Aristotle divided arguments that persuade into the rhetorical (which happen to persuade), the dialectical (which are strong so ought to persuade to some degree) and the demonstrative (which must persuade if rightly understood). Dialectical arguments were long neglected, partly because Aristotle did not write a book about them. But in the sixteenth and seventeenth century late scholastic authors such as Medina, Cano and Soto developed a sound theory of probable arguments, those that have logical and not merely psychological force (...) but fall short of demonstration. Informed by late medieval treatments of the law of evidence and problems in moral theology and aleatory contracts, they considered the reasons that could render legal, moral, theological, commercial and historical arguments strong though not demonstrative. At the same time, demonstrative arguments became better understood as Galileo and other figures of the Scientific Revolution used mathematical proof in arguments in physics. When originally published, this historical and textual study was the first to examine in detail the line of continuity between Dogen and his Chinese predecessors, through his Chinese master, Ju-ching.

James Tully sees the emergence of modern constitutionalism as the intellectual legacy of writers such as Hobbes, Bodin and Locke. For Tully, modern constitutionalism not only centralizes authority, it also excludes diversity. Tully’s work represents a significant part of the growing antipathy towards uniformity and the universalising tendencies of the modern organization, which, he believes, underwrite a loss of local empowerment. In this respect his thinking and that of the communitarians is consistent with contemporary disenchantment with, not to mention (...) resistance to globalization. Globalization, or the tendency to inter‐national uniformity in culture and increasing integration into a global system of economics and power, appears to promote an analogous universalising conformity across borders, while centralizing economic if not political power and control in certain trans‐national corporations. Hernando de Soto, the Peruvian economist, gives us a very different perspective on the motley of overlapping jurisdictions and argues that diversity of systems, customs and rules with respect to property has conspired to maintain the entrenched poverty of the developing world. He argues that it is the unified, codified and integrated systems of the West that have allowed these societies to mobilize capital to escape the endemic widespread poverty of the pre‐capitalist age. In the course of this paper I seek to compare and evaluate the competing claims of Tully and de Soto. (shrink)

Francis Bacon, the English philosopher, statesman and jurist, is best known for developing the empiricist method which forms the basis of modern science. Bacon's writings concentrated on philosophy and judicial reform. His most significant work is the Instauratio Magna comprising two parts - The Advancement of Learning and the Novum Organum. The first part is noteworthy as the first major philosophical work published in English. James Spedding and his co-editors arranged this fourteen-volume edition, published in London between 1857 and (...) 1874, not in chronological order but by subject matter, so that different volumes would appeal to different audiences. The material is divided into three parts: philosophy and general literature; legal works; and letters, speeches and tracts relating to politics. Volume 1, published 1857, contains the biography by Bacon's secretary, William Rawley, and part 1 of the philosophical works included in the Instauratio Magna. (shrink)

This book explores the role of aggression in primate social systems and its implications for human behavior.

Conformity is an often criticized feature of human belief formation. Although generally regarded as a negative influence on reliability, it has not been widely studied. This paper attempts to determine the epistemic effects of conformity by analyzing a mathematical model of this behavior. In addition to investigating the effect of conformity on the reliability of individuals and groups, this paper attempts to determine the optimal structure for conformity. That is, supposing that conformity is inevitable, what is the best way for (...) conformity effects to occur? The paper finds that in some contexts conformity effects are reliability inducing and, more surprisingly even when it is counterproductive, not all methods for reducing its effect are helpful. These conclusions contribute to a larger discussion in social epistemology regarding the effect of social behavior on individual reliability. (shrink)

