A growing group of institutional investors use divestment strategically to deter misconducts that are harmful for the climate and society. Based on Kantian ethics, we propose that divestment represents investors’ universal and absolute moral commitment to socially responsible investing (SRI). Following categorical and hypothetical imperatives and reciprocity as a norm, we hypothesize how institutional investors’ commit to SRI through a divestment strategy against ethically reprehensible behaviour of banks, especially when these investors represent banks themselves. Using a hand-collected database of the (...) revelation dates of enforcement actions on banks, we find evidence that banks are less likely to divest equity holding on banks with misconduct (fined banks) than their non-bank institutional investors peers. Banks that commit to invest responsibly by signing for the Principles for Responsible Investment (PRI) are not significantly more likely to divest on fined banks stocks than non-signatory banks. Moreover, divestment of fined banks whose own legitimacy to operate is in question is not significantly different from non-fined banks divestment. We find that European banks are more inclined to sell their holdings permanently on fined banks than their United States peers. Therefore, bank’s moral commitment to SRI via divestments is influenced more by cultural and reciprocity norms than their moral commitment to participate in the PRI. (shrink)

It is widely thought that functionalism and the qualia theory are better positioned to accommodate the ‘affective’ aspect of pain phenomenology than representationalism. In this paper, we attempt to overturn this opinion by raising problems for both functionalism and the qualia theory on this score. With regard to functionalism, we argue that it gets the order of explanation wrong: pain experience gives rise to the effects it does because it hurts, and not the other way around. With regard to the (...) qualia theory, we argue that it fails to capture the sense in which pain 's affective phenomenology rationalises various bodily-directed beliefs, desires, and behaviours. Representationalism, in contrast, escapes both of these problems: it gets the order of explanation right and it explains how pain 's affective phenomenology can rationalise bodily-directed beliefs, desires, and behaviours. For this reason, we argue that representationalism has a significant advantage in the debates about pain 's affective phenomenology. We end the paper by examining objections, including the question of what representationalists should say about so-called ‘disassociation cases’, such as pain asymbolia. (shrink)

Animals, Equality and Democracy examines the structure of animal protection legislation and finds that it is deeply inequitable, with a tendency to favor those animals the community is most likely to see and engage with. Siobhan O'Sullivan argues that these inequities violate fundamental principle of justice and transparency.

This paper focuses on ethics in community-based participatory research (CBPR) from inception to post-publication. Central to CBPR is a collaborative, partnership approach that recognises the strengths of partners and engages their distinctive voice and knowledge in the research process. While the ethical complexities that arise in the course of research practice in CBPR can transcend individual projects, they are also grounded in the particularity of the project, community, and research partners. This paper reflects on the experiences of two participatory social (...) policy research projects on housing in Ireland, conducted over the past three years. These projects involved collaborating with older people living in rural areas nationwide and with residents of small communities on offshore islands. The paper explores the ethics of engagement (regarding methods of involvement and access), and the ethics of representation (incorporating the depiction and sharing of research findings) and argues that researchers must pay attention to the specificity of each project and be alive to generating an organic research ethics in how research is set up, conducted, represented, and disseminated. In so doing, we can better foster agency and authenticity in the relationships developed throughout research processes and reflect on and meet shared values and responsibilities. (shrink)

Maurice O'Sullivan was born on the Great Blasket in 1904, and Twenty Years A-Growing tells the story of his youth and of a way of life which belonged to the Middle Ages. He wrote for his own pleasure and for the entertainment of his friends, without any thought of a wider public; his style is derived from folk-tales which he heard from his grandfather and sharpened by his own lively imagination.

Bertrand Russell developed a conception of the nature of the visual field, and of other sensory fields, as part of his project of explaining the construction of the external world. Wittgenstein's remarks on the visual field in the Tractatus are in part a response to Russell. Wittgenstein, against Russell, analyses the visual field in terms of facts rather than objects. Further, his conception of the field is, in a distinctive sense, depsychologised.

