Besonders in jüngster Zeit findet es Interesse bei älteren Menschen, die dem Tode nahe sind und über Zeitpunkt und Umstände ihres Todes ein gewisses Maß an Gestaltungsspielraum behalten wollen. Unter den Befürwortern dieses Verfahrens ist allerdings u. a. strittig, wieweit Sterbefasten als eine „passive“ Form von Suizid gelten kann. Auf dem Hintergrund der WHO-Definition des Suizids verteidigt der Beitrag eine affirmative Antwort und (...) diskutiert, wieweit sich daraus Konsequenzen für die ethische Beurteilung des Sterbefastens ergeben. The focus of this book is on conceptual and philosophical issues of perception including the classic notion of unconscious inferences in perception. The book consists of contributions from a group of internationally renowned researchers who spent a year together as distinguised fellows at the German Centre for Advanced Study.

Is causal analysis an appropriate method to discover causal laws? Some prerequisites for any successful application of mathematical causal models are worked out and discussed. It can be shown that these prerequisites cannot be fulfilled by present models and there are strong reasons to assume that they cannot be satisfied by any model. Therefore causal analysis will probably be of no importance for the discovery of causal laws in sociology.

Krause’s philosophy deserves to be memorized as the first link in a chain of thinking on animal rights that is still on the way today. Though Krause was not the first to talk of animal rights in the history of animal ethics, his theory of animal rights is pathbreaking in embedding a conception of animal rights in an all-encompassing metaphysical system. ZusammenfassungWährend die terminale Sedierung neueren niederländischen Erhebungen zufolge bereits in mehr als 5% aller Sterbefälle zur Leidensminderung am Lebensende angewandt wird, sind viele der durch dieses Verfahren aufgeworfenen begrifflichen und ethischen Fragen weiterhin offen. Kontrovers ist insbesondere die begriffliche Einordnung der Kombination von terminaler Sedierung und Behandlungsabbruch sowie die Frage nach den dafür einschlägigen ethischen Kriterien. Ausgehend von einer Analyse von drei Szenarien mit unterschiedlicher kausaler Rollenverteilung argumentiere ich dafür, den Standardfall der Kombination von terminaler Sedierung und Behandlungsabbruch unter die (...) Kategorie der „passiven Sterbehilfe“ zu subsumieren und für sie dieselben ethischen Kriterien wie für den Behandlungsabbruch allein gelten zu lassen. Eine tentative vergleichende Bewertung ergibt, dass die terminale Sedierung als ultima ratio der Leidensminderung am Lebensende gegenüber der Alternative des assistierten Suizids insgesamt als ethisch vorzugswürdig gelten sollte, ohne jedoch die Alternative des assistierten Suizids als in toto unzulässig erscheinen zu lassen. In der Einleitung zu Kerstings und Essers Target-Artikel fällt ein Stichwort, das mir in mehrfacher Hinsicht für den gegenwärtigen Stand des Nachdenkens über Sterben und Tod bezeichnend zu sein scheint: Pluralisierung der Todesbilder. Pluralisierung ist eine Herausforderung für jede einzelne der drei Fragestellungen des Artikels. In Bezug auf den Todesbegriff stellt sich die Frage, ob es einen – und nur einen – verbindlichen Begriff des Todes geben kann oder sollte; in Bezug auf das Verständnis des Todes als anthropologisches Grunddatum stellt (...) sich die Frage, ob es eine – und nur eine – gültige sinnverleihende Interpretation des Phänomen des Todes geben kann oder sollte; hinsichtlich des praktischen Umgangs mit dem Tod – dem eigenen wie dem anderer – stellt sich die Frage, ob sich bei aller kulturellen Diversität ein Katalog von basalen Normen findet, für den sich Allgemeinverbindlichkeit beanspruchen lässt. Wie viel Pluralismus ist notwendig, um der faktischen Vielfalt gerecht zu werden? Wie viel ist möglich, ohne Beliebigkeit und Orientierungslosigkeit heraufzubeschwören? Die Antworten der Autoren zeigen, dass sie in der Zulassung von Pluralismus zumeist das rechte Maß finden. Bei einigen scheinen sie mir allerdings zu weit zu gehen, bei anderen wiederum zu wenig weit. (shrink)

