This paper analyzes and evaluates the 2007 majority opinion of the German National Ethics Council which seeks to establish new information (as to the inferior quality of legally procurable human embryonic stem cells) as a sufficient reason for a relaxation of the 2002 Stem Cell Law. A micro-level analysis of the opinion’s central section is conducted and evaluated vis à vis the strongest known opponent position in the national debate at that time. What steps are needed to make life better and more convivial? The Second Convivialist Manifesto has presented a short diagnosis of the current crises and sketches of a possible and desirable future. It has been a necessary work of theoretical synthesis, but preserving a viable world also requires passion. It is thus urgent to show what people would gain from a shift to a post-neoliberal and post-growth convivialist future. This volume includes a theoretical debate on convivialism which reflects dystopias and (...) shows the multiple and major obstacles that convivialism will have to face. I present a “reduced” version of the fifteen Pragma-dialectical rules and inquire into their theoretical status as necessary conditions for a critical discussion. Questions: In what respect is PD’s non-sufficiency a deficiency, can and must it be remedied? Brief answers: with respect to defining the concept ‘critical discussion,’ possibly, yes, if, and only if, one seeks to identify the concept ‘critical discussion’; no, if PD is for fallacy-detection.

Frank Palmeri sees the conjectural histories of Rousseau, Hume, Herder, and other Enlightenment philosophers as a template for the development of the social sciences in the nineteenth and early twentieth centuries. Without documents or memorials, these thinkers, he argues, employed conjecture to formulate a naturalistic account of society's commercial and secular progression. This approach can be traced in the work of political economists, anthropologists, sociologists, and sociologists of religion, and its speculative framework creates a surprising ambivalence toward modernity in (...) these disciplines. Time travel has been a staple of science fiction. With the advent of general relativity it has been entertained by serious physicists. But, especially in the philosophy literature, there have been arguments that time travel is inherently paradoxical. The most famous paradox is the grandfather paradox: you travel back in time and kill your grandfather, thereby preventing your own existence. To avoid inconsistency some circumstance will have to occur which makes you fail in this attempt to kill your grandfather. Doesn't (...) this require some implausible constraint on otherwise unrelated circumstances? We examine such worries in the context of modern physics. (shrink)

Gerhard Schurz [2001, Journal for General Philosophy of Science, 32, 65-107] has proposed to reconstruct auxiliary hypothesis addition, e.g., postulation of Neptune to immunize Newtonian mechanics, with concepts from non-monotonous inference to avoid the retention of false predictions that are among the consequence-set of the deductive model. However, the non-monotonous reconstruction retains the observational premise that is indeed rejected in the deductive model. Hence, his proposal fails to do justice to Lakatos' core-belt model, therefore fails to meet what Schurz coined (...) "Lakatos' challenge". It is argued that Lakatos's distinction between core and belt of a research program is not mapable onto premise-set and consequence-set and that Schurz's understanding of a ceteris paribus clause as a transfinite list of interfering factors is problematic. I propose a simple reading of Lakatos's use of the term ceteris paribus clause and motivate why the term hypothesis addition, despite not being interpretable literally, came to be entrenched. A proposal by Ferguson [2003, Argumentation 17, 335–346] for a fully monotonic argument form allowing for the expression of defeasible generalizations is critically examined and rejected as a general solution. It is argued that (i) his proposal reaches less than the default-logician’s solution allows, e.g., the monotonously derived conclusion is one-sided and itself not defeasible. (ii) when applied to a suitable example, his proposal derives the wrong conclusion. Unsuccessful remedies are discussed.

This paper discusses an example of social policy argumentation from an opinion of the 2007 majority among the German National Ethics Council. It is employed to problematize argument reconstruction with respect to the Informal Logic quality criteria relevance, sufficiency, acceptability. The main thesis is conditional and rather weak: If the RSA criteria are sub-stitutes for the notion of soundness, then—next to premise-truth and validity—they also substitute recon-structive charity.

