The Logical Foundations of Social Theory describes Gert Mueller’s argument that physical, biological, social, moral, and cultural reality form an asymmetrical hierarchy of founding and controlling relationships that condition social reality rather than mechanically determining it. This book offers the fullest and most sophisticated account of Gert's influential moral theory, a model first articulated in the classic work The Moral Rules: A New Rational Foundation for Morality, published in 1970. In this final revision, Gert makes clear that the moral rules are only one part of an informal system that does not provide unique answers to every moral question but does always provide a range of morally acceptable options. Considered by many to be Abraham Robinson's magnum opus, this book offers an explanation of the development and applications of non-standard analysis by the mathematician who founded the subject. Non-standard analysis grew out of Robinson's attempt to resolve the contradictions posed by infinitesimals within calculus. He introduced this new subject in a seminar at Princeton in 1960, and it remains as controversial today as it was then. The life and work of Hermann Günther Graßmann (1809–1877) attract not only ever again the attention of mathematicians, mathematical historians and those interested in the history of mathematics, they constitute also a challenge for the methodology of historiographical research. This challenge persists since Friedrich Engel’s biography of 1911; there, two sources were presented and interpreted in a not legitimate manner which even mislead since then various scholars. This paper faces the intricate task to unravel not only the methodological shortcomings of (...) Engel’s biography, but also to re-assess the misinterpretations – particularly of alleged influences on Graßmann’s approaches – induced by Engel’s misleading claims. Based upon broader historically contextualised analyses of Graßmann’s innovative elements in his theory of extension and upon new primary sources for his student times at the Gymnasium and Berlin University, the paper presents a novel assessment of Graßmann’s approaches. I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. In The Sources of Normativity, Christine Korsgaard tried to argue against what she called the ‘privacy’ of reasons, appealing to Wittgenstein's argument against the possibility of a private language. In recent work she continues to endorse Wittgenstein's perspective on the normativity of meaning, although she now emphasizes that her own argument was only meant to be analogous to the private language argument. The purpose of the present paper is to show that the Wittgensteinian perspective is not only not useful in (...) support of Korsgaard's general project, but that it is positively inimical to it, in two ways. First, Wittgenstein opposes views on which principled or rule-following behavior requires that one be guided by anything like a mental representation of a rule or principle. But for Korsgaard, human action essentially requires this. Second, Wittgenstein systematically attempts to de-emphasize the importance of the first-personal perspective, and to emphasize the social functions even of concepts that might seem deployed primarily from that perspective: for example, concepts of sensations and intentions. This is the reverse of Korsgaard's emphasis. The paper also argues, however, that the private language argument does have some implications for a theory of rationality and reasons. (shrink)

_Religion and Education: The Forgotten Dimensions of Religious Education?_ explores fundamental questions about the role of religion and education in contemporary religious education. Drawing from a range of educational and religious traditions and perspectives, it investigates the future of religious education for all.

The use of philosophy in educational programmes and practices under such names as philosophy for children, philosophy with children, or the community of philosophical enquiry, has become well established in many countries around the world. The main attraction of the educational use of philosophy seems to lie in the claim that it can help children and young people to develop skills for thinking critically, reflectively and reasonably. By locating the acquisition of such skills within communities of enquiry, the further claim (...) is that engagement with philosophy can foster the development of moral reflection and sensitivity and of social and democratic skills more generally. Claims like these provide a set of arguments for the inclusion of philosophy in the school curriculum that goes well beyond philosophy as just another curricular subject or body of knowledge. The aim of this article is to raise some questions about the conception of education that appears to inform the discussion about the educational use of philosophy. My ambition is to suggest an additional rather than an alternative view about the educational use of philosophy in the hope that this may act as a reminder of a different way in which one can engage with philosophy in educational settings which, in turn, might also act as a reminder of how philosophy might engage with us. The philosophical distinction in which my argument is phrased is that between humanism and post-humanism and the guiding educational concept is that of exposure. (shrink)

Moral problems do not always come in the form of great social controversies. More often, the moral decisions we make are made quietly, constantly, and within the context of everyday activities and quotidian dilemmas. Indeed, these smaller decisions are based on a moral foundation that few of us ever stop to think about but which guides our every action. Here distinguished philosopher Bernard Gert presents a clear and concise introduction to what he calls "common morality" -- the moral system (...) that most thoughtful people implicitly use when making everyday, common sense moral decisions and judgments. Common Morality is useful in that -- while not resolving every disagreement on controversial issues -- it is able to distinguish between acceptable and unacceptable answers to moral problems. In the first part of the book Gert lays out the fundamental features of common morality: moral rules, moral ideals, and a two-step procedure for determining when a violation of a moral rule is justified. Written in a non-technical style, the ten general moral rules include rules on which everyone can agree, such as "do not kill," "do not deceive," and "keep your promises." The moral ideals include similarly uncontroversial precepts such as "Relieve pain" and "Aid the needy." In the second part of the book Gert examines the underlying concepts that justify common morality, such as the notions of rationality and impartiality. The distillation of over 40 years of scholarship, this book is the most accessible version of Gert's influential theory of morality as well as an eye-opening look at the moral foundations of our everyday actions. The aim of this article is to answer two questions: (1) what kind of person should the hospice nurse be? and (2) how should the hospice nurse engage in caring conversations? To answer these questions we analyse a nurse’s story that is intended to be a profile of an exemplary hospice nurse. This story was constructed from an analysis of five semistructured (...) interviews with hospice nurses, based on the ‘ethics of the caring conversation’, which is inspired by the ethical perspective of Paul Ricoeur. The research questions concentrate on the norms of respect, responsibility and reciprocity, which are integral parts of the ‘ethics of the caring conversation’. (shrink)