One moot point in bioethical debates about genetic testing concerns the conditions that have to be fulfilled to make individual genetic testing or individual participation in genetic screening programs truly voluntary. Though there is a relatively broad consensus about the non-viability of views on the extremes of the spectrum of opinions, there is considerable disagreement in the middle. This mirrors the difficulties in defining satisfactory demarcation lines between autonomous choice, pressured choice and coercion in cases in which the decision to (...) participate is triggered, wholly or partly, by factors such as material incentives, urgent health needs, massive social expectations, or moral pressure from relatives. In this contribution, some of the semantic conditions and ethical principles concerning coercion are explored with a view to applying them to genetic testing, especially in the context of insurance and participation in clinical trials. Popper gives the concept of social situation the role of key term in the method ology of situational analysis. The important characteristics of the social situation are aims and knowledge, which are attributed to the actor and are part of the situation. Furthermore, the elements of the situation create or are, as social institutions, obstacles to the actor. But more complex situations exist which here are called actor specific situations and are much more structured by the actor. The aims and (...) knowledge of the actors vary widely, so they cannot be attributed to the actors without a serious loss of information. The elements have social meanings and meanings which are ascribed to them by the actors. The concept of dual methodology tries to grasp these complex situations for the purpose of empirical research by combining causal explanation of analytical methodology with intentional explanation of a methodology of understanding. The interface between these methodologies is formed by the concept of generative mecha nisms. These are part of the causal theory as well as data gathered for the intentional explanation. The ideal result of research is achieved if the hypothesis cannot be rejected and the two kinds of generative mechanisms coincide. In this case, the hypothesis is a proven causal statement. Finally, the aptitude of the interpretative methodology for gathering the generative mechanisms is dis cussed. (shrink)

