In Australia, since 2004, there has been a move to expand the range of models for legal practice. Lawyers may now incorporate a legal practice, which may have non-legal directors and shareholders. They may also enter into a partnership with a range of non-legal professional partners. This change is happening at the same time that legal practice culture is moving from a professional service model to a business-oriented model. Increased pressures have been thrown into the mix by the global financial (...) crisis and the downturn in the legal market. Inevitably, these changes have created new conflict problems. When a lawyer is responsible to both clients and shareholders, how can that conflict be resolved? What are the roles of non-legal directors or partners? What if they have ethical or legal duties which conflict with a lawyer?s duty to a client? When a corporate legal business is listed on the stock exchange, what pressure may that bring to bear on the business model of the legal practice? How can all of these issues be resolved in grim financial times? The author will examine all of these issues in light of Australian and international experiences with new lawyering patterns and the global financial crisis. (shrink)

Driving anxiety is a relatively undervalued topic of research, despite the fact that it can have a substantial detrimental impact on an individuals’ life. The prevalence of driving anxiety in motor vehicle crash survivors has been found to range from 18-77%. Although driving anxiety can develop without crash involvement, no information currently exists on the prevalence of driving anxiety in the general population. One barrier to gathering this information is that most of the instruments are designed to measure driving anxiety (...) in MVC survivors. However, the Driving and Riding Avoidance Scale is one instrument that shows promise as a more general measure of driving anxiety, although previous research has noted the need for some minor adaptations. Therefore, the present study investigated the psychometric properties of an adapted version of the DRAS and the level of driving anxiety amongst a sample of 210 Polish participants. Internal consistency for the overall DRAS was.91 and ranged from.77 to.85 for the subscales. Factor analysis of the DRAS resulted in two clear factors, with the first containing driving avoidance items and the second consisting solely of riding avoidance items. Therefore it appears that the DRAS can be a useful measure of driving avoidance in samples drawn from the general population as well as MVC survivors. (shrink)

This narrative symposium examines the relationship of bioethics practice to personal experiences of illness. A call for stories was developed by Tod Chambers, the symposium editor, and editorial staff and was sent to several commonly used bioethics listservs and posted on the Narrative Inquiry in Bioethics website. The call asked authors to relate a personal story of being ill or caring for a person who is ill, and to describe how this affected how they think about bioethical questions and the (...) practice of medicine. Eighteen individuals were invited to submit full stories based on review of their proposals. Twelve stories are published in this symposium, and six supplemental stories are published online only through Project MUSE. Authors explore themes of vulnerability, suffering, communication, voluntariness, cultural barriers, and flaws in local healthcare systems through stories about their own illnesses or about caring for children, partners, parents and grandparents. Commentary articles by Arthur Frank, Bradley Lewis, and Carol Taylor follow the collection of personal narratives. (shrink)

Today, she gives her name to the journal for feminist philosophy. She is a symbol for those women who, over the centuries, have struggled to be part of the philosophical life of their time.Until very recently, the centuries that separated Hypatia from the present were assumed to have been a philosophical desert for women. But times have changed. Hypatia’s Daughters is a sign of this change. It contains eighteen articles on seventeen philosophers: Hypatia; Hildegard of Bingen, Heloise, and Christine de Pisan from the Middle Ages; Elizabeth of Bohemia, Sor Juana de la Cruz, Anne Conway, Damaris Masham, Catharine Trotter, Belle van Zuylen and Mary Wollstonecraft from the seventeenth and eighteenth centuries; Anne Doyle Wheeler and Harriet Taylor Mill from the nineteenth; Charlotte Perkins Oilman, Edith Stein, Hannah Arendt, and Angela Davis from the late nineteenth century into contemporary times. Few are known as well as they deserve, but many names are familiar even to non-specialists. Their ideas, however, are another matter.The collection in no way constitutes a definitive selection of women philosophers; those discussed are not presented as the most significant women philosophers in the history of philosophy. (A different kind of study would be necessary for evaluations of that kind.) The women here studied have little in common as a group; they wrote on many topics of philosophical concern; their views and their supporting reasoning differ. Further, as the subjects of the articles differ in their ideas, so do the contributors’ approaches and their methods of studying those ideas differ. These differences are the strengths of a collection that is stimulating, enlightening, provocative. The following examples indicate their range.Andrea Nye examines the correspondence of Heloise and Abelard