The ‘Principal Principle’ states, roughly, that one's subjective probability for a proposition should conform to one's beliefs about that proposition's objective chance of coming true. David Lewis has argued (i) that this principle provides the defining role for chance; (ii) that it conflicts with his reductionist thesis of Humean supervenience, and so must be replaced by an amended version that avoids the conflict; hence (iii) that nothing perfectly deserves the name ‘chance’, although something can come close enough by playing the (...) role picked out by the amended principle. We show that in fact there must be ‘chances’ that perfectly play what Lewis takes to be the defining role. But this is not the happy conclusion it might seem, since these ‘chances’ behave too strangely to deserve the name. With the advent of synthetic biology, scientists are increasingly relying on digital sequence information, instead of physical genetic resources. This article examines the potential impact of this shift on the access and benefit-sharing (ABS) regime of the Convention on Biological Diversity (CBD) and the Nagoya Protocol. These treaties require benefit-sharing with the owners of genetic resources. However, whether “genetic resources” include digital sequence information is unsettled. The CBD conceives genetic resources as genetic material containing functional units of heredity. “Material” implies (...) tangibility, and for some scholars, “functional units of heredity,” undefined in both treaties, mean full-coding sequences. This article argues that digital sequence information obtained from physical genetic resources, full-coding or not, should be treated as genetic resources. Literal construction of the CBD risks eroding its usefulness and the ABS regime. This is because through bioinformatics, sequence information can easily be obtained from genetic resources for utilization, without physically moving them or concluding ABS agreement with owners. The CBD must evolve with scientific progress also because sequence functionality depends on the state of knowledge. These arguments are vindicated by domestic ABS laws equating genetic information with genetic resources; Nagoya Protocol provisions deeming research exploiting the genetic composition of genetic resources as utilization of genetic resources; and CBD provisions requiring the sharing of benefits from the utilization of genetic resources. Moreover, treaty interpretation and case law demand that generic, scientific terms, such as “genetic resources” and “functional units of heredity” be interpreted in an evolutionary manner to capture scientific developments. Like many governments in this COVID-19 pandemic, the Nigerian government imposed a lockdown on the country. As a consequence of the lockdown, many businesses shutdown and effectively had no source of revenue. Yet, without receiving any bailout or palliatives from the government, these businesses are required to meet their tax obligations to the government. Bearing in mind that this time (COVID-19 era) is different, one wonders what is required of businesses in view of the taxation problem and the social contract (...) between the businesspersons and the government. In view of social contract obligations, in this COVID-19 pandemic should businesses pay tax to a government that seems to have delegitimised itself by its exploitative actions in terms of taxation and delinquent omission in terms of the provision of public goods and social services? The Nigerian government at all tiers (federal, state and local) seldom respect the essence of taxation. Therefore, businesses often pay tax for nothing. For many businesses, as far as taxation is concerned, to pay or not to pay? that is the question. This article is aimed at teasing out this taxation problem that may or may not be a moral dilemma. In view of certain ethical considerations, this article shows why in spite of social contract obligations, there is no consensus or canonical agreement on whether, as law-abiding citizens and juridical persons (legal entities), businesspersons and businesses ought to or ought not to pay tax to the Nigerian government in this COVID-19 pandemic. What is honor? Is it the same as reputation? Or is it rather a sentiment? Is it a character trait, like integrity? Or is it simply a concept too vague or incoherent to be fully analyzed? In the first sustained comparative analysis of this elusive notion, Frank Stewart writes that none of these ideas is correct. Drawing on information about Western ideas of honor from sources as diverse as medieval Arthurian romances, Spanish dramas of the sixteenth and seventeenth centuries, (...) and the writings of German jurists of the nineteenth and twentieth centuries, and comparing the European ideas with the ideas of a non-Western society—the Bedouin—Stewart argues that honor must be understood as a right, basically a right to respect. He shows that by understanding honor this way, we can resolve some of the paradoxes that have long troubled scholars, and can make sense of certain institutions that have not hitherto been properly understood. Offering a powerful new way to understand this complex notion, _Honor_ has important implications not only for the social sciences but also for the whole history of European sensibility. (shrink)

This work contrasts conservative or minimally mutilating revisions of empirical theories as they are identified in the presently dominant AGM model of formal belief revision and the structuralist program for the reconstruction of empirical theories. The aim is to make understandable why both approaches only partly succeed in substantially informing and formally restraining the issue. With respect to the rationality of minimal change, the overall result is negative. Readers with an interest in formal epistemology are provided with application cases, the (...) historically inclined reader is offered a systematic perspective. I will argue that time reversal operations on fundamental states should be allowed. I will furthermore argue that the form that time reversal operations take is determined by the type of fundamental geometric quantities that occur in nature and that we have good reason to believe that the fundamental geometric quantities that occur in nature correspond to irreducible representations of the Lorentz transformations. Evaluative conditioning (EC) is one of the terms that is used to refer to associatively induced changes in liking. Many controversies have arisen in the literature on EC. Do associatively induced changes in liking actually exist? Does EC depend on awareness of the fact that stimuli are associated? Is EC resistant to extinction? Does attention help or hinder EC? As an introduction to this special issue, we will discuss the extent to which the papers that are published in this issue (...) help to resolve some of the controversies that surround EC. We also speculate about possible boundary conditions of EC and attempt to reconcile conflicting results on the functional properties of EC. (shrink)

I discuss under what conditions the objection that an expert’s argument is biased by her self-interest can be a meaningful and sound argumentative move. I suggest replacing the idea of bias qua self-interest by that of a conflict of interests, exploit the distinction between an expert context and a public context, and hold that the objection can be meaningful. Yet, the evaluation is overall negative, because the motivational role of self-interest for human behavior remains unclear. Moreover, if recent social-psychological results (...) from the “heuristics and biases” program are accepted, it is plausible to assume that humans also satisfice (rather than optimize/maximize) when identifying and then acting in their self-interest. My thesis is: insofar as the objection is sound with a particular audience, it is not needed; and insofar as the objection is needed, it is unsound. (shrink)

The literature on human mate preferences is vast but most data come from studies on college students in complex societies, who represent a thin slice of cultural variation in an evolutionarily novel environment. Here, I present data on the mate preferences of men and women in a society of hunter-gatherers, the Hadza of Tanzania. Hadza men value fertility in a mate more than women do, and women value intelligence more than men do. Women place great importance on men’s foraging, and (...) both sexes rate character as important. Unlike college students, Hadza men place considerable importance on women being hard-working, and Hadza women cite looks about as often as men do. (shrink)

In this paper we investigate first order common knowledge logics; i.e., modal epistemic logics based on first order logic with common knowledge operators. It is shown that even rather weak fragments of first order common knowledge logics are not recursively axiomatizable. This applies, for example, to fragments which allow to reason about names only; that is to say, fragments the first order part of which is based on constant symbols and the equality symbol only. Then formal properties of "quantifying into" (...) epistemic contexts are investigated. The results are illustrated by means of epistemic representations of Nash Equilibria for finite games with mixed strategies. (shrink)
