This is not yet another book on Heideg-ger's politics, nor does its author attempt, as have others, to discover within the development of Heidegger's thought the basis for his infamous political convictions. Rather, Schalow argues that there are unacknowledged—particularly by Heidegger himself—trajectories in Heidegger's thought, present as early as Sein und Zeit, that provide the basis and inspiration for a postmodern politics and its standard values of pluralism and tolerance. The basis for these trajectories lies in a subargument within Heidegger's (...) deconstruction of Western metaphysics, namely, a critique of traditional moral philosophy that seeks to uncover a more primordial ethos underlying all moral values that sustains rather than dismisses or radically reinterprets those values. Schalow contends that Heidegger's reflections on language and his critique of instrumental reason point toward the possibility of a new ethos and sense of “the good” that can inspire and sustain a radical challenge to the political status quo and a new argument for positive freedom within a postmodern world. This paper provides an update semantics for counterfactual conditionals. It does so by giving a dynamic twist to the ‘Premise Semantics’ for counterfactuals developed in Veltman (1976) and Kratzer (1981). It also offers an alternative solution to the problems with naive Premise Semantics discussed by Angelika Kratzer in ‘Lumps of Thought’ (Kratzer, 1989). Such an alternative is called for given the triviality results presented in Kanazawa et al. (2005, this issue).

For three decades Frank Cioffi has been at the center of the debate over Freud's legacy and the legitimacy of psychoanalysis.

We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

This paper investigates (modal) extensions of Heyting-Brouwer logic, i.e., the logic which results when the dual of implication (alias coimplication) is added to the language of intuitionistic logic. We first develop matrix as well as Kripke style semantics for those logics. Then, by extending the Gö;del-embedding of intuitionistic logic into S4, it is shown that all (modal) extensions of Heyting-Brouwer logic can be embedded into tense logics (with additional modal operators). An extension of the Blok-Esakia-Theorem is proved for this embedding.

This paper investigates the structure of lattices of normal mono- and polymodal subframelogics, i.e., those modal logics whose frames are closed under a certain type of substructures. Nearly all basic modal logics belong to this class. The main lattice theoretic tool applied is the notion of a splitting of a complete lattice which turns out to be connected with the “geometry” and “topology” of frames, with Kripke completeness and with axiomatization problems. We shall describe the set of strongly meet irreducible logics in the lattice ϵLin.t of normal tense logics of weak orderings. Based on this description it is shown that all logics in ϵLin.t are independently axiomatizable. Then the description is used in order to investigate tense logics with respect to decidability, finite axiomatizability, axiomatization problems and completeness with respect to Kripke semantics. The main tool for the investigation is a translation of bimodal formulas into a language talking about partitions of (...) general frames into intervals so that relative to both Kripke frames and descriptive frames the expressive power of both languages coincides. It is known that even seemingly small fragments of the first-order temporal logic over the natural numbers are not recursively enumerable. In this paper we show that the monodic fragment is an exception by constructing its finite Hilbert-style axiomatization. We also show that the monodic fragment with equality is not recursively axiomatizable.

From its start, American philosophy looked beyond Europe's atomistic empiricism toward a continuity between our thought and nature's aesthetic splendor. Jonathan Edwards found beauty in the structure of being reflected in relations among ideas. For Emerson, each of us is a "transparent eyeball" in which nature's beauty fortifies our moral and spiritual agency. At the apex of this tradition is John Dewey, for whom "aesthetic experience [is] the highest mode of human experience" (Henning 55).Although aesthetic theory is usually associated with the cognitive evaluation of art, Dewey explores a broader non-reflective or unconscious dimension. Henning's appropriation of "unconscious"—the cradle of Freud's infantile id—is intentionally provocative. American culture, reflected in academic thought, has largely resisted appeals to subterranean urges and drives. In doing so, however, we perpetuate a myth of rational and moral exceptionalism masking a history of colonialism, oppression, and crass commercialism. In The Democratic Horizon: Hyperpluralism and the Renewal of Political Liberalism, Alessandro Ferrara seeks a philosophical breakthrough from what looks like it could be a pending dead-end for democracy. The best hope, Ferrara superbly maintains, lies through an extension or updating – a “renewal,” as he calls it – of lines of thought bequeathed to us, by John Rawls and others, under the name of political liberalism. Somewhere near the crux of Ferrara’s reflection stands a class of institutional fixtures whose (...) name is missing from his title. I mean the class “constitution.” I use that word to name a country’s scriptural basic law, its publicly cognizable corpus of canonically worded sentences ordaining the country’s basic institutional framework. My suggestion will be that it is no less tellingly a “constitutional” than a “democratic” horizon that Ferrara’s work, in conjunction with Rawls’s, shows us to be facing. (shrink)

