Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)

Overtreatment is when medical or dental services are provided with a higher volume or cost than is appropriate. This study aimed to investigate how a group of dentists in Switzerland, a wealthy country known to have high standards of healthcare including dentistry, evaluated the meaning of unnecessary treatments from an ethical perspective and, assessed the expected frequency of different possible behaviors among their peers.

Drawing on a rich digitalized corpus of early modern texts, Hans-Juergen Diller argues that the concepts expressed by the English words >passion emotion emotion passion emotion<. But there are two concepts of a concept. According to the first, the meaning of a word expressing a concept is not sharply distinguished from the complete discourse in which it figures. According to the second, meaning is more narrow. For instance, it is restricted to the explicit definition an author provides. I show (...) that Descartes provides an explicit definition of passion and emotion in purely physical, a-moral terms. So Diller's method is not apt to trace concepts in the second, more restricted sense which Descartes himself has in mind. (shrink)

This article explores conditionals expressing that the antecedent makes a difference for the consequent. A ‘relevantised’ version of the Ramsey Test for conditionals is employed in the context of the classical theory of belief revision. The idea of this test is that the antecedent is relevant to the consequent in the following sense: a conditional is accepted just in case the consequent is accepted if the belief state is revised by the antecedent and the consequent fails to be accepted if (...) the belief state is revised by the antecedent’s negation. The connective thus defined violates almost all of the traditional principles of conditional logic, but it obeys an interesting logic of its own. The article also gives the logic of an alternative version, the ‘Dependent Ramsey Test,’ according to which a conditional is accepted just in case the consequent is accepted if the belief state is revised by the antecedent and the consequent is rejected if the belief state is revised by the antecedent’s negation. This conditional is closely related to David Lewis’s counterfactual analysis of causation. (shrink)

What role do metaphors play in philosophical language? Are they impediments to clear thinking that should be eradicated in the interests of terminological exactness? Or can they be used by philosophers to indicate the attitudes that regulate an epoch?

Shipwreck with Spectator traces the evolution of the complex of metaphors related to the sea, to shipwreck, and to the role of the spectator in human culture from ancient Greece to modern times. This elegant essay exemplifies Blumenberg's ideas about the ability of the historical study of metaphor to illuminate essential aspects of being human. Originally published in the same year as his monumental Work on Myth, Shipwreck with Spectator traces the evolution of the complex of metaphors related to the (...) sea, to shipwreck, and to the role of the spectator in human culture from ancient Greece to modern times. The sea is one of humanity's oldest metaphors for life, and a sea journey, Blumenberg observes, has often stood for our journey through life. We all know the role that shipwrecks can play in this journey, and at some level we have all played witness to others' wrecks, standing in safety and knowing that there is nothing we can do to help, yet fixed comfortably or uncomfortably in our ambiguous role as spectator. Through Blumenberg's seemingly inexhaustible knowledge of letters, from ancient texts through nineteenth-century reminiscences and modern speeches, we see layer upon layer revealed in the meaning humans have given to these metaphors; and in this way we begin to understand what metaphors can do that more straightforward modes of expression cannot. This edition of Shipwreck with Spectator also includes "Prospect for a Theory of Nonconceptuality," an essay that recounts the evolution of Blumenberg's ideas about metaphorology in the years following his early manifesto "Paradigms for a Metaphorology.". Most of the reports on synthetic biology include not only familiar topics like biosafety and biosecurity but also a chapter on ‘ethical concerns’; a variety of diffuse topics that are interrelated in some way or another. This article deals with these ‘ethical concerns’. In particular it addresses issues such as the intrinsic value of life and how to deal with ‘artificial life’, and the fear that synthetic biologists are tampering with nature or playing God. Its aim is to analyse what (...) exactly is the nature of the concerns and what rationale may lie behind them. The analysis concludes that the above-mentioned worries do not give genuine cause for serious concern. In the best possible way they are interpreted as slippery slope arguments, yet arguments of this type need to be handled with care. It is argued that although we are urged to be especially vigilant we do not have sufficiently cogent reasons to assume that synthetic biology will cause such fundamental hazards as to warrant restricting or refraining from research in this field. SummaryGrotius has a rudimentary theory of sociability. Only with hindsight has a remark about appetitus societatis been promoted to the starting point of a theory that flourished in the writings of later natural jurists. In this article, I address the issue of the appearance in Grotius's natural law of sociability [as the 1715/38 English translation of John Morrice renders appetitus societatis, following Barbeyrac's sociabilité]. Writing in the just war tradition, Grotius is first of all interested in finding out the conditions (...) for peace, and although injustice is a condition of war, it is not per se true that injustice is a perversion of society. Apparently, not all societies are perfect and the violence of war and the legal actions of peace are both instruments for achieving a greater modicum of justice in this world. Yet appetitus et custodia societatis is called the foundation of justice. Grotius achieved this context for sociability in phases, through a series of writings from c. 1600 until De iure belli ac pacis of 1625, and its revision of 1631. In this development the notion of fides plays an intriguing role, through which we can obtain a better understanding of the meaning of appetitus societatis in the later work. The present article is a sequel to a previous publication, on fides in De iure praedae. Analysing the genesis of appetitus societatis in De iure belli ac pacis, I argue that Grotius was changing his strategy over the years, without however arriving at a definitive solution to the question of what commits men to the pursuit of justice. This article explores hamartiological questions at the interface of evolutionary biology and theology. Such questions include the problem of evil, the possibility of a historical fall, and the meaning of human sinfulness in light of biology. First, I examine some of the leading accounts of animal theodicy, including John Schneider's aesthetic theodicy, Christopher Southgate's compound theodicy, and Joshua Moritz's free creatures’ defense. Second, I review several non‐lapsarian accounts of how sin originated within the human story (e.g., Robert Russell's concept of (...) entropy as the physical origin of sin). Then third, I discuss noteworthy attempts to revise the doctrine of original sin in light of evolutionary psychology. Although the quest for a post‐Darwinian doctrine of sin has prompted fascinating areas of research, I conclude that an evolutionary hamartiology remains a remarkably difficult project. (shrink)