and, in a second article, of Elizabeth of Bohemia and Descartes. Heloise and Elizabeth are usually regarded as passive followers or, at best, no more than serious questioners seeking answers of their correspondents. Nye’s fresh look at the Heloise-Abelard correspondence finds not only important differences between two ways of thinking, but also sees already underlying their disagreement what she calls the “macroquestion” of philosophy’s future: philosophy as “a professional discipline independent of political or social concerns or... an ongoing critical and cultural discourse.” (25) Elizabeth’s persistent questions to Descartes reveal ideas that challenge his views, especially on moral issues and physiological-psychological [End Page 164] phenomena; these are views that have a greater complexity than the basic issue of mind-body interaction that is usually identified as central to their exchange.Writing on Harriet Taylor Mill, Jo Ellen Jacobs examines changing attitudes towards her subject, beginning with views of Taylor Mill’s contemporaries and moving through the decades into our time. She finds parallels between criticisms of Taylor Mill and attitudes towards the so-called intellectual woman. In times encouraging of women, Taylor Mill is regarded as having made important contributions to the development of J. S. Mill’s thinking, in addition to writing and speaking about her own ideas and positions that did not always follow those of J. S. Mill. In less encouraging times, her significance tends to be minimized.Hannah Arendt is not usually thought of as a feminist. Proposals to lower the age of voting, to 15 for example, are regularly met with worries that people that age are not sufficiently ‘competent’. Notice however that we allow people that age to sign binding legal contracts, provided that those contracts are co-signed by their parents. Notice, further, that in a democracy voters are collectively ‘joint authors’ of the laws that they enact. Enfranchising some less competent voters is no worry, the Condorcet Jury Theorem assures us, so long as the (...) electorate's competence averaging across all voters remains better-than-random. Campaigning activities of non-governmental organisations (NGOs) have increased public awareness and concern regarding the alleged unethical and environmentally damaging practices of many major multinational companies. Companies have responded by developing corporate social responsibility strategies to demonstrate their commitment to both the societies within which they function and to the protection of the natural environment. This has often involved a move towards greater transparency in company practice and a desire to engage with stakeholders, often including many of the campaign organisations that (...) have been at the forefront of the criticisms of their activity. This article examines the ways in which stakeholder dialogue has impacted upon the relationships between NGOs and businesses. In doing so, it contributes to the call for more ‘stakeholder-focused’ research in this field (Frooman in Acad Manag Rev 24(2): 191–205, 1999; Steurer in Bus Strategy Environ 15: 15–69 2006). By adopting a stakeholder lens, and focusing more heavily upon the impact on one particular stakeholder community (NGOs) and looking in depth at one form of engagement (stakeholder dialogue), this article examines how experiences of dialogue are strategically transforming interactions between businesses and NGOs. It shows how experiences of stakeholder dialogue have led to transformations in the drivers for engagement, transformations in the processes of engagement and transformations in the terms of engagement. Examining these areas of transformation, the article argues, reveals the interactions at play in framing and shaping the evolving relationships between business and its stakeholders. (shrink)

Equilibrium explanations use an equilibrium to represent and explain a system’s dynamic behavior. They provide a system with the property of global stability: a system will converge towards and remain in equilibrium regardless of its initial conditions and dynamic process. Thus, equilibrium explanations are generally treated as non-causal explanations. There are two claims subsumed under that comprehensive thesis. The first claim is that equilibrium explanations do not identify any causes because a system with global stability resists manipulation. The second claim (...) is that even if equilibrium explanations do identify causes by manipulation, those causes are embedded in a system’s deeper, underlying structural relationships, and those causes are irrelevant to explaining a system’s behavior. Only the system’s structural relationships are relevant. But equilibrium explanations are not monolithic. I compare dynamic systems with multiple, competing equilibria to systems with a globally stable equilibrium. Equilibrium explanations of the former use intervention on a system’s initial conditions and dynamic process to manipulate equilibria, which identifies causes. Furthermore, a system’s initial conditions and dynamic process are relevant to explaining why one equilibrium is selected instead of another. I then apply these lessons to systems with a globally stable equilibrium and discuss when their corresponding equilibrium explanations have a proper role in the parent sciences. (shrink)