Presenting Henrich's philosophy of subjectivity as a credible alternative to analytic philosophy of mind and a radical challenge to Heideggerian, Habermasian, neo-pragmatist, and postmodern positions, Freundlieb argues that a philosophy of the kind developed by Henrich can regain the cultural significance philosophical thinking once possessed. First I argue that the prohibition of linguistic self-reference as a solution to the antinomy problem contains a pragmatic contradiction and is thus not only too restrictive, but just inconsistent (chap.1). Furthermore, the possibilities of non-restrictive strategies for antinomy avoidance are discussed, whereby the explicit inclusion of the – pragmatically presuposed – consistency requirement proves to be the optimal strategy (chap.2). The central question here is that about the actual reason for antinomic structures. It turns out to be a form (...) of negative self-conditioning (chap.3). This makes it necessary to clarify the status of negative concepts (chap.4). The generalization of these considerations (chap.5) leads to the actual analysis of the antinomic basic structure (chap.6): Decisively for the pragmatics of the concept is that it positively owns a meaning, so that positivity is always constituted by the concept qua concept. Thus a negative concept is characterized by a fundamental ambivalence: From a semantic point of view it has negative character, in its pragmatic status as a concept, however, it has positive character. If the meaning is especially that of a negative self-reference, the ambivalence leads to the antinomic constellation of a negative self-condition – that is the crux of the matter here! The concept thus possesses the property defined by it exactly when it does not possess it and vice versa. A closer analysis shows that the function of reflective structures for the occurrence of antinomies has to be judged much more differentiated than previous opinions suggest. Not only are four forms of reflectivity to be distinguished in this context – ontic, semantic, pragmatic reflectivity, and especially the form of negative self-condition; but it is also apparent that these are intertwined with each other in a way that is difficult to be understood. The astonishing variety of relationships associated with this makes the irritation that has always emanated from the antinomy problem appear more comprehensible. In the developed pragmatic perspective furtheron parallels to the structure of self-consciousness become visible (chap.7). Der Begriff besitzt so die durch ihn definierte Eigenschaft genau dann, wenn er sie nicht besitzt und umgekehrt. Die nähere Analyse zeigt, dass hierbei die Funktion reflexiver Strukturen für das Auftreten von Antinomien weitaus differenzierter zu beurteilen ist, als bisherige Auffassungen nahelegen. Nicht nur dass in diesem Kontext vier Formen von Reflexivität – ontische, semantische, pragmatische Reflexivität und insbesondere auch die Form negativer Selbstbedingung – unterschieden werden müssen; es zeigt sich auch, dass diese in schwer durchschaubarer Weise ineinander verschränkt sind. Die damit verbundene erstaunliche Beziehungsvielfalt läßt die Irritation, die seit je vom Antinomienproblem ausging, begreiflicher erscheinen. The Snowden leaks, first published in June 2013, provided unprecedented insights into the operations of state-corporate surveillance, highlighting the extent to which everyday communication is integrated into an extensive regime of control that relies on the ‘datafication’ of social life. Whilst such data-driven forms of governance have significant implications for citizenship and society, resistance to surveillance in the wake of the Snowden leaks has predominantly centred on techno-legal responses relating to the development and use of encryption and policy advocacy around (...) privacy and data protection. Based on in-depth interviews with a range of social justice activists, we argue that there is a significant level of ambiguity around this kind of anti-surveillance resistance in relation to broader activist practices, and critical responses to the Snowden leaks have been confined within particular expert communities. Introducing the notion of ‘data justice’, we therefore go on to make the case that resistance to surveillance needs to be conceptualized on terms that can address the implications of this data-driven form of governance in relation to broader social justice agendas. Such an approach is needed, we suggest, in light of a shift to surveillance capitalism in which the collection, use and analysis of our data increasingly comes to shape the opportunities and possibilities available to us and the kind of society we live in. Den an den gewaltigen Umwälzungen unserer Zeit Interessierten bewegen heute in erster Linie die Probleme des sozialen Wandels - oder besser des dringend not wendigen Umbaus unserer Welt. Erst dahinter tritt seit einiger Zeit die Forderung nach dem Umbau des Menschen auf 1. Sie ist von der öffentlichkeit noch relativ wenig beachtet und offenbar als unangenehm fast tabuiert. Von den die Frage initiierenden Biologen ist diese Forderung aber durchaus ernst gemeint. Ihre Ten denz ist radikal. Außerhalb dieser Tendenz laufen aber (...) bereits unentwegt Prozesse, die zuerst Eingriff in die Physis und Psyche des Menschen, dann eben doch schon Veränderung bedeuten oder bedeuten können. Der Massenausstoß von Chemikalien bis ins Trinkwasser und in die Zahnpasta hinein und die permanente massenhafte Massenbeeinflussung teilgeplanter Art, zum Beispiel durch Werbung, deren Wirkung (besonders insgesamt!) völlig unbekannt ist, ist damit gemeint. Hier setzt unser Interesse ein. Die Idee einer Veränderung des Menschen ist einmal überhaupt bewegend. Zum anderen gilt ihr deshalb unser Fachinteresse, weil eine an der Kulturanthropologie und der sogenannten Philosophischen Anthropologie orientierte Soziologie durch die Behauptung und Verbreitung des Konzeptes von der »Offenheit« und »Plasti zität«, der unbegrenzten Beeinflußbarkeit und Lernfähigkeit des Menschen, zu sammen mit einer untheoretischen Evolutionstheorie erst den Hintergrund für die Idee der Möglichkeit eines »Umbaus« des Menschen geliefert hat. Ist der Mensch total offen, nicht festgelegt, dann kann er auch beliebig angepaßt werden. (shrink)

Multitrait-multimethod (MTMM) analysis is one of the most frequently employed methods to examine the validity of psychological measures. Confirmatory factor analysis (CFA) is a commonly used analytic tool for examining MTMM data through the specification of trait and method latent variables. Most contemporary CFA-MTMM models either do not allow estimating correlations between the trait and method factors or they are restricted to linear trait-method relationships. There is no theoretical reason why trait and method relationships should always be linear, and quadratic (...) relationships are frequently proposed in the social sciences. In this article, we present two approaches for examining quadratic relations between traits and methods through extended latent difference and latent means CFA-MTMM models (Pohl et al., 2008; Pohl and Steyer, 2010). An application of the new approaches to a multi-rater study of the nine inattention symptoms of attention-deficit/hyperactivity disorder in children (N = 752) and the results of a Monte Carlo study to test the applicability of the models under a variety of data conditions are described. In recent years, some ethicists have defended that we should genetically engineer farmed animals to diminish or eliminate their capacity to experience negative affective states, a process known as disenhancement that would, according to these authors, result in a situation that is better than the status quo. While we agree with this overall assessment, we believe that it is a mistake to defend disenhancement as a good solution to farmed animals’ plight. This is because disenhancement entails some generally unseen harms (...) that arise from the fact that negative affective states, despite feeling bad, support the access to a number of intrinsic goods, such as individuality, social relationships, meaning, and political participation. Though farmed animals currently have few opportunities to enjoy these goods, we argue that this is a reason to change the environment in which they are kept, not the animals. If we truly care about improving farmed animals’ lives, we should aim to enrich their environment, rather than impoverish their mental lives. (shrink)

