En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. Background The COVID-19 pandemic has influenced the approach to the health-disease system, raising the question about the principles of bioethics present in physician–patient relations. The principles while widely accepted may not be sufficient for a comprehensive ethical analysis. Therefore, the aim of this study was to explore the perception of these principles and the physician–patient relationship during a hospital stay through a qualitative approach. Method Sixteen semi-structured interviews took place to know the patients’ perception during their 2020 hospitalization for COVID-19. (...) The data was analyzed through the constant comparison method, creating categories and comparing them. In the end, seven categories were established and were grouped in three: bioethical principles (dignity, charity, vulnerability, autonomy), doctor-patient relationship (participant commitment, informed consent, health staff-patient relationship) and the experience of the disease (illness, the role of the family). Results The research found that most patients described a positive experience, with the feeling of having been well cared for with no sense of discrimination or injustice done. The majority also reported that their autonomy was respected in the treatment decisions. The evaluation of these attitudes is an area of opportunity, especially when the patients' vulnerability is at risk. Conclusions The ethics of virtue offers a better reflection of how human beings manifest themselves by emphasizing the development of virtuous character and behaviors that allow them to realize their values in life. El presente artículo propone realizar una lectura filosófica de la narrativa de Rul- fo, en especial del cuento “Luvina”, haciendo hincapié en la interpretación de la historia y el antihistoricismo según Nietzsche; con la finalidad de explorar de manera crítica los ideales de la figura moderna del progreso. Igualmente, examina la concepción de la historia —siguiendo a Benjamin— a partir de una noción a contrapelo de los discursos hegemónicos de la narración histórica de Occidente, entendida ésta en clave de catástrofe. Este análisis será comprendido como una estrategia para rememorar a las víctimas ausentes de la figura del pro- greso histórico, a quienes hallamos en los personajes olvidados y desarraigados de la modernidad rural mexicana de mitad del siglo xx, descrita por Rulfo. Dichos personajes representan una subjetividad angustiada del México posrevolucionario y tienden a volcarse a su interioridad, debido al absurdo de un mundo cada vez más ajeno a lo humano. (shrink)

Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

Dos místicos relativamente contemporáneos: Etty Hillesum y Benjamín González Buelta; dos estilos, dos contextos y una coincidencia establecida desde sus experiencias espirituales, en profunda conexión con la realidad, en medio de la vida y sus desafíos. Hillesum no habla propiamente de la experiencia mística, sin embargo, su proceso personal existencial en el duro contexto de guerra que le tocó vivir, la condujo a descubrirse profundamente habitada. Su experiencia de Dios le hizo posible comprender y gestionar el dolor en medio de (...) la guerra, así como la necesidad de ‘hacerse bálsamo sobre las heridas’ de sus hermanos judíos. Etty es una mística de ojos abiertos. Benjamín González Buelta ha profundizado en la comprensión de la mística, describiéndola y analizándola desde la experiencia de Dios en el contexto latinoamericano. Su reflexión permite hoy leer a Etty Hillesum desde la perspectiva del místico de ojos abiertos. (shrink)

While philosophical questions about health and disease have attracted much attention in recent decades, and while opinions are divided on most issues, influential accounts seem to embrace negativism about health, according to which health is the absence of disease. Some subscribe to unrestricted negativism, which claims that negativism applies not only to the concepts of health and disease as used by healthcare professionals but also to the lay concept that underpins everyday thinking. Whether people conceptualize health in this manner has (...) implications for medical care and public health, and so we set out to examine this claim in two studies. Participants were asked to assess and compare the health states of two people presented in two vignettes. We found that both lay people and medical students conceptualize health as something more than the absence of disease. We argue that our findings highlight a need to rethink unrestricted negativism and indicate a need to rethink the way the debate has traditionally focused on disease. (shrink)