The notion of whether people focus on the past, present or future, and how it shapes their behaviour is known as Time Perspective. Fundamental to the work of two of its earliest proponents, Zimbardo and Boyd (2008), was the concept of balanced time perspective and its relationship to wellness. A person with balanced time perspective can be expected to have a flexible temporal focus of mostly positive orientations (past-positive, present-hedonistic, and future) and much less negative orientations (past-negative and present-fatalistic). This (...) study measured deviation from balanced time perspective (DBTP: Zhang, Howell, and Stolarski, 2013) in a sample of 243 mature adults aged 45 to 91 years and explored relationships to Retirement Planning, Depression, Anxiety, Stress, Positive Mood, and Negative Mood. Results indicate that DBTP accounts for unexplained variance in the outcome measures even after controlling for demographic variables. DBTP was negatively related to Retirement Planning and Positive Mood and positively related to Depression, Anxiety, Stress and Negative Mood. Theoretical and practical implications regarding balanced time perspective are discussed. (shrink)

For older workers, self-employment is an important alternative to waged employment. Drawing on social learning theory and social cognitive career theory we examine how attitudes toward one’s own aging, future time perspective (captured by perceived time left to live) and perceived support from referent individuals predict self-efficacy for entrepreneurship and outcome expectations, influencing self-employment interest. Findings from a sample of professional association members (n = 174, mean age 52.5 years), revealed that an open-ended time perspective relates positively to entrepreneurial self-efficacy, (...) while social support relates positively to outcome expectations. Consistent with social cognitive career theory, entrepreneurial self-efficacy mediated the relationship between future time perspective and interest in self-employment, and outcome expectations mediated the relationship between social support and interest in self-employment. This study extends current career and entrepreneurship theory in several ways. First, the inclusion of age-related psychosocial and sociocultural factors in the study model shed light on the intersection between older age, the contextual environment and development of self-employment interest. Second, the findings support earlier arguments that older entrepreneurship is a social process whereby the social context in which people work and live influences their interest in entrepreneurship, and that entrepreneurial behavior among older peop... The essays examine visual, print, and performance media — stand-up comedy, movies, television, and a blockbuster trilogy of novel. These philosophical feminist analyses of popular culture consider the possibilities, both positive and negative, that popular culture presents for articulating the structure of the social and cultural practices in which gender matters, and for changing (...) these practices if and when they follow from, lead to, or perpetuate discrimination on the basis of gender. The essays bring feminist voices to the conversation about gender where is it taking place and attest to the importance of feminist critique in what is sometimes claimed to be a post-feminist era. The implementation of sustainable development goals forces the leaders of organizations to develop cognitive and behavioural capacities to manage the resulting complexity. These abilities can be associated with authentic leadership. Reflective approaches are recognized as showing promise for developing this type of leadership. However, they are rarely used in the context of university training. This article compares two learning approaches that target leadership development in master’s level students. Background and Objectives People living with dementia have historically been excluded from qualitative research and their voices ignored due to the perception that a person with dementia is not able to express their opinions, preferences and feelings. Research institutions and organizations have contributed by adopting a paternalistic posture of overprotection. Furthermore, traditional research methods have proven to be exclusionary towards this group. The objective of this paper is to address the issue of inclusion of people with dementia in research and (...) provide an evidence-based framework for dementia researchers based on the five principles of human rights: Participation, Accountability, Non-discrimination and equality, Empowerment and Legality (PANEL). Design This paper adapts the PANEL principles to the research context, and uses evidence from the literature to create a framework for qualitative research in people with dementia. This new framework aims to guide dementia researchers in designing studies around the needs of people with dementia, to improve involvement and participation, facilitate research development and maximize research outcomes. Results A checklist is presented with questions related to the five PANEL principles. These questions cover ethical, methodological and legal issues that researchers may need to consider while developing qualitative research for people with dementia. Conclusions The proposed checklist offers a series of questions and considerations to facilitate the development of qualitative research in patients with dementia. It is inspired by current human rights work of recognized dementia researchers and organizations who have been directly involved in policy development. Future studies need to explore its utility in improving participation, facilitating ethics approvals and ensuring that outcomes are relevant to people with dementia. (shrink)