Despite the opening of the market and partial privatization of state‐owned companies in China, the state still represents the controlling shareholder in larger companies. By analyzing the weaknesses of Chinese corporate governance we illustrate the framework for harmful corruption. China is characterized by a weak legal system and strong influences of traditions such as guanxi. In this article we analyze the influence of guanxi on the Chinese corporate governance system. We find that guanxi is in general a double‐edged sword, but (...) business‐to‐government guanxi in particular can harm the weak Chinese corporate governance system and hamper its further economic development and growth. If one takes seriously the idea that a scientific language must be extensional, and accepts Quine’s notion of truth-value-related extensionality, and also recognizes that a scientific language must allow for singular terms that do not refer to existing objects, then there is a problem, since this combination of assumptions must be inconsistent. I will argue for a particular solution to the problem, namely, changing what is meant by the word ‘extensionality’, so that it would not be the truth-value that had (...) to be preserved under the substitution of co-extensional expressions, but the state of affairs that the sentence described. The question is whether or not elementary sentences containing empty singular terms, such as ‘Vulcan rotates’, are extensional in the substitutivity sense. Five conditions are specified under which extensionality in the substitutivity sense of such sentences can be secured. It is demonstrated that such sentences are state-of-affairs-as-extension-related extensional. This implies that such sentences are also truth-value-related extensional in Quine’s sense, but not truth-value-as-extension-related extensional. (shrink)

What happens to the concept of security if legal disorder manifests itself not only as illegal behavior but also as alegal behavior—acts that challenge the very distinction between legality and illegality, as drawn by a political community? Focusing on European immigration policy, this paper examines how the distinction between illegal and alegal acts critically illuminates the relation between collective (in)security and the concept of legal (dis)order. It concludes by arguing that this distinction sheds new light on the systematic relation—and tension—between (...) security, freedom, and justice. (shrink)

Phanomenologie als Ursprungswissenschaft vom Leben in ihren Strukturen und thematischen Bereichen aufzuweisen, steckt Rahmen und Ziel dieser Freiburger Dozentenvorlesung ab. In dieser Grundtendenz ist die Vorlesung ein bedeutendes Zeugnis des Durchbruchs des Heideggerschen Denkens hin zur Position von Sein und Zeit. Sie ist aber mit Blick auf Heideggers Denkweg nicht nur entwicklungsgeschichtlich von Interesse, sondern sie bezieht ihr Gewicht zudem auch aus ihrer Anlage als systematische Vorlesung. Mit kritischem Blick auf die Tradition, insbesondere aber im Bemuhen um Distanzgewinnung zur zeitgenossischen (...) Philosophie (Phanomenologie, Neukantianismus, Lebensphilosophie) sucht Heidegger die eigenen Konzeption einer Urwissenschaft vom Leben an und fur sich zu profilieren. Im Zentrum steht dabei der Aufweis der in sich unterschiedenen, aber darin gleichwohl ineinander verwobenen Bekundungsgestalten des faktischen Lebens (Selbstsein, Mitwelt, Umwelt) und ihrer Thematisierungsmoglichkeiten im alltaglichen, wissenschaftlichen und philosophischen Verhalten. In immer neuen Anlaufen lasst so diese Vorlesung plastisch Heideggers Ringen um den Ansatz einer hermeneutischen Phanomenologie hervortreten. (shrink)

This article investigates the scope and effects of enhanced consumer choice in health insurance that is presented as a cornerstone of the new health insurance legislation in the Netherlands that will come into effect in 2006. The choice for choice marks the current libertarian trend in Dutch health care policymaking. One of our conclusions is that the scope of enhanced choice should not be overstated due to many legal and non-legal restrictions to it. The consumer choice advocates have great expectations (...) of the impact of enhanced choice. A critical analysis of its impact demonstrates that these expectations may not become true and that enhanced consumer choice should not be perceived as the ‘magic bullet’ for many problems in health care.