Dotted throughout the records of the turbulent last decades of fourth-century Athens are reports—often frustratingly vague—of prosecutions, many of intellectuals on the charge of . Most belong to the period of Macedonian domination: Theophrastus was one targeted at this time, and we hear also of actions against Demetrius of Phalerum, Theodorus the atheist, and Stilpo of Megara. Even before the Athenian capitulation to Macedon, in the immediate aftermath of the death of Alexander, prosecutions were launched against Demades and Aristotle. These (...) two early prosecutions are generally accepted to have had a political purpose, being attacks aimed at Macedonian sympathizers by the more staunchly pro-democratic Athenian elements; the later trials, however, are poorly attested in the sources and have received less scholarly attention, particularly for their political aspects. Of the hundreds of Greek common nouns and adjectives preserved in our MSS of Cicero, about three dozen are found written in the Latin alphabet as well as in the Greek. So we find, alongside συμπάθεια, alsosympathia, and ἱστορικός as well ashistoricus.This sort of variation has been termed alphabet-switching; it has received little attention in connection with Cicero, even though it is relevant to subjects of current interest such as his bilingualism and the role of code-switching and loanwords in his (...) works. Rather than addressing these issues directly, this discussion sets out information about the way in which the words are written in our surviving MSS of Cicero and takes further some recent work on the presentation of Greek words in Latin texts. It argues that, for the most part, coherent patterns and explanations can be found in the alphabetic choices exhibited by them, or at least by the earliest of them when there is conflict in the paradosis, and that this coherence is evidence for a generally reliable transmission of Cicero's original choices. While a lack of coherence might indicate unreliable transmission, or even an indifference on Cicero's part, a consistent pattern can only really be explained as an accurate record of coherent alphabet choice made by Cicero when writing Greek words. Through recourse to Gilles Deleuze’s short polemical essay ‘Postscript on Control Societies’ and the accompanying interview on ‘Control and Becoming’, this article attempts to map out the conceptual contours of an artistic war machine that might be pitched against control and also play a role in the more ethico-political function of the constitution of a people. Along the way a series of other Deleuzian concepts are introduced and outlined – with an eye to their pertinence for art practice and, indeed, (...) for any more general ‘thought’ against control. At stake here is the development of a concept of fictioning – the production of alternative narratives and image-worlds – and also the idea of art practice as a form of myth-science, exemplified by Burroughs’ cut-up method. It is argued that these aesthetic strategies might offer alternative models for a subjectivity that is increasingly standardized and hemmed in by neoliberalism. (shrink)

Objective: Parental influence during children’s “everyday” pain events is under-explored, compared to clinical or experimental pains. We trialed two digital reporting methods for parents to record the real-world context surrounding their child’s everyday pain events within the family home.Methods: Parents completed a structured e-diary for 14 days, reporting on one pain event experienced by their child each day, and describing child pain responses, parental supervision, parental estimates of pain severity and intensity, and parental catastrophizing, distress, and behavioral responses. During the (...) same 2-week period, a subsample of parent-child pairs completed digital ecological momentary assessments, immediately after any chosen pain event. Children reported their current pain while parents estimated the child’s pain and indicated their own distress.Results: “Everyday” pain events frequently featured minor injuries to the child’s head, hands or knees, and child responses included crying and non-verbal comments. Pain events occurred less frequently when parents had been supervising their child, and supervising parents reported lower levels of worry and anxiety than non-supervising parents. Child sex was significantly associated with parental estimates of pain intensity, with parents of girls giving higher estimates than parents of boys. Child age was significantly associated with both the number of pain events and with parental estimates of pain intensity and child distress: the youngest children experienced the fewest pain events but received higher pain and distress estimates from parents than older children. Hierarchal Linear Modeling revealed that parental estimates of pain severity were significant positive predictors of parental distress and catastrophizing in response to a specific pain event. Furthermore, higher levels of parental catastrophic thinking in response to a specific pain event resulted in increased distress, solicitousness, and coping-promoting behaviors in parents. The EMA data revealed that children reported significantly higher pain intensity than their parents.Conclusion: The electronic pain diary provided a key insight into the nature of “everyday” pain experiences around the family home. Digital daily reporting of how the family copes with “everyday” events represents a viable means to explore a child’s everyday pains without disrupting their home environment. (shrink)

