakeholder relationship may limit our understanding of how organization–stakeholder linkages are formed and evolve over time. By adopting the perspective of the stakeholder, this article examines organization–stakeholder relationship formation and tracks changes in the salience (...) of stakeholder groups otherwise considered to be nonstakeholders. This research draws from a case study of small coffee producers in Southern Mexico who formed a cooperative and developed salience within their stakeholder network after a long history of diverse individual, organizational, and institutional arrangements. The findings suggest that the replacement of bureaucratic stakeholder relationships with relationships characterized by strong moral commitment to stakeholders’ claims enabled independent farmers to transform into an integrated, solid, and worldwide competitive group of coffee producers. Paper presented at the Heidegger Circle 2011. Although Aristotle’s influence on young Heidegger’s thought has been studied at length, such studies have almost exclusively focused on his interpretation of Aristotle’s ethics, physics and metaphysics. I will rather address Heidegger’s appropriation of Aristotle’s ontology of life. Focusing on recently published or recently translated courses of the mid 20’s (mainly SS 1924, WS 1925-26 and SS 1926), I hope to uncover an important aspect of young Heidegger’s thought left unconsidered: namely, that Dasein’s (...) existential structures – Befindlichkeit, Understanding and being-with-one-another through language – arose from his close reading of Aristotle’s ontology of life, of animal life. La psychanalyse de famille et de couple prend en compte le corporel pulsionnel, les ressentis, le sensoriel, les comportements, dans le champ transféro-contretransférentiel et intertransférentiel. Dans la rencontre intersubjective, patients et thérapeutes sont dans la co-émotionalité. La médiation, fréquemment utilisée en séance familiale ou de couple, vise à mobiliser dans l’ici et maintenant des affects, des sensations, pour aller vers l’émotion partagée. Elle permet de passer de l’indicible, innommable, impensable, à la figuration, l’imaginaire, puis à l’ordre symbolique grâce au récit.

Ovid’s poetic descriptions of Rome are not as vivid, as pictorial as one tends to suppose. In the poems from exile the lack of detail and the flat imagery seem to be programmatic. Thus, the reader’s attention is directed to the metapoetic message conveyed, by bringing into focus the role of enargeia/evidentia and the rivalry between literature and the visual arts. Evidence for this hypothesis is furnished by passages from the “Metamorphoses”, the “Tristia” and the “Epistulae ex Ponto” as well (...) as by statements concerning the ancient theory of evidentia. Alors que les phénoménologues prétendent avoir dépassé le solipsisme, la plupart n’ont en fait que repousser les frontières de l’intersubjectivité des individus humains aux individus des autres espèces. Pourtant, Husserl reconnaît l’existence d’une intersubjectivité interspécifique, c’est-à-dire d’une intersubjectivité dépassant les limites de l’espèce. Il va même jusqu’à affirmer qu’on comprend parfois mieux un animal familier qu’un humain étranger. Toutefois, même s’il admet que plusieurs animaux sont capables d’une vie de conscience subjective et qu’ils vivent dans un monde de sens partagé, (...) il ne les considère pas comme des « personnes » selon sa conception exigeante de la « personne » associée à la rationalité, à la maturité, la normalité et l’historicité. Reste qu’être une « personne », en son sens le plus primordial – et plus décisif puisque c’est celui sur lequel s’édifient des conceptions politiques,juridiques et éthiques – signifie simplement être le sujet d’un monde environnant, d’un monde commun et d’une existence biographique. Distinguer deux sens du concept de personne permet de reconnaître que les animaux ont part à la transcendantalité, qu’ils ne sont pas simplement en vie mais ont une vie à la fois biographique et communautaire, même s’ils ne sont pas en mesure de réfléchir à cette vie de conscience qui est la leur pour considérer leur place dans l’enchaînement des générations et pour adopter ce que Husserl appelle une « vocation ». La phénoménologie husserlienne des anomalies permet ainsi de reconnaître que les animaux ressortissent bien de la figure d’autrui, qu’ils sont des alter ego sujets d’une vie de conscience, et qu’à ce titre ils participent pleinement, comme les enfants, les fous et les étrangers, à la co-constitution du monde de l’esprit. Nous proposons que le fantasme de parentalité inversée, dans les familles ayant un parent âgé dépendant, entraîne une collusion entre les besoins externes du parent et les représentations internes des descendants, occasionnant une grande souffrance des liens et transgénérationnelle. Nous proposons des dispositifs de soin et une petite vignette clinique illustrera nos propos.