Humanity needs a way to pool scientific community opinion quickly and efficiently on a given statement of interest. This should be on a very large scale, such that one can have confidence that the result reflects international scientific opinion. For this pilot project (2022-23), we developed tailored architecture in the form of a novel polling platform, to survey a network of scientists at 30 academic institutions around the world. Personal, one-to-one emails were sent to all relevant scientists at those institutions, (...) asking them for their position on our pilot statement, "Science has put it beyond reasonable doubt that COVID-19 is caused by a virus." Scientists answered by clicking a URL embedded in the email, and confirming their response on a 5-point Likert scale. Voting was anonymous, with the token linking the scientist to their vote being destroyed upon voting, and their response logged against the demographics of scientific field of expertise (broadly construed) and institution for subsequent data analysis. BackgroundOver the last decades there has been a change in the way schooling is perceived recognizing that children’s learning is closely linked to children’s health. Children spend most of their time at school, which is often the place where problems are identified and interventions are offered, not only for treatment but also prevention. Embedding arts therapies into the educational system may help address children’s emerging needs and have a positive impact on their wellbeing.MethodsA pilot cross-over randomized controlled design was employed (...) to investigate the effectiveness of an arts therapies intervention on a series of child- and teacher-reported outcome measures, specifically, health related quality of life, wellbeing and life functioning, emotional and behavioral difficulties, as well as duration of sleep. Sample size calculations for future large-scale studies were also performed, and the sustained impact of the intervention was evaluated at 3, 6, and 12 months follow-up. The pluralistic theoretical and therapeutic framework of this intervention was informed by a systematic review on school-based arts therapies interventions and is presented in detail in the study protocol. Participants were 62 children with mild emotional and behavioral difficulties.ResultsImprovements in HRQOL and CORS were greater in those engaged in the arts therapies intervention than the control groups and were maintained at the follow-up stages. Significant improvements were only found for duration of sleep and SDQ. Minimal clinically important differences as defined in the published protocol were found for CORS, SDQ and duration of sleep, but not HRQOL.DiscussionFindings indicate that the arts therapies interventions were having a clinically significant effect on life functioning, duration of sleep, emotional and behavioral difficulties. Findings also indicate a small effect size for health related quality of life, suggesting the intervention was having a small positive effect on this outcome measure. The study indicates that all outcome measures assessed here would be suitable for inclusion in a larger randomized controlled study utilizing these arts therapies interventions, and that a sample size of 225 participants would be required if these outcome measures were used. How should patriotism be handled in schools? We argue that schools cannot afford to ignore the topic, but nor are they justified in either promoting or discouraging patriotic feeling in students. The only defensible policy is for schools to adopt a stance of neutrality and teach the topic as a controversial issue. We go on to show that there is general support among British teachers and students for school neutrality on patriotism and that the currently preferred classroom practice is to (...) address patriotic ideas in the context of open discussion. In lieu of an abstract, here is a brief excerpt of the content:A Báñezian Grounding for Counterfactuals of Creaturely Freedom:A Response to James Dominic Rooney, O.P.Taylor Patrick O'NeillIntroductionIn a recently published article, James Rooney, O.P., critiques a fundamental aspect of Réginald Garrigou-Lagrange's articulation of the relation between divine causality and creaturely freedom, which I also defended in my recent book.1 Specifically, Rooney argues that at least some of what Garrigou-Lagrange holds is rooted in a Molinist rather than Báñezian understanding (...) of human freedom and divine causality. The aim of this paper is to articulate the basic objections raised by Rooney and to show why the objections fail. We shall not provide an exegetical or textual analysis of Báñez himself, but rather will establish a speculative grounding and agreement between basic principles of Báñezianism and Garrigou-Lagrange's articulation, ultimately affirming the necessity of positing creaturely counterfactuals for Báñezianism.Rooney makes two distinct (but related) objections to Garrigou-Lagrange's treatment. First, he claims that Báñezianism as a system rejects the notion of "alternative possibilities" when considering the creaturely will and its relation to divine causality, especially in regard to physical premotion. I shall argue that this is incorrect, and indeed misses one of the constitutive elements of Báñezianism—in fact the very grounding for its claim that infallibly moved actions remain