The movement repertoire that develops in the first year of life is a language in itself and conveys desires, intentions, and emotions. This early life in motion serves as the roots of ongoing nonverbal interaction and later verbal expression – in short, this language remains a key element in communication throughout life. In their path-breaking book, gestalt therapist Ruella Frank and psychoanalyst Frances La Barre give readers the tools to see and understand the logic of this nonverbal realm. They (...) demonstrate how observations of fundamental movement interactions between babies and parents cue us to coconstructed experiences that underlie psychological development. In this article, I critically analyze the anthropological foundation of the bioethics of philosopher Jean-François Malherbe, particularly as presented in his book, Pour une Éthique de la Médecine. Malherbe argues that such practices as organ donation and transplants, assisted reproduction, resuscitation, and other uses of biotechnologies in contemporary medicine are unethical because they go against essential human nature. Furthermore, he uses this position as a basis to prescribe public policy and institutional practice. In contrast, I argue not only that (...) ‘human nature’ is much more malleable and adaptive to changes in technology and society than Malherbe allows, but also that his criticisms of medicine and technoscientific development overstep the bounds of the social function of philosophical ethics, which is to inform and clarify public debate. Public policy and institutional practice is thus best left to the democratic political process under the parameters of the just rule of law. (shrink)

SUMMARYIn the wake of the geo-political development in recent years, the question of sacrifice has come to the fore in the contemporary philosophical discussion. Does sacrifice merely sharpen conflicts between cultures, or should it be seen as an inevitable part of their foundation? This article addresses the question from the perspective of the biblical view of sacrifice, expressed paradigmatically in the story of the Akedah. The author picks up Merold Westphal's argument – developed in extension to Kierkegaard – that (...) the biblical view of sacrifice rather implies an unsettling of human culture, by pointing to a God whose transcendence disrupts and relativises every human culture. However, although Westphal's appeal for transcendence is greeted, a more discriminating approach to transcendence, involving phenomenological and hermeneutical questions, is pleaded for. The author seeks to outline such an approach by combining Emmanuel Levinas' critical reading of the Akedah with René Girard's argument that the Bible ultimately reveals an anti-sacrificial logic. Many statistical problems, including some of the most important for physical applications, have long been regarded as underdetermined from the standpoint of a strict frequency definition of probability; yet they may appear wellposed or even overdetermined by the principles of maximum entropy and transformation groups. Furthermore, the distributions found by these methods turn out to have a definite frequency correspondence; the distribution obtained by invariance under a transformation group is by far the most likely to be observed experimentally, in the (...) sense that it requires by far the least “skill.” These properties are illustrated by analyzing the famous Bertrand paradox. On the viewpoint advocated here, Bertrand's problem turns out to be well posed after all, and the unique solution has been verified experimentally. We conclude that probability theory has a wider range of useful applications than would be supposed from the standpoint of the usual frequency definitions. (shrink)

Henry Home (1696-1782) has been called "perhaps the most complete 'Enlightenment man' among the eighteenth-century Scottish thinkers." Kinsman and friend of David Hume, mentor and patron of Adam Smith, John Millar, and Thomas Reid, he was a key figure in that circle of luminaries. He read law, was called to the bar in 1723, was raised to the Bench of the Court of Session in 1752, with the title Lord Kames (the name of his family estate), and joined the (...) High Court of the Justiciary in 1763. Publishing broadly in law, history, philosophy, and criticism, Kames made significant contributions to the Enlightenment's science of human nature. The Essays is commonly considered Kames's most important philosophical work. In the first part, he sets forth the principles and foundations of morality and justice, attacking Hume's moral skepticism and addressing the controversial issue of the freedom of human will. In the second part, Kames focuses on questions of metaphysics and epistemology to offer a natural theology in which the authority of the external senses is an important basis for belief in the Deity. The text of this volume is based on the third edition of 1779, while the appendix presents substantial variant readings in the first and second editions. (shrink)

In his new book the eminent Kant scholar Henry Allison provides an innovative and comprehensive interpretation of Kant's concept of freedom. The author analyzes the concept and discusses the role it plays in Kant's moral philosophy and psychology. He also considers in full detail the critical literature on the subject from Kant's own time to the present day. In the first part Professor Allison argues that at the centre of the Critique of Pure Reason there is the foundation (...) for a coherent general theory of rational agency. The second part employs this account of rational agency as a key to understanding Kant's concept of moral agency and associated moral psychology. The third part focuses on Kant's attempt to ground both moral law and freedom in the Groundwork and the Critique of Practical Reason. This is a major contribution to the interpretation of Kant which will be of special interest to scholars and graduate students of Kant's moral theory. (shrink)

This article identifies a novel challenge to standard understandings of responsibility practices, animated by experimental studies of biases and heuristics. It goes on to argue that this challenge illustrates a general methodological challenge for theorizing about responsibility. That is, it is difficult for a theory to give us both guidance in real world contexts and an account of the metaphysical and normative foundations of responsibility without treating wide swaths of ordinary practice as defective. The general upshot is that theories must (...) either hew more closely to actual practice than they appear to, or they must provide some normative foundation for responsibility that does not go through actual practice. This book is both a critique of the concept of the rights-holding, free, autonomous individual and attendant ideology dominant in the contemporary West, and an account of an alternative view, that of the role-bearing, interrelated responsible person of classical Confucianism, suitably modified for addressing the manifold problems of today.