John Rawls proposed, as what he called “the liberal principle of legitimacy,” that coercive exercises of political power can be justified to free and equal dissenters when “in accordance with a constitution (written or unwritten) the essentials of which all citizens, as reasonable and rational, can endorse.” Does “unwritten constitution” there refer to norms of constitutional import, but that subsist only as custom, not as law? This paper investigates partitions of lattices of modal logics based on superintuitionistic logics which are defined by forming, for each superintuitionistic logic L and classical modal logic , the set L[] of L-companions of . Here L[] consists of those modal logics whose non-modal fragments coincide with L and which axiomatize if the law of excluded middle p V p is added. Questions addressed are, for instance, whether there exist logics with the disjunction property in L[], whether L[] contains a (...) smallest element, and whether L[] contains lower covers of . Positive solutions as concerns the last question show that there are (uncountably many) superclean modal logics based on intuitionistic logic in the sense of Vakarelov [28]. Thus a number of problems stated in [28] are solved. In a modern, plural society, there can be no settled agreement on the concrete legal content of a country's constitution. The idea of the constitution is nonetheless pivotal in contemporary, liberal‐minded theories of political justification, such as the ones advanced by Jürgen Habermas and John Rawls. Justification in these theories depends finally on “constitutional patriotism,” a consciously shared sentiment arising from an ethical assessment of their country by the country's people, according to which the country credibly pursues a certain regulative (...) political ideal for which the constitution stands. Secular change in sex ratios is examined in relation to experience in the family. Two theoretical perspectives are outlined: Guttentag and Secord’s (1983) adaptation of social exchange theory, and sexual selection theory. Because of large-scale change in number of births and typical age differentials between men and women at marriage, low sex ratios at couple formation ages existed in the U.S. between 1965 and the early 1980s. The currently high sex ratios, however, will persist until the end of the century. (...) High sex ratios appear to be associated with lower divorce rates, male commitment to careers that promise economic rewards, male willingness to engage in child care, higher fertility, and higher rates of sexual violence. Sexual selection theory calls attention to intrasexual competition in the numerically larger sex. (shrink)

For several decades, renewed interest in the connection between perception and knowledge has sustained a robust debate over external world skepticism. Recently, however, a growing consensus claims the skeptical challenge has been substantially met, and that realism in some robust form has emerged a clear victor. I invite us to rethink this consensus in a two-part response. The first forges a temporary alliance with skepticism against prominent forms of contemporary realism. That these fail to rebuff ews bolsters Barry Stroud’s call (...) for a new paradigm of objectivity. In the second part I sketch such a paradigm based upon a transactional interpretation of John Dewey’s pragmatism, and indicate its resilience to skeptical attacks. (shrink)