Unmanned Aerial Vehicles, or drones, are increasingly employed for military purposes. They are extolled for improving operational endurance and targeting precision on the one hand and keeping drone crew from harm on the other. In the midst of such praise, what falls by the wayside is an entangled set of concerns about the ways in which the relationship between the pilots and their operational environment is being reconfigured. This paper traces the various manifestations of this reconfiguration and goes on to (...) situate our being-with drones in a broader set of sociotechnical practices that shape our understanding of visual technologies. Our inquiry is grounded in technical reports of performance, media coverage of accidents, as well as a detailed first-person account of a former drone pilot. Our analysis suggests that being-with drones is disciplining our perception in subtle ways that remain underexplored. We conclude that when it comes to appraising technologies that interface with the human sensorium, functionalist claims of enhancement are inadequate to the task and propose that phenomenology’s commitment to the phenomena themselves can serve as a useful corrective. Background and aim Difficult moral situations assume more critical importance in pediatric wards since children are more vulnerable than adults. Given that professional ethics is a substantial part of children treatment, the present study was conducted to determine the ethical performance of nurses from the perspective of mothers and nurses in the pediatric wards of Be'esat Hospital in Hamadan. Materials and methods The present descriptive-analytical study was conducted on 58 nurses and 263 mothers of children referred to the pediatric wards (...) of Be'esat Hospital in Hamadan in 2019. The study samples were randomly selected. Data collection tools included the demographic form and Ethical Performance Assessment Questionnaire developed by Beykmirza et al. The obtained data were analyzed in SPSS software version 23using descriptive and inferential statistics. Results As evidenced by the obtained results, the mean ethical performance of nurses from the perspective of nurses and mothers were reported as 86.72 ± 6.397 and 69.92 ± 18.09. From the mothers' viewpoint, 27%, 39.2%, and 33.8% of nurses had weak, moderate and good levels of performance, respectively. On the other hand, from the nurses' perspective, 24.6% and 75.4% of nurses had moderate and good levels of performance, respectively. The obtained results were indicative of a statistically significant difference between the performance score as reported by mothers and nurses. Conclusion Considering that the majority of mothers rated the ethical performance of nurses as weak and moderate, it is suggested that professional ethical principles be implemented in the form of Retraining programs in an attempt to improve the ethical performance of nurses. While many profound philosophical questions arise about psychopaths, I wish to draw attention to two limitations in current debates. First, philosophers mainly deal with offender and forensic populations neglecting so-called ‘successful’ psychopaths. Second, philosophers mainly focus on the issue of empathy and responsibility, while relatively little attention is paid to volitional aspects. I address these two limitations together and argue that ‘successful’ psychopaths are volitionally constrained. This paper examines parallels between contemporary Western and Islamic thought. It will propose that there is congruence between Western and Muslim political thought processes on issues of soft-foundationalism, negative theology, provisional truth claims and religious democracy, in order to offset hegemonic tendencies. This will be illustrated by a concise juxtaposition of the ideas of Davutoglu, Winkel, Sardar, Tariq Ali, Derrida, Foucault, Abdolkarim Soroush, Mohammed Arkoun and others. In the social sciences, namely political science, the neutralization of ideology is also supported (...) in relation to the concern of ideological encroachments into the discipline by William E. Connolly, that echoes Karl Mannheim’s sociology of knowledge. This paper concludes that similar concerns on the relationship between power and knowledge in contemporary Western and Islamic political thought processes are beneficial to the study of Islam and its transformation as a social and political phenomenon. In this paper I criticize libertarianism and skepticism about free will. The criticism of libertarianism takes some steps towards filling in an argument that is often mentioned but seldom developed in any detail, the argument that libertarianism is a scientifically implausible view. I say "take some steps" because I think the considerations I muster (at most) favor a less ambitious relative of that argument. The less ambitious claim I hope to motivate is that there is little reason to believe that (...) extant libertarian accounts satisfy a standard of naturalistic plausibility, even if they do satisfy a standard of naturalistic compatibility. The argument against skepticism about free will tries to show (1) perhaps the most prominent form of skeptical argument against the existence of free will does not work, and (2) there is a good general argument against skepticism about free will. There is a familiar chain of reasoning that goes something like this: if everything is caused, no one is free, and thus, no one can be morally responsible. Reasoning like this has made scientific explanations of human behavior (e.g., biology, psychology, and neuroscience) threatening to familiar ideas of responsibility, blameworthiness, and merit. Rather than directly attacking the chain of reasoning that gives rise to these worries, I explore an alternative approach, one that begins by considering the "use" of moral responsibility. (...) What role does the concept play for us? What structure, if any, would an ideal set of practices and attitudes about moral responsibility have to it? I outline a new account of responsibility and consider what it might mean for traditional worries about causal, scientific explanations of human behavior. (shrink)