The system presented by the author in The Logical Foundations of Statistical Inference suffered from certain technical difficulties, and from a major practical difficulty; it was hard to be sure, in discussing examples and applications, when you had got hold of the right reference class. The present paper, concerned mainly with the characterization of randomness, resolves the technical difficulties and provides a well structured framework for the choice of a reference class. The definition of randomness that leads to this framework (...) is simplified and clarified in a number of respects. It resolves certain puzzles raised by S. Spielman and W. Harper in their contributions to Profiles: Henry E. Kyburg, Jr. and Isaac Levi 1982). (shrink)

In a recent keynote speech Paul Standish noted ‘there is agreement in judgments. But how the response to those judgments is realised is always cultural’. Making judgments about what constitutes ‘crisis’ for children is not necessarily agreed universally, though clearly there are some commonalities across many countries, as evident in United Nations on the Convention of the Rights of the Child agreements. This article examines the local rhetoric and reality of ‘crisis’ for children in countries across the world. What constitutes (...) a crisis for children, and how this plays out in the contexts of nine countries is explored by the authors based on the insights of each countries’ Chapter representatives. Policies will be juxtaposed with provision based on the experiences of OMEP members reporting from their various contexts. Taken together they provide a contextualised perspective on ‘crisis’ and its relationship to a non-absolutist foundation to children’s rights. The article concludes that what constitutes crisis from a global perspective warrants consideration in the context of local reality—in this locale the concept of every child as having access to ‘rights’ is far from realisation. This paper defends a realist interpretation of theories and a modest realism concerning the existence of quantities as providing the best account both of the logic of quantity concepts and of scientific measurement practices. Various operationist analyses of measurement are shown to be inadequate accounts of measurement practices used by scientists. We argue, furthermore, that appeals to implicit definitions to provide meaning for theoretical terms over and above operational definitions fail because implicit definitions cannot generate the requisite descriptive content. The (...) special case of establishing a temperature scale is examined to show that nonrealist accounts fail to provide insight into the theoretical connections that scientific laws postulate to hold among quantities. Dans « Le rire : essai sur la signification du comique » (1900), il trouve que le comique est soulevé des que nous percevons dans les actions humaines les automatismes, répétitions ou dysfonctionnements qui contrastent avec l´essentielle spontanéité de la vie réelle. Penser l'homme et la folie : dans ce recueil d'études où s'est condensée, au fil des dernières années, sa réflexion, Henri Maldiney se propose de penser ensemble l'énigme de l'humanité et l'énigme de la " catastrophe " qui survient à certains d'entre nous. Double décentrement de la pensée, qui la met à la fois hors de l'anthropologie, fût-elle philosophique, et de son envers dans les théories psycho-pathologiques. Double décentrement où s'éprouvent donc au mieux la tradition philosophique - et en particulier (...) celle qui est issue de Heidegger - et la tradition de la Daseinsanalyse et de la Schicksalsanalyse, telle qu'elle est représentée par Binswanger, Straus, Minkiwski, Von Weizsäcker et Szondi. Dans une démarche authentiquement phénoménologique, où il s'agit de retourner à la " chose même " de l'humain et de la folie, de penser en va-et-vient de l'énigme à penser à ce qui en a été dit, Henri Maldiney dégage, par sa conception toute nouvelle de la transpossibilité et de la transpassibilité, une " compréhension " globale du phénomène humain qui le rend moins intraitable que par le passé. Le " séisme " de la folie, montre-t-il, vient d'un énigmatique court-circuit de la transpossibilité et de la transpassibilité, qui est seul propre à les mettre véritablement en relief comme la dimension profonde et cachée de notre expérience : celle de l' "événement " ou de l'émergence du nouveau, de la surprise de l'inattendu. La transpassiblité est une " possibilité " qui nous excède, en ce qu'elle fonde toute possibilité pour nous d'exister, parce qu'elle est en deçà de tout projet, transpossiblité de l'accueil - et de l'accueil transpassible -, y compris de l'accueil par nous-mêmes, de nous-mêmes. Sie zeigt uns in der Fähigkeit des Verstehens einen Ausläufer der Fähigkeit des Handelns, eine immer schärfere, immer mehrgliedrigere, immer geschmeidigere Anpassung des Lebewesens an die gegebenen Existenzbedingungen. Woraus zu folgern wäre, daß unser Intellekt im engeren Sinn des Worts dazu bestimmt sei, die vollkommene Verwebung unseres Körpers (...) in seine Umgebung zu sichern, die Beziehungen der äußeren Dinge aufeinander vorzustellen, kurz: dazu, die Materie zu denken.
