In general, the development of the theory of the legal system has focused on the contributions of legal positivism authors, leaving to one side the contributions of natural law theory. This study seeks to rebuild the theory of the legal system developed by the School of Salamanca’s founder, Francisco de Vitoria, showing its explanatory advantages in comparison with the first analytical legal theory of legal system formulated by John Austin. This study shows that, just as in Austin, it is (...) possible in Francisco de Vitoria to reconstruct the existence and identity criteria of legal systems from the notions of command and sovereignty. These findings allow us to maintain that 300 years before Austin, and in a non-analytical environment, Francisco de Vitoria developed a theory of legal system. (shrink)

In this paper, I engage the debate on Suits’ theory of games by providing a Kantian view of Utopia. I argue that although the Kantian aspects of Suits’ approach are often overlooked in comparison to its Socratic-Platonic aspects, Kant’s ideas play a fundamental role in Suits’ proposal. In particular, Kant’s concept of ‘regulative idea’ is the basis of Suits’ Utopia. I regard Utopia as Suits’ regulative idea on game playing. In doing so, I take Utopia to play a double role (...) in Suits’ theory of games. First, it highlights the primary condition of possibility of game-playing, namely, the lusory attitude. Second, it provides a normative criterion that serves as a critical principle to evaluate instances of game playing and as a counterfactual assumption that makes game playing possible. I provide further support for my Kantian interpretation of Suits’ Utopia by bringing to light the anthropological assumptions upon which Utopia is built. In doing so, I argue that both Suits’ theory of games, in general, and his Utopia, in particular, lay out the conditions of possibility of game playing, not an analysis on the life most worth living. How can science be brought to connect with experience? This book addresses two of the most challenging problems facing contemporary neurobiology and cognitive science. Firstly, understanding how we unconsciously execute habitual actions as a result of neurological and cognitive processes that are not formal actions of conscious judgment but part of a habitual nexus of systematic self-organization. Secondly, attempting to create an ethics adequate to our present awareness that there is no such thing as a transcendental self, a stable subject (...) or soul. The new biotechnology raises expectations for modifying human behaviour through its use. This article focuses on the ethical analysis of the not so remote possibility of rehabilitating criminals by means of neurotechnological techniques. The analysis is carried out from a synthetic position of, on the one hand, the consequentialist conception of what is right and, on the other hand, the emphasis on individual liberties. As a result, firstly, the ethical appropriateness of adopting a general predisposition for allowing the neurorehabilitation of (...) prisoners only if it is safe and if they give their consent will be defended. But, at the same time, reasons will be given for requiring, in certain circumstances, the exceptional use of neurotechnology to rehabilitate severely psychopathic prisoners, even against their will, from the same ethical perspective. In his posthumous work Power and Prosperity , the economist Mancur Olson asked why the economies of many of those countries of the former Soviet Union and other emergent countries that had at last adapted to the theoretical and practical presuppositions of the market economy had not seen themselves, notwithstanding, recompensed with the prosperity that this economic model promises to all those who follow its rules. This study attempts to analyse the relationship between two key psychological variables associated with performance in sports - Self-Determined Motivation and Competitive Anxiety - through Bayesian Networks analysis. We analysed 674 university students/athletes from 44 universities that competed at the University Games in México, with an average age of 21 years (SD = 2.07) and with a mean of 8.61 years’ (SD = 5.15) experience in sports. Methods: Regarding the data analysis, first a CHAID algorithm was carried out to determine (...) the dependence links between variables, and then a Bayesian networks was developed. The validation of the BN revealed AUC values ranging from 0.5 to 0.92. Subsequently, various instantiations were performed with hypothetical values applied to the “bottom” variables. Results showed two probability trees that have extrinsic motivation and amotivation at the top, while the anxiety/activation due to worries about performance was at the bottom of the probabilities. The instantiations carried out support the existence of these probabilistic relationships, demonstrating their scarce influence on anxiety about competition generated by the intrinsic motivation, and the complex probabilistic effect of introjected and identified regulation regarding the appearance of anxiety due to worry about performance. The target article concludes that it is essential to introduce the personal level in cognitive science. We propose to take this conclusion one step further. The personal level should consist of first-person accounts of specific, contextualized experiences, not abstract or imagined cases. Exploring first-person accounts at their own level of detail calls for the refinements of method that can link up with neural accounts.

As it is well known, in the forties of the past century, Curry proved that in any logic S closed under Modus Ponens, uniform substitution of propositional variables and the Contraction Law, the naïve Comprehension axiom trivializes S in the sense that all propositions are derivable in S plus CA. Not less known is the fact that, ever since Curry published his proof, theses and rules weaker than W have been shown to cause the same effect as W causes. Among (...) these, the Contraction rule or the Modus Ponens axiom, for example, are to be noted. But, moreover, as Brady has proved, even the Generalized Modus Ponens axiom or the Generalized Contraction rule give rise to “Curry’s Paradox” under the same circumstances as W does. In some previous work by us, “weak relevant model structures” are defined on “weak relevant matrices” by generalizing Brady’s model structure MCL built upon Meyer’s Crystal matrix CL. We have proved that wr-ms only verify logics with the “depth relevance condition”. The aim of this paper is to show how to falsify gMPa and gRW in certain wr-ms. In particular, it will be shown that gMPa is falisfied in any wr-ms and gRW in any wr-ms verifying Routley and Meyer’s basic positive logic B+. (shrink)

En este trabajo me propongo comparar el patrón argumentativo de los sofistas del siglo V a. C. tal como son retratados en la obra de Platón con el de los erísticos del _Eutidemo_. Defenderé que ninguno de estos sofistas es presentado por Platón como experto en dialéctica refutativa, actividad discursiva que caracteriza a la erística. Por el contrario, el retrato platónico de Pródico, Hipias, Gorgias y Protágoras los muestra como incapaces, desinteresados u hostiles a la argumentación de tipo dialéctica.

What would it mean for an emotion to successfully “recognize” something about an object toward which it is directed? Although the notion of "emotional recognition" is central to Rick Furtak’s _Knowing Emotions_, the text does not provide an account of this concept that enables us to assess the extent to which a given emotional response is recognitive. This article draws from the text to articulate a novel account of emotional recognition. According to this account, emotional recognition can be assessed not (...) only in terms of the “accuracy” of an emotional construal in a strictly epistemological sense, but also in terms of the quasi-ethical ideal of responding emotionally to what we encounter in ways that are “specific,” “deep," and “balanced.". Este artículo aborda el papel que juega la “admiración” en la traducción heideggeriana de tres pasajes de la Metafísica de Aristóteles. Con base en el volumen 62 de la Gesamtausgabe, se muestra que la “admiración” se relaciona con tres temas fundamentales, a saber: el mundo, la vida y la comprensión. En primer lugar, analizo el tema del mundo compartido y del mundo circundante. En segundo lugar, describo el tema de la vida, la cual es interpretada como “premura insoslayable” y “clara (...) permanencia tranquila”. En tercer lugar, desarrollo el tema de la comprensión en tres fases: “epistémica”, “propia” y “visible”. Estos temas serán retomados en trabajos ulteriores como Ser y tiempo. Por tal motivo, las lecciones de 1922 son valiosas para conocer el itinerario filosófico de Heidegger en los años veinte. Finalmente, se intenta mostrar que la triple traducción del vocablo griego θαυμάζειν realizada por Heidegger, obedece a un criterio específico de interpretación fenomenológica acorde a los temas mencionados.