For the sake of explaining the merits of a Leśniewski type nominalism, it should be made clear what is meant by „nominalism” and what the characteristics of this special type of nominalism are. To the first question we can find quite a lot of mutually inconsistent answers. Therefore I will just explain the distinction between two different nominalistic traditions which I hold to be fundamental. I think we should not just focus on the question which so-called abstract entities are rejected (...) but as well look for basic entities nominalists rely on. (shrink)

Wer kennt GOTTLOB FREGE (1848-1925)? Nur wenige verbinden mit seinem Namen einen der groaten Logiker aller Zeiten, ohne dessen "Logik von Funktion und Argument" die heutige Computertechnik kaum denkbar ist. Frege fuhlte sich zeitlebens zu seiner Heimat im Norden Deutschlands hingezogen. In Wismar verbrachte er seine Kindheit und in Bad Kleinen, in unmittelbarer Nahe, seinen Lebensabend. Das im Jahre 2000 gegrundete Gottlob-Frege-Zentrum der Hochschule Wismar organisierte ihm zu Ehren im Mai 2013 in seiner Geburtsstadt eine internationale Konferenz, an der Forscher (...) aus der mathematischen Grundlagenforschung und der Analytischen Philosophie teilnahmen. Previous efforts to bring the Hegelian dialectic closer to a clarification give reason for skepticism. The question: "What is dialectic", according to Dieter Henrich, "has remained without an answer so far". Hegel's objective-idealistic program is, however, so much linked to the possibility of a dialectical logic that it is an urgent desideratum to gain clarity about the stringency of dialectical argumentation. But this is only possible on the basis of a theory of dialectic. Hegel's own reflection on methods cannot (...) be considered sufficient in this respect. It does not enable us to defend the dialectical procedure against objections or to answer questions of method. In the following, a detailed reconstruction of the dialectic of 'being' and 'nothing' in Hegel's 'Science of Logic' will reveal basic structures of dialectical argumentation. As will be shown, antinomic structures play a key role. Such a 'reconstruction', however, will not be a simple confirmation of Hegelian texts, but will always have the character of a critique. In fact, it will turn out that in comparison with Hegel's development of categories, radical revisions are to be expected. ----- Bisherige Bemühungen, das Verfahren Hegelscher Dialektik einer Klärung näherzubringen, geben Anlass zur Skepsis. Die Frage: „Was ist Dialektik?“, so Dieter Henrich, sei „bisher ohne Antwort geblieben“. Das objektiv-idealistische Programm Hegels ist indes so sehr mit der Möglichkeit einer dialektischen Logik verknüpft, daß über die Stringenz dialektischer Argumentation Klarheit zu gewinnen ein dringliches Desiderat darstellt. Das aber ist nur auf der Grundlage einer Theorie der Dialektik möglich. Hegels eigene Methodenreflexion kann diesbezüglich nicht als zureichend erachtet werden. Sie versetzt uns nicht in die Lage, das dialektische Verfahren gegen Einwände zu verteidigen oder Methodenfragen zu beantworten. Im Folgenden sollen in einer detaillierten Rekonstruktion der Dialektik von ‘Sein’ und ‘Nichts’ in Hegels ‘Wissenschaft der Logik’ Grundstrukturen dialektischer Argumentation sichtbar gemacht werden. Wie gezeigt wird, kommt dabei antinomischen Strukturen eine Schlüsselfunktion zu. Eine solche 'Rekonstruktion' wird allerdings nicht eine umstandslose Bestätigung der Hegelschen Textvorlage sein können, sondern immer auch den Charakter einer Kritik haben. In der Tat wird sich ergeben, daß im Vergleich mit Hegels Kategorienentwicklung einschneidende Revisionen zu gewärtigen sind. (shrink)