We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. This paper aims to clarify the nature of understanding in medicine. The first part describes in more detail what it means to understand something and links a type of understanding (i.e., objectual understanding) to explanations. The second part proceeds to investigate what objectual understanding of a disease (i.e., biomedical understanding) requires by considering the case of scurvy from the history of medi- cine. The main hypothesis is that grasping a mechanistic explanation of a condi- tion is necessary for a biomedical (...) understanding of that condition. The third part of the paper argues that biomedical understanding is necessary, but not sufficient for understanding in a clinical context (i.e., clinical understanding). The hypothe- sis is that clinical understanding combines biomedical understanding of a disease or pathological condition with understanding illness, which involves some degree of personal understanding of the patient. It is argued that, in many cases, clinical understanding necessitates adopting a particular second-personal stance and using cognitive resources in addition to those involved in biomedical understanding. Neil Levy (2007) argues that empirical data shows that psychopaths lack the moral knowledge required for moral responsibility. His account is intriguing, and it offers a promising way to think about the significance of psychopaths for work on moral responsibility. In what follows we focus on three lines of concern connected to Levy's account: his interpretation of the data, the scope of exculpation, and the significance of biological explanations for anti-social behavior.

Este artículo explora las consideraciones éticas que rodean el uso de la Inteligencia Artificial (IA) en la academia. Se establecen principios éticos generales para la IA en este ámbito, como la transparencia, la equidad, la responsabilidad, la privacidad y la integridad académica. En cuanto a la educación asistida por IA, se enfatiza la importancia de la accesibilidad, la no discriminación y la evaluación crítica de los resultados. Se recomienda que la IA se use para complementar y no para reemplazar la (...) enseñanza tradicional. En cuanto al ámbito de la investigación, se hace énfasis en la necesidad de garantizar la calidad y la veracidad de los datos utilizados, así como la transparencia en los métodos y resultados. Se deben considerar los posibles sesgos y riesgos de la IA en la investigación. El artículo concluye que la adopción responsable de la IA en la academia requiere una reflexión crítica sobre sus implicaciones éticas. Se recomienda la creación de marcos éticos específicos para cada contexto y la participación de diversos actores en la toma de decisiones. (shrink)