The destruction of animality that takes place in Heidegger’s Fundamental Concepts of Metaphysics goes as far as to destroy the very idea of an animal life as distinct from plant life. “Life”, as Heidegger says in Being and Time, is “a specific mode of being”, that is to say, as the 1929-30 lecture course will show, that it is “the mode of being of animals and plants”. Conceived as a mere organism that does “nothing more than to live”, the animal (...) find itself deprived of world, living in a vegetative state, in a kind of stupor (Benommenheit). The method of the ontology of life – announced in Being and Time as a “privative interpretation” – will reveal itself as a biological reduction: the strategy is to find functional equivalences for all that, in animals, resemble in any way what we find in humans. The life of animals is not a life, but biological processes. The traditional faculties associated with animal life – movement, perception and irrational desire (i.e. impulsion) – will be held as properly human, letting the animals a form of life deprived of signification, of possibility, of world. Distinguer le rituel de la ritualisation, c'est opposer l'aspect statique du rituel, comme disposition collective mobilisée par un groupe ou une communauté pour gérer ses interactions entre ses membres et son contact avec d'autres groupes, d'avec l'aspect dynamique des processus d'instauration de règles de fonctionnement de nouvelles formes d'agir social. La ritualisation des processus d'apprentissage et de formation réclame l'instauration inaugurale d'un cadre. Celui-ci renvoie à l'explicitation volontaire, réitérée des règles de fonctionnement, par un animateur symboliquement garant de la loi. (...) En ce sens cette distinction postule, à côté d'une approche fonctionnelle du rite, une approche génétique des processus de ritualisation. Par ritualisation, j'entends la mise en place progressive d'habitus au moyen d'un cadre, édictant les règles de fonctionnement et les objectifs de l'activité. Au paradigme d'une causalité circulaire, qui présente les rituels à la fois comme résultats et comme producteurs d'habitus, on peut opposer le modèle d'une causalité linéaire qui pose le cadre comme induisant des processus d'apprentissage ritualisés. L'étude se focalise plus spécialement sur les rituels d'accueil et sur le démarrage des processus d'apprentissage et de formation ritualisés.Distinguish the ritual of ritual is to oppose the static aspect of the ritual, as collective provision mobilized by a group or a community to manage interactions between its members and contact with other groups, with the appearance dynamic process of establishing operating rules for new forms of social action. The ritualization of learning and training calls for the establishment of a framework inaugural. It refers to explaining voluntary repeated operating rules by a facilitator symbolic guarantor of the law. In this sense the distinction postulates next to a functional approach to the rite, a genetic process of ritualization. By ritual, I mean the gradual establishment of habitus through a frame, establishing the rules of operation and objectives of the activity. Paradigm of circular causality, which presents the rituals both as producers and as a result of habit, we can contrast the model of linear causality that arises as part of the learning process inducing ritualized. The study focuses especially on the rituals of home and starting the process of learning and training ritualized. (shrink)

While phenomenologists claim to have overcome solipsism, most have not pushed beyond the boundaries of individual human intersubjectivity to that of individuals of other species. Yet Husserl recognizes the existence of an interspecific intersubjectivity, an intersubjectivity beyond the limits of the species. He even goes so far as to say that we sometimes understand a companion animal better than a foreign human. However, even if he admits that many animals are capable of a life of subjective consciousness and live in (...) a world of shared meaning, he does not consider them to be “persons” according to his strict conception that associates personhood with rationality, maturity, normality and historicity. Being a “person” in its most primordial sense – and its most decisive as the basis for political, legal and ethical conceptions – simply means being the subject of a surrounding world, of a common world and a biographical existence. Distinguishing two meanings of the concept of person