Following much work in linguistic theory, it is hypothesized that the language faculty has a modular structure and consists of two basic components, a lexicon of (structured) entries and a computational system of combinatorial operations to form larger linguistic expressions from lexical entries. This target article provides evidence for the dual nature of the language faculty by describing recent results of a multidisciplinary investigation of German inflection. We have examined: (1) its linguistic representation, focussing on noun plurals and verb inflection (...) (participles), (2) processes involved in the way adults produce and comprehend inflected words, (3) brain potentials generated during the processing of inflected words, and (4) the way children acquire and use inflection. It will be shown that the evidence from all these sources converges and supports the distinction between lexical entries and combinatorial operations. (shrink)

The World Health Organization (WHO) is currently in advanced stages of developing a ‘WHO convention, agreement, or other international instrument on pandemic prevention, preparedness and response’ (also known as WHO CA+, referred to below as: Pandemic Agreement).1 Rightly, the instrument places equity at the centre. Yet, it currently also omits reference to an impactful tool to promote equity that has been adopted in an unprecedented manner during COVID-19—a set of measures known as disadvantage indices. Embedding disadvantage indices would provide concrete (...) constructive guidance; align the Pandemic Agreement with the use of indices by other United Nations (UN) agencies; help realise the Agreement’s goal of addressing social and other determinants of health within countries, and furthermore offer feasible ways improving equity in allocation across countries. WHO member states began work on a Pandemic Agreement in December 2021. The current timeline envisages a final version to be considered by the May 2024 World Health Assembly.1 The publicly available version of the Pandemic Agreement at the time of writing comprises 36 articles under three separate chapters (Bureau’s Text, A/INB/7/3, 30 Oct 2023).1 Chapter 1 provides general scene setting describes objectives, and highlights key terms. While the concept of equity is still somewhat implicit and would benefit from further articulation,2 overall, there seems to be a latent understanding that inequity obtains when there are unfair differences in health outcomes and opportunities within and across countries. Correspondingly, ‘[e]quity is at the centre of pandemic prevention, preparedness, response, both at the national level within States and at the international level between States. Thus, confronted (...) with the strangeness of Michael K, his noncommunicativeness, his odd combination of meekness and intransigence, the medical officer in J. M. Coetzee’s Life and Times of Michael K assigns K a place “above and beneath classification” [Coetzee 151]. Michael K is at once too large and too small to fit into the administrative and humanitarian categories that pertain at the prisoner camp. He appears to the medical officer—whose good intentions and patient, selfless interest in K cannot be doubted—as a recalcitrant, nonidentifiable object that flirts with dehumanization. To put it in Bataille’s terms, Michael K is formless (informe), and his existence can, by mere virtue of that fact, be called scandalous.2Let us take a closer look at the expression “above and beneath classification.” We can note that (1) it names something that situates itself on the outside of any classification; (2) this something must have a paradoxical status, since it is at once above and beneath classification; (3) the nonclassifiable is regarded as such from a classifying perspective. Although the latter point may sound tautological, it nonetheless touches upon one of the most difficult dimensions of the exception: if the exception is always an exception to the rule, how can it exist otherwise than by virtue of that rule? how can it be more than just the rule’s negative? But if the exception radically breaks away from the rule, then how is it possible for that rule to identify the exception and recognize it as such? This crucial problem has formed the basis for reflection on the relation between rule and exception. Freud, for instance, saw the exception (crime) as constitutive of social ties and the social order. Lacan needed a special topology to show the extimate character of what is at once inside and outside the symbolic order [Lacan, Miller]. Religious ways of thinking could be said to have located the exception as transcendent to any human order. For Badiou, the secularization of the infinite cannot be thought apart from an immanent, rather than transcendent, event that is disruptive of all order. In Derrida’s subtle analyses, the originary supplement appears as both constitutive and deconstructive. Agamben regards the exception as having become the political rule. These interpretative frameworks, in spite of some deep distinctions, all show not only that the rule cannot do without the exception, but that the exception is just as dependent on the rule. Even when the exception is regarded as a kind of pure, ruleless being-as-such, the rule is at the very least conceptually [End Page 157] indispensable for this pure, mere being to be thinkable in the first place. P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. Leaving out of account those Socratic" dialogues which Thesleff takes to be latish and the posthumously completed Laws, we can say that a series of late dialogues starts with the Parmenides and includes the Timaeus, Critias, Sophist, Politicus, and Philebus. ABSTRACT In The Netherlands, the public funding of a number of health care services is controversial. What can we learn from this about the moral concerns that underlie these judgements? And, if there is anything to learn, can we use this improved understanding to scrutinise the adequacy of particular decisions concerning the public funding of health care services? In the present paper, I will analyse three cases: corrective surgey, In Vitro Fertilisation and liver transplantation. I will summarise the arguments that (...) have been used to support or to challenge the public funding of these services. I will then assess the merits of Daniels’fair equality of opportunity account of justice in health care. Can this account improve our understanding of the moral concerns underlying our judgements about the public funding of these services? Can it serve to scrutinise the adequacy of particular decisions that are made concerning the public funding of health care services? My answer to both questions will be a qualified yes. Daniels’account can provide guidance, but not because we can deductively infer from it what is right and what is wrong. Instead, I will argue for a more casuistic use of the concept of fair equality of opportunity. (shrink)