Quadruple Helix Collaborations (QHCs) is a cooperation model in which industry, government, academia, and the public interact to innovate. This paper analyses the impact of a training intervention to provide specific knowledge, skills, and attitudes to deal with barriers commonly found in the progress of QHCs. We designed, implemented, and evaluated three training programs in Austrian, Colombian, Danish, and Spanish institutions. We analysed trainees’ (n = 66) and trainers’ (n = 9) perceptions to identify the competencies acquired with the intervention (...) and the approach’s limitations. We used online questionnaires (35 trainees; 9 trainers), semi-structured interviews (10 trainees), and a focus group (6 trainers). Trainees answered positively regarding their self-perception about the impact of the course and highlighted the acquisition of inspiration for their practice (score 4.1 out of 5.0) and knowledge (3.7). In contrast, they perceived that a deeper interaction with other participants (2.7) was challenging. After the courses, 74% of respondents indicated that they know more about how QHCs work in practice, and 86% about collaboration or engagement methods. Moreover, participants plan to be more sensitive towards setting common goals (71%) and power imbalances (63%). Trainers’ perceptions align with those expressed by participants, except that they considered that the interaction amongst participants during the course was higher. Qualitative analysis of interviews with participants and the focus group with trainers provides more detail about the strengths and weaknesses of the intervention. Our study shows that the collaborative design and implementation of training impact the participant’s learning competencies, with potential implications in their medium- to long-term practice. The importance of socio-economic impacts from the introduction and use of genetically modified crops is reflected in increasing efforts to include them in regulatory frameworks. Aiming to identify and understand the present knowledge on SEI of GM crops, we here report the findings from an extensive study of the published international scientific peer-reviewed literature. After applying specified selection criteria, a total of 410 articles are analysed. The main findings include: limited empirical research on SEI of GM crops in the scientific (...) literature; the main focus of the majority of the published research is on a restricted set of monetary economic parameters; proportionally, there are very few empirical studies on social and non-monetary economic aspects; most of the research reports only short-term findings; the variable local contexts and conditions are generally ignored in research methodology and analysis; conventional agriculture is the commonly used comparator, with minimal consideration of other substantially different agricultural systems; and there is the overall tendency to frame the research upon not validated theoretical assumptions, and to over-extrapolate small-scale and short-term specific results to generalized conclusions. These findings point to a lack of empirical and comprehensive research on SEI of GM crops for possible use in decision-making. Broader questions and improved methodologies, assisted by more rigorous peer-review, will be required to overcome current research shortcomings. (shrink)

Our EcoDialogue Center is an educational space for human sustainability within the University of Veracruz. We propose that creating sustainable knowledge requires re-thinking how we conceive ourselves as human beings. This requires paying attention to what we call “the quality of being,” which means caring about and attending to the physical–emotional–mental–spiritual as the foundation of education. This way we can create a space where we can dialogue contemplatively where all dimensions of our lives interact; the physical, the emotional, the communitarian, (...) the social politic, the planetarium, and the spiritual being act with social–environmental responsibility. Se trata de nuevo proyecto basa- do en una docencia híbrida, donde las masterclass más teóricas se han complemen- tado con un aprendizaje basado en retos vinculados a materias de comunicación y sostenibilidad, aplicando la metodología Design Sprint. It is common to distinguish between “holist” and “reductionist” views of brain function, where the former envisions the brain as functioning as an indivisible unit and the latter as a collection of distinct units that serve different functions. Opposing reductionism, a number of researchers have pointed out that cortical network architecture does not respect functional boundaries, and the neuroanatomist V. Braitenberg proposed to understand the cerebral cortex as a “great mixing machine” of neuronal activity from sensory inputs, motor commands, and (...) intrinsically generated processes. In this paper, we offer a contextualization of Braitenberg’s point, and we review evidence for the interactions of neuronal activity from multiple sensory inputs and intrinsic neuronal processes in the cerebral cortex. We focus on new insights from studies on audiovisual interactions and on the influence of respiration on brain functions, which do not seem to align well with “reductionist” views of areal functional boundaries. Instead, they indicate that functional boundaries are fuzzy and context dependent. In addition, we discuss the relevance of the influence of sensory, proprioceptive, and interoceptive signals on cortical activity for understanding brain-body interactions, highlight some of the consequences of these new insights for debates on embodied cognition, and offer some suggestions for future studies. This article addresses the relationships between dialectic and learning within the constellations of the conceptual universes of Adorno and Vygotsky. In that order, we proceed to analyze the set of links between the main dialectical categories that structure the dialectical approach that characterizes both representatives of the Marxist thought tradition (process, totality, mediation, fields of force, antagonism, praxis) and the communicating vessels that go from epistemology to aesthetics and that demonstrate the relevance of the tasks of thought in the face (...) of social transformation. Finally, the article addresses the question of an (im)possible analytical horizon that arises, from both thinkers, to emphatically think about social emancipation and its challenges today. (shrink)