free. Second, Rooney claims that Garrigou-Lagrange posits [End Page 651] a circular argument regarding the reality of sin. Garrigou-Lagrange's argument would be circular if it corresponded to a single order of causality or if counterfactuals of creaturely freedom were incompatible with Báñezianism. But we shall argue that they are not. As such, the argument is not only not circular, but rather elucidates a constitutive element of the Báñezian system, thereby refuting the objection. In short, Garrigou-Lagrange's articulation of Báñezian premotion admits of counterfactuals without relying upon divine passivity, and it remains internally coherent.Rooney's Critique of the So-called "Garrigou Manoeuvre"Rooney begins the essay by outlining a few of the major differences between a Molinist and Báñezian view of human freedom. Rooney's argument is that there is a potential "grounding problem" for Báñezianism, or at least for Báñezianism as articulated by Garrigou-Lagrange. As Rooney notes, Báñezianism posits that God's efficacious grace is ontologically antecedent to our good actions (and his permission of sin is ontologically antecedent to our sin). But how does this position retain free choice, if divine causation or permission is infallibly determinative and antecedent to creaturely choice? Rooney says:The Banezians need to account for how it is possible that a creature can do otherwise in the special case when God moves the creature to act through grace. Specifically, what grounds the truth of the claim that, even when God determines human free choices from eternity such that a human being has only one course of action open to them, those human beings are morally responsible for their actions? If the Banezian view entails that human beings, acting under grace, strictly lack any ability to do otherwise, then the view is incoherent.2As such, we can see that "the ability to do otherwise" is an essential, grounding element for defending Báñezianism against radically compatibilist or double-predestinarian views of human freedom, which have been condemned by the Church at Trent and in subsequent condemnations of Jansenism.3 Of course, the phrase "ability to do otherwise" is metaphysically [End Page 652] ambiguous, which Rooney admits. Although there is a long-standing international debate concerning the privatization and corporatization of health services, there has been relatively little systematic analysis of the ways these types of reform manifest. We examine the impact of privatization and corporatization on public hospitals, and in particular on hospitals’ autonomy and accountability, with two aims: to uncover the key themes in the literature, and to consider implementation issues. The review of 2,319 articles was conducted using content analysis and a discussion of selected key (...) issues. Several major themes appear in the privatization and corporatization literature, including their use as tools in health systems reform, and the role of governments in sponsoring the processes. We show that much of the underlying argument is ideological rather than evidence based. Those who promote versions of privatization or corporatization claim that decreased government involvement in the management of hospitals leads inter alia to benefits such as greater efficiency, better quality services, and increased choice for patients. Those who argue against say that increased privatization leads to deleterious outcomes such as decreased equity, compromised efficiency and poorer quality of care. The evidence is often weak and at times conflicting. Privatization and corporatization are difficult to implement, and at best produce mixed results, and their impact seems to depend more on the motivation of the evaluator than the standard of the results. To a student audience seduced by the claims of a ‘secular Christianity’, Professor Gordon Rupp once urged the combined loyalties of ‘worldmanship’ and ‘other-worldmanship’. The Muslim world shows little friendship to secularist ideologies which explicitly reject the eschatological dimension, but Muslims are increasingly involved in secularising processes; many of these are ‘Islamised’, if they are compatible with Islamic social or political ideals, and the stigma of bid‘ah , innovation, is thereby avoided. This article examines the theoretical implications of the changing relationships between NGOs and businesses that have emerged as a response to the evolving agenda around CSR and sustainable development. In particular, it focuses upon examining whether greater engagement from non-governmental organisations (NGOs) in this area reflects a process of appropriation and co-optation of protest by the business community. To examine this process, the article considers two forms of appropriation—appropriation of language and appropriation via participation—as a basis for discussion. While co-optation (...) pressures are identified within both areas, the article argues that co-optation is identified almost as an inevitable outcome of engagement without significant consideration of the ability of movements to identify and respond to these processes. In identifying an alternative approach, the article utilises Mouffe’s framework of agonistic pluralism. Mouffe’s framework, it is argued, provides an understanding of the way in which agonistic relationships are emerging between NGOs and businesses while highlighting the continuance of conflict between parties struggling to influence the contested interpretations of responsible business.