This article attends to Deleuze and Guattari's idea of a ‘minor literature’ as well as to Deleuze's concepts of the figural, probe-heads and the diagram in relation to Bacon's paintings. The paper asks specifically what might be usefully taken from this Deleuze–Bacon encounter for the expanded field of contemporary art practice.

The concept of the public realm is the most fundamental of all political concepts because it is only the shared relationship it constitutes between rulers and ruled that makes government more than mere domination. It is therefore not surprising that the question of how the public realm is to be defined has been a central concern of political thinkers from Plato to more recent philosophers like Hannah Arendt. Although the answers they have given have of course varied greatly, what is (...) relevant in the present context is simply the assumption, for well over two thousand years, that there could be an answer. What is novel today, by contrast, is the increasing realization that political theory cannot in principle provide philosophical guidance of any kind about how the public realm can be finally and definitively identified, in a way which would clearly distinguish it from the private realm and thereby enable an incontestable limit to be set to the proper scope of politics and of state action. The present essay considers how some leading contemporary political thinkers have responded to this situation. (shrink)

Some of the most important contributions to animal ethics over the past decade or so have come from political, as opposed to moral, philosophers. As such, some have argued that there been a ‘political turn’ in the field. If there has been such a turn, it needs to be shown that there is something which unites these contributions, and which sets them apart from previous work. We find that some of the features which have been claimed to be shared commitments (...) of the turn are contested by key theorists working in the field. We also find that the originality of the turn can be exaggerated, with many of their ideas found in more traditional animal ethics. Nonetheless, we identify one unifying and distinctive feature of these contributions: the focus on justice; and specifically, the exploration of how political institutions, structures and processes might be transformed so as to secure justice for both human and nonhuman animals. This article examines Michael Oakeshott's views on European political history, based on the essays, reviews, lectures and unpublished works which he produced throughout his intellectual career. These pieces are less familiar than his writings on political philosophy, but deal with the same themes, notably the relationships between individuals, groups and the state. The conclusion is that Oakeshott was telling a new version of an old tale, the history of the development of a fundamental division in European political thought and practice (...) between two contrasting forms of human association, one communal and consensual, the other individualistic and contractarian. Discussions of whistleblowing whether in academic literature or in more popular media have tended to very one-sided assessments of the moral worth of the act. Indeed, much of the current literature concentrates on psychological or managerial aspects of whistleblowing while taking for granted this or that moral position or eschewing any normative commitment on the question. The purpose of this article is firstly to reemphasise the importance and complexity of the normative foundations of whistleblowing acts; and secondly, through a moral (...) philosophical analysis of the component decisions that make up any act of whistleblowing, to contribute to a more balanced and less polarised treatment of the topic. It is argued that the polarisation of views on the topic is in part due to a failure to decompose the act of whistleblowing into a number of inevitable component moral decisions leading up to the act. It is furthermore argued on the basis of the analysis that it is impossible to state a priori as a matter of general principle that whistleblowing is always morally right or morally wrong . The article will close with a reflection on the degree to which the weighing up of good and bad in the act of whistleblowing differs sharply among cultures; and with a conjecture as to a possible relation to a people's history which may serve as a pointer to interesting future empirical research on the topic. Contemporary philosophers of perception, even those with otherwise widely differing beliefs, often hold that universals enter into the content of perceptual experience. This doctrine can even be seen as a trivial inference from the observation that we observe properties – ways that things are – as well as things. I argue that the inference is not trivial but can and should be resisted. Ordinary property perception does not involve awareness of universals. But there are visual experiences which do involve determinate (...) universals: following Wittgenstein, I call these ‘aspect experiences’. The common view of perceptual content effectively conflates aspect experiences with mere property perceptions. Wittgenstein’s later writings on the philosophy of psychology provide an alternative way to think about both aspects and properties. It also forms a contrast with Wittgenstein’s own early treatment of perception in the Tractatus, the doctrine of which is much closer to the contemporary norm among philosophers of perception. In seeing how Wittgenstein moved away from his early view, we can see how we might move away from that norm. (shrink)