During natural speech perception, listeners rely on a wide range of cues to support comprehension, from semantic context to prosodic information. There is a general consensus that prosody plays a role in syntactic parsing, but most studies focusing on ambiguous relative clauses (RC) show that prosodic cues, alone, are insufficient to reverse the preferred interpretation of sentence. These findings suggest that universally preferred structures (e.g., Late Closure principle) matter far more than prosodic cues in such cases. This study explores an (...) alternative hypothesis: that the weak effect of prosody might be due to the influence of various syntactic, lexical-semantic, and acoustic confounding factors, and investigate the consequences of prosodic breaks while controlling these variables. We used Spanish RC sentences in three experimental conditions where the presence and position (following the first or second noun phrase) of prosodic breaks was manipulated. The results showed that the placement of a prosodic break determined sentence interpretation by changing the preferred attachment of the RC. Listeners’ natural preference for low attachment (in the absence of break) was reinforced when a prosodic break was placed after the first noun. In contrast, a prosodic break placed after the second noun reversed the preferred interpretation of the sentence, toward high attachment. We argue that, in addition to other factors, listeners indeed use prosodic breaks as robust cues to syntactic parsing during speech processing, as these cues may direct listeners toward one interpretation or another. When William James spoke about belief to the philosophy clubs of Yale and Brown in 1896, he forewarned his audience of the nature of his comments by describing them as a “sermon on justification by faith” (James 13), titling the talk “The Will to Believe.” Although there is disagreement about the substance of James’s remarks, it is fairly innocuous to assert that James thought they were appropriate because of the prevalence of the “logical spirit” of many (...) of those who practiced academic philosophy that led them to the conclusion that religious faith was untenable. According to a growing consensus in the secondary literature on Quine, the judgment Quine makes in favor of the nominalism outlined in “Steps Toward a Constructive Nominalism” is in tension with the naturalism he later adopts. In this paper, I show the consensus view is mistaken by showing that Quine’s judgment is rooted in a naturalistic standard of clarity. Moreover, I argue that Quine late in his career is committed to accepting one plausible reading of his judgment in 1947. In (...) making these arguments, I draw attention to a version of naturalism that misreadings of Quine have prevented philosophers from appreciating, and thereby articulate and clarify a version of naturalism I recommend philosophers investigate today. W.V. Quine is a well-known proponent of naturalism, the view on which reality is described only in science. He is also well-known for arguing that our current scientific theories commit us to the existence of abstract objects. It is tempting to believe that the naturalistic philosopher should think scientists outside of philosophy are in the best position to assess the merits of revising our current commitment to abstract objects. But Quine rejects this deferential view. On the reading of Quine’s philosophical (...) methodology that I defend in this paper, the naturalistic philosopher not only may assess the merits of revising the commitments of our scientific theories, but also will recommend we make such revisions if doing so simplifies and clarifies our science. To develop my reading, I will examine John Burgess and Gideon Rosen’s naturalism in ontology that includes the deferential view Quine rejects. By explaining how Quine’s naturalism differs from the anti-revisionist, deferential naturalism in philosophy of mathematics that Burgess and Rosen advance, I seek to clarify and advance contemporary debates on naturalism. A central criticism of William James’s “The Will to Believe” is that it gives individuals a license for wishful thinking. There may be insufficient evidence with respect to the existence of God, but our willing to believe that God exists does not make it the case. Simply put, wanting something to be true does not make it true. Accordingly, some of James’s early critics proposed that the essay would have been more accurately titled “The Will to Deceive” or (...) “The Will to Make Believe.” More recently, a number of scholars have defended James’s essay from these charges of wishful thinking. The ontological argument appears in a multiplicity of forms. Over the past ten or twelve years, however, the philosophical community seems to have been concerned principally with those versions of the proof which claim that God is a necessary being. In contemporary literature, Professors Malcolm and Hartshorne have been the chief advocates of this view, both men holding that God must be conceived as a necessary being and that, as a result, his existence is able to be demonstrated a priori (...) . This claim has not gone unchallenged; indeed, numerous writers have argued that neither Malcolm nor Hartshorne has exercised due care in his use of ‘necessary’. That is, critics charge that the arguments of both men have only the appearance of validity, for in their reasonings the defenders of the a priori proof have tacitly assumed that God is a logically necessary being. Whether or not a being can be logically necessary, however, is a quaestio disputata . In fact, until recently the question was not in dispute at all—virtually all ‘competent judges’ agreed that only propositions could be spoken of as logically necessary, and thus that God must be defined as a physically or factually necessary being. But is the statement, ‘a physically necessary being exists’, logically true? Critics of the ontological argument think not; and in support of this view they offer analyses of ‘physical necessity’ which, they feel, not only give meaning to the phrase, but also show that a physically necessary being's existence can be proven only by some kind of a posteriori investigation.