allows us to recognize that animals share transcendentality; they are not simply alive but have a life that is both biographical and communal, even if they are not able to reflect on their own conscious life in order to consider their place in the chain of generations and to adopt what Husserl calls a “vocation”. The Husserlian phenomenology of anomalies allows us to recognize that animals truly come under the figure of the other, that they are alter ego subjects of a conscious life, and as such they participate fully, just as do children, the insane, and foreigners, in the co-constitution of the spiritual world. Unser Beitrag stellt ein interaktives Ethik-Konzept vor, das in Zusammenarbeit der BruderhausDiakonie Reutlingen und der Universität Tübingen entwickelt wurde, um den Eigenheiten und Bedarfen einer komplexen Organisationsstruktur gerecht zu werden, die mehrere Geschäftsfelder und Standorte unter sich vereint. Wir skizzieren die Grundzüge des interaktiven Nijmegener Modells, in dem die Kooperation eines auf Leitungsebene angesiedelten Komitees und situationsbezogener Fallbesprechungen ein fruchtbares Zusammenspiel zweier unverzichtbarer Reflexionsweisen bewirken soll. Wir zeigen auf, welche Herausforderungen sich bei der Implementierung dieses Modells in die konkrete Aufbauorganisation (...) der BruderhausDiakonie ergaben, und mit welchen konzeptionellen oder „implementationstechnischen“ Mitteln ihnen begegnet wurde. Im Zentrum steht dabei die Erweiterung des Nijmegener Modells um ein Verbindungselement, welches die Zusammenarbeit zwischen zentralem Ausschuss und dezentralen Fallbesprechungen koordiniert und das interaktive Moment des Modells erst ermöglicht. Definition of the problemMedical and nursing care often takes place within complex organizational structures that comprise numerous facilities at numerous locations. We introduce an interactive ethical concept, designed in cooperation with the diaconal foundation BruderhausDiakonie Reutlingen and the International Centre for Ethics in Science, University of Tübingen, to address the particular needs of such organizations.ArgumentsTherefore we portray the interactive Nijmegen Model which combines an ethics committee located at the management level and situational ethical case deliberations on the ward in order (...) to bring together two indispensable ways of ethical reflection in organizations: “top-down”/“bottom-up”. We illustrate the challenges of implementing the said model into the organizational construction of the BruderhausDiakonie and how to address these by means of conception and implementation.ConclusionConsidering the implementational challenges that we encountered, the Nijmegen Model needs to be enhanced by introducing a link between the committee and the case deliberations. We delineate the basic elements and the requirements for such a position while reporting our initial practical experience with this model. (shrink)

We cannot talk about the role of philosophy of education in teachers' training programs without examining the relationship between philosophy and educational theories. Even when theoreticians like Kieran Egan, for example, claim that education is a normative discourse that cannot be inferred from "local" empirical psychological research, the role of philosophy seems of utmost importance because philosophy has essentially to do with norms and values. Another way of looking at the "sciences" of education that renews our comprehension of their relationship (...) is by analysing a new cognitive psychological approach named "metacognition" which rests on one's ability to understand one's own cognitive strategies and mechanisms of regulation. The well-known psychologist Adrien Pinard in Quebec has been working on those concepts lately, inspired by Flavell's model of cognitive regulation. This approach is remarkably similar both to Wilson's definition of procedural criteria which he claims educational theory is all about and to the very specific method of philosophy, that of analytical and reflective thought. Philosophy or reflective thought cannot be separated from practice in teacher training since education is not only a matter of pedagogical means but also of attitudes to and relationship with another person. Thus, besides theory and practice, a third parameter should be taken into account in the elaboration of a teacher training program: the meta-practice and theory parameter, or the reflection on one's own practice, which is essentially philosophical.