Both the current research literature and a tradition stemming from Husserl himself agree that it was Brentano’s notion of intentionality which „gave rise“ to Husserl’s phenomenology. I rely on extensive primary materials, including unpublished sources from four archives, to revisit this thesis. Already a survey of the historical circumstances of Brentano’s second decade in Vienna, when Husserl studied under him, hints at possible discrepancies in the reception of Brentano’s thought, which are further deepened by the editing policy employed by his (...) orthodox students. I analyze an unpublished lecture manuscript of Brentano to find three different notions of intentionality, including a strikingly a-phenomenological one, which I then relate to the discussion by modern scholarship and try to identify those notions of intentionality which were encountered by Husserl as a student of Brentano. Given this heterogeneous matrix of influences, it is far from surprising that a closer look at Husserl’s philosophical juvenilia shows that he misunderstood Brentano’s notion of intentionality and attempted to employ it in a different theoretical context (maybe motivated by an idiosyncratic notion of inner perception). Finally, the notion of intentionality Husserl later attributed to Brentano was probably mitigated to him by indirect sources, including lecture manuscripts copied by the extravagant and less-know student of Brentano, Hans Schmidkunz, and a debate between a contemporary logician Christoph Sigwart and Brentano’s orthodox disciples. The analysis of these transmission mechanisms could reveal a distinct transformation which proved to be instrumental in the development of Husserl’s transcendental phenomenology. The allegedly decisive influence of Brentano’s notion of intentionality at Husserl thus seems to consist in a productive misunderstanding (which apparently corresponds to Brentano’s surprisingly dismissive evaluation of Husserl after Husserl’s departure from Vienna). This paper examines from a historical perspective Tarski's 1936 essay, "On the concept of logical consequence." I focus on two main aims. The primary aim is to show how Tarski's definition of logical consequence satisfies two desiderata he himself sets forth for it: (1) it must declare logically correct certain formalizations of the -rule and (2) it must allow for variation of the individual domain in the test for logical consequence. My arguments provide a refutation of some interpreters of Tarski, (...) and notably John Etchemendy, who have claimed that his definition does not satisfy those desiderata. A secondary aim of the paper is to offer some basic elements for an understanding of Tarski's definition in the historical logico-philosophical context in which it was proposed. Such historical understanding provides useful insights on Tarski's informal ideas on logical consequence and their internal cohesion. (shrink)

Diseases of complex origin have a component of quantitative genetics that contributes to their susceptibility and phenotypic variability. However, after several studies, a major part of the genetic component of complex phenotypes has still not been found, a situation known as “missing heritability.” Although there have been many hypotheses put forward to explain the reasons for the missing heritability, its definitive causes remain unknown. Complex diseases are caused by multiple intermediate phenotypes involved in their pathogenesis and, very often, each one (...) of these intermediate phenotypes also has a component of quantitative inheritance. Here we propose that at least part of the missing heritability can be explained by the genetic component of intermediate phenotypes that is not detectable at the level of the main complex trait. At the same time, the identification of the genetic component of intermediate phenotypes provides an opportunity to identify part of the missing heritability of complex diseases. (shrink)

Este artículo explora algunas de las relaciones entre dialéctica y filosofía dentro del programa de una dialéctica modificada de Theodor W. Adorno ¿Cómo pensar la tensión entre las categorías dialécticas y la filosofía desde el prisma de una dialéctica negativa? ¿Qué significa desde el pensamiento de Adorno a liberar a la filosofía y a la dialéctica de su carácter afirmativo? Elaborar estas preguntas es el objetivo de este trabajo.

En aquest article pretenem fer una crítica, des de postulats ètics de caràcter republicà, al mode actual d’entendre i, per tant, posar en pràctica el principi d'autonomia de la bioètica. Pretenem mostrar que, en l’estat actual d’aplicació d'aquest principi, emprant una definició liberal de llibertat i de la natura humana, aquest idea de llibertat i autonomia que es pretén protegir, no es compleix en deixar fora de l’equació tot un seguit de circumstàncies socials, polítiques o econòmiques que poden dificultar al (...) pacient prendre una veritable decisió sobirana sobre quin ha de ser el fet d'actuar dels professionals sanitaris sobre el seu cos en cada cas.