The term “judicial restraint,” applied to courts engaged in judicial constitutional review, may refer to any one or more of three possible postures of such courts, which we here will distinguish as “quiescent,” “tolerant,” and “weak-form.” A quiescent court deploys its powers sparingly, strictly limiting the agenda of social disputes on which it will pronounce in the constitution’s name. A tolerant court confirms as valid laws whose constitutional compatibility it finds to be reasonable sustainable, even though it independently would conclude (...) to the contrary. A weak-form court acts on the understanding that its pronouncements on matters constitutional will be duly open to considered rejection by other political agencies. Theory commonly tends to treat the question of judicial restraint as turning on a bedrock political value of democracy. We may also, however, understand debates over judicial restraint in the light of a different bedrock value, that of political legitimacy. Where democracy is the focal concern, debaters may tend toward conflating into one measure the three dimensions of judicial restraint. A focus on legitimacy rather tends toward a dis-bundling of the three dimensions, thus complicating the choices while also clarifying the stakes. In 1995 the People's Republic of China passed a controversial Eugenics Law, which, after a torrent of international criticism, was euphemistically renamed the Maternal and Infant Health Law. Aimed at "the implementation of premarital medical checkups" to ensure that neither partner has any hereditary, venereal, reproductive, or mental disorders, the ordinance implies that those deemed "unsuitable for reproduction" should undergo sterilization or abortion or remain celibate in order to prevent "inferior births." Using this recent statute as a springboard, Frank (...) Dikötter explores the contexts and history of eugenics in both Communist China and Taiwan. Dikötter shows how beginning in Late Imperial China, Western eugenics was imported and combined with existing fears of cultural, racial, or biological degeneration in Chinese society, leading to government regulation of sexual reproduction. _Imperfect Conceptions_ is a revealing look at the cultural history of medical explanations of birth defects that demonstrates how Chinese assumptions about the relationship of the individual to society form the very core of their attitudes toward procreation. Dikötter explains the patrilineal model of descent, where a person is viewed as the culmination of his or her ancestors and is held responsible for the health of all future generations. By this logic, a pregnant woman's behavior and attitude directly influence the well-being of her baby, and a deformed or retarded child reflects a moral failing on the part of the parents. Dikötter also shows how the holistic medicine practiced in China blurs any distinction between individual and environment so that people are held responsible for illness. Drawing on cultural, social, economic, and political approaches, Dikötter goes beyond a simple authoritarian model to provide a more complex view of eugenic policy, showing how a variety of voices including those of popular journalists, social reformers, medical writers, sex educators, university professors, and politicians all disseminate information that supports rather than questions the state's program. _Imperfect Conceptions_ reveals how Chinese cultural currents--fear and fascination with the deviant and the urge to draw clear boundaries between the normal and the abnormal--have combined with medical discourse to form a program of eugenics that is viewed with alarm by the rest of the world. In this article I explore two accounts of the Fallacy of Many Questions made famous by the question "Have you stopped beating your wife?" The accounts are from the works of Lennart Aqvist and Noel Belnap, and the two authors differ in their accounts of the fallacy. Then I give my own account based on understanding a facet of erotetic logic, i. e., the logic of questions.

Our intention here is to present the essential character of classical, sunnm within a strictly formal perspective and to set out its basic aspects. It was conceived by the mutakallimm differed in a number of basic concepts and constructs and in its analytic system, the topical organisation of the major compendia parallels that of metaphysics as understood in the contemporary Aristotelian tradition. The debates between kalm, however, is theological in the strict sense of the term and it is as such (...) that its problematic and its procedures are primarily to be understood. Thus seen, the object of kalām is to rationalise the cognitive content presented to Believers in the symbolic language of the koranic revelation. It has, then, four principal tasks, sc, to conceptualise, to order, to explain, and where possible to justify the primary doctrines of the community whose belief is held to be normative. The question of what is truly just in the matter of a country's currently established human-rights interpretations appears not to be the same as the question of what it is morally right to do by way of coercively effectuating a given set of such interpretations. There are grounds for contending that acts of support for a coercive political regime can be justified morally on the condition that the regime's prevailing human-rights interpretations are made continuously available to effective, democratic critical re-examination. What is honor? Is it the same as reputation? Or is it rather a sentiment? Is it a character trait, like integrity? Or is it simply a concept too vague or incoherent to be fully analyzed? In the first sustained comparative analysis of this elusive notion, Frank Stewart writes that none of these ideas is correct. Drawing on information about Western ideas of honor from sources as diverse as medieval Arthurian romances, Spanish dramas of the sixteenth and seventeenth centuries, (...) and the writings of German jurists of the nineteenth and twentieth centuries, and comparing the European ideas with the ideas of a non-Western society—the Bedouin—Stewart argues that honor must be understood as a right, basically a right to respect. He shows that by understanding honor this way, we can resolve some of the paradoxes that have long troubled scholars, and can make sense of certain institutions that have not hitherto been properly understood. : This article aims: 1) to review several, key, earlier studies of Josiah Royce's relations to Asian thinkers (mainly Indian); 2) to discover through a survey of Royce's writings how widely and deeply Royce familiarized himself with, and employed Hindu, Buddhist, and other Asian traditions; and, 3) to measure how relevant Royce's most mature philosophy (1912–1916) is for the currently needed inter-cultural, inter-religious, and inter-faith dialogues. Parts One and Two supply foundations which reveal Royce's lifelong commitment to open "windows" to (...) Eastern thought, in order to dialogue with Asian thinkers and invite other Westerners to do the same. The article climaxes in Part Three by revealing the relevance of the late Royce's "philosophy of the 'Spirit,' his "philosophical pneumatology." I trace ten of its implied positions, significant for contemporary philosophers of religion and theologians. I conclude by showing that Royce's "philosophy of the 'Spirit"' and its implied positions are all rooted in Royce's view of a "middle faith." Such a faith supports his view of the "invisible church," his "Beloved Community of all "Christians"—"Christians" taken in his wider sense of "all genuine loyalists who are members of a Beloved Community.".