SummaryThe term ‘category mistake’ began to turn up regularly in public discourse in the 1990s as a general term to describe a confusion between different fields of thought with serious practical consequences. But it began its career in philosophy, introduced by Gilbert Ryle in The Concept of Mind in 1949 to attack Cartesian dualism and assert a monistic solution to the so-called mind-body problem. This paper traces the stages by which it came into general usage, arguing that while by the (...) later 1960s it had generally been rejected by philosophers, it was saved from disappearance by its migration into fields such as psychology and theology. From there, it moved into critical theory and then into international relations. Its entry into these latter areas first made plain its potential in political argument. Eventually, multiple meanings of the term came to coexist with one another, with the practical and rhetorical usage supplementing rather than replacing its original philosophical sense. (shrink)

Some theorists have argued recently that Berlinian value pluralism points not to liberalism, as Berlin supposed, but, in effect, to some form of communitarianism. To what extent is this true, and, to the extent that it is true, what kind of communitarianism fits best with the pluralist outlook? I argue that pluralists should acknowledge community as an important source of value and as a substantial value in itself, but they should also be prepared to question traditions and to respect values (...) other than community. In particular, pluralism points to personal autonomy as playing a special role when we must choose among incommensurable goods in conflict. Consequently, the pluralist outlook is at odds with conservative communitarianisms that tend to place existing traditions beyond question, and with radical variants of communitarianism, such as Marxism and classical anarchism, which look forward to future communities in which the need to cope with hard public choices has largely been eliminated. Rather, Berlinian pluralism fits best with a liberal or moderate kind of communitarianism that balances community with other goods, especially personal autonomy. (shrink)

This book is a fascinating exploration of ethical issues in the restoration of extinct species, viewed from multidisciplinary perspectives. It does not, however, include law. Scientific possibilities and experimentation that appear to operate outside of the ethical sphere are explored in detail and various outcomes are considered. Several essays moot the possibility of more public debate, but a nexus will need to be made to know how this feeds into the regulation of science and its progression. An overarching possibility emerging (...) from the conglomeration of essays is that animals may need recognition as legal persons in order to counterbalance their current treatment as property. This highly readable new collection of thirty pieces by Michael Oakeshott, almost all of which are previously unpublished, covers every decade of his intellectual career, and adds significantly to his contributions to the philosophy of historical understanding and political philosophy, as well as to the philosophy of education and aesthetics. The essays were intended mostly for lectures or seminars, and are consequently in an informal style that will be accessible to new readers as well as to those already well acquainted (...) with Oakeshott’s works.Early pieces include a long essay ‘On the Relations of Philosophy, Poetry, and Reality’, and Oakeshott’s comments on ‘The Cambridge School of Political Science’ through which he himself had passed as an undergraduate. The collection also reproduces a substantial wartime essay ‘On Peace with Germany’. There are two new essays on the philosophy of education, and the essay which gives the work its title, ‘What is History?’, is just one of over half a dozen discussions of the nature of historical knowledge. Oakeshott’s later sceptical, ‘hermeneutic’, thought is also well represented by pieces such as ‘What is Political Theory?’ and ‘The Emergence of the History of Thought.’ Reviews of books by English and European contemporaries such as Butterfield, Hayek, Voegelin, and Arendt also help to place him in context more clearly than before.The book will be indispensable for all Oakeshott’s readers, no matter which area of his thought concerns them most